CONSERVATION COMMISSION LOWELL, MASSACHUSETTS September 25, 2024 Note: These minutes are not completed verbatim. Members Present: Chairman Brad Buitenhuys, Commissioner Kevin Dillon, Commissioner Perry Downs, Commissioner Roberto Cicarelli, Commissioner Marie Burns Members Absent: Commissioner Stephen Laput Others Present: Peter Cutrumbes, Assistant Planner CALL TO ORDER B. Buitenhuys called the meeting to order at 7:00pm with a quorum of members present. ORDER OF BUSINESS CONTINUED BUSINESS NEW BUSINESS Request for Determination of Applicability Lowell Regional Wastewater Utility 451 First Street Boulevard Lowell, MA 01850 Project Location: 438 Douglas Road 01852 A Request for Determination of Applicability has been filed by the Lowell Regional Wastewater Utility to install a wet weather flood relief tank at 438 Douglas Road. The proposed work is within the 100-foot buffer zone of a protected wetland. On Behalf: Evan Walsh and Aaron Fox of the LRWWU appeared on behalf. E. Walsh said the proposed project is a 1.8 million gallon wet weather flood relief tank that is 105x45 at the Cawley Stadium parking lot. Flow will be directed to the tank via the existing combined sewer under Douglas Road. The water will be pumped back into the sewer after the storm. Erosion controls such as silt sacks will be installed. The project will run from Spring 2025-Spring 2026. Speaking in Favor: None Speaking in Opposition: None Discussion: M. Burns asked if there will also be erosion control inside the fenced area. E. Walsh said yes and referenced document C-102 in the application that shows the specific controls. Motion: K. Dillon motioned to issue a negative 3 determination with M. Burns seconding. The vote was unanimous (5-0). Emergency Certificate Jeff Hernandez 1254 Pawtucket Blvd Lowell, MA 01854 Project Location: 1254 Pawtucket Blvd 01854 Mr. Jeff Hernandez has requested an Emergency Certificate to remove a tree limp that was fallen by strong wind on August 15, 2024. The approval will not allow for the removal of the full tree. On Behalf: Jeff Hernandez, the property owner, spoke on behalf. Said Francesca Cigliano approved the work. He does not want to remove the entire tree anyway, as it is helpful for stabilizing soil at his property. Speaking in Favor: None Speaking in Opposition: None Discussion: The Commissioners did not express any concerns. Motion: P. Downs motioned to ratify the Emergency Certificate, with R. Ciccarelli seconding. The vote was unanimous (5-0). OTHER BUSINESS 9/11 Meeting Minutes Motion to approve seconded by P. Downs, seconded by K. Dillon. The vote was unanimous (5-0). ADJOURNMENT Motion to adjourn by P. Downs, seconded by K. Dillon. The meeting was adjourned at 7:05 PM.
