BOARD OF COMMISSIONERS MEETING MINUTES REGULAR MEETING October 15, 2018 Page I of9 A regular meeting of the City of Madeira Beach Board of Commissioners was held at 6:00 p.m. on October 15, 2018 in the Patricia Shontz Commission Chambers at City Hall, located at 300 Municipal Drive, Madeira Beach, Florida. Mayor Black called the meeting to order. CALL TO ORDER Mayor Black called the meeting to order at 6:00 p.m. 2. INVOCATION AND PLEDGE OF ALLEGIANCE Commissioner Nancy Hodges gave the Invocation and led the Pledge of Allegiance. 3. ROLLCALL The City Clerk called the roll and said the absence of Commissioner Douthirt is excused. 4. APPROVAL OF THE AGENDA A. PROCLAMATIONS B. PRESENTATIONS C. DAIS LOG REVIEW In accordance with the Board ofCommissioners Policy Handbook the Dais Log Review is provided to update and explain any item that is presented on the Board of Commission Dais Log. The Dais Log is created when items are completed for presentation after the distribution of the packets but before the meetings. Items can only be placed on the Dais Log by City Manager approval. City Manager Jonathan Evans said staff requested that Resolution 2018-13, establishing January 19th as the City of Madeira Beach Community Day of Good Deeds [ Agenda Item 7 .A] be pulled and placed on the agenda for the first meeting in November. BOARD OF COMMISSIONERS MEETING MINUTES REGULAR MEETING October 15, 2018 Page2 of9 Commissioner Hodges made a motion to approve the Agenda with the modification of removing the Resolution 2018-13 item an placing it on the first meeting agenda in November. Commissioner Oakley added that Agenda Item 9.D., the downtown market item, is to also be moved. Vice-Mayor Weinstein seconded the motion approving the agenda with the Resolution 2018-13 item being moved to the first meeting in November and the 9.D. item being moved to the October 23rd workshop meeting. PUBLIC COMMENT John Hendrix, 569 Normandy Road, stressed concern about the email that went out regarding the Seafood Festival event and the lack of cooperation received from the City regarding the event. He said the City owed Ms. Sonny Flynn, the organizer of the event, an apology. Steven Barrett, 11975 3rd Street East, Treasure Island, commented that the Moderates for Madeira Political Committee are urging people to vote no on Charter Amendments 2, 5, 6 & 7 so they can fire the City Manager, City Clerk and City Attorney, and hire back former City Manager Shane Crawford, and former City Clerk Cheryl Crawford. 6. She said the corrected minutes were provided to the Board in the revised meeting agenda packet before the meeting. The City Attorney said the motion can be to approve the minutes as written since the corrected minutes were provided to the Board. Vice-Mayor Weinstein made a motion to approve all the meeting minutes listed, July 11, 2018 through September 25, 2018, which includes the minutes amended by the City Clerk. Mayor Black opened to public comment. There were no comments by the public. Commissioner Oakley seconded the motion. Resolution 2018-13, Establishing January 19th As the City of Madeira Beach Community Day of Good Deeds -Jonathan Evans, City Manager Agenda Item 7. A. removed from the Agenda to be placed on the November 13, 2018 Regular Meeting agenda. B. Resolution 2018-16, Rescinding Resolution 2018-15, Parking Fee Waiver -Jonathan Evans, City Manager City Manager Jonathan Evans reviewed Agenda Item 7 .B. He said if the resolution is adopted by the Board, it allows for the City Manager to administratively suspend parking for a period of 72 hours if the conditions worsen, and to bring the item back to the Board for additional legislative action. Vice-Mayor Weinstein commented that it was wonderful the City was able to provide support for the business community and the visitors coming to the beach. The residents do not pay for metered parking in Madeira Beach. It is time for the waiver to go away, impose parking fees, and not wait BOARD OF COMMISSIONERS MEETING MINUTES REGULAR MEETING October 15, 2018 Page4 of9 five days to impose it. She said based on the September 2016 and September 2017 data provided to her, the City might have lost about $70,000 in metered parking revenue in 27 days. The City Manager said the resolution will allow for metered parking fees to be charged effective tomorrow. The Finance Director, later as part of his presentation, will be providing information concerning the projected loss. According to historical data, the cost for waiving the parking is about $3,200 a day, but with red tide it is not known how many would have parked during that. For a perfect September with no issues, the loss is about $3,200 per day. Commissioner Oakley asked the City Manager if he was working with all those that stage their equipment in the parking area where the Seafood Festival is to be located to bring visitors in. The City Manager explained they will be informed about the upcoming events and space will be provided to them. The City benefits by having them stage their equipment there. Robert Preston, 425 S. Bayshore Drive, commented he does not agree that the City lost 70,000 in 27 days because the parking lots had been almost empty during the red tide event. Doug Andrews, 90 14181 Avenue, asked why the Seafood Festival was being charged $31,833 for four days, $8,000 a day, for a waiver if the City is losing $3,200 per day in metered parking fees. Lauree Tyner, 4996 Miramar Drive, commented that the City did not lose much money at Archibald Park because the parking lots had been almost empty. The City Clerk read Resolution 2018-16 by title only. Commissioner Oakley made a motion to approve Resolution 2018-16, rescinding Resolution 2018- 15 and reinstating parking fees. Resolution 2018-19, Supporting the Seafood Festival in Madeira Beach-Jonathan Evans, City Manager The City Clerk read Resolution 2018-19 in its entirety. City Manager Jonathan Evans explained that the resolution memorializes the actions taken by the Board and confirms the longstanding commitment ofthe City to ensure that the event continues in perpetuity. It reaffirms how important the event is to the City and how important it is for everyone BOARD OF COMMISSIONERS MEETING MINUTES REGULAR MEETING October 15, 2018 Page 5 of9 to work together in making sure the community-based event remains in Madeira Beach and remains in John's Pass Village to continue promoting economic viability and tourism in the region. Staff is committed to working with event organizers, promoters, and community leaders to ensure the event continues and to assume whatever role necessary to work in close collaboration under the direction of the Board of Commissioners. As part of the resolution, staff is recommending that a Board member be assigned to serve as the liaison with the John's Pass Village Association, work with whoever assumes the role of coordinating the event and be the spokesperson for the Board of Commissioners. He would like an after-action discussion after the event on lessons learned and how to improve on the success of the event to prepare for the one in 2019. Mayor Black said the resolution is positive. The Seafood Festival is an award-winning event. Commissioner Hodges said the Seafood Festival is an award event in Madeira Beach. Sunny has received rewards for the Seafood Festival event and again in August 2017 received the Henry Award. Mayor Black opened to public comment. Robert Preston, 425 S. Bayshore Drive, complemented the City Manager for his wording in the resolution and explained how the that type of resolution should have been done long ago. Doug Andrews, 90 141 st A venue, commented that a resolution was not needed for 36 years until now. The event had occurred for a long time with no problems. He could not understand why Commissioner Weinstein would vote against the Seafood Festival when it is in her district. Sunny deserves an apology from the City Manager especially for the press release that went out. Steven Barrett, 11975 3n1 Street East, Treasure Island, commented that the Seafood Festival event is expensive, blocks traffic, and causes a lot of trash to be everywhere. Mayor Black said people have commented that the Board was not allowing concerts and not approving them. No one has ever come before the Board asking for approval of a concert. It is not the job of the Board to look for music performers. That is the responsibility of the Recreation Department. The same applies to the market. The vendors at the market chose on their own to leave Madeira Beach. The Board did not say no to them. Commissioner Oakley made a motion to approve Resolution 2018-19. CONTRACTS/AGREEMENTS 9. NEW BUSINESS A. Ordinance 2018-14, Amendment to Sign Ordinance - 1st Reading - 1st Reading- Linda Portal, Community Development Director Linda Portal, Community Development Director, reviewed Agenda Item 9.A. She explained the proposed changes, the reason for the changes, and answered questions from the Board. Mayor Black opened to public comment. John Hendricks, 569 Normandy Road, asked if the proposed ordinance affected political signs. Director Portal explained that one of the reasons the amendment is taking place is because of political signs. Under the current Code, they cannot regulate for content. If they allow anybody to put a political sign in their yard to support an issue or a candidate, then everyone else in town has the same right and to put anything on the sign they want. They can regulate the time limit, size of the signs, and the placement of signs. Mr. Hendricks said he does not think the City can keep people from putting political signs up in their yards. Director Portal said they cannot regulate content, but they can regulate how many and what size, but enforcement must be consistent. Mr. Hendricks asked how many signs a person can have on a piece of property. Director Portal said she would have to read the proposed ordinance to find that out. Mr. Hendricks said everyone needed to know that because the election is getting closer. Director Portal said she would get with him on that and explained how she planned to get the information out to the public. Alex [last name ?], college student, commented in favor of the proposed ordinance and urged its approval. Robert Preston, 425 S. Bayshore Drive, commented in opposition of the proposed ordinance. He said people should be allowed to put a flutter sign up and digital signs should be allowed. City Clerk Clara VanBlargan read Ordinance 2018-14 by title only. Vice-Mayor Weinstein made a motion to approve Ordinance 2018-14, amendment to sign ordinance, after first reading. Commissioner Oakley seconded the motion. Interlocal Agreement between Pinellas County and the City of Madeira Beach - Flood Plain Insurance Maps - Linda Portal, Community Development Director BOARD OF COMMISSIONERS MEETING MINUTES REGULAR MEETING October 15, 2018 Page 7 of9 Linda Portal, Community Development Director, reviewed Agenda Item 9.B. and said the cost of services to the City would only be up to $5,000 and any cost above that would have come back to the Board for approval. She answered questions and comments from the Board. Mayor Black opened to public comment. There were no public comments. Commissioner Oakley made a motion to approve the Interlocal Agreement between Pinellas County and the City of Madeira Beach for provision of preliminary floodplain insurance maps. Resolution 2018-17, Amendment I -Additional Homestead Exemption -Jonathan Evans, City Manager City Manager Jonathan Evans reviewed Agenda Item 9.C. He explained the impacts of Amendment 1 if it passes by the voters in November and said the exemption is not a tax exemption or a tax cut, but a tax shift. The fiscal impact that Pinellas County anticipates if it passes, is about $42 million in loss of revenue and that is compounding. The City of Madeira Beach anticipates losing $54,000 of general revenue associated with the additional exemption in 2020. This does not provide a tax cut for all residents. The additional homestead exemption was not asked for by the voters. It was put on the Ballot by members of the Legislative Delegation in Tallahassee and politicians that thought it was appropriate to go after the revenue stream that helps to fund local governments. They did not do anything to impact their local revenue streams, which is primarily sales tax. Staff crafted a resolution that they would like to share with the Florida League of Cities and other government entities to encourage folks to become knowledgeable about Amendment 1 and understand that it is not a tax break for all Floridians. Vice-Mayor Weinstein made a motion to approve Resolution 2018-17, Amendment 1, additional homestead exemption, the letter being in support of the Florida League of Cities initiative. City of Madeira Beach Downtown Market Fee/Wavier and Co-Sponsor Opportunity - Jonathan Evans, City Manager Agenda Item 9.D. was removed from the Agenda to be placed on the October 23, 2018 Regular Workshop Meeting agenda. 10. STAFF REPORTS A. Parking Machine Revenue Comparison for 2017 and 2018 - Walt Pierce, Finance Director Finance Director Walt Pierce reported on Agenda Item 1O.A. The City Manager and Finance Director answered questions from the Board. Mayor Black opened to public comment. Robert Preston, 425 S. Bayshore Drive, commented that if the City had a boat storage facility for people to store their boats at the Marina, a lot of revenue could be made. The revenue would offset things like loss of parking revenue. When parking revenue is down, people are still storing their boats. He said Ms. Weinstein gets a packet and she should be calling the City if she has questions instead of spending a lot of time on the dais asking questions and debating numbers. 11. REPORTS/CORRESPONDENCE • City Commission Mayor Black commented that she is tired of reading comments on social media, Nextdoor, and other places that are not correct. She read some ofthe unfactual comments and responded the facts. Commissioner Oakley asked the City Manager to contact people who responded on the survey that they would like to volunteer. She said John's Pass is in major need of cleanup. Trash is everywhere. The City Manager said he would do that. Vice-Mayor Weinstein commented on the recent Florida League of Cities conference training she attended in Tampa.
