MINUTES OF A SPECIAL MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON December 28, 2020 - 7 p.m. CALL TO ORDER The Special Meeting of the Mayor and Council of the Borough of Madison was held on the 28th day of December, 2020. Mayor Conley called the meeting to order at 7:00 p.m. via teleconference in the Council Chamber of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Daily Record, posting a copy on the bulletin board at main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on December 22, 2020. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Council Members: Carmela Vitale Astri J. Baillie Maureen Byrne John F. Hoover Debra J. Coen Rachael Ehrlich Also Present: Raymond M. Codey, Borough Administrator James E. Burnet, Assistant Borough Administrator Elizabeth Osborne, Borough Clerk Matthew J. Giacobbe, Esq. Borough Attorney AGENDA REVIEW There was approval of the Special Meeting Agenda. ITEMS OF BUSINESS a) Area in Need of Redevelopment, Block 1601, Lot 1.01 Mayor Conley read proposed Resolution 304-2020 by title, noting this is an area recently subdivided from the Central Avenue School property along Community Place. Mayor Conley also noted that an ordinance to accept a redevelopment plan will be introduced in January, 2021. R 304-2020 RESOLUTION OF THE BOROUGH OF MADISON DETERMINING TAX BLOCK 1601, LOT 1.01 BOROUGH OF MADISON, NEW JERSEY TO BE AN AREA IN NEED OF REDEVELOPMENT AND CONFIRMING THE AUTHORIZATION AS TO THE PREPARATION OF A NON-CONDEMNATION REDEVELOPMENT PLAN FOR THE AREA Special Meeting Minutes – December 28, 2020 WHEREAS, pursuant to N.J.S.A. 40A:12A-6, the Borough Council of the Borough of Madison (the “Council”) is authorized to determine delineated areas in the Borough of Madison which meet certain statutory criteria to be an area in need of redevelopment; and WHEREAS, the subdivided property owned by the Borough, designated on the Official Tax Map of the Borough of Madison as Block 1601, Lot 1.01 (the “Property”), is such an area; and WHEREAS, the location, shape and dimensions of the Property are shown on the Tax Map sheet attached as Exhibit A; and WHEREAS, the Council by Resolution 284-2020 adopted on November 16, 2020, referred this matter to the Madison Planning Board for review and the Planning Board at their December 15, 2020 meeting recommended the adoption of a resolution designating the Property as an area in need of redevelopment; and WHEREAS, the Council has determined that redevelopment of the Property may be expected to promote smart growth principles and generate development on Borough-owned vacant real property; and WHEREAS, the Borough Planner has advised that the Property meets the statutory criteria for designation as an area in need of redevelopment; and WHEREAS, the governing body wishes to confirm the authorization to the Borough Planner as to final preparation of a non-condemnation Redevelopment Plan for the area. NOW THEREFORE, IT IS HEREBY RESOLVED by the Borough Council of the Borough of Madison that the delineated area designated on the Tax Map of the Borough of Madison as Block 1601, Lot 1.01, Madison, New Jersey, be and hereby is determined pursuant to N.J.S.A. 40A:12A-6 to be an area in need of redevelopment. IT IS FURTHER RESOLVED, that the Borough Planner is hereby authorized to finalize a non-condemnation Redevelopment Plan for the area; IT IS FURTHER RESOLVED, that the Borough Clerk shall promptly forward a certified true copy of this resolution to the Commissioner of the New Jersey Department of Community Affairs in conformance with the requirements of N.J.S.A. 40A:12A-6. PAGE 2 OF 3 Special Meeting Minutes – December 28, 2020 Mrs. Vitale moved adoption of the Resolution 304-2020. Ms. Baillie seconded the motion. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Ms. Byrne Mr. Hoover, Ms. Coen, Ms. Ehrlich Nays: None INVITATION FOR PUBLIC COMMENT Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda. Mayor asked that, upon recognition by the Chair, the person shall proceed to the lectern and give his/her name and address in an audible tone of voice, and print the same on the sheet provided for the record. He/she shall limit his/her statement to three (3) minutes or less. Since no member of the public wished to be heard, the invitation for discussion was closed. APPROVAL OF VOUCHERS On motion by Mrs. Vitale, seconded by Ms. Baillie and carried, the following vouchers of the Borough of Madison were approved for payment, and the supporting documentation of said vouchers was made part of the Supplemental Minute Book.
