MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON January 24, 2022 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 24th day of January, 2022. Mayor Conley called the meeting to order at 7:00 p.m. via Teleconference in the Council Chamber of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 6, 2022. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. READING OF CLOSED SESSION RESOLUTION Ms. Byrne moved: RESOLVED, that the meeting be adjourned to an Executive Session to consider the following matters: MINUTES FOR APPROVAL (1) January 10, 2022 Date of public disclosure 60 days after conclusion, if disclosure required. PERSONNEL MATTERS (1) ACTING POLICE CHIEF Date of public disclosure 90 days after conclusion, if disclosure required. Seconded: Ms. Baillie Vote: Approved by voice vote RECONVENE VIA TELECONFERENCE Mayor Conley reconvened the Regular Meeting at 8 p.m. via teleconference with all members present. The Pledge of Allegiance was recited by all. Mayor Conley asked for a moment of silence for the passing of Madison residents Phyllis Franke and Frank A. Iannarone, Jr. APPROVAL OF MINUTES Ms. Byrne moved approval of the Reorganization Meeting Minutes of January 3, 2022. Ms. Coen seconded the motion, which passed with a unanimous voice call vote recorded. Mr. Range moved approval of the Executive Minutes of January 10, 2022. Ms. Byrne seconded the motion, which passed with a unanimous voice call vote recorded. Ms. Coen moved approval of the Regular Meeting Minutes of January 10, 2022. Mr. Landrigan seconded the motion, which passed with a unanimous voice call vote recorded. GREETINGS TO PUBLIC Mayor Conley made the following comments: Mayor Conley noted an increase in reported COVID-19 cases due to the Omicron variant and stated that Council meeting will be virtual through the Month of February. REPORTS OF COMMITTEES Utilities Mr. Landrigan, Chair of the Committee, made the following comments: The Electric Department is working with on the beginning stages of the town’s large scale solar project. The department continues to be busy with emergency mark- outs, new construction services, and converting street lights to LED fixtures. On Sunday, February 6th, the Water Department repaired a 6 inch water main break on East Lane near the Cross Gates intersection, with the assistance of the Stand-by crew. The water pressure was reduced by shutting the main valves feeding the East Lane section, and repairs were made. Full water pressure was restored in approximately two hours. Radio readable water meters are still being installed regularly. Anyone interested in having their meter changed to the automated reading system should call the Water Department to schedule an appointment. PAGE 2 OF 15 Regular Meeting Minutes – January 24, 2022 Public Safety Ms. Byrne, Chair of the Committee, made the following comments: In January, Chief Miscia attained certification as an “Accredited Chief Executive” by the NJ Chiefs of Police Association. This certification gives surety of merit in the NJ Chiefs of Police Association’s gauging of effective police leadership through a model of peer review. Two police interns have started during the month of February. Both interns are college students and are looking to gain experience in the field of law enforcement and they are both graduating college in May of this year. Community Affairs Mr. Hoover, Chair of the Committee, made the following comments: The Downtown Development Commission will hold their regular meeting this Thursday, February 17th. May Day is scheduled for Saturday, May 7, 2022. The Chamber of Commerce will once again hold Easter events, including Find Shelley the Rabbit for fun and prizes beginning April 9th. The DDC is also working on a Cinco de Madison event for May. The Madison Chatham Coalition is a community prevention organization funded by the Office of National Drug Control Policy and Substance Abuse Mental Health Services Administration. The Coalition seeks to establish and strengthen community collaboration, educate youth and adults about marijuana. They will hold a “Night of Conversation” regarding substance abuse and mental Health. Parents can pick up kits at the health department. Finance and Borough Clerk Ms. Coen, Chair of the Committee, made the following comments: This is the third of four budget presentations. On February 28th, department heads will make presentations. Introduction of the budget is scheduled for March 28th with the public hearing and adoption scheduled for April 25th. The Borough is under State review this year. The Borough will make two large payments this week including $3,643,154.75 to the Board of Education and a $38,668.00 bond payment on the MRC land and turf field. Public Works and Engineering Ms. Ehrlich, Chair of the Committee, made the following comments: The Department of Public Works reports two snow events, one that required plowing. Fleet services will be taking an in-person class in April on electric vehicles and short term charging in Edison NJ. Madison had for years two very old signs coming into town one on Madison Ave and the other on Main St. by the Chatham border. We used the original iron and repainted both poles. The Electric Department is upgrading the lights to LED and they will be replaced in April. A new snow thrower purchased as a result of an inter-local agreement with Kearny is working well. Health Mr. Range, Chair of the Committee, made the following comments: Annual pet licensing renewals are underway, as well as Retail Food Handlers licensing. The holidays showed a surge in a variant of the COVID-19 virus. Residents are encouraged to get vaccinated and or boosted. Numbers are showing a decline in infection rates. Residents are encouraged to get tested if they are not feeling well. Public Schools will lift masking mandates as of March 7th. The Health Department will continue to work with schools on health protocols. Masks will continue to be mandatory on all public transportation and will still be required in public buildings. PAGE 3 OF 15 Regular Meeting Minutes – January 24, 2022 COMMUNICATIONS AND PETITIONS The Borough Clerk announced receipt of the following communications: Email dated January 24, 2022, from Sundari and Daniel Luts to Mayor Conley on the seventh anniversary of their wedding. INVITATION FOR DISCUSSION (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. Mayor asked that, upon recognition by the Meeting Moderator, each person give his/her name and address in an audible tone of voice, for the record. He/she shall limit his/her statement to three (3) minutes or less. Since no member of the public wished to be heard, the invitation for discussion was closed. AGENDA DISCUSSIONS 01/24/2022-1 STATE OF THE SCHOOLS ADDRESS Superintendent of Madison Public Schools, Mark Schwarz, presented an update of the state of the schools, noting a need for facility improvements. 01/24/2022-2 BUDGET HEARING – ELECTRIC UTILITY, WATER UTILITY AND PUBLIC WORKS Mr. Burnet provided a presentation regarding Public Works, Utilities and Utilities Financial Performance. Jim Mattina, Electric Utilities Superintendent and Ken O’Brien, Director of Public works explained their department’s 2021 accomplishments, 2022 goals and capital budgets. Mr. Burnet noted that the municipal budget includes three entities, current fund, electric utility and water utility. Mr. Burnet provided residential rate comparisons for the utilities, noting a water rate increase should be considered. 01/24/2022-3 MEDICAL CANNABIS IN MADISON Ms. Coen explained proposed legislation regarding a medicinal cannabis dispensary in the Borough of Madison, noting a majority of voters voted to legalize marijuana in the State of New Jersey at the last general election. Following discussion there will be additional information at upcoming Council meetings. ADVERTISED HEARINGS The Clerk made the following statement: Ordinances scheduled for hearing tonight were submitted in writing at a Regular meeting of the Mayor and Council held on January 10, 2022, were introduced by title and passed on first reading, were published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 1-2022 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $840,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR 2022 ROAD RECONSTRUCTION PROJECTS, RELATED WORK AND MISCELLANEOUS PROJECTS PAGE 4 OF 15 Regular Meeting Minutes – January 24, 2022 Mayor Conley opened up the public hearing on Ordinance 1-2022. Since no member of the public wished to be heard, the public hearing was closed. Mr. Ehrlich moved that Ordinance 1-2022, which was read by title, be finally adopted. Ms. Coen seconded the motion. There was no Council discussion, and the motion passed with the following roll call vote recorded: Yeas: Ms. Byrne, Mr. Hoover, Ms. Coen, Ms. Ehrlich, Mr. Landrigan, Mr. Range Nays: None Mayor Conley declared Ordinance 1-2022 adopted and finally passed and ordered the Clerk to publish the notice thereof in the newspaper and to record the ordinance as required by law. ORDINANCE 2-2022 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $645,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR 2022 MILLING AND OVERLAY PROJECTS Mayor Conley opened up the public hearing on Ordinance 2-2022. Since no member of the public wished to be heard, the public hearing was closed. Mr. Ehrlich moved that Ordinance 2-2022, which was read by title, be finally adopted. Ms. Coen seconded the motion. There was no Council discussion, and the motion passed with the following roll call vote recorded: Yeas: Ms. Byrne, Mr. Hoover, Ms. Coen, Ms. Ehrlich, Mr. Landrigan, Mr. Range Nays: None Mayor Conley declared Ordinance 2-2022 adopted and finally passed and ordered the Clerk to publish the notice thereof in the newspaper and to record the ordinance as required by law. Mayor asked that, upon recognition by the Meeting Moderator, each person give his/her name and address in an audible tone of voice, for the record. He/she shall limit his/her statement to three (3) minutes or less. Since no member of the public wished to be heard, the invitation for discussion was closed. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of February 14, 2022 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. PAGE 5 OF 15 Regular Meeting Minutes – January 24, 2022 Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 3-2022 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $80,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE PURCHASE OF A HANDICAPPED EXTERIOR DOOR REPLACEMENT AND ACCESSORIES WHEREAS, the Assistant Borough Administrator/CFO has recommended that the Borough appropriate $80,000.00 from the General Capital Improvement Fund for the replacement of the handicapped door at the Hartley Dodge Memorial and accessories; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $80,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $80,000.00 from the General Capital Improvement Fund for the replacement of the handicapped door at the Hartley Dodge Memorial and accessories. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $80,000.00 is hereby appropriated from the General Capital Improvement Fund for the replacement of the handicapped door at the Hartley Dodge Memorial and accessories. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Ms. Ehrlich moved that Ordinance 3-2022, which the Borough Clerk read by title, be adopted. Ms. Coen seconded the motion. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Ms. Byrne, Mr. Hoover, Ms. Coen, Ms. Ehrlich, Mr. Landrigan, Mr. Range Nays: None R 48-2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING PURCHASE OF BODY WORN CAMERAS AND ACCESSORIES FOR THE POLICE DEPARTMENT THROUGH THE NEW JERSEY COOPERATIVE PRICING SYSTEM WHEREAS, the Borough of Madison desires to award a contract for the purchase of forty (40) body worn cameras and accessories through the New Jersey Cooperative Pricing System program; and WHEREAS, the purchase of goods and services by local contracting units is authorized by the Local Public Contracts Law, N.J.S.A. 40A:11-10, et seq.; and WHEREAS, Watchguard Video of Allen, Texas, has been awarded the New Jersey Cooperative Pricing System contract number T0106/17-Fleet-00793, Law Enforcement Firearms and Supplies; and WHEREAS, the Borough Qualified Purchasing Agent has recommended that the Borough Council utilize this contract for the purchase of forty (40) body worn cameras and accessories; and WHEREAS, funds are available in a grant award in the amount of $81,520.00 from the New Jersey Department of Law and Public Safety Office of the Attorney General, SFY21 Body-worn Camera Grant Program., # 21-BWC-243, for body worn cameras and related equipment, accept by Resolution 208-2021, with any required additional funding in any other account that may be deemed appropriate by the Chief Financial Officer or his designee, including, but not limited to, the Police Department operating budget. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. A contract with Watchguard Video of Allen, Texas for the purchase of forty (40) body worn cameras and accessories for the Police Department, in an amount not to exceed $82,785.00, funded by a grant with the remainder funded through the Police Department operating budget, is hereby approved. 2. The Borough Administrator is hereby authorized and directed on behalf of the Borough to execute a purchase order and contract to Watchguard PAGE 7 OF 15 Regular Meeting Minutes – January 24, 2022 Video of Allen, Texas, for the purchase of a body worn cameras and accessories for the Police Department, in a form acceptable to the Borough Attorney. R 49-2022 RESOLUTION OF THE BOROUGH OF MADISON AWARDING CONTRACT TO BOHLER ENGINEERING, WARREN, NEW JERSEY, FOR PROFESSIONAL LANDSCAPE ARCHITECTURAL SERVICES WHEREAS, the Borough Administrator has recommended that a professional services contract be awarded to Bohler Engineering, for professional landscape architectural services to be supplied to the Borough of Madison for proposed improvements to Waverly Place, based upon the proposal dated August 4, 2021 in the amount of $36,625; and WHEREAS, said services would constitute professional services for which a contract may be awarded without the need of competitive bidding pursuant to N.J.S.A. 40A:11-5; and WHEREAS, funds will be available in account 1-09-55-500-215, or any other budget or capital account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been certified by the Chief Financial Officer. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. The Borough Administrator is hereby authorized to execute, on behalf of the Borough, a professional service contract with Bohler Engineering, for professional landscape architectural services to be supplied to the Borough of Madison for proposed improvements to Waverly Place, in a form acceptable to the Borough Attorney, based upon the proposal dated August 4, 2021 in an amount not to exceed $36,625.00. 2. The Borough Clerk is hereby directed to publish notice of the adoption of this resolution in the official newspaper of the Borough of Madison within ten (10) days of its adoption pursuant to N.J.S.A. 40A:11-5. R 50-2022 RESOLUTION OF THE BOROUGH OF MADISON AWARDING PROFESSIONAL SERVICES CONTRACT TO RICHARD WOLOWICZ, RICHVIEW CONSULTING FOR MUNICIPAL ARBORIST SERVICES WHEREAS, municipal arborist services constitute professional services for which a contract may be awarded without the need of competitive bidding pursuant to N.J.S.A. 40A:11-5; and PAGE 8 OF 15 Regular Meeting Minutes – January 24, 2022 WHEREAS, the Qualified Purchasing Agent has recommended that the Borough Council renew the contract with Richard Wolowicz, Richview Consulting for municipal arborist services for 2022 at a rate of $82.00 per hour through December 31, 2022; and WHEREAS, Richard Wolowicz, Richview Consulting has submitted to the Borough Purchasing Agent the required documents to satisfy the requirements of N.J.S.A. 19:44A-20.5, since this matter may be awarded without competitive bidding; and WHEREAS, funds will be available in the Engineering Professional Services or in any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer, pending approval of the 2022 municipal budget. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. The Mayor and Borough Clerk are hereby authorized to execute, on behalf of the Borough, a professional service contract with Richard Wolowicz, Richview Consulting for Municipal Arborist Services in an amount not to exceed $82.00 per hour, such contract to be in a form approved by the Borough Attorney. 2. The Borough Clerk is hereby directed to publish notice of the adoption of this resolution in the official newspaper of the Borough of Madison within ten (10) days of its adoption pursuant to N.J.S.A. 40A:11-5. R 51-2022 RESOLUTION OF THE BOROUGH OF MADISON APPROVING RENEWAL APPLICATION FOR A BOWLING ALLEY LICENSE FOR NJ ENTERTAINMENT, LLC TRADING AS STRYXE WHEREAS, in compliance with the provisions of Chapter 70 of the Borough Code, application has been made by NJ Entertainment, LLC, trading as Stryxe, for an annual bowling alley license; and WHEREAS, the above applicant has complied with all requirements of the State Law and the above mentioned Borough Code provision. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey, that the following Bowling Alley License be renewed for 2022: Company Name: NJ Entertainment LLC Name of Bowling Alley: Stryxe Location of Bowling Alley: 53 Madison Plaza 306 Main Street, Unit 6 Madison, New Jersey PAGE 9 OF 15 Regular Meeting Minutes – January 24, 2022 R 52-2022 RESOLUTION OF THE BOROUGH OF MADISON APPROVING APPLICATION FOR AMUSEMENT DEVICE LICENSE AND PERMITS FOR YEAR 2022 FOR NJ ENTERTAINMENT, LLC D/B/A STRYXE WHEREAS, in compliance with the provisions of Chapter 58 of the Borough Code, application for amusement device premise license and twenty-nine (29) amusement device permits has been made by NJ Entertainment LLC t/b/a Stryxe; and WHEREAS, the above applicant has complied with all requirements of the State Law and the above-mentioned Ordinance; NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey that the following Amusement Device Premise License be issued to: NJ Entertainment LLC d/b/a Stryxe 53 Madison Plaza 306 Main Street, Unit 6 Madison, NJ 07940 BE IT FURTHER RESOLVED, that this License will permit the operation of twenty-nine amusement device machines at the above mentioned location. R 53 - 2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING A SHARED SERVICE AGREEMENT WITH THE BOROUGH OF CHATHAM AND THE CITY OF SUMMIT TO PROVIDE INFORMATION TECHNOLOGY SERVICES WHEREAS, the Borough of Madison wishes to renew Shared Services agreements for the provision of Information Technology Support Services, wherein Madison provides IT Support Services, pursuant to the attached contracts with the Borough of Chatham and the City of Summit; and WHEREAS, the Madison Borough Council has determined to renew said shared services agreements. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the Mayor and Borough Clerk are authorized to enter into a Shared Services agreement with the Borough of Chatham and the City of Summit for the provision of Information Technology Support Services, such agreements to be in a form approved by the Madison Borough Attorney. R 54-2022 RESOLUTION OF THE BOROUGH OF MADISON APPROVING A SPECIAL EVENT PERMIT TO ALLOW THE USE OF MEMORIAL PARK PARKING AREA BY THE ADULT SCHOOL OF THE CHATHAMS, MADISON AND FLORHAM PARK PAGE 10 OF 15 Regular Meeting Minutes – January 24, 2022 WHEREAS, the Adult School of the Chathams, Madison and Florham Park has requested permission to use the parking area at Memorial Park on Wednesday, February 23, 2022, from 8:30 a.m. to 6:00 p.m.; and WHEREAS, the Borough Administrator has recommended this request be approved; and WHEREAS, the Adult School of the Chathams, Madison and Florham Park will submit a Certificate of Liability Insurance naming the Borough of Madison as an additional insured; and WHEREAS, the Borough Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the Adult School of the Chathams, Madison and Florham Park is hereby given permission to use the parking area at Memorial Park on Wednesday, February 23, from 8:30 a.m. to 6:00 p.m., for a bus trip activity subject to approval of the Madison Police Department. R 55-2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING AN APPLICATION TO THE NJ CLEAN ENERGY PROGRAM COMMUNITY ENERGY PLANNING GRANT PROGRAM WHEREAS, a sustainable community seeks to ensure that its environmental, economic and social objectives are balanced and mutually supportive; and WHEREAS, the Borough of Madison strives to assure clean land, air and water for current and future generations; and WHEREAS, New Jersey’s Energy Master Plan: Pathway to 2050 (“EMP”) established that community-level action is necessary to achieve the State’s goal of 100% clean energy by 2050; and WHEREAS, the New Jersey Board of Public Utilities has created a Community Energy Plan Grant program for municipalities to develop a community energy plan to meet the goals of the State’s Energy Master Plan; and WHEREAS, the Borough of Madison is invested in developing a community energy plan to help the State achieve the goal of 100% clean energy by 2050; and WHEREAS, the Community Energy Plan Grant program will help the Borough of Madison to plan for and invest in renewable energy and to work towards a better environment for all residents by using the state’s Energy Master Plan (EMP) as a guide to develop sustainable strategies that increase clean energy production, reduce energy use, and cut emissions. R 60-2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING ACCEPTANCE OF A NEW JERSEY HISTORIC TRUST FUND GRANT APPLICATION FOR RESTORATION OF THE MADISON MASONIC LODGE NO. 93 WHEREAS, the governing body of the Borough of Madison desires to further historic preservation through a grant from the New Jersey Historic Trust Fund in the amount of $488,100.00 for renovation of the Madison Masonic Lodge No.93; and WHEREAS, the Borough Council has determined it is appropriate to authorize the Mayor and Clerk to execute a Grant agreement with the New Jersey Historic Preservation Trust Fund Grant Program in connection with architectural plans previously completed for renovation of the Madison Masonic Lodge No.93. R 61-2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING GOOD GRIEF INC. TO HOLD A 5K RUN AT GIRALDA FARMS ON SUNDAY, JUNE 5, 2022 WHEREAS, Good Grief, Inc. has requested permission to use portions of Laurel Way, Woodland Road, Treadwell Avenue, and Madison Avenue in connection with a benefit 5k run at Giralda Farms; and WHEREAS, the Police Chief recommends approval of this request; and WHEREAS, Good Grief, Inc. has agreed to reimburse the Madison Police Department for all expenses incurred in connection with the monitoring of said race; and WHEREAS, the Borough Council has reviewed said request and determined that it should be granted. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris, State of New Jersey that Good Grief, Inc. is hereby granted permission to use portions of Laurel Way, Woodland Road, Treadwell Avenue, and Madison Avenue in connection with the 5k Run to be conducted on Sunday, June 5, 2022, between the hours of 6:30 a.m. and 2:00 p.m. subject to the condition that Good Grief, Inc. reimburse the Madison Police Department for all expenses incurred in connection with the monitoring of said race.
