MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON February 26, 2024 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 26th day of February, 2024. Mayor Conley called the meeting to order at 7:00 p.m., in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 12, 2024. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. Imbriaco APPROVAL OF MINUTES Mr. Range moved approval of the Executive Minutes of February 12, 2024. Ms. Ehrlich seconded the motion, which passed with a unanimous voice call vote recorded. GREETINGS TO PUBLIC Mayor Conley made the following comments: Mayor Coley noted the Lead Morris member held a meeting at the Hartley Memorial on Friday, February 23, 2024. Information regarding municipal government was shared and tours of the municipal building were conducted. Mayor Conley noted the installation of a park bench at the Museum of Early Trades & Crafts, donated by the Madison Harding Girl Scouts, constructed with approximately 50,000 donated recycled bottle tops. Mayor Conley recognized State Assemblyman Christian E. Barrabco, who addressed the Council, noting that the Borough of Madison is now in District 25, which he represents. Assemblyman Barrabco thanked all for the opportunity to serve. REPORTS OF COMMITTEES Public Safety Mr. Range, Chair of the Committee, made the following comments: Reporting for the Madison Police Department, Mr. Range noted that department officers were trained in defensive tactics for police officers which is a training course that is now mandated by the Police Training Commission as part of their police licensing guidelines. On February 27th, members of the department will take part in the coffee shop at Madison High School which is run by their special services students. The school resource officer has been inviting weekly “guests” to meet and greet with special service students. On March 15th, Madison officers will be taking part in the Law Enforcement Night at Mennen Arena. The Madison Fire Department reports a total of 105 calls in the Month of February. The Fire Department has been PAGE 2 OF 13 Regular Meeting Minutes – February 26, 2024 working hard on updating and replacing old equipment with items that are more environmentally friendly. This includes replacing all gasoline generator powered hydraulic rescue tools with battery units. They have replaced approximately 85% of the lighting in fire headquarters with LED bulbs and fixtures, ventilation fans with electric plugin fans and battery fans, and replaced gasoline powered chainsaws and other equipment with electric models. The Department applied window tint to the day room and office windows to reduce cooling costs in the summer months and the new engine number 3 meets new EPA clean diesel standards. Finance and Borough Clerk Ms. Ehrlich, Chair of the Committee, made the following comments: This evening is the 5th hearing on the municipal budget. The Council has previously discussed capital, public works, the electric utility, the water utility and the Fire Department and their new EMT services. Tonight, the Council and the public will hear from some of the department heads. The Police Department, Construction Department, Library and Engineering will be talking about their goals, objectives and capital needs. Two weeks from tonight, on March 11, there will be another budget hearing along with a review of the financial strategic planning guidelines. We hope to introduce the official state budget document on March 25th. Later this evening, the Council will be asked to approve the Bill List, which includes over $7.6 million in payments to various vendors and entities. This is an unusually large bill list due to three significant payments. First is $2.7 million to the County for their first quarter taxes along with an additional $69,545 for the County Open Space assessment. The bill list also includes a payment to the Board of Education for $3,941,111.67 for their monthly share of property taxes. It also includes a payment of $467,887.60 made for the renovation work at the Library. The tax quarter closed earlier this month and the delinquent notices went out two weeks ago. Residents that took advantage of the State of New Jersey Senior Freeze program last year, should have received their paperwork for this year. Residents interested in the program are required to meet certain income and age criteria. The Tax Office expects to have the forms available in the next few weeks. Public Works and Engineering Mr. Landrigan, Chair of the Committee, made the following comments: The Borough experienced two snowstorms since last meeting, mechanical staff is working on post storm preventative maintenance and repairs on plows and salting equipment. Sewer jetting has been pushed back until emergency sewer repairs are complete on Rosedale Avenue. Work started today, Monday, February 26th, and should be completed tomorrow. When sewer jetting resumes, locations will be posted on social media / Borough website. Roads Department has patched more potholes. The Sewer Department responded to more issues at Lorraine Road pump station. Please remember not to flush wipes, floss, and hygiene products down the toilet. The Engineering Department reports progress on upgrades at Well B, the Utility building roof project will begin in a few weeks, and an application for a grant for the Memorial Park Trails Phase 3 construction has been submitted. Utilities Mr. Haralampoudis, Chair of the Committee, made the following comments: National Metering continues to change out meters throughout the Borough. Construction at Well B is progressing. Staff replaced a fire hydrant and continues monthly water testing. The Electric Utility Department also assisted with construction at Well B, installing new underground wiring, and installed a new pole on Danforth PAGE 3 OF 13 Regular Meeting Minutes – February 26, 2024 Road. Bids have been advertised for the Solar Carport project, with a bid opening date of March 28, 2024. Community Affairs Ms. Honohan, Chair of the Committee, made the following comments: The next regular meeting of the Downtown Development Commission will be held on Thursday, March 21, at 7:15 pm in the 2nd Floor Committee Room in the Hartley Dodge Memorial Building. The public is invited to attend. The Downtown Development Commission plans to reinvent the Madison Farmers Market for the 2024 season. It will now be called the Madison Farm & Artisan Market and will be held on Saturdays from May 25th through December 14th in the Prospect Street Parking Lot, from 10:00 am until 3:00 pm. The hope is that the new format will allow for greater participation closer to the heart of Madison. The 2024 Taste of Madison takes place on Monday, March 18th. VIP tickets are $125.00 each. VIP tickets will feature early admission and access to all vendors at 6:00 pm. In addition, VIPs can participate in a cooking demonstration with food and wine tastings and will receive a special gift bag and an entry into a special raffle. General Admission tickets are priced at $85.00 each, and entry to the event will begin at 7:00 pm. The new venue for the 2024 edition of the Taste is The Madison Hotel. Tickets are now available at Gary's Wine & Marketplace at 121 Main Street in Madison and online at www.TasteOfMadison.org. Tickets must be purchased in advance. Guests must be at least 21 years old. The recommended attire is business casual. The Downtown Development Commission launched a total refresh of the event formerly known as May Day last year, and the event is now called Madison Green & Clean. The event will again incorporate a town wide beautification day on Saturday, April 27th, from 9:00 to 2:00 pm. The rain date will be Sunday, April 28th. The annual Arbor Day celebration will once again kick off the event. This event also now features a focus on eco-friendly initiatives. Information on sponsorship, donation, and volunteering is available on rosenet. At the Madison Community Center from March 1st through March 31st, the Roseum Gallery will feature Multicolored Viewpoints, the multi-media work of Katie Truck. Ms. Honohan reported for the Health Department noting that influenza activity is high, and recommends that residents stay home if they don’t feel well, wash your hands frequently. Covid test kits are available in the Health Department and residents can receive influenza and Covid vaccines at clinics held by the Westfield Health Department. Health Mr. Forte, Chair of the Committee, absent. PAGE 4 OF 13 Regular Meeting Minutes – February 26, 2024 AGENDA DISCUSSIONS 02/26/2024-1 COMMUNITY ENERGY PLAN Ms. Ehrlich presented a proposed Community Energy Plan prepared by the Climate Action Advisory Committee. This report was made possible through a grant from New Jersey’s Clean Energy Program. Madison participated in the NJ Board of Public Utilities (BPU) Community Energy Plan program, which helps municipalities plan for reliable, affordable, low-carbon energy in their communities. Following adoption of the Community Energy Plan (CEP) by the governing body, Madison will apply for implementation grants from BPU to pursue initiatives in the plan. Madison’s CEP also includes Resiliency Strategies to adapt to the changed climate. Ms. Ehrlich explained each strategy and next steps, including approval of Resolution 93-2024, adopting the CEP, which will allow the Borough to apply for grant funds to pursue initiatives in the plan. Following discussion there was no objection to listing a resolution on the Consent Agenda. Resolution 93-2024 is listed on the Consent Agenda. 02/26/2024-2 2024 MUNICIPAL BUDGET HEARING – DEPARTMENT HEADS Russ Brown, Construction Code Official, provided a recap of 2023 Building Department activity, noting the department accomplishments and goals. Mr. Brown also noted upcoming projects in both Chatham Borough and Madison. Mr. Brown noted that operating expenses are paid by permit revenues. Police Chief John Miscia provided information regarding Police Department divisions, organization and annual statistics. Chief Miscia noted accomplishments and goals, including increases in motor vehicle stops, summons and arrests. Chief Miscia’s goals for 2024 include increased filling a part-time civilian position in the Police Records Division and to restart the Crime Prevention program to meet with residents and conduct home safety inspections/burglar alarm assessments. Officers are now attending training. Library Director Lynn Favreau explained 2023 activities at the Library and goals for 2024, including the Construction and abatement projects for the library, noting the project is on schedule. Assistant Borough Engineer Dennis Harrington presented 2023 accomplishments and 2024 capital projects, including those planned for this year. Mr. Harrington noted reconstruction of the Dodge Field Playground and Cook Plaza reconstruction will begin this spring/summer. ADVERTISED HEARINGS- None Ordinance 9-2024 has a hearing scheduled for March 11, 2024. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of March 11, 2024 in the 2nd Floor Council Chamber of the PAGE 5 OF 13 Regular Meeting Minutes – February 26, 2024 Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 10-2024 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $15,250.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR FUNDING OF TO PURCHASE SECURE SMART ELECTRONIC KNOX COMPANY KEY BOXES WHEREAS, the Fire Chief has recommended that the Borough appropriate $15,250.00 from the General Capital Improvement Fund for the funding to purchase secure smart electronic Knox Company key boxes; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $15,250.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $15,250.00 from the General Capital Improvement Fund for the funding to purchase secure smart electronic Knox Company key boxes. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $15,250.00 is hereby appropriated from the General Capital Improvement Fund for the funding to purchase secure smart electronic Knox Company key boxes. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Mr. Range moved that Ordinance 10-2024, which the Borough Clerk read by title, be adopted. Ms. Ehrlich seconded the motion. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Ms. Ehrlich, Mr. Landrigan, Mr. Range, Mr. Haralampoudis, Ms. Honohan, Mr. Forte Nays: None R 92-2024 RESOLUTION OF THE BOROUGH OF MADISON APPROVING PROMOTION OF JOHN CERUTTI TO THE POSITION OF TRUCK DRIVER I IN THE PUBLIC WORKS DEPARTMENT WHEREAS, John Cerutti has secured a Commercial Driver’s License (CDL); and WHEREAS, the Personnel Director has recommended the approval of a promotion for John Cerutti to the position of Truck Driver I, in the Public Works Department effective January 12, 2024; and WHEREAS, the Borough Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey, that John Cerutti is hereby promoted to the position of Truck Driver I in the Public Works Department, effective January 12, 2024, to be compensated at the annual salary of $48,860.00. R 93-2024 RESOLUTION OF THE BOROUGH OF MADISON TO ADOPT THE COMMUNITY ENERGY PLAN (CEP) AS PART OF THE NEW JERSEY BOARD OF PUBLIC UTILITIES CEP GRANT PROGRAM WHEREAS, New Jersey Board of Public Utilities (NJBPU) authorizes and oversees the NJCEP program and has created a Community Energy Plan Grant program for municipalities to develop a community energy plan (CEP) to meet the goals of the New Jersey’s Energy Master Plan; and, WHEREAS, New Jersey’s Energy Master Plan: Pathway to 2050 (“EMP”) established that community-level action is necessary to achieve the state’s goal of 100% clean energy by 2050; and, WHEREAS, Community Energy Planning is the process by which communities collaboratively select and strategically implement emissions-reducing initiatives that fulfill the EMP goals; and, WHEREAS, by way of Resolution 55-2022 the Borough received a grant from the NJBPU to formulate a Community Energy Plan, and; PAGE 7 OF 13 Regular Meeting Minutes – February 26, 2024 WHEREAS, the Borough’s 2022 Climate Action goals call for Madison to reduce carbon pollution, decreasing Madison’s total carbon footprint by 80 percent from 140,000 tons in 2018 to 28,000 tons by 2050; and, WHEREAS, the Borough of Madison is invested in developing a community energy plan to help the state achieve its goal of 100% clean energy by 2050; and, WHEREAS, during the creation of this plan, the Borough solicited input through community events, community organizations, meetings with Borough staff, and public presentations at Madison Borough Council meetings; and, WHEREAS, the resulting Community Energy Plan will help the Borough of Madison plan for and invest in renewable energy and enhance community resiliency for all residents by using the EMP and Climate Change Resiliency Strategy as guides to develop sustainable strategies that increase clean energy production, reduce energy use, cut carbon pollution, and strengthen our community against the impacts of climate change. NOW, THEREFORE, BE IT RESOLVED, the Madison Borough Council adopts the Madison Community Energy Plan to guide energy efficiency and resiliency initiatives in the Borough of Madison. R 94-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE USE OF $16,750.00 IN MUNICIPAL OPEN SPACE, RECREATION AND HISTORIC PRESERVATION TRUST FUNDS TO ACQUIRE FURNITURE AND FIXTURES AT THE MASONIC LODGE WHEREAS, the Masonic Lodge is in the process of relocating to new headquarters; and WHEREAS, the Borough has previously purchased the Masonic Lodge at 170 Main Street, Madison; and WHEREAS, the Masons have identified historic furniture and fixtures available for purchase; and WHEREAS, the Borough wants to purchase Cuban mahogany benches and historic chandeliers in the amount of $16,750.00; and WHEREAS, the Open Space, Recreation and Historic Preservation Advisory Committee supports expending $16,740.00 for this purpose. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that $16,750.00 is hereby authorized to be allocated from the Open Space, Recreation and Historic Preservation Trust Fund for this purpose. PAGE 8 OF 13 Regular Meeting Minutes – February 26, 2024 R 95-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING SPECIAL EVENT PERMIT TO ALLOW THE USE OF LIVESEY PARK BY MR. PETER LIVESEY ON JULY 19, 2024 WHEREAS, Mr. Peter Livesey of Madison has requested permission to use Livesey Park, on Friday, July 19, 2024, for a wedding event; and WHEREAS, the Livesey family previously owned the property which was operated as a kennel and cooperated with the Borough to preserve the property as open space; and WHEREAS, the Borough Administrator has recommended that such permission be granted; and WHEREAS, Mr. Livesey has submitted a Special Event Permit Application to the Borough and provided a Certificate of Liability Insurance naming the Borough of Madison as an additional insured; and WHEREAS, the Borough Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that Peter Livesey of Madison is hereby given permission to use Livesey Park, on Friday, July 19, 2024, for a wedding event, subject to such safety requirements as may be directed by the Madison Police Department and/or Fire Department. R 96-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE USE OF UP TO $1,000.00 PLUS SHIPPING FOR THE PURCHASE OF WEEVILS TO COMBAT INVASIVE SPECIES AT THE MADISON RECREATION CENTER WHEREAS, the Community Garden Advisory Committee has requested funding for the purchase of Weevils to combat Invasive Species at the Madison Recreation Center Community Garden; and WHEREAS, funds are available in Ordinance 21-2019, MRC Conservation Management Plan; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the MRC Conservation Management Plan in an amount not to exceed $1,000.00 plus shipping for this purpose. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that up to $1,000.00 plus shipping is hereby authorized to be allocated for the purchase of Weevils to combat Invasive Species at the Madison Recreation Center. PAGE 9 OF 13 Regular Meeting Minutes – February 26, 2024 R 97-2024 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING PART-TIME PER DIEM EMERGENCY MEDICAL TECHNICIAN (EMT) TO THE MADISON FIRE DEPARTMENT WHEREAS, the Chief of the Madison Fire Department recommends the appointment of Bronte Dakota to the position of Part-Time Per Diem Emergency Medical Technician (EMT); and WHEREAS, the Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey, that Bronte Dakota is hereby appointed to the position of Part-Time Per Diem EMT effective immediately; and BE IT FURTHER RESOLVED, that Bronte Dakota will be compensated at the rate of $30.00 per hour without benefits. R 98-2024 RESOLUTION OF THE BOROUGH OF MADISON ACCEPTING THE IRREVOCABLE RETIREMENT OF CHIEF LINEMAN JOEL PHILLIPS EFFECTIVE MAY 1, 2024 WHEREAS, Electric Utility Chief Lineman Joel Phillips, has advised the Borough in writing of his irrevocable retirement on May 1, 2024. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey, that the irrevocable retirement of Joel Phillips as Electric Utility Chief Lineman, is hereby acknowledged and accepted with appreciation for his many years of public service. No. 1575 – On-Premise Merchandise Date of Raffle – March 22, 2024 PAGE 10 OF 13 Regular Meeting Minutes – February 26, 2024 R 100-2024 RESOLUTION OF THE BOROUGH OF MADISON ADOPTING REVISED DEFERRED COMPENSATION PROGRAM WITH LINCOLN NATIONAL LIFE INSURANCE COMPANY AND LINCOLN FINANCIAL GROUP WHEREAS, the Borough Council of the Borough of Madison (hereinafter referred to as the “Employer”) by resolution previously adopted a Deferred Compensation Plan (hereinafter referred to as the “Plan”) with the Lincoln Retirement Services, LLC Lincoln National Life Insurance Company and Lincoln Financial Group (hereafter referred to as “Lincoln”) for the purpose of making available to eligible employees the accrual of tax benefits under a Section 457 Deferred Compensation Plan; and WHEREAS, the Economic Growth and Tax Relief Reconciliation Act of 2001, the 2005 final regulations issued under the Uniformed Services Employment and Reemployment Rights Act of 1994, the Pension Protection Act of 2006, final Treasury Regulation §1.457-4, the Heroes Earnings Assistance and Relief Tax Act of 2008, the Worker, Retiree and Employer Recovery Act of 2008 and the Small Business Act of 2010 amended sections of the Internal Revenue Code (the “Code”) and the rules and/or regulations issued thereunder affecting Section 457 Deferred Compensation Plans (cumulatively referred to as the “Acts and Regulations”); and WHEREAS, the Employer desires its Plan 92-PD-Lincoln-0121316 conforms with the changes in the Code and Treasury regulations brought about by the Acts and Regulations; and WHEREAS, the Employer’s current Administrative Services Agreement 94- SA-Lincoln-112017 remains in force; and WHEREAS, the Employer desires to add an additional investment option to be made available to plan participants; and WHEREAS, the additional investment option will have no negative future impact on any participant account and will not negatively affect any past benefits accrued to the participant or the participant’s beneficiaries up to the adoption of this resolution; and WHEREAS, this additional investment has been previously approved by the New Jersey Division of Local Government Services as a permissible investment. NOW, THEREFORE BE IT RESOLVED that the Employer will provide an additional investment option to plan participants. BE IT FURTHER RESOLVED that The Lincoln Retirement Services, LLC has agreed to continue to be the provider of the Deferred Compensation Program for employees; and BE IT FURTHER RESOLVED that the Lincoln will continue to provide, for the benefit of the participants the Multi-Fund Variable Annuity contract and add the Alliance Program as an additional investment option; and BE IT FURTHER RESOLVED that the Chief Financial Officer or Borough Administrator is authorized to execute all agreements as are necessary to maintain the Employer’s Deferred Compensation Program. It is implicitly understood that there is to be no cost or contribution by the Employer to the program; and BE IT FURTHER RESOLVED that the Chief Financial Director or Borough Administrator will continue to serve as the “Administrator” of the plan, represent the PAGE 11 OF 13 Regular Meeting Minutes – February 26, 2024 Borough of Madison, and execute individual deferred compensation agreements with each said employee; and BE IT FURTHER RESOLVED by the Employer that the Clerk forward a certified true copy of this resolution to the Chief Financial Officer or Borough Administrator; and BE IT FURTHER RESOLVED that a certified copy of this resolution shall be forwarded to the Director of the Division of Local Government Services at P.O. No. 1576 – Off-Premise 50/50 Date of Raffle – May 4, 2024 R 102-2024 RESOLUTION OF THE BOROUGH OF MADISON APPROVING THE PERSON-TO-PERSON TRANSFER OF PLENARY RETAIL CONSUMPTION LICENSE NUMBER 1417-33-017-008 WHEREAS, an application has been filed for a Person-to-Person Transfer of Plenary Retail Consumption License Number 1417-33-017-008 heretofore issued to MADISON MARKET, LLC to HARTLEY RESTAURANT, LLC, located at 17 Greenwood Avenue, Madison, N.J. 07940; and WHEREAS, the submitted application form is complete in all respects, the transfer fees have been paid, and the license has been properly renewed for the current license term; and WHEREAS, the applicant is qualified to be licensed according to all standards established by Title 33 of the New Jersey Statutes, regulations promulgated thereunder, as well as pertinent local ordinances and conditions consistent with Title 33; and WHEREAS, the applicant has disclosed and the issuing authority reviewed the source of all funds used in the purchase of the license and the licensed business and all additional financing obtained in connection with the licensed business.
