MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON February 26, 2025 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 26th day of February, 2025. Mayor Conley called the meeting to order at 7:00 p.m., in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 9, 2025. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. Seconded: Ms. Ehrlich Vote: Approved by voice vote RECONVENE IN COUNCIL CHAMBER Mayor Conley reconvened the Regular Meeting at 8 p.m. in the Council Chamber with all members present. The Pledge of Allegiance was recited by all. Mayor Conley asked for a moment of silence for the passing of the following Madison residents: Victor H. Schumacher Edward H. Pellow, Jr. Carolyn M. Campbell Fausta M. Roberto Linda A. Tyler APPROVAL OF MINUTES - None GREETINGS TO PUBLIC Mayor Conley made the following comments: Mayor Conley noted the annual Taste of Madison Held Monday, February 24th at the Madison Hotel and on February 14th Mayor Conley officiated his 300th wedding ceremony. REPORTS OF COMMITTEES Finance and Borough Clerk Ms. Ehrlich, Chair of the Committee, made the following comments: This evening, is the 5th hearing on the municipal budget. Privious discussions include capital, public works, the electric utility, the water utility and the Fire Department and new EMT services. Tonight, the Council and the public will hear from department heads. The Police Department, Construction Department, Library and Engineering will be talking about goals, objectives and capital needs. On March 24th, there will be a budget hearing, a review of the financial strategic planning guidelines and introduction of the official state budget document. Later this evening, the Council will be asked to approve the Bill List, which includes over $9 million in payments to various vendors and entities. This is an unusually large bill list due to some significant payments. First is $3.1 million to the County for the first quarter taxes and the County Open Space assessment. The bill list also includes a payment to the Board of Education for $4,067,724.33 for the monthly share of property taxes. It also includes a payment of over $340,000 for the Cook Avenue Parking Lot project, a payment of over $94,000 for replacement of a sewer lift station pump and a payment of over $266,000 for repairs at one of the water wells. PAGE 2 OF 12 Regular Meeting Minutes – February 26, 2025 A very short report from the Tax Collector, the tax quarter closed earlier this month and delinquent notices went out two weeks ago. Please contact the Tax Collector if you have questions regarding your tax bill. Public Safety Mr. Landrigan, Chair of the Committee, made the following comments From the Madison Fire Department, the ladder truck was returned to full active status. The bucket was repaired and placed back on the truck. The Fire Department will be getting in-service training on animal emergencies soon. Right to Know Survey for 2024 completed. Purged Firehouse of 18 gallons of hand sanitizer through the County Haz-mat program. Training almost complete for new EMS protocols: Blood Sugar testing, CPAP therapy, and Albuterol administration. Chief Miscia and Captain Longo will be attending the New Jersey Conference of Mayors Winter Summit on February 27th to take part in a panel to discuss the ARRIVE Together Program. Mayor Conley is hosting the panel and this will also include remarks from Matthew Platkin, Attorney General- State of New Jersey. This upcoming Saturday, March 1st, Madison Police Department will be attending "Coffee with a Cop" at Delikositas, a Colombian restaurant in town, to meet and discuss local topics with visitors. The goal is to continue to strengthen our relations with members of all communities in town. Chief Miscia met with Pastor Carol Howard from Presbyterian Church of Madison during the week of February 17th. Pastor Carol wanted to learn more about the Police Chaplain program and we are hoping to bring her on as a member. Public Works and Engineering Mr. Range, Chair of the Committee, made the following comments: Twice in the last week, the Borough had issues with one of the sewer pump stations. Our Sewer Dept. would like to remind residents, please do not flush oil, grease, floss, hygiene products or wipes. Another snow / ice event occurred since last council meeting, crews salted roads, parking lots, cleared crosswalks and sidewalks. While there have been several reports on the news about salt shortages, Madison DPW is well prepared for any future snow / ice events. Utilities Mr. Haralampoudis, Chair of the Committee, absent. Community Affairs Ms. Honohan, Chair of the Committee, made the following comments: The next meeting of the Downtown Development Commission will be held on Thursday, March 20th, at 7:15 pm in the 2nd Floor Committee Room in the Hartley Dodge Memorial Building. The public is invited to attend. Planning is underway for Madison Green & Clean 2025. The event will be held on Saturday, April 26, 2025. More information will be released shortly. The 2025 Madison Farm & Artisan Market vendor contracts have been sent. Prospective vendors should contact Lisa Ellis at ddc@rosenet.org. The Madison Area Chamber of Commerce Nautilus Diner Placemat Program is back. We’re printing 40,000 full-color placemats for a six- month run, offering prime exposure to local customers. This advertising program is open to members and non-members, with limited spaces available on a first-come, first-served basis. Contact Karen at MadisonChamber@gmail.com for more information. Easter Fun Fest is scheduled for April 12. 2025 from 11:00 am to 12:30 pm. PAGE 3 OF 12 Regular Meeting Minutes – February 26, 2025 Health Mr. Forte, Chair of the Committee, made the following comments: Mr. Forte noted that influenza activity is high and the Health Dept. still has vaccines. The Board of Health is currently working on a new chicken coop license and residents are reminded that pet licenses need to be renewed before March 1st. COMMUNICATIONS AND PETITIONS - None INVITATION FOR COMMENT (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. Mayor asked that, upon recognition by the Meeting Moderator, each person give his/her name and address in an audible tone of voice, for the record. He/she shall limit his/her statement to three (3) minutes or less. Since no member of the public wished to be heard, the invitation for discussion was closed. AGENDA DISCUSSIONS 02/26/2025-1 BUDGET HEARING – DEPARTMENT HEADS Mr. Burnet noted the municipal budget schedule, noting this year the Borough will have State review and introduced Department Heads. Russ Brown, Construction Code Official, provided a recap of 2024 Building Department activity, noting the department has three full-time and five part-time employees. Mr. Brown also noted upcoming projects in both Chatham Borough and Madison. Police Chief John Miscia provided information regarding Police Department divisions, organization and annual statistics. Chief Miscia noted accomplishments and goals, including increases in motor vehicle stops, summons and arrests. Chief Miscia’s goals for 2025 include increased community relations and events, shared services and training for mental health calls, noting the ARRIVE program will go county wide. Fire Chief Kyle Wickman noted 2024 statistics and accomplishments and 2025 goals, including increased recruitment of volunteers. Library Director Lynn Favreau explained 2024 activities at the Library and goals for 2025, including completion of the Construction and abatement projects for the library. Assistant Engineer Dennis Harrington provided 2024 accomplishments and 2025. Mr. Harrington noted that the Land Use services is very busy. Ryan Fury, Borough Project Manager provided updates on the water and sewer systems, noting work for replacement of the aging systems. ADVERTISED HEARINGS The ordinance scheduled for hearing tonight was submitted in writing at a Regular meeting of the Mayor and Council held on February 10, 2025, was introduced by title and passed on first reading, was published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinance 4-2025 for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 4-2025 ORDINANCE OF THE BOROUGH OF MADISON AMENDING CHAPTER 94 APPENDIX A OF THE BOROUGH CODE ENTITLED “ELECTRIC DEPARTMENT RULES AND REGULATIONS” REGARDING TIME OF USE RATES PAGE 4 OF 12 Regular Meeting Minutes – February 26, 2025 WHEREAS, the Assistant Borough Administrator/CFO has recommended amendments to the Borough Code regarding time of use rates (TOU) for customers of the Borough of Madison electrical system; and WHEREAS, residents can choose to use TOU rates for rates during regular peak and off peak use. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris, and State of New Jersey, as follows: SECTION 1: Chapter 94 of the Code of the Borough of Madison, Appendix A, thereof entitled “SCHEDULE OF RATES FOR ELECTRIC UTILITY” is hereby amended as follows: .... § Appendix A, Attachment 1:1. Applicable to use of service for: Individual residential dwelling units and associated incidental nonresidential use and separately metered auxiliary residential use. Character of service: Single or three-phase service at secondary voltages. Rate per month: Customer charge: $4.86 which shall be charged as a separate service and not offset by any generation credit. Energy charge: 0 to 600 kWh $0.1929, 601 kWh or higher $0.2039 Minimum charge per month: Monthly bills computed under this service classification shall not be rendered for less than the sum of the customer charge, plus applicable additional extension, special facilities, or supplemental customer charges. Term of contract: None, except that reasonable notice of discontinuance will be required. Standard terms and conditions: This service classification is subject to the standard terms and conditions of this tariff for electric service. RESIDENTIAL TIME OF USE (TOU) RATES: Residents can choose a TOU Rate Structure as follows: Regular Rate of $0.19 per kWh, for electricity consumed from 7AM to 3PM and 7PM to 11PM Monday through Friday, non-holiday. Peak Rate of $0.375 per kWh, for electricity consumed from 3PM to 7PM Monday through Friday, non-holiday. Off Peak of $0.152 per kWh, for electricity consumed 11PM to 7AM every day and all day on weekends and holidays. Term of contract for Time of Use (TOU): This is a PILOT program and as such, Residents that select the TOU Rates are required to remain in this program a minimum of 12 months or until rates change or the program is discontinued. PAGE 5 OF 12 Regular Meeting Minutes – February 26, 2025 This rate structure will take effect when the Chief Financial Officer determines that the rate structure can be accommodated by the Borough’s billing system. SECTION 2: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 4-2025. Since no member of the public wished to be heard, the public hearing was closed. Ms. Ehrlich moved that Ordinance 4-2025, which was read by title, be finally adopted. Mr. Landrigan seconded the motion. There was no Council discussion, and the motion passed with the following roll call vote recorded: Yeas: Ms. Ehrlich, Mr. Landrigan, Mr. Range, Ms. Honohan, Mr. Forte Nays: None Absent: Mr. Haralampoudis Mayor Conley declared Ordinance 4-2025 adopted and finally passed and ordered the Clerk to publish the notice thereof in the newspaper and to record the ordinance as required by law. INVITATION FOR COMMENT (2 of 2) Mayor opened the meeting to the public for their opportunity to ask questions and make comments on any subject. Mayor asked that, upon recognition by the Meeting Moderator, each person give his/her name and address in an audible tone of voice, for the record. Brian Mortenson; Myrtle Avenue, asked that the traffic barriers along Main Street at the Chipotle Restaurant be returned for safety reasons. Judy Kroll; Laurel Way, representing the Friends of the Drew Forest and continue to thank the Mayor and Council for their efforts to save the Drew Forest for future generations. James Burnet; Main Street, noted that on February 28, 2025, the 200 anniversary of the Presbyterian Meeting House originally located on Main Street. Since no other member of the public wished to be heard, the invitation for discussion was closed. INTRODUCTION OF ORDINANCES - None CONSENT AGENDA RESOLUTIONS The Clerk made the following statement: Consent Agenda Resolutions will be enacted with a single motion; any Resolution requiring expenditure is supported by a Certification of Availability of Funds; any Resolution requiring discussion will be removed from the Consent Agenda; all Resolutions will be reflected in full in the minutes. Ms. Ehrlich moved adoption of the Resolutions listed on the Consent Agenda. Mr. Landrigan seconded the motion. WHEREAS, Chapter 98 of the Borough Code permits the Borough Clerk issue filming permits under certain guidelines; and WHEREAS, an application was received for a film permit for 159 Garfield Avenue and local roadways in Madison by Winger Productions, Inc. for filming on February 18, 2025; and WHEREAS, upon review, the Borough C lerk and Borough Administrator have recommended issuance of a permit, contingent upon receipt of all fees and insurance. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the request of Winger Productions to film in the Borough of Madison is hereby approved. R 86-2025 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING APPOINTMENT OF NICHOLAS FIORELLO TO THE POSITION OF MECHANIC IN THE PUBLIC WORKS DEPARTMENT WHEREAS, the Director of Public Works and the Personnel Director recommend that an offer of employment be made to Nicholas Fiorello for the position of Mechanic in the Public Works Department; and WHEREAS, the Borough Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey, as follows: 1. The Personnel Director shall make an offer of employment to Nicholas Fiorello for the position of Mechanic in the Public Works Department. 2. The Personnel Director is authorized to hire Nicholas Fiorello for the position of Mechanic in the Public Works Department upon receipt of satisfactory results of physical and back assessment and drug/alcohol test, effective immediately, at an annual salary of $66,683.00 with a 120 business day. PAGE 7 OF 12 Regular Meeting Minutes – February 26, 2025 R 87-2025 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING APPOINTMENT OF ALBERT GREGORIO TO THE POSITION OF LABORER IN THE PUBLIC WORKS DEPARTMENT WHEREAS, the Director of Public Works and the Personnel Director recommend that an offer of employment be made to Albert Gregorio for the position of Laborer in the Public Works Department; and WHEREAS, the Borough Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey, as follows: 2. The Personnel Director shall make an offer of employment to Albert Gregorio for the position of Laborer in the Public Works Department. 3. The Personnel Director is authorized to hire Albert Gregorio for the position of Laborer in the Public Works Department upon receipt of satisfactory results of physical and back assessment and drug/alcohol test, effective immediately, at an annual salary of $41,157.00 with a 120 business day probationary period, in accordance with the appropriate collective bargaining unit contract. R 88-2025 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING APPOINTMENT OF ROBERT A. VOGEL TO THE POSITION OF PART-TIME SITE INSPECTOR IN THE CONSTRUCTION DEPARTMENT WHEREAS, the Personnel Director and Borough Administrator have recommended the appointment of Robert A. Vogel to the position of part-time Site Inspector, at the rate of $50.00 per hour; and WHEREAS, the Borough Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that Robert A. Vogel is appointed to the position of part-time Site Inspector at the rate of $50.00 per hour. R 89-2025 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE RELEASE OF THE PERFORMANCE BOND FOR 306 MAIN STREET, BLOCK 2208, LOT 27 WHEREAS, the Assistant Borough Engineer has recommended that the Surety Performance Bond Guaranty be released to HS Investors, LLC, in connection with site improvements located at 306 Main Street, Block 2208, Lot 27. R 90-2025 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE FRIENDS OF THE MADISON PUBLIC LIBRARY TO HOLD A TOUCH A TRUCK FUNDRAISER ON SUNDAY, JULY 20, 2025 WHEREAS, the Friends of the Madison Public Library have requested permission to hold a “Touch a Truck” fundraiser on Sunday, July 20, 2025, on the grounds of the Madison Public Library; and WHEREAS, the Friends of the Madison Public Library have requested participation by the Madison Fire, Police, and Public Works departments; and WHEREAS, the Borough of Madison Police Department will display a police car or other vehicles; and WHEREAS, the Borough of Madison Fire Department will display a truck or trucks as well as an ambulance with paid firefighters and per-diem EMTs; and WHEREAS, the Borough Council has determined to grant this request. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey, that the request by the Friends of the Madison Public Library to hold a “Touch a Truck” fundraiser on Sunday, July 20, 2025, on the grounds of the Madison Public Library is hereby approved, subject to such safety requirements as may be determined by the Madison Fire, Police, and Public Works Departments. R 91-2025 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING PASTOR CAROL HOWARD AS POLICE CHAPLAIN FOR THE MADISON POLICE DEPARTMENT WHEREAS, Ordinance 60-2016 establishes the position of volunteer Chaplain for the Madison Police Department, under the control of the Chief of Police; and WHEREAS, the Chief of Police has recommended the appointment of Pastor Carol Howard of the Presbyterian Church of Madison to serve as Police Chaplain for the Madison Police Department. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that Pastor Carol PAGE 9 OF 12 Regular Meeting Minutes – February 26, 2025 Howard is appointed as Police Chaplain for the Madison Police Department, effective immediately. R 92-2025 RESOLUTION OF THE BOROUGH OF MADISON AWARDING PROFESSIONAL SERVICES CONTRACT TO HELENA RUMAN, R.A. TO SERVE AS AN ARCHITECT AND CONSULTANT FOR BOROUGH-RELATED CAPITAL PROJECTS AND IMPROVEMENTS WHEREAS, the Borough Administrator has recommended awarding a professional services contract for architectural and consultation services for borough-related capital projects; and WHEREAS, said services would constitute professional services for which a contract may be awarded without the need of competitive bidding pursuant to N.J.S.A. 40A:11-5; and WHEREAS, the Borough Administrator has recommended that the Borough Council award the contract to Helena Roman, R.A. at an hourly rate of $175.00; and WHEREAS, funds are available in the 2025 operating budget or in any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been certified by the Chief Financial Officer. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. The Mayor and Borough Clerk are hereby authorized to execute, on behalf of the Borough, a professional service contract with Helena Ruman, R.A. for architectural and consultation services for capital projects at an hourly rate of $175.00, such contract to be in a form approved by the Borough Attorney. 2. The Borough Clerk is hereby directed to publish notice of the adoption of this resolution in the official newspaper of the Borough of Madison within ten (10) days of its adoption pursuant to N.J.S.A. 40A:11-5. R 93-2025 RESOLUTION OF THE BOROUGH OF MADISON APPROVING RAFFLE LICENSE APPLICATION SUBMITTED BY MADISON HIGH SCHOOL PTSO BE IT RESOLVED by the Council of the Borough of Madison, County of Morris, State of New Jersey, that the following application for Raffle License, to be held as listed below, be and the same is hereby approved: PAGE 10 OF 12 Regular Meeting Minutes – February 26, 2025 MADISON HIGH SCHOOL PTSO I.D. No. 274-5-33795 R.A. No. 1571 – On-Premises Merchandise Date of Raffle – May 17, 2025 R 94-2025 RESOLUTION OF THE BOROUGH OF MADISON APPROVING JACOB HENRY PERKINS TRUST DISBURSEMENT WHEREAS, the Assistant Borough Administrator recommends a grant from the Jacob Henry Perkins Trust (hereafter Perkins Trust) on behalf of the Madison Housing Authority (MHA); and WHEREAS, the Assistant Borough Administrator has advised the Borough Council that the MHA request meets the criteria for a Perkins Trust grant; and WHEREAS, the Borough Council has determined to approve the request for a Perkins Trust grant for financial hardship in the amount of $1,039.14. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that a grant is hereby approved from the Perkins Trust in the amount of $1,039.14 for the benefit of MHA, to be disbursed by the Finance Department. R 95-2025 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING ANDRE FERNANDEZ TO THE PART-TIME POSITION OF PART-TIME ARTS AND EVENTS ASSISTANT WHEREAS, the Personnel Director recommends the appointment of Andre Fernandez to the part-time position of Part-Time Arts and Events Assistant; and WHEREAS, the Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey that Andre Fernandez is hereby appointed to the part-time position of Part-Time Arts and Events Assistant, effective immediately, to be compensated at the hourly rate of $22.50 per hour up to 29 hours a week on an as needed basis, with no benefits, contingent upon a satisfactory background check. UNFINISHED BUSINESS - None APPROVAL OF VOUCHERS On motion by Ms. Ehrlich, seconded by Mr. Landrigan and carried, the following vouchers of the Borough of Madison were approved for payment, and the PAGE 11 OF 12 Regular Meeting Minutes – February 26, 2025 supporting documentation of said vouchers was made part of the Supplemental Minute Book.
