Brown – Present CITY OFFICIALS COURT REPORTER City Attorney Patrick Gunn Lauren Goodman Planning and Zoning Director Erika Kennett ATTENDEES Mr. Mario Jones CASE #16-V-002 John Macenulty Mr. John Ottenad CALL to ORDER Chairman Goddard called the meeting to order at 6:30 p.m. and asked Director Kennett to call the roll. The record of attendance is shown above. APPROVAL OF MINUTES A motion to approve the January 14, 2016 minutes as submitted was made by Member Mayer and seconded by Member Moeckel. The minutes were approved. OLD BUSINESS None NEW BUSINESS. Director Kennett gave the details of the variance case. A deck permit application was submitted by Mr. and Mrs. Jones. Director Kennett verified the adjacent property owners were notified about the variance request and the City had received no feedback regarding this case. Testimony #1 - Mr. Mario Jones Testimony #2 - Mr. John Macenulty Testimony #3 – Mr. John Ottenad With all the questions satisfactorily answered, Member Mayer made a motion and seconded by Member Brown to approve the variance. The resulting vote was 3-2 which voted down the variance. 1 Member Nissenbaum moved to allow Mr. and Mrs. Jones to encroach onto the side yard as shown in Exhibit C to the width of the previous deck. Member Nissenbaum moved to accept and Mr. Brown seconded. The resulting vote was 5-0 in favor of granting the variance. ADJOURNMENT The meeting adjourned at approximately 7:35 p.m. 2
