MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, DECEMBER 4, 2017 AT 200 HIGHLANDS BOULEVARD DRIVE 1. CALL TO ORDER Mayor David L. Willson called the Regular Board of Aldermen meeting to order at 7:00 p.m. 2. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Clement, Alderman Nolte, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Diehl, Mayor Willson and Attorney Gunn. A quorum was present. 3. APPROVAL OF THE MINUTES: a. MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, NOVEMBER 20, 2017 Alderman Clement made the motion to approve the Minutes of the Regular Board of Aldermen meeting of Monday, November 20, 2017. The motion was seconded by Alderman Hamill and carried unanimously, without objection. 4. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Mayor Willson said he would be introducing a Boy Scout, and Alderman Ottenad stated she wanted to postpone the second reading of item 9(a). Alderman Clement stated he would be recommending some changes to item 10(a). Alderman Hamill made the motion to approve the Order of Items on the Agenda as amended. The motion was seconded by Alderman Clement and carried unanimously, without objection. 5. CONSIDERATION OF PETITIONS AND COMMENTS FROM THE PUBLIC Regular Board of Aldermen 12/04/2017 Page 1  a. Comments from the Public Mr. Chris Winters, 510 Cardinal Lane, asked the following questions: 1) What are you going to do about the starting police salary when Ballwin raises their starting police salary to $57,000 at the beginning of next year? 2) What are you going to do in 2020 when employee salaries will be at the median salaries of 2017? 3) What happened with getting the health insurance through SLAIT? Did we have to use the same Broker again? 4) You’ve consumed a considerable amount of money from the General Fund to pay for projects over the past several years. Are you intending to replenish those funds? How much money did you remove from the General Fund and how much money do you plan on replenishing the fund and when? 5) How many lawsuits are pending against the City at this time? 6) You’re proposing a more than $16 million Bond Issue that will cost Manchester residents an additional $2 to $5 million to borrow depending on how long it takes to pay back. Do you know what it is going to cost each household every year to pay this back and for how long? 7) Candidate filing for Mayor and Alderman in April 2018 begins December 12 and ends January 16. I’m certain there are plenty of rules from the State, County and City for Campaigning. Is there any one publication or location on the Internet that contains all of these rules? Mr. Lee Presser, 1140 Big Bend Station Drive, advised that he is a trustee for Big Bend Station Subdivision, stated that the St. Louis Post Dispatch reported that trash was going to be charged for in Manchester. He was reminded by a number of the original owners that were here during the annexation period that one of the things that sold them to vote for the annexation was a promise made of residents having free trash collection, but he has since learned a lot. Mr. Presser suggested that it is time for a letter to be sent to every household in the City to explain that. He said it is a shame that there is no newspaper especially for the City of Manchester. He said he learned that most of the City’s expenditures are not covered by property tax, so the City needs to depend on sales tax. He suggested that a more forceful campaign needs to be done by Manchester to encourage people to come and shop in Manchester, and we need to work together to figure out Manchester’s financial situation. Mr. Presser said he has gone on a door-to-door campaign in his subdivision in regard to the deer population. He said it is about 50/50 between not touching them and shooting them. Mr. Presser said he believes the Board has heard about setting up a butterfly sanctuary, and this was brought up by Bruce Burkhart. He said that is something that the City wouldn’t have to spend much money on. Mr. Presser added that he would encourage the Board to ask for more than what is being thought about for the road projects. He said there are a number of streets in his subdivision that need Regular Board of Aldermen 12/04/2017 Page 2 attention, and it is better to get these things done now, because it takes less money to maintain them than to have to rip down to bedrock and rebuild. 6. REPORTS FROM THE MAYOR a. Introduction of Boy Scout Mayor Willson introduced Boy Scout Cole Long of Troop 624 who is working on his Communication in the Community merit badge. b. Mayoral Report Mayor Willson reported that on November 28, Alderman Clement, Chief Walsh and he went to the Country Lane Woods Subdivision meeting. On November 30, he went to the Municipal League of Metro St. Louis meeting in Berkeley. He discussed the plan to have all of the St. Louis area Police Departments accredited. He stated that on December 1, Manchester hosted the Lafayette Area Mayors Organization holiday reception. There is support for a Resolution by the eight mayors to present to St. Louis County to do something about the deer population. December 2 was the Breakfast with Santa, both sessions were sold out. Everyone was very complimentary of Manchester and very appreciative. December 3 was the Homecoming Appreciation Dinner for the volunteers; there were 62 people at Tucker’s Place West for the dinner. 7. REPORTS FROM THE CITY ADMINISTRATOR a. List of Paid Bills (Warrant dates of November 18 – December 2, 2017) There were no questions. 8. REPORTS FROM COMMITTEES a. Planning and Zoning Commission Alderman Clement stated that the Planning and Zoning Commission did not meet and they do have an agenda for next week. b. Homecoming Committee Alderman Ottenad stated they did not have a meeting, but they had a great time at the appreciation dinner yesterday at Tucker’s. c. Manchester Arts Alderman Baumann stated that he did not have anything to report. 9. ACTION ON OLD BILLS a. BILL # 17-2314 – AN ORDINANCE APPROVING THE 2018 BUDGET This item was postponed to a future meeting. Regular Board of Aldermen 12/04/2017 Page 3  b. BILL # 17-2315 – AN ORDINANCE AMENDING THE CODE OF ORDINANCES RELATING TO IGNITION INTERLOCK DEVICES Alderman Hamill read for the second time Bill # 17-2315, entitled: “AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF MANCHESTER BY ADDING THERETO NEW SECTIONS 342.090 AND 342.100 RELATING TO THE REGULATION OF IGNITION INTERLOCK DEVICES”, by title only. Alderman Hamill made the motion that Bill # 17-2315 become Ordinance # 17-2198. The motion was seconded by Alderman Clement. A poll of the Board showed: Alderman Baumann – aye Alderman Ottenad – aye Alderman Clement – aye Alderman Nolte – aye Alderman Hamill – aye Alderman Diehl – aye Mayor Willson announced the vote passed 6 – 0, with no objections. 10. INTRODUCTION OF NEW BILLS a. RESOLUTION ESTABLISHING A NON-VALID ALARM POLICY Alderman Diehl stated that prior to reading this Resolution, he would like for Alderman Clement to discuss this Resolution. Alderman Clement stated that it was postponed, if everyone could recall at the last meeting because of the opening statement “The City of Manchester has experienced a significant increase in non-valid alarms. He said they asked to see the data, the data did not show a significant increase but it did show it happens more than we would want it to happen. So the first change he is proposing is “The City of Manchester is experiencing a significant number of non-valid alarms”. The second and third changes are to make it a little easier for the Police Department to monitor and acknowledge that when two police officers go out on a false alarm there is an expense associated with it. The second change would be to C(2), and that would be to change from $50.00 to $100.00. The third item of change would be a change to C(3) to “in the event of additional non- valid alarms, such alarm user within a twelve month the alarm user should pay to the City of Manchester a fine of $175. He said he wanted to suggest that we take out C\(4), (5), and (6). Alderman Diehl read Proposed Resolution # 17-0606, entitled: “A RESOLUTION ESTABLISHING A POLICY RELATING TO NONVALID ALARMS”, by title only. There being no additional questions, Alderman Diehl made the motion to approve this Resolution. The motion was seconded by Alderman Clement and carried unanimously, without objection. BILL ENGAGING SERVICES REGARDING ISSUANCE OF GENERAL OBLIGATION BONDS Alderman Nolte introduced Bill # 17-2316, entitled: “AN ORDINANCE ENGAGING THE SERVICES OF GILMORE & BELL, P.C., AS BOND COUNSEL, IN CONNECTION WITH THE ISSUANCE OF GENERAL OBLIGATION BONDS OF THE CITY”, by title only. There being no questions, no further action at this time. c. BILL CALLING A BOND ELECTION Alderman Clement introduced Bill # 17-2317, entitled: “AN ORDINANCE CALLING A BOND ELECTION IN THE CITY OF MANCHESTER, MISSOURI”, by title only. Alderman Clement also read: “WHEREAS, the Board of Aldermen of the City of Manchester, Missouri (the “City”) finds it necessary and hereby declares its intent to borrow $16,000,000 for the purpose of constructing, reconstructing, extending, repairing and improving the City’s streets and sidewalks, including acquiring any land or right-of-way necessary therefor (the “Project”) and to evidence such borrowing by the issuance of general obligation bonds of the City in the amount of $16,000,000. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF MANCHESTER, MISSOURI, AS FOLLOWS: Section One: A special election is hereby ordered to be held in the City on April 3, 2018, on the following proposition: PROPOSITION ___ Shall the City of Manchester, Missouri, issue its general obligation bonds in the amount of $16,000,000 for the purpose of constructing, reconstructing, extending, repairing and improving the City’s streets and sidewalks, including acquiring any land or right-of-way necessary therefor?” There being no questions, no further action at this time. d. BILL ADJUSTING THE 2017 BUDGET Alderman Baumann introduced Bill # 17-2318, entitled: “AN ORDINANCE AMENDING ORDINANCE NO. 16-2167 ADOPTING AND APPROVING THE BUDGET FOR THE CITY OF MANCHESTER FOR THE YEAR JANUARY 1, 2017 THROUGH DECEMBER 31, 2017, BY (1) INCREASING THE ESTABLISHED BUDGET FOR THE SANITARY SEWER REPAIR FUND BY FIFTY THOUSAND DOLLARS ($50,000.00), AND (2) REDUCING THE SANITARY SEWER REPAIR FUND BALANCE FOR THE BEGINNING OF 2018 BY FIFTY THOUSAND DOLLARS ($50,000.00)”, by title only. There being no questions, no further action at this time. 11. MISCELLANEOUS Regular Board of Aldermen 12/04/2017 Page 5  a. Comments from the Public There were none. 12. EXECUTIVE SESSION: a. Closed Session: Pursuant to Section 610.021 (12) of the Revised Statutes of the State of Missouri pertaining to sealed bids and related documents, until the bids are opened; and sealed proposals and related documents or any documents related to a negotiated contract until a contract is executed, or all proposals are rejected. Alderman Hamill made the motion to go into Closed Session: Pursuant to Section 610.021 (12) of the Revised Statutes of the State of Missouri pertaining to sealed bids and related documents, until the bids are opened; and sealed proposals and related documents or any documents related to a negotiated contract until a contract is executed, or all proposals are rejected. The motion was seconded by Alderman Clement. A poll of the Board showed: Alderman Ottenad – aye Alderman Clement – aye Alderman Nolte – aye Alderman Hamill – aye Alderman Diehl – aye Alderman Baumann – aye Mayor Willson announced the vote passed 6 – 0, with no objections. 13. ADJOURNMENT At 8:00 p.m., after the Executive Session, there being no further business, Alderman Hamill made the motion to adjourn.
