MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, DECEMBER 3 , 2018 AT 200 HIGHLANDS BOULEVARD DRIVE 1. CALL TO ORDER Mayor Mike Clement called the Regular Board of Aldermen meeting to order at 7:00 p.m. 2. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Huether, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Toben and Mayor Clement. Alderman Nolte was absent. A quorum was present. 3. APPROVAL OF THE MINUTES: a. Minutes of the Monday, November 19, 2018 Regular Board of Aldermen meeting Alderman Toben made the motion to approve the Minutes of the Monday, November 19, 2018 Regular Board of Aldermen meeting. The motion was seconded by Alderman Hamill and carried unanimously, without objection. 4. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Mayor Clement stated that he is aware of one change, and that is listed under “Old Bills”, but there is an amended version of that Bill, so it will be read as a “New Bill”. He asked City Attorney Paul Rost to explain. City Attorney Paul Rost stated that in regard to Section E of this Bill, because of the recommendation of the City’s Prosecuting Attorney, that section has been amended to reflect lowering the amount to $225 for minor traffic violations. Attorney Rost said this shouldn’t be a problem because the City’s schedule of fines, even if doubled, would still come beneath $225. He said it is also stated in the Bill that if it isn’t a minor traffic violation, the fine can be higher. The motion was seconded by Alderman Toben and carried unanimously, without objection. 5. CONSIDERATION OF PETITIONS AND COMMENTS FROM THE PUBLIC a. New Liquor License 1. Discount Liquors Alderman Hamill made the motion to approve the liquor license for Discount Liquors. The motion was seconded by Alderman Ottenad and carried unanimously, without objection. b. Comments from the Public There were none. 6. REPORTS FROM THE MAYOR a. Introduction of and presentation to Parkway South High School student Isabelle Hefele Mayor Clement stated that there was an article recently in the West Newsmagazine about Isabelle Hefele. She is a member of the Parkway South Marching Band and she applied for and was the only musician locally who was accepted to march in the Great American Marching Band during the Macy’s Thanksgiving Day Parade in New York. Mayor Clement also acknowledged that Isabelle Hefele is a member of the Manchester Community Band, and she also teaches swimming at the Manchester City Park Aquatic Center. Mayor Clement presented a Proclamation to Isabelle Hefele commending her on her accomplishments. b. Introduction of Cub Scouts from Cub Scout Pack 781 Mayor Clement introduced Cub Scouts Amir Jabareen, Braylon Ruder, Kate Cowan, Liam Cluck, Liam Linton, Logan Scott, Ankith Raghavendra and Bilal Jabareen, a Troop from Hanna Woods School. c. Mayoral Report Mayor Clement thanked volunteers and parks staff for the Breakfast with Santa on Saturday, December 1, 2018 where there was a sold-out crowd. That afternoon the police and more community volunteers hosted this year’s second Shop with a Cop Program. Mayor Clement reminded everyone that December 11 is candidate filing for the 2019 election. December 13 is the Senior Holiday Luncheon at First Evangelical Free Church. He acknowledged that the 2018 Prop S street work is winding down for this year, and will pick up again next spring. Mayor Clement stated the pace of the search for a police chief picks up this week, as potential candidates are being interviewed. Regular Board of Aldermen 12/03/2018 Page 2 7. REPORTS FROM THE CITY ADMINISTRATOR a. List of Paid Bills (Warrant dates of November 18 – December 1, 2018) There were no questions. 8. REPORTS FROM COMMITTEES a. Planning and Zoning Commission Alderman Hamill stated that there was only one case, and it was for the McKee property, and it was unanimously rejected. 9. ACTION ON OLD BILLS a. BILL # 18-2355 – AN ORDINANCE APPROVING THE 2019 BUDGET Alderman Huether read for the second time Bill# 18-2355, entitled: “AN ORDINANCE ADOPTING AND APPROVING THE BUDGET FOR THE CITY OF MANCHESTER FOR THE YEAR JANUARY 1, 2019 THROUGH DECEMBER 31, 2019, AND APPROPRIATING SUCH SUMS AS SET FORTH HEREIN FOR ALL DEPARTMENTS AND ACCOUNTS THEREIN SPECIFIED”, by title only. Alderman Baumann stated that earlier this afternoon he sent an email request to Chelsea, our new HR person, to let us know on March 1st how many employees are taking advantage of the additional retirement option. The new one he was talking about is where the employees put in an additional 4% of their salary and receive another 2% from the City. Alderman Baumann said he has searched out feedback from some employees and from what he has been hearing is that they think this new retirement option is good, but they still have concerns about the cost of the insurance. These concerns are validated by the loss of four employees recently. Alderman Baumann addressed City Administrator Larry Perney and stated that he was proposing that the employee committee meet this year and give the aldermen some recommendations on how best to use the approximate $200,000 of benefit money needed to get the employees up to the 50th percentile. Alderman Baumann said he would like them to come up with specific resolutions with accurate dollar amounts attached to it. Because this problem directly affects the employees, he wanted input from them on how this can be solved. If the employee committee would like him to join their discussion, he would be happy to make that happen. Alderman Huether made the motion that Bill # 18-2355 become Ordinance # 18-2241. The motion was seconded by Alderman Ottenad. AMENDED BILL # 18-2358 – AN ORDINANCE RELATING TO INCREASED SAFETY AREAS Alderman Baumann introduced Amended Bill # 18-2358, entitled: “AN ORDINANCE AMENDING CHAPTER 320 OF THE MUNICIPAL CODE OF THE CITY OF MANCHESTER PERTAINING TO INCREASED SAFETY AREAS AND FINDING THAT PUBLIC SAFETY REQUIRES THAT JOYCE ANN DRIVE AND CONNIE LANE BE DESIGNATED AS INCREASED SAFETY AREAS SUBJECT TO DOUBLE FINES”, by title only. Alderman Baumann stated that emergency legislation had been requested. He made the motion for approval of emergency legislation. The motion was seconded by Alderman Toben and carried unanimously, without objection. Alderman Baumann read for the second time Bill # 18-2358, entitled: “AN ORDINANCE AMENDING CHAPTER 320 OF THE MUNICIPAL CODE OF THE CITY OF MANCHESTER PERTAINING TO INCREASED SAFETY AREAS AND FINDING THAT PUBLIC SAFETY REQUIRES THAT JOYCE ANN DRIVE AND CONNIE LANE BE DESIGNATED AS INCREASED SAFETY AREAS SUBJECT TO DOUBLE FINES”, by title only. Alderman Baumann made the motion that Bill # 18-2358 become Ordinance # 18- 2242. The motion was seconded by Alderman Ottenad. A poll of the Board showed: Alderman Ottenad – aye Alderman Huether – aye Alderman Nolte – absent Alderman Hamill – aye Alderman Toben – aye Alderman Baumann - aye Mayor Clement announced the motion passed 5 – 0, with one absentee and no objections from the Board. 10. INTRODUCTION OF NEW BILLS a. BILL AMENDING THE 2018 BUDGET Alderman Ottenad introduced Bill # 18-2359, entitled: “AN ORDINANCE AMENDING ORDINANCE NO. 17-2199 THAT ADOPTED AND APPROVED THE BUDGET FOR THE CITY OF MANCHESTER FOR THE YEAR JANUARY 1, 2018 THROUGH DECEMBER 31, 2018, BY ESTABLISHING A REVENUE BUDGET FOR THE DEBT SERVICE FUND BY INCREASING REVENUES BY ONE MILLION DOLLARS ($1,000,000)”, by title only. EXECUTIVE SESSION: a. Closed Session: Pursuant Section 610.021 (12) of the Revised Statutes of Missouri pertaining to sealed bids and related documents, until the bids are opened; and sealed proposals and related documents or any documents related to a negotiated contract until a contract is executed or all proposals are rejected; and, Closed Session: Pursuant to Section 610.021 (1) of the Revised Statutes of the State of Missouri pertaining to legal actions, causes of action or litigation involving a public governmental body and any confidential or privileged communication between a public governmental body or its representatives and its attorneys; and, Closed Session: Pursuant to Section 610.021 (2) of the Revised Statutes of the State of Missouri pertaining to the leasing, purchase or sale of real estate by a public governmental body where public knowledge of the transaction might adversely affect the legal consideration therefore.
