MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, SEPTEMBER 21, 2020 BY VIDEO CONFERENCING ON ZOOM AND ALSO OPEN FOR THE PUBLIC AT 200 HIGHLANDS BOULEVARD DRIVE 1. CALL TO ORDER Mayor Mike Clement called the Regular Board of Aldermen meeting to order at 7:00 p.m. 2. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Huether, Alderman Nolte, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Toben, and Mayor Clement. A quorum was present. 3. APPROVAL OF THE MINUTES a. Minutes of the Tuesday, September 8, 2020 Public Hearing Alderman Ottenad made the motion to approve the Minutes of the Tuesday, September 8, 2020 Public Hearing. The motion was seconded by Alderman Hamill and carried unanimously, with no objections from members of the Board of Aldermen. b. Minutes of the Tuesday, September 8, 2020 Regular Meeting Alderman Hamill made the motion to approve the Minutes of the Tuesday, September 8, 2020 Regular Board of Aldermen Meeting. The motion was seconded by Alderman Ottenad and carried unanimously, with no objections from members of the Board of Aldermen. 4. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Alderman Hamill made the motion to approve the Order of Items on the Agenda, as Regular Board of Aldermen Meeting 09-21-2020 Page 1 submitted. The motion was seconded by Alderman Baumann and carried unanimously, with no objections from any members of the Board of Aldermen. 5. CONSIDERATION OF PETITIONS AND COMMENTS FROM THE PUBLIC a. Picnic License – St. Joseph’s Church Annual Sausage Supper Alderman Toben made the motion to approve the Picnic License for St. Joseph’s Church Annual Sausage Supper. The motion was seconded by Alderman Ottenad and carried unanimously, with no objections from any members of the Board of Aldermen. b. Comments from the Public Ms. Trish Gunby, State Representative in the 99th, said she wanted to let people know that if they are having problems or need a resource with unemployment, they can reach out to her and she can connect to her liaison. Ms. Gunby wanted to remind everyone they have their shop and support event on October 3rd. Ms. Gunby wanted to remind everyone of a couple key voting days coming up. September 22 is the first day absentee voting starts in person for the general election. The last day to register to vote is October 7. She said the Election Board is suggesting if they are doing a mail in ballot or absentee ballot to mail them in two weeks prior. 6. REPORTS FROM THE MAYOR a. “Lessening the Distance” Mayor Clement stated Alderman Ottenad spoke in her invocation about the need to treat people with dignity and justice. He said that is what has driven City Administrator Perney, Chief Will, Captain Smith, Alderman Huether and himself into looking and examination the Police Department’s policies to ensure the department remains open and transparent. Mayor Clement stated they met with a local pastor and used his guidance and direction. They have started a book study and they are focused on how to make a better community. In addition to the policy changes with the intent of lessening the distance of people that are different. b. Parkway Update – Alderman Huether Alderman Huether stated the task force she is part of is entitled the “Equity and Diversity Acceleration Task Force”, this group was convened as a result of an equality Regular Board of Aldermen Meeting 09-21-2020 Page 2 survey that the district did last year. She was asked to join because she is a Parkway Family and her also being in local government. Parkway believes they can’t make change alone and they need community support also. Alderman Huether stated that she was assigned to a small team that is focused on on inviting and engaging parents and community and members in the work of equity for all youth. c. Mayoral Reports Mayor Clement stated Homecoming was September 12. It was a fun weekend and he wanted to thank Director Schien and her staff. They had a great 5k launch in the morning for the event. The parade was different and interesting, but it was fun. Mayor Clement stated the kids did clean up at the top of Indian Hill. The Police and Fire Department were there, and the kids were being proactive and doing good things. Mayor Clement stated that on Friday, September 18, they held their virtual POW/MIA event at the Veterans Memorial. He wanted to thank everyone that helped with the event. Mayor Clement stated Manchester held another Recycling event on September 19. There were almost 600 cars that attended. They started the event earlier than planned. Total weight they collected was 40,000 pounds. Manchester had a grant from St. Louis County that paid for those who were turning in their televisions. The number of tv’s that were turned in was over 300. 7. REPORTS FROM THE CITY ADMINISTRATOR a. List of Paid Bills (Warrant dates of 09-07-2020 to 09-20-2020) There were no questions. b. City Administrator Report City Administrator Larry Perney stated they have been working hard on the budget and they hope to have a draft late this week or early next week. They will have it by the next meeting, October 5. A schedule of work shops has been mailed out by Director Yucuis. Director Yucuis stated they are going to have an audit and finance committee meeting on October 5, in person at the Justice Center. He said the budget work sessions are scheduled for the 3rd and 4th week in October. Regular Board of Aldermen Meeting 09-21-2020 Page 3 8. REPORTS FROM COMMITTEES a. Planning and Zoning Commission Alderman Hamill stated they did not meet. b. Veterans Commission Alderman Huether stated they did meet on September 17. She said the Commission finalized a modest budget they will be putting in for that will be helping with activities they have planned. Alderman Huether stated the next meeting will be October 14. c. Homecoming Committee Alderman Ottenad stated Covid made Homecoming challenging this year. Manchester Parks had their first Manchester 5k run and walk at Schroder Park on September 12. Manchester also had a 2020 Homecoming Parade. She did feel like the crowds were larger along the parade route. She said she saw many kids wanting candy, which she did not have any. 9. ACTION ON OLD BILLS a. BILL NO. 20-2417 – 2020 PROPERTY TAX LEVY Alderman Toben read the second reading of Bill #20-2417, entitled: “AN ORDINANCE ESTABLISHING AND LEVYING THE RATE OF TAXATION UPON ALL REAL AND PERSONAL PROPERTY IN THE CITY OF MANCHESTER FOR CALENDAR YEAR 2020”, by title only. Alderman Toben made the motion that Bill #20-2417 become Ordinance #20-2302. The motion was seconded by Alderman Ottenad. A poll of the Board showed: Alderman Ottenad – aye Alderman Huether – aye Alderman Nolte – aye Alderman Hamill – aye Alderman Toben – aye Alderman Baumann – aye Mayor Clement announced that the motion passed 6 – 0, with no objections from any members of the Board of Aldermen. BILL NO. 20-2418 – AMENDMENT TO CHAPTER 610 - SOLICITATION Alderman Baumann read Proposed Bill #20-2418, entitled: "AN ORDINANCE AMENDING CHAPTER 610, ARTICLE I, SECTION 610.010, OF THE MUNICIPAL CODE OF THE CITY OF MANCHESTER, TO AMEND THE DEFINITION OF SOLICITOR TO CLARIFY SUCH DOES NOT INCLUDE CANVASSER", by title only. City Clerk Justin Klocke stated back in mid-August, Manchester had a situation where a candidate for a political office in a neighborhood and we had a resident who requested that they not be knocking on their doors in their neighborhood for soliciting. They believed canvassing to be soliciting and called the police. City Clerk Klocke stated that tonight’s Bill is to clarify canvassing as a lawful activity within the City. Alderman Baumann stated that emergency legislation had been requested, so he made the motion for approval of emergency legislation. The motion was seconded by Alderman Ottenad, and carried unanimously, without objection. Alderman Baumann read for the second time Bill #20-2418, entitled “AN ORDINANCE AMENDING CHAPTER 610, ARTICLE I, SECTION 610.010, OF THE MUNICIPAL CODE OF THE CITY OF MANCHESTER, TO AMEND THE DEFINITION OF SOLICITOR TO CLARIFY SUCH DOES NOT INCLUDE CANVASSER", by title only. Alderman Baumann made the motion that Bill #20-2418, become Ordinance #20- 2303. The motion was seconded by Alderman Ottenad. A poll of the Board showed: Alderman Huether – aye Alderman Nolte – aye Alderman Hamill – aye Alderman Toben – aye Alderman Baumann – aye Alderman Ottenad – aye Mayor Clement announced that the motion passed 6 – 0, with no objections from any members of the Board of Aldermen. b. BILL NO. 20-2419 – AMENDMENT TO CHAPTER 500 – BUILDING CODES AND Regular Board of Aldermen Meeting 09-21-2020 Page 5  REGULATIONS AND CHAPTER 505 – PROPERTY MAINTENANCE CODE Alderman Ottenad read Proposed Bill #20-2419, entitled: “AN ORDINANCE OF THE CITY OF MANCHESTER, MISSOURI, AMENDING CERTAIN SECTIONS OF CHAPTERS 500 AND 505 OF THE MUNICIPAL CODE, CITY OF MANCHESTER, MISSOURI PERTAINING TO THE BUILDING CODE, ELECTRICAL CODE, PLUMBING CODE, MECHANICAL CODE, RESIDENTIAL CODE, EXISTING BUILDING CODE, AND PROPERTY MAINTENANCE CODE AND ENACTING A NEW FUEL AND GAS CODE AND SWIMMING POOL AND SPA CODE” by title only. No further action at this time. c. RESOLUTION NO 20-0767 – 2020 CLOVERLEAF LANE STORMWATER IMPROVEMENTS Alderman Nolte read Proposed Resolution 20-0767, entitled “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO A CONTRACT WITH K.J.U. INC. D/B/A K.J. UNNERSTALL CONSTRUCTION CO. IN AN AMOUNT NOT TO EXCEED ONE HUNDRED NINETEEN THOUSAND FOUR HUNDRED FIFTY- SIX DOLLARS AND SEVENTY CENTS ($119,456.70) INCLUDING A TEN (10) PERCENT CHANGE ORDER IN THE AMOUNT OF TEN THOUSAND EIGHT HUNDRED FIFTY-NINE DOLLARS AND SEVENTY CENTS ($10,859.70) FOR UNFORESEEN CONDITIONS FOR CONSTRUCTION OF STORMWATER IMPROVEMENTS IN THE AREA KNOWN AND REFERRED TO AS THE 2020 CLOVERLEAF LANE STORM IMPROVEMENTS PROJECT,” by title only. Alderman Nolte made the motion for approval of Resolution #20-0767. The motion was seconded by Alderman Ottenad and carried unanimously, without any objections from any members of the Board of Aldermen. d. RESOLUTION NO 20-0768 – MANCHESTER JUSTICE CENTER SECURITY FENCING BID CONSTRUCTION Alderman Huether read Proposed Resolution 20-0768, entitled: “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO A CONTRACT WITH COLLINS & HERMANN, INC. IN AN AMOUNT NOT TO EXCEED TWENTY-TWO THOUSAND SIX HUNDRED TWENTY-SEVEN DOLLARS AND ZERO CENTS (22,627.00) FOR CONSTRUCTION OF IMPROVEMENTS KNOWN AND REFERRED TO AS THE MANCHESTER JUSTICE CENTER SECURITY FENCING PROJECT”, by title only. Chief of Police Scott Will stated they requested this for a couple different reasons but primarily for security. There have been several instances around the country that officers have been sitting on their own police department lots and have been ambushed by Regular Board of Aldermen Meeting 09-21-2020 Page 6 people. He recognizes that the fence that they are proposing is not going to completely stop that but does give them some security. Alderman Huether made the motion for approval of Resolution #20-0768. The motion was seconded by Alderman Ottenad and carried unanimously, without any objections from any members of the Board of Aldermen. e. RESOLUTION NO 20-0769 – CARES ACT MUNICIPALITY RELIEF PROGRAM FUNDING AGREEMENT AUTHORIZATION Alderman Hamill read Proposed Amended Resolution 20-0769, entitled: “A RESOLUTION REQUESTING THAT ST. LOUIS COUNTY DISTRIBUTE $47 MILLION OF CARES ACT FUNDS ON A PER CAPITA BASIS TO THE MUNICIPALITIES WITHIN THE COUNTY TO BE USED FOR ELIGIBLE EXPENSES, AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER, MISSOURI, TO ACCEPT CARES ACT FUNDING AND EXECUTE A MUNICIPALITY RELIEF PROGRAM FUNDING AGREEMENT, AND CONFIRMING AGREEMENT TO INDEMNIFY AND HOLD HARMLESS ST. LOUIS COUNTY FROM SUCH DISTRIBUTION,” by title only. Alderman Hamill made the motion for approval of amended Resolution 20-0769. The motion was seconded by Alderman Nolte and carried unanimously, without any objections from any members of the Board of Aldermen. 11. MISCELLANEOUS a. Comments from the Public There were none. 12. ADJOURNMENT There being no further business, Alderman Hamill made a motion to adjourn. The motion was seconded by Alderman Nolte and carried unanimously.
