MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, OCTOBER 5, 2020 BY VIDEO CONFERENCING ON ZOOM AND ALSO OPEN FOR THE PUBLIC AT 200 HIGHLANDS BOULEVARD DRIVE 1. CALL TO ORDER Mayor Mike Clement called the Regular Board of Aldermen meeting to order at 7:00 p.m. 2. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Huether, Alderman Nolte, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Toben, and Mayor Clement. A quorum was present. 3. APPROVAL OF THE MINUTES a. Minutes of the Monday, September 21, 2020 Regular Board of Aldermen Meeting Alderman Hamill made the motion to approve the Minutes of the Monday, September 21, 2020 Regular Board of Aldermen Meeting. The motion was seconded by Alderman Toben and carried unanimously, with no objections from members of the Board of Aldermen. 4. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Mayor Clement asked Alderman Ottenad to speak under his Mayoral Report regarding the shredding event. Alderman Ottenad made the motion to approve the Order of Items on the Agenda, as amended. The motion was seconded by Alderman Hamill and carried unanimously, with no objections from any members of the Board of Aldermen. Regular Board of Aldermen Meeting 10-05-2020 Page 1 5. CONSIDERATION OF PETITIONS AND COMMENTS FROM THE PUBLIC a. Comments from the Public There were no comments from the Public. 6. REPORTS FROM THE MAYOR a. Mayoral Reports Alderman Ottenad stated Manchester held their annual Shredding event this past Saturday, October 3rd at Paul Schroeder Park. They had a great shredding event. The 2019 event brought 106 cars and this year 210 over a two-hour window. She has not heard how many pounds of paper they shredded this year, but they suspect it will be about 8,000 pounds. Alderman Ottenad stated last year they collected a 167 food items and this year there were 601 food and personal care items donated. Last years cash donations were $230. This year’s cash donations were $655. Alderman Ottenad wanted to thank Alderman Huether for getting a wonderful lady who she got connected with the event. That lady brought four teenagers that kept busy helping to get the paper and food items out of the vehicles. Mayor Clement stated that Wednesday, October 7 is the next “Chat with the Chief”. He hopes everyone that would like to talk with the Chief can make it. Mayor Clement stated that Thursday, October 8, Manchester is having the next small business meeting at the Parks Department. It starts at 7:30 a.m. Mayor Clement wanted to remind everyone that on October 10 from 8 a.m. to noon there is the notary ballot drive. It will be in Paul Schroeder Park. The City has posted 4 separate voting videos regarding voting in 2020 and have attracted quite a few followings and activity. The Board of Elections has also shared them on their website. They are cool and funny and far better than the normal boring videos in the past. Mayor Clement wanted to thank Director of Finance Don Yucuis and City Administrator Larry Perney on getting the budget together and out to the Board of Aldermen and all their hard work. Preparing the budget is a lot of work. Mayor Clement wanted to acknowledge the retirement of Public Works Director Bob Ruck. We will miss Bob Ruck after his 49 years with the City. 7. REPORTS FROM THE CITY ADMINISTRATOR City Administrator Larry Perney stated they have scheduled budget meetings on Regular Board of Aldermen Meeting 10-05-2020 Page 2 October 22 and October 29. There is a schedule of topics that will be discussed for each of the nights. He said right now it will be either in person or on Zoom, but it is scheduled at the Justice Center. They will keep everyone posted as to which way they will do the meeting. a. Lafayette Community Improvement District 2021 Preliminary Budget City Administrator Perney stated they received the Lafayette CID 2021 Preliminary Budget. They submitted it to the City, and they have established the CID in 2016 which allowed them to create an improvement district and collect an additional sales tax to improve their property. Mayor Clement asked if it was open ended or if it ends at a certain time. City Administrator answered it will end but it will be awhile. b. List of Paid Bills (Warrant dates of 09-07-2020 to 09-20-2020) There were no questions. 8. REPORTS FROM COMMITTEES a. Planning and Zoning Commission Alderman Hamill stated they did meet for three different site plans for the Bend at Sulphur Spring. He said all site plans were approved unanimously. b. Veterans Commission Alderman Huether stated there is no report since they have not met. They do plan to meet on October 14. c. Homecoming Committee Alderman Ottenad stated the Homecoming 5K and Rover Run had over 80 participants. A resident that was counting seemed to think it was closer to 100 participants, which is not bad for our first time. For this year’s parade they had 60 participants. She said that although the Parks Department received many positive emails from the Community who are grateful for event despite all the modifications, there were some concerns that were voiced to some of them about the darkness and late hours. 9. ACTION ON OLD BILLS a. BILL NO. 20-2419 – AMENDMENT TO CHAPTER 500 – BUILDING CODES AND REGULATIONS AND CHAPTER 505 – PROPERTY MAINTENANCE CODE Alderman Ottenad read the second reading of Bill #20-2419, entitled: “AN Regular Board of Aldermen Meeting 10-05-2020 Page 3 ORDINANCE OF THE CITY OF MANCHESTER, MISSOURI, AMENDING CERTAIN SECTIONS OF CHAPTERS 500 AND 505 OF THE MUNICIPAL CODE, CITY OF MANCHESTER, MISSOURI PERTAINING TO THE BUILDING CODE, ELECTRICAL CODE, PLUMBING CODE, MECHANICAL CODE, RESIDENTIAL CODE, EXISTING BUILDING CODE, AND PROPERTY MAINTENANCE CODE AND ENACTING A NEW FUEL AND GAS CODE AND SWIMMING POOL AND SPA CODE” by title only. Alderman Ottenad made the motion that Bill #20-2419 become Ordinance #20- 2304. The motion was seconded by Alderman Hamill. A poll of the Board showed: Alderman Hamill – aye Alderman Toben – aye Alderman Baumann – aye Alderman Ottenad – aye Alderman Huether – aye Alderman Nolte – aye Mayor Clement announced that the motion passed 6 – 0, with no objections from any members of the Board of Aldermen. 10. ACTION ON NEW LEGISLATION a. RESOLUTION NO 20-0770 – 2020 CONCRETE SIDEWALK SLAB ELEVATION CORRECTION PROJECT BID CONSIDERATION Alderman Nolte read Proposed Resolution 20-0770, entitled “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO A CONTRACT WITH LIFT RITE, INC. IN AN AMOUNT NOT TO EXCEED SEVENTY-SIX THOUSAND FIVE HUNDRED DOLLARS AND ZERO CENTS ($76,500.00) FOR CONSTRUCTION OF IMPROVEMENTS KNOWN AND REFERRED TO AS THE 2020 CONCRETE SIDEWALK SLAB ELEVATION CORRECTION PROJECT”, by title only. Director of Public Works Bob Ruck stated Manchester is striving to undertake a program with addressing sidewalk conditions. One of the least expensive but most efficient ways to do it is with the mud jacking process. The City of St. Charles is also using this process. Mayor Clement asked how long this process would take once they get started. Director Ruck answered it would probably be about two months. Alderman Huether stated that she knows that the department has gone through and determined what sidewalks can be mud jacked and which ones need to be replaced within Regular Board of Aldermen Meeting 10-05-2020 Page 4 the year. She asked what the percentage is to be ground and mud jacked compared to replaced. Director Ruck stated they do have that information and could get it to the Board. Alderman Nolte made the motion for approval of Resolution #20-0770. The motion was seconded by Alderman Hamill and carried unanimously, without any objections from any members of the Board of Aldermen. 11. MISCELLANEOUS a. Comments from the Public There were none. 12. EXECUTIVE SESSION a. CLOSED SESSION: PURSUANT TO SECTION 610.021 (1) OF THE REVISED STATUTES OF THE STATE OF MISSOURI PERTAINING TO LEGAL ACTIONS, CAUSES OF ACTION OR LITIGATION INVOLVING A PUBLIC GOVERNMENTAL BODY AND ANY CONFIDENTIAL OR PRIVILEGED COMMUNICATIONS BETWEEN A PUBLIC GOVERNMENTAL BODY OR ITS REPRESENTATIVES AND ITS ATTORNEYS. Alderman Hamill made the motion to go into Closed Session: Pursuant to Section 610.021 (1) of the Revised Statutes of the State of Missouri pertaining to legal actions, causes of action or litigation involving a public governmental body and any confidential or privileged communication between a public governmental body or its representatives and its attorneys. The motion was seconded by Alderman Toben. A poll of the Board showed: Alderman Toben – aye Alderman Baumann – aye Alderman Ottenad – aye Alderman Huether – aye Alderman Nolte – aye Alderman Hamill – aye Mayor Clement announced the vote passed 6 – 0, with no objections from any members of the Board. 13. ADJOURNMENT There being no further business, Alderman Nolte made a motion to adjourn. The motion was seconded by Alderman Hamill and carried unanimously.
