MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, NOVEMBER 21, 2022 AT 200 HIGHLANDS BOULEVARD DRIVE CALL TO ORDER Mayor Mike Clement called the Regular Board of Aldermen Meeting to order at 7:00 p.m. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Nolte, Alderman Dodge, Alderman Huether, Alderman Toben, Alderman Baumann, and Mayor Clement. Alderman Ottenad was absent. A quorum was present. APPROVAL OF THE MINUTES November 7, 2022 Public Hearing Alderman Toben made the motion to approve the minutes of the Monday, November 7, 2022 Public Hearing. The motion was seconded by Alderman Huether and carried unanimously, with no objections from any members of the Board of Aldermen. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Mayor Clement reassigned the reading of Bill No. 22-2491 to Alderman Baumann. Alderman Toben made the motion to approve the Order of Items on the Agenda, as amended. The motion was seconded by Alderman Baumann and carried unanimously, with no objections from any members of the Board of Aldermen. CONSIDERATION OF PETITIONS Comments from the Public There were none. REPORTS FROM THE MAYOR Proclamation for Lafayette Industries Mayor Clement presented a proclamation to Lafayette Industries to thank them for being active in the Manchester community and to honor their work in providing employment opportunities for adults with disabilities. Many members of Lafayette Industries were present to hear the reading of the proclamation. Mayoral Reports Regular Board of Aldermen Meeting 11/21/2022 Page 1 Mayor Clement reported on the successful electronic and metal recycling event stating that there were around 407 vehicles that came. He updated the Board that MoDOT had given the City the go ahead on the cleanup of the discussed portion of141. Mayor Clement notified the Board that the ManchesterCares nonprofit will come to the next Board meeting to discuss their progress. He continued that Councilman Tim Fitch was retiring and would be present at a future meeting for the Board to thank him and his staff for their support of the Manchester area. REPORTS FROM THE CITY ADMINISTRATOR Missouri Attorney General Opioid Settlement Discussion City Administrator Klocke reported on a notice received from the Attorney General’s office that the City would be receiving approximately $75,000 over the next 18 years from the Opioid Settlement with many national opioid providers. He continued that the funds are required to be used for opioid treatment and abatement and would amount to around $4,000 per year. City Administrator Klocke explained he had an email into the Attorney General’s office to discuss what the funds could be directed toward but was open to suggestions from the Board. Alderman Toben and Alderman Huether gave suggestions of programs that currently take place in schools that could be effective. Alderman Huether also commended SRO White for his contribution to drug prevention in the high school. Adult Use for Marijuana City Administrator Klocke reported that with the passage of Amendment 3, cities have the ability to levy an additional 3% tax on the sale of marijuana. He noted that the voters would need to approve this levy on the ballot, and it would pass with a simple majority vote. He inquired on the views of the Board regarding the tax and potential of putting it on the April 2023 ballot. Mayor Clement reported that most municipalities are putting it on the ballot for their residents. There was no opposition from the Board on the tax being put on the April ballot. List of Paid Bills (Warrant dates of 11-02-2022 to 11-20-2022) There were no questions. Reports from the Committees Planning and Zoning Commission Mayor Clement reported that the Planning & Zoning Commission did not meet. Veterans Commission Alderman Huether reported that the Veterans Commission did not meet. Audit and Finance Committee Alderman Toben reported that the Audit and Finance Committee did not meet. Tree Advisory Board Alderman Dodge reported that the Tree Advisory Board did not meet. ACTION ON OLD BILLS BILL NO. 22-2490 Regular Board of Aldermen Meeting 11/21/2022 Page 2 SUP Amendment and Transfer Electric for Vehicle Charging Stations at Kohl’s Alderman Baumann read for the second time Bill No. 22-2490, entitled: “AN ORDINANCE AMENDING AND TRANSFERING A SPECIAL USE PERMIT TO KOHLS, INC., AT 14425 ANDERSOHN DRIVE, PURSUANT TO SECTION 405.585 OF THE MUNICIPAL CODE OF THE CITY OF MANCHESTER AND FOR AN AMENDMENT TO THE SPECIAL USE PERMIT TO ALLOW FOUR (4) EV CHARGING STATIONS PURSUANT TO SECTION 405.240(C)(14) OF THE MUNICIPAL CODE,” by title only. Alderman Baumann made the motion that Bill No. 22-2490, become Ordinance No. 22-2374. The motion was seconded by Alderman Toben. A poll of the Board showed: Alderman Nolte – aye Alderman Dodge – aye Alderman Huether – aye Alderman Toben – aye Alderman Baumann – aye Alderman Ottenad – absent Mayor Clement announced that the motion passed 5 to 0, with no objections from any members of the Board of Aldermen. INTRODUCTION OF NEW LEGISLATION BILL NO. 22-2491 Fiscal Year 2023 Budget Alderman Baumann read Proposed Bill No. 22-2491, entitled: “AN ORDINANCE ADOPTING AND APPROVING THE BUDGET FOR THE CITY OF MANCHESTER FOR THE YEAR JANUARY 1, 2023 THROUGH DECEMBER 31, 2023, AND APPROPRIATING SUCH SUMS AS SET FORTH HEREIN FOR ALL DEPARTMENTS AND ACCOUNTS THEREIN SPECIFIED,” by title only. No further action at this time. Resolution No. 22-0897 Demolition of Stoecker Park Buidling Alderman Toben read Proposed Resolution No. 22-0897, entitled: “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR TO EXECUTE A CONTRACT WITH AALCO WRECKING CO., INC. IN THE AMOUNT OF TWENTY-ONE THOUSAND NINE HUNDRED SEVENTY DOLLARS ($21,970.00) FOR THE DEMOLITION OF 220 HENRY AVENUE,” by title only. Alderman Toben made the motion for approval of Resolution No. 22-0897. The motion was seconded by Alderman Huether and carried unanimously, with no objections from any members of the Board of Aldermen. Regular Board of Aldermen Meeting 11/21/2022 Page 3 Resolution No. 22-0898 Fuel Budget Amendment Alderman Nolte read Proposed Resolution No. 22-0898, entitled: “A RESOLUTION INCREASING THE BUDGET AMOUNT FOR THE 2022 BULK PURCHASE OF REGULAR UNLEADED GASOLINE AND ULTRA LOW SULFUR DIESEL FUEL PURSUANT TO ST. LOUIS COUNTY’S COOPERATIVE PROCUREMENT CONTRACT AND AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ISSUE PURCHASE ORDERS THEREFOR,” by title only. City Administrator Klocke and Mayor Clement reported that there had been discussions of installing electric vehicle (EV) charging stations utilizing Ameren’s 50% rebate program. They continued that staff was looking into the prices of installation of a few EV charging stations that would be located at different City buildings. Costs show one station with 2 ports to be around $15,000 which would be a cost of $8,800 after the utilization of Ameren’s rebate. They continued that this was a discussion to continue as there seems to be a trend of electrical vehicles. The Board discussed the longevity of the EV technology. Alderman Nolte made the motion for approval of Resolution No. 22-0898. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. Resolution No. 22-0899 Construction Services for Dinard Channel B Improvement Project Alderman Huether read Proposed Resolution No. 22-0899, entitled: “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR TO ENTER INTO A CONTRACT WITH TWO ALPHA CONTRACTING LLC IN THE AMOUNT NOT TO EXCEED ONE HUNDRED SEVENTY-SIX THOUSAND SEVEN HUNDRED AND FORTY-EIGHT DOLLARS ($176,748.00) FOR THE CHANNEL B CREEK IMPROVEMENT PROJECT – DINARD 822-828 IN THE CITY OF MANCHESTER,” by title only. Alderman Baumann inquired on the number of houses this project affects. Director Tate explained there are four houses affected with this project. Alderman Huether made the motion for approval of Resolution No. 22-0899. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. Resolution No. 22-0900 Agreement for Stock & Associates for Dinard Channel B Improvement Project Alderman Huether read Proposed Resolution No. 22-0900, entitled: “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO A CONTRACT WITH STOCK & ASSOCIATES CONSULTING ENGINEERS, INC. IN AN AMOUNT NOT TO EXCEED EIGHTEEN THOUSAND THREE HUNDRED DOLLARS ($18,300.00) TO PROVIDE THE CITY WITH CONSTRUCTION INSPECTION SERVICES FOR THE CHANNEL B CREEK IMPROVEMENT PROJECT– DINARD 822-828 IN THE CITY OF Regular Board of Aldermen Meeting 11/21/2022 Page 4 MANCHESTER,” by title only. Alderman Huether made the motion for approval of Resolution No. 22-0900. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. Resolution No. 22-0901 Hanna Phase 1&2 STBG Agreement w/ MoDOT Alderman Dodge read Proposed Resolution No. 22-0901, entitled: “A RESOLUTION OF THE CITY OF MANCHESTER AUTHORIZING THE MAYOR TO EXECUTE A SURFACE TRANSPORTATION BLOCK GRANT PROGRAM (STBG) – URBAN PROGRAM AGREEMENT BETWEEN THE MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION AND THE CITY OF MANCHESTER FOR THE HANNA ROAD RESURFACING AND PEDESTRIAN IMPROVEMENTS,” by title only. Alderman Dodge explained the project location of Phase 1 and of Phase 2. He continued that it included water management and sidewalks. Alderman Huether asked for clarification on their timeframe. Alderman Dodge made the motion for approval of Resolution No. 22-0901. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. MISCELLANEOUS Comments from the Public There were none. CLOSED SESSION Alderman Toben read “Notice is hereby given that pursuant to Chapter 610, Section 610.021 of the Revised Statutes of Missouri (the Missouri Open Meetings and Records Law) and subject to a motion duly made and adopted by roll call vote, the Board of Aldermen will hold a closed meeting for the purpose of dealing with matters relating to the following: Legal actions, causes of action or litigation involving a public governmental body and any confidential or privileged communications between a public governmental body or its representatives and its attorneys (Sec. 610.021(1) RSMo) Hiring, firing, disciplining, or promoting of particular employees by a public governmental body when personal information about the employee is discussed or recorded, including individually identifiable personnel records, performance ratings or records pertaining to employees or applicants for employment (Section 610.021(3) & (13) RSMo).” Alderman Toben made the motion to go into closed session. The motion was seconded by Alderman Baumann.
