MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF TUESDAY, JANUARY 17, 2023 AT 200 HIGHLANDS BOULEVARD DRIVE CALL TO ORDER Alderman Ottenad called the Regular Board of Aldermen Meeting to order at 7:00 p.m. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Dodge, Alderman Nolte, Alderman Huether, Alderman Ottenad, Alderman Baumann, and Alderman Toben. Mayor Clement was absent. A quorum was present. APPROVAL OF THE MINUTES January 3, 2023 Regular Board of Aldermen Meeting Alderman Dodge made the motion to approve the minutes of the Tuesday, January 3, 2023 Regular Board of Aldermen Meeting. The motion was seconded by Alderman Baumann and carried unanimously, with no objections from any members of the Board of Aldermen. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Alderman Ottenad noted that there was an amended agenda. Alderman Dodge made the motion to approve the Order of Items on the Agenda, as amended. The motion was seconded by Alderman Huether and carried unanimously, with no objections from any members of the Board of Aldermen. CONSIDERATION OF PETITIONS Comments from the Public There were none. REPORTS FROM THE COMMITTEES Veterans Commission Alderman Huether reported that the Veterans Commission met January 12th and approved the guidelines for the Veteran’s scholarship for summer activities like camp and swim lessons and the funds would be available for the February 1 registration of the programs. Tree Advisory Board Alderman Dodge reported that plans for Arbor Day 2023 were underway. He continued with a report on the Fall Limb Chipping event informing the Board that Ward 1 had 61 houses participate filling up 4 truckloads, Ward 2 had 91 houses and filled up 4 truckloads, and Ward 3 has 126 homes participate that filled up 5 truckloads. The event in total filled up 13 truckloads of chips and was utilized by around 278 homes in Manchester. He continued that the city collected 292 trees for the Holiday Tree Pickup that will be mulched and used at Regular Board of Aldermen Meeting 1/17/2023 Page 1 Siebert Park. Alderman Dodge thanked the Public Works Department for their work. Alderman Toben also thanked them for the cleanup along 141. ACTION ON OLD BILLS BILL NO. 23-2495 3% Tax on Marijuana Sales Ballot Language Alderman Ottenad read for the second time Bill No. 23-2495, entitled: “AN ORDINANCE OF THE CITY OF MANCHESTER, MISSOURI IMPOSING AN ADDITIONAL SALES TAX ON ALL TANGIBLE PERSONAL PROPERTY RETAIL SALES OF ADULT USE MARIJUANA WITHIN THE CITY IN ACCORDANCE WITH ARTICLE XIV, SECTION 2, SUBSECTION 6 FOR GENERAL REVENUE PURPOSES,” by title only. Alderman Ottenad made the motion that Bill No. 23-2495, become Ordinance No. 23-2379. The motion was seconded by Alderman Dodge. A poll of the Board showed: Alderman Nolte – aye Alderman Ottenad – aye Alderman Toben – aye Alderman Dodge – aye Alderman Huether – aye Alderman Baumann – aye Alderman Ottenad announced that the motion passed 6 to 0, with no objections from any members of the Board of Aldermen. BILL NO. 23-2496 820 Hanna Road Final Subdivision Plat Alderman Dodge read for the second time Bill No. 23-2496, entitled: “ORDINANCE APPROVING A FINAL PLAT FOR 820 HANNA ROAD BEING LOT 1 OGROSKI ESTATES IN THE CITY OF MANCHESTER AND AUTHORIZING THE FINAL PLAT TO BE RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS COUNTY, MISSOURI, SUBJECT TO CERTAIN CONDITIONS,” by title only. Alderman Dodge made the motion that Bill No. 23-2496, become Ordinance No. 23-2380. The motion was seconded by Alderman Baumann. A poll of the Board showed: Alderman Toben – aye Alderman Huether – aye Alderman Nolte – aye Alderman Baumann – aye Alderman Ottenad – aye Alderman Dodge – aye Alderman Ottenad announced that the motion passed 6 to 0, with no objections from any Regular Board of Aldermen Meeting 1/17/2023 Page 2 members of the Board of Aldermen. INTRODUCTION OF NEW LEGISLATION Resolution No. 23-0905 City-Contractor Agreement with Facilitec Inc. Alderman Huether read Proposed Resolution No. 23-0905, entitled: “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER A CONTRACT WITH FACILITEC, INC. IN THE SUM OF ONE HUNDRED FIFTY THOUSAND FIVE HUNDRED SEVENTY-FIVE DOLLARS AND SEVENTY-SIX CENTS ($150,575.76) FOR FURNITURE PROCUREMENT AND INSTALLATION FOR THE MANCHESTER CITY HALL RENOVATION PROJECT,” by title only. Alderman Huether made the motion for approval of Resolution No. 23-0905. The motion was seconded by Alderman Dodge and carried unanimously, with no objections from any members of the Board of Aldermen. Resolution No. 23-0906 Engineering, Survey, and Design Services for the Glan Tai and Grenadier Stormwater Improvement Project – Horner and Shifrin Alderman Baumann read Proposed Resolution No. 23-0906, entitled: “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO A CONTRACT WITH HORNER & SHIFRIN, INC. IN AN AMOUNT NOT TO EXCEED EIGHTY-FIVE THOUSAND AND SIXTY DOLLARS ($85,060.00) TO PROVIDE THE CITY WITH ENGINEERING, SURVEY, AND DESIGN SERVICES FOR THE GLAN TAI AND GRENADIER STORMWATER IMPROVEMENT PROJECT IN THE CITY OF MANCHESTER,” by title only. Alderman Baumann made the motion for approval of Resolution No. 23-0906. The motion was seconded by Alderman Dodge. Alderman Ottenad abstained from the vote. The motion passed 5 to 0 with one abstention. BILL NO. 23-2497 Hanna Phase 1&2 STBG Agreement w/MoDOT Alderman Dodge read an explanation from the Public Works Director explaining that in November 2022 the Board approved a resolution for this case, but it should have been approved by ordinance. Alderman Dodge read Proposed Bill No. 23-2497 entitled: “AN ORDINANCE AUTHORIZING THE MAYOR OR THEIR DESIGNEE TO EXECUTE A SURFACE TRANSPORTATION BLOCK GRANT PROGRAM (STBG) – URBAN PROGRAM AGREEMENT BETWEEN THE MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION AND THE CITY OF MANCHESTER FOR THE HANNA ROAD RESURFACING AND PEDESTRIAN IMPROVEMENTS,” by title only. Regular Board of Aldermen Meeting 1/17/2023 Page 3 Alderman Dodge stated Emergency Legislation has been requested. Alderman Dodge made the motion for approval of emergency legislation. The motion was seconded by Alderman Baumann. MISCELLANEOUS Comments from the Public There were none. ADJOURNMENT There being no further business, Alderman Dodge made the motion to adjourn.
