MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, JUNE 3, 2024 AT 200 HIGHLANDS BOULEVARD DRIVE CALL TO ORDER Mayor Clement called the Regular Board of Aldermen Meeting to order at 7:00 p.m. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Streeter, Alderman Dodge, Alderman Ottenad, Alderman Huether, Alderman Toben, Alderman Baumann, and Mayor Clement. A quorum was present. APPROVAL OF THE MINUTES May 20, 2024 Regular Board of Aldermen Meeting Alderman Dodge made the motion to approve the minutes of the Monday, May 20, 2024, Regular Board of Aldermen Meeting. The motion was seconded by Alderman Huether and carried unanimously, with no objections from any members of the Board of Aldermen. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Mayor Clement requested that there be a postponement of Bill No. 24-2534 under old business. No motion was taken. CONSIDERATION OF PETITIONS Comments from the Public Saaber Khodr, resident of 1659 Huntington Hill Dr, expressed sympathy and gratitude for those honored on Memorial Day. He extended this sentiment to first responders, more specifically, those who responded to the events of September 11th. He continued that he hoped for the reopening of an independent investigation of September 11th to investigate the sounds heard by these first responders. Melissa Copeland, resident of 610 Wren Ave, stated she had emailed the Board a timeline regarding the use of the field on Wren Ave between Wren Hollow Elementary School and Southwest Middle School. She stated she had also shared this timeline with Parkway Board Members. Ms. Copeland continued that the field was used frequently, and the space was important for the children in the neighborhood. She said that the area was like a park, bringing people in to play after school lets out. Ms. Copeland also recounted an accident that almost occurred on Wren Avenue recently and stated that she hoped people would take the traffic on Wren Ave into consideration. Regular Board of Aldermen Meeting 06/03/2024 Page 1 REPORTS FROM THE MAYOR Flag Dedication – Wayne Hartmann Mayor Clement brought up resident Wayne Hartmann and thanked him for the two handcrafted flags he gifted to the City in support of West County EMS & Fire and the Manchester Police Department. Mayoral Proclamation – Ed Skaggs’ 35 Year Work Anniversary Mayor Clement read a proclamation honoring and thanking Lieutenant Skaggs for his 35 years of service with the City of Manchester. Mayoral Reports Mayor Clement recounted the Memorial Day Ceremony and those who spoke and helped make the event possible. Mayor Clement notified the Board and members of the public of upcoming events including the Ticket to the Beatles Concert on June 7th, screening of the documentary “Join or Die” on June 6th at 5:30pm, Teacher Appreciation Day at the Pool on June 9th, Flag Day on June 14th at 12pm, Manchester Community Band Concert on June 16th, Padre and the Pulse Concert on June 22nd, and the retirement of Commander Sam Fletcher on June 24th. REPORTS FROM THE CITY ADMINISTRATOR Check Presentation from Tuckers for Special Olympics Chief Will explained that the Police Department was very supportive of the Special Olympics and that they have an annual event at Tuckers where Officers bus table and a portion of the proceeds benefit Special Olympics. A Tucker’s representative presented Chief Will with a check from the event. Sergeant Absolon stated that in 2024 the Police Department had raised $18,494 with the help of Tuckers from their Clean Up for Special Olympics and the Polar Plunge. To date they had raised a total of $202,266.00 for Special Olympics. Introduction of Executive Assistant Nicole Albert Chief Will introduced Nicole Albert as Manchester’s new Executive Assistant. Nicole joined the City after serving years in the United States Air Force. Nicole has her bachelor’s degree in public safety with a specialization in Crime Scene Investigation from Florida State University. Introduction of Public Works Administrative Assistant Amy Matthes Director Tate introduced Amy Matthes as Manchester’s new Administrative Assistant for Public Works. Amy joined the City from the private sector and enjoys outdoor activities. Parkway Early Childhood Center Traffic Impact Study City Administrator Klocke updated the Board on the City’s review of the Parkway Early Childhood Center explaining that they are still in the technical review process. He continued that as part of that review, staff believed the City should perform its own traffic study looking at the traffic impact currently in the streets surrounding the schools and what the impact would be with the addition of the Early Childhood Center. He explained that this approach was developed in response to the concerns of the residents and that the City could learn valuable information about traffic calming that could be applicable to other areas in the City. Regular Board of Aldermen Meeting 06/03/2024 Page 2 City Administrator Klocke stated that Director Tate would be getting proposals together for a review by the Board of Aldermen in July. He explained that getting a quality proposal took time and review by multiple parties. He gave a tentative timeline of the study and stated it would be conducted when school was back in session. He updated the Board on the process of review and indicated that Parkway had requested input from school staff at their public meetings. Alderman Baumann requested that the stealth stat be utilized to see traffic prior to school being in session. City Administrator Klocke notified the Board that beyond the traffic study, Staff had been looking into multiple ways to help with pedestrian safety around the City. List of Paid Bills (Warrant dates of 05-20-2024 to 06-02-2024) There were no questions. REPORTS FROM THE COMMITTEES Planning and Zoning Commission Alderman Baumann stated that the Planning and Zoning Commission reviewed and approved a walk-in freezer for Pan Asia. Veterans Commission Alderman Huether thanked the community members and Manchester Staff that contributed to making the Memorial Day Ceremony a beautiful day. The next major activity of the Veterans Commission would participate in would be the City’s 4th of July celebration where they would have a tent to engage with veterans. Mayor Clement added that there would be the first Flags of Valor that was focused on first responders over the anniversary of 9/11 in Stoecker Park. Audit and Finance Committee Alderman Toben stated that there was no Audit and Finance Committee report. Tree Advisory Board Alderman Dodge stated that there was no Tree Advisory Board report. Homecoming Committee Alderman Ottenad stated that the Veterans Commission did not meet. The next meeting would be June 19th at 6:30pm at the Parks office. OLD LEGISLATION BILL NO. 24-2534 Solid Waste Code Amendment Alderman Huether made the motion to postpone Bill No. 24-2534 until the August 5, 2024, Regular Board of Aldermen Meeting. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. Regular Board of Aldermen Meeting 06/03/2024 Page 3 NEW LEGISLATION Bill No. 24-2537 Agreement with MoDOT for Manchester Road, Phase Two Alderman Ottenad read Proposed Bill No. 24-2537 entitled: “AN ORDINANCE AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO AN AGREEMENT WITH THE MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION FOR FUNDING IN CONNECTION WITH A FEDERAL AID PROJECT RELATING TO THE MANCHESTER ROAD PEDESTRIAN IMPROVEMENTS IN THE CITY OF MANCHESTER,” by title only. Director Tate answered the Board’s questions explaining that this project included both sides of Manchester Road and that the crosswalks were already present at the existing signals but would become ADA accessible and the signal head would add the push button for crossing. Director Sieve and Director Tate answered Alderman Streeter and Alderman Ottenad’s questions about the financing of the project and explained the cost share fund grant process and financial options if grants were not awarded. Aldermen Dodge expressed concern over emergency legislation being requested for agenda items, stating there was little time for review. Alderman Ottenad stated Emergency Legislation had been requested. Alderman Ottenad made the motion for approval of emergency legislation. The motion was seconded by Alderman Toben. The motion passed 5 to 1, with Alderman Dodge as the dissenting vote. Alderman Ottenad read for the second time Bill No. 24-2537, entitled: “AN ORDINANCE AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO AN AGREEMENT WITH THE MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION FOR FUNDING IN CONNECTION WITH A FEDERAL AID PROJECT RELATING TO THE MANCHESTER ROAD PEDESTRIAN IMPROVEMENTS IN THE CITY OF MANCHESTER,” by title only. Alderman Ottenad made the motion that Bill No. 24-2537, become Ordinance No. 24-2419. The motion was seconded by Alderman Huether. A poll of the Board showed: Alderman Dodge – nay Alderman Baumann – aye Alderman Toben – aye Alderman Huether – aye Alderman Streeter – aye Alderman Ottenad – aye Mayor Clement announced that the motion passed 5 to 1. Bill No. 24-2538 Special Prosecuting Attorney Regular Board of Aldermen Meeting 06/03/2024 Page 4 Alderman Streeter read Proposed Bill No. 24-2538 entitled: “AN ORDINANCE AMENDING CHAPTER 115, OFFICERS AND EMPLOYEES, OF THE MUNICIPAL CODE, CITY OF MANCHESTER, MISSOURI CREATING THE OFFICE OF SPECIAL PROSECUTOR,” by title only. City Attorney Rost explained that this would essentially allow for a backup prosecutor if the City’s prosecutor had a conflict of interest or was out of town. No further action at this time. MISCELLANEOUS Comments from the Public None CLOSED SESSION Alderman Baumann read “Notice is hereby given that pursuant to Chapter 610, Section 610.021 of the Revised Statutes of Missouri (the Missouri Open Meetings and Records Law) and subject to a motion duly made and adopted by roll call vote, the Board of Aldermen will hold a closed meeting for the purpose of dealing with matters relating to the following: Legal actions, causes of action or litigation involving a public governmental body and any confidential or privileged communications between a public governmental body or its representatives and its attorneys (Sec. 610.021(1) RSMo) Leasing, purchase, or sale of real estate by a public governmental body where public knowledge of the transaction might adversely affect the legal consideration therefor (Sec. 610.021(2) RSMo)” Alderman Baumann made the motion to go into closed session. The motion was seconded by Alderman Dodge. A poll of the Board showed: Alderman Huether – aye Alderman Ottenad – aye Alderman Streeter – aye Alderman Toben – aye Alderman Baumann – aye Alderman Dodge – aye Mayor Clement announced that the motion passed 6 to 0, with no objections from any members of the Board of Aldermen. ADJOURNMENT There being no further business, Alderman Ottenad made the motion to adjourn. The motion was seconded by Alderman Toben and carried unanimously.
