PROCEEDINGS OF THE MANISTEE CITY COUNCIL – MARCH 7, 2023
A regular meeting of the Manistee City Council was called to order by her honor, Mayor Jermaine Sullivan
on Tuesday, March 7, 2023, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by
the Pledge of Allegiance.
PRESENT: David Bachman, Lynda Beaton, Cindy Lundberg, Jermaine Sullivan, Seth Pratt, James
Grabowski, and Erin Martin Pontiac

• Notification Regarding Next Study Session – Tuesday, March 14, 2023, at 7:00 p.m. A discussion will
be conducted on a Sewer Backup Policy; and such business as may come before Council.
• Consideration of 2023 Manistee National Forest Festival Events - The Manistee Area Chamber of
Commerce has requested authorization to hold the 2023 Manistee National Forest Festival and
associated events scheduled for June 29-July 4, 2023. Events include carnival, Marketplace,
Whispering Pines Petting Zoo, food truck court, parade, and fireworks.
• Consideration of the 2023 LaborFest event Salt City Rock and Blues proposes to hold a day long
music festival on Saturday, September 2, 2023. This event includes onsite alcohol consumption;
the event also includes a classic car show, mini-Labor Day parade, tethered hot air balloon rides,
free afternoon music and a paid music event in the evening. This year’s event will take place in
Douglas Park, the Lions Pavilion, and the City parking lot adjacent to the Armory Youth Project.
MOTION by Grabowski, second by Martin Pontiac to approve the Consent Agenda as presented.
With a roll call vote this motion passed unanimously.

CONSIDERATION OF AN AGREEMENT TO PARTICIPATE IN THE MANISTEE COUNTY HOUSEHOLD
HAZARDOUS WASTE PROGRAM
The City of Manistee has participated in the Manistee County Household Hazardous Waste program for
many years. The Program provides residents an avenue to safely dispose of hazardous materials. This
event is typically held at the County Road Commission on the third Saturday in August, this year scheduled
for Saturday, August 19, 2023. The request includes a $2,525.00 payment from the City based on
population.
MOTION by Beaton, second by Pratt to approve a contract with Manistee, Mason-Lake, and Oceana
Conservation Districts and authorize the City Manager to execute the agreement.
With a roll call vote this motion passed unanimously.

CONSIDERATION OF THE 2023 SMOKE ON THE WATER EVENT
Salt City Rock and Blues, in conjunction with Authentic 231, proposes to hold a day long music festival
with onsite alcohol and cannabis consumption on Saturday, July 29, 2023. Music would start at 5:00 p.m.
and continue until 11:30 p.m. in the Lions Pavilion area. Douglas Park and the First Street Beach and Boat
Launch parking lot will also be used during this event. This is a 21 and older event, with IDs being checked
at both the main gate and the entrance to the cannabis sales and consumption area. Food trucks will be
staged on the circular drive immediately adjacent to the venue.
MOTION by Beaton, second by Grabowski to approve the Saturday, July 29, 2023, Smoke on the Water
event and authorize the consumption of marihuana on public property in a controlled area in accordance
with MCL 33.2795 (e.) and City Ordinance 867.14; subject to appropriate departmental approvals.
MOTION by Beaton, second by Sullivan to AMEND the original motion to cap ticket sales for the event at
3000.
With a roll call vote this motion to AMEND the previous motion passed unanimously.

A roll call vote was then taken on the original motion as amended. The motion passed unanimously.

CONSIDERATION OF TEXT AMENDMENT TO THE ZONING ORDINANCE
For the approval of language to amend the Zoning Ordinance to allow for the use of a Duplex as a
permitted use in the R-2 Medium Density Residential District. Currently, a Duplex is an allowable use as a

special land use within the R-2 District. The Planning Commission voted to not recommend approval of
this amendment.
As an ordinance two separate readings are required. If this ordinance is introduced at this time, it could
be adopted at the next regular meeting.
MOTION by Bachman, second by Grabowski to approve the proposed text amendments to the Zoning
Ordinance.
With a roll call vote this motion failed unanimously.

A REPORT FROM THE MANISTEE AREA CHAMBER OF COMMERCE, ECONOMIC DEVELOPMENT AND
DOWNTOWN DEVELOPMENT AUTHORITY
Ms. Stacie Bytwork and Mr. Marc Miller reported on the activities of Manistee Area Chamber of
Commerce, Economic Development and Downtown Development Authority and responded to questions
the Council had regarding their activities.
