PROCEEDINGS OF THE MANISTEE CITY COUNCIL – SEPTEMBER 17, 2024 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Jermaine Sullivan on Tuesday, September 17, 2024, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. PRESENT: David Bachman, Wesley Smith, Cindy Lundberg, Jermaine Sullivan, Seth Pratt, James Grabowski, and Erin Martin Pontiac ABSENT: None ALSO PRESENT: City Manager – Bill Gambill, City Attorney – Tim Figura, City Clerk – Heather Pefley, Finance Director – Ed Bradford, Community Development Director – Theresa Waldo, Police Chief – Josh Glass, Fire Chief – Tom Hernden, and City Engineer – Shawn Middleton COMMENTS ON AGENDA RELATED ITEMS None CONSENT AGENDA • Minutes September 3, 2024 Regular Meeting • Financial Reports Payroll August 2024 Invoices August 2024 • Consideration of 2024 Paint the Town Pink For over a decade, Paint the Town Pink had been held during Breast Cancer Awareness Month in October but was paused during COVID-19. Munson Healthcare Hospital and Foundations team are requesting to reintroduce the Paint the Town Pink event on Friday, October 25, 2024, at 4:00 p.m. The event will include a memorial walk down River Street, starting at Cypress Street and ending just past the fountain at Pine Street. The event will end with a ceremony at the boulder near the fountain which will be covered in pink shrink wrap and the community is invited to add names in remembrance at the ceremony. A street closure is not being requested for this event. MOTION by Lundberg, second by Pratt to approve the Consent Agenda as presented. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF A MUTUAL AID AGREEMENT WITH CLARE COUNTY The Manistee City Police Department, in partnership with the Sleighbell Committee, has requested assistance from the Clare County Mounted Division. Clare County will assist with police presence and crowd control on Saturday, December 7, 2024, during and after the Manistee Victorian Sleighbell Parade. MOTION by Smith, second by Grabowski to approve the Clare County Mutual Aid Agreement. | Page 1 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – SEPTEMBER 17, 2024 With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF APPROVING A PROPOSAL AND CHANGE ORDER IN THE AMOUNT OF $48,800 FOR THE REHABILITATION OF THE RAMSDELL THEATRE PILLARS AND AMENDING THE CAPITAL IMPROVEMENT FUND BUDGET BY $57,800 The Ramsdell Theatre Pillar rehabilitation has been budgeted for the last several years. The City did not receive any responses when it was bid out in April. The City solicited a proposal to complete the work from the qualified contractor that is currently restoring the Fire Station. The proposal was for $48,800 which will come from the previously unspent budgeted amount of $35,000 plus additional capital improvement funds. MOTION by Pratt, second by Martin Pontiac to approve a proposal and change order in the amount of $48,800 for rehabilitation of the Ramsdell Theatre Pillars and authorize the Mayor to sign the Amendment to Owner-Engineer Agreement; and amend the Capital Improvement fund budget by $57,800. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF A CHANGE ORDER FOR FIRE STATION MASONRY IMPROVEMENTS At the May 21, 2024, Council meeting, Council took action to award Fire Station Masonry Improvements to Bornor Restoration in the amount of $199,939.00. The original contract included removal of paint from exterior bricks, minimal tuck pointing, and repainting the fire station. This change order will complete the fire station’s exterior by completing window and door restoration, as well as tuck point the entire brick exterior and eliminate painting the brick. The cost of this work is $261,498, increasing the contract to $461,434. This amount is available within the current bond funds for fire station improvements. MOTION by Grabowski, second by Smith to approve a $261,498 change order for additional Fire Station masonry improvements and authorize the Mayor to sign the Amendment to Owner-Engineer Agreement. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF AN AGREEMENT WITH GRANICUS FOR SHORT-TERM RENTAL DATA COLLECTION Granicus offers a software platform with modules that specialize in short-term rental data collection and can help identify short-term rental addresses, monitor occupancy, assist with host compliance and education. The basic module will help to identify addresses and provide online staff training for an annual cost of $6,903. | Page 2 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – SEPTEMBER 17, 2024 MOTION by Pratt, second by Grabowski to approve an agreement with Granicus for short-term rental data collection for a term of one year in the amount of $6,903; contingent on final City Attorney approval. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF COMMISSION APPOINTMENT The Housing Commission has taken action to advertise among their residents the one resident vacancy, five-year term. This is a mayoral appointment which requires a motion, second and Council voted support. The following applications have been received: Kelli Walsh – 106 Park Avenue Tammy Alkire – 237 Sixth Avenue #128 William Hall – 237 Sixth Avenue #517 Sue Majchrzak – 1204 Cypress Street Mayor Sullivan appointed Kelli Walsh, 106 Park Avenue to the Housing Commission, resident vacancy, five-year term. MOTION by Pratt, second by Lundberg to support the Mayor’s appointment of Kelli Walsh, 106 Park Avenue to the Housing Commission, resident vacancy, five-year term. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None A REPORT FROM THE TREE COMMISSION No report given. CITIZEN COMMENT None OFFICIALS AND STAFF Gambill provided updates on the upcoming City Attorney interviews, change in venue for the next Parks Commission meeting, and the removal of the net shed from the riverwalk. CONSIDERATION OF A CLOSED SESSION, MANAGER ANNUAL EVALUATION City Manager William Gambill has requested a Closed Session this evening as permitted by the Open Meetings Act, Section 8 (a) for discussion on the City Manager’s Annual Evaluation. MOTION by Grabowski, second by Lundberg to proceed to Closed Session under Section 8 (a) of the Open Meetings Act. With a roll call vote this motion passed unanimously.
