141 PROCEEDINGS OF THE MANISTEE CITY COUNCIL- APRIL 15, 2025 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Jermaine Sullivan, on Tuesday, April 15, 2025, at 7: 00 p. m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. The City fiscal year runs from July 1 through June 30. Under Section 7- 4 of the Charter, a public hearing is required on the budget which must be adopted not later than May 15 of each year. A study session was held on Tuesday, April 8, and a budget discussion is on the agenda for later this evening. An optional budget study session could be added on April 22. The Budget Calendar anticipates adoption of the budget at the Wednesday, May 7, 2025, meeting. The public had an opportunity to comment on the 2025- 2026 Budget and Capital Improvement Plan. Lakeshore Church is requesting to hold a Christian Praise and Worship Concert at the First Street Beach Pavilion on Saturday, August 2, 2025, 6: 00- 8: 00 p. m. Consideration of the United Veterans Council 2025 Memorial Day Parade. The United Veterans Council ( UVC) would like to host a Memorial Day Parade on Monday, May 26, 2025, 9: 15- 11: 45 a. m. The parade will start on River Street at Division Street and travel west, turning and crossing the Maple Street bridge, ending at Veterans Memorial Park. The focus of the parade is to honor Veterans who have paid the ultimate sacrifice in defense of our great nation. Consideration of the 2025 Manistee Car Show. The Outsider is requesting to host the 2025 Manistee Car Show on west River Street around the I Page 1 142 PROCEEDINGS OF THE MANISTEE CITY COUNCIL- APRIL 15, 2025 Fountain Park and the City Marina Park on Saturday, August 9 and Saturday, September 6, 2025. This event will provide a family friendly experience in downtown Manistee and raise funds for local non- profits through selling vote tokens. The proposed plan is to keep River Street open to traffic at all hours. The car show will take place 9: 30 a. m.- 6: 00 p. m. on both Saturdays requested. There will be 50- 60 cars that will arrive and park in their pre- registered spot within the barriers. Consideration of the Alternative for Area Youth Tag Day fundraiser. The Alternatives for Area Youth ( AAY) is requesting a Tag Day fundraiser over Memorial Day weekend, May 23- 26, 2025. They will have volunteers set up on River Street or the Riverwalk area with collection cans to collect donations in return for a tag with AAY information on it. They will have some signage telling people who AAY are and what they do in the community. Their hope is to purchase a new ice hockey table and a commercial skate sharpener with the proceeds of the fundraiser. MOTION by Grabowski, second by Keck to approve the Consent Agenda as presented. Consideration of the American Legion Auxiliary Poppy Distribution. In honor of the United States of America Veterans, the American Legion Auxiliary is requesting permission to distribute American Legion Poppies in the City of Manistee during Tight Lines for Troops, May 16- 17, 2025, over the Memorial Day holiday weekend, May 23- 26, 2025. MOTION by Grabowski, second by Keck to approve the Consent Agenda as presented. With a roll call vote this motion passed unanimously. AYES: Raddatz, Smith, Laskey, Sullivan, Keck, Grabowski, and Rozga NAYS: None GRANICUS OVERVIEW PRESENTATION Jerry Bleau, Building Official, provided an overview of the Granicus host compliance software purchased by the City to identify Short Term Rentals and answered any questions Council had regarding the software and its capabilities. CONSIDERATION OF ORDINANCE 25- 02 TO ADD CHAPTER 868 SHORT- TERM RENTALS AND AMEND CHAPTER 1482 RESIDENTIAL RENTAL PROPERTIES OF CITY OF MANISTEE, MICHIGAN CODIFIED ORDINANCES. City staff prepared a draft short- term rental ( STR) ordinance which went before the Planning Commission on March 13, 2025. The City Ordinance Committee comprised of three City Council members met on March 21, 2025 to review the Planning Commission' s recommended draft ordinance. The current draft being considered includes the Planning Commission' s proposed STR ordinance, with the changes by the Ordinance Committee. As an ordinance two separate readings are required. If this ordinance is introduced at this time, it could be adopted at the next regular meeting. MOTION by Rozga, second by Smith to introduce Ordinance 25- 02 adding Chapter 868 Short-Term Rentals and amending Chapter 1482 Residential Rental Properties. With a roll call this motion failed, 3- 4 vote. AYES: Raddatz, Sullivan, and Rozga NAYS: Smith, Laskey, Keck, and Grabowski CONSIDERATION OF ZONING ORDINANCE Z25- 02 TO ADD ARTICLE 23 SHORT- TERM RENTALS AND AMEND VARIOUS ARTICLES TO INCLUDE SHORT- TERM RENTALS. Zoning Ordinance Z25- 02 adding Article 23 Short-Term Rentals and amendments to various articles, defines and establishes the short- term rental overlay which shows the exempt areas from the short-term rental cap for the rest of the City. As an ordinance two separate readings are required. MOTION by Grabowski to introduce Zoning Ordinance Z25- 02 adding Article 23 Short- Term Rentals and amending various articles to include short- term rentals. No second was received, motion failed. CONSIDERATION OF ORDINANCE 25- 03 TO AMEND CHAPTER 867 RECREATIONAL MARIHUANA, OF CITY OF MANISTEE, MICHIGAN CODIFIED ORDINANCES. The Ordinance Committee recommends changes including establishing scoring criteria for applications as well as creating a Marihuana License Review Committee to review applications and serve other administrative functions. As an ordinance two separate readings are required. If this ordinance is introduced at this time, it could be adopted at the next regular meeting. MOTION by Smith, second by Grabowski to introduce Ordinance 25- 03 amending Chapter 867 Recreational Marihuana. With a roll call vote this motion passed unanimously. AYES: Raddatz, Smith, Laskey, Sullivan, Keck, Grabowski, and Rozga NAYS: None CONSIDERATION OF AWARDING A CONTRACT TO PERFORM PAVING UPGRADES TO A PORTION OF THE TRUCK ROUTE. The City has received a $ 375, 000 Category F grant from the Michigan Department of Transportation. The grant will assist in rehabilitation of the City' s truck route from US- 31 to Eighth Street. The project was publicly bid with one bid received. The bid came in below the budgeted project amount. The City has not yet received the notice to proceed from MDOT. MOTION by Rozga, second by Grabowski to approve a contract with Rieth Riley Construction in the amount of $609, 498. 91 for the Old US- 31 Truck Route Rehabilitation and authorize the Mayor and City Clerk to execute the documents pending MDOT approval and notice to proceed. With a roll call vote this motion passed unanimously. AYES: Raddatz, Smith, Laskey, Sullivan, Keck, Grabowski, and Rozga NAYS: None CONSIDERATION OF RECOGNIZING MANISTEE AREA PUBLIC SCHOOLS BAND BOOSTERS CLUB AS A NONPROFIT ORGANIZATION. Manistee Area Public Schools ( MAPS) Band Boosters Club has requested the City of Manistee adopt a resolution to recognize their organization as a nonprofit for the purpose of a Charitable Gaming License through the State of Michigan. They plan to hold 50/ 50 raffle drawings during band concerts, some of which are April 24, May 6, and May 18, 2025. In addition, they would like to have ongoing fundraising efforts throughout the year. MOTION by Smith, second by Raddatz to adopt a resolution recognizing MAPS Band Boosters Club as a nonprofit organization for the purpose of applying for a Charitable Gaming License through the State of Michigan. With a roll call vote this motion passed unanimously. AYES: Raddatz, Smith, Laskey, Sullivan, Keck, Grabowski, and Rozga NAYS: None I Page 3 144 PROCEEDINGS OF THE MANISTEE CITY COUNCIL- APRIL 15, 2025 CONSIDERATION OF PROPOSED INSTALLATION LOCATIONS FOR TWO MANISTEE AREA LEADERSHIP PROGRAM SENSORY BOARDS. The Manistee Area Leadership Program' s service project, Art for All, is meant to enrich the community with inclusive, multisensory art installations. The Leadership group is proposing four possible locations for sensory boards installations within the City of Manistee, asking Council to select two of the four suggested. MOTION by Raddatz, second by Smith to select two locations for the installation of two sensory boards within the City of Manistee. With a roll call vote this motion passed unanimously. AYES: Raddatz, Smith, Laskey, Sullivan, Keck, Grabowski, and Rozga NAYS: None Waldo presented the four possible locations: 1. First Street 2. Fifth Avenue 3. Manistee Riverwalk Switchback 4. Manistee City Marina MOTION by Raddatz, second by Keck to select First Street and the Riverwalk Switchback as the sensory board locations for the City of Manistee. With a roll call vote this motion passed unanimously. AYES: Raddatz, Smith, Laskey, Sullivan, Keck, Grabowski, and Rozga NAYS: None A REPORT FROM THE ALTERNATIVES FOR AREA YOUTH. Ms. Sheila Kaminski reported on the activities of Alternatives for Area Youth and responded to any questions the Council had regarding their activities. DISCUSSION OF THE FISCAL YEAR 2025- 2026 BUDGET. Administration has prepared the proposed 2025- 2026 Fiscal Year Budget. It was introduced to Council and the community at the April 1, 2025, Council meeting by the Finance Director and City Manager. A public hearing to review these budget recommendations and receive public input on them took place earlier in this meeting. In addition to tonight' s discussion, a budget study session took place on April 8 and an optional study session could be added Tuesday, April 22. The Budget Calendar anticipates adoption of the budget at the Wednesday, May 7, 2025, meeting.
