The meeting was called to order at 4:00 pm by Vice Chair Connor. Halo lighting is currently allowed by the stated standards put forth by the Historical Commission. On this sign, halo lighting alone would mean that only the sun rays would be illuminated, with the business name dark and obscured. Our proposed design would be fashioned in such a way that the business name would be illuminated at night as well, via cut,out lettering in the aluminum front panel allowing light to shine through a translucent backing panel. This would somewhat depart from the current standards, but tastefully, and in a way that would add to the feeling of warmth and aliveness downtown after dark. Each request will be reviewed individually by the Commission based on its own merit. Exceptions to these guidelines may be made by the Commission on a case by case basis. The examples used in the guidelines reflect buildings in the district which are Victorian, but alterations to a building should reflect the era in which the building was constructed. Signage within the Historic District can be approved by the Museum Director or Curator, who reserves the right to submit requests to the Commission at their discretion. The Historic District Commission uses the Secretary of the Interior's Standards for Rehabilitation as interpreted by the Preservation Briefs. Copies are available at the Manistee County Historical Museum and the Planning & Zoning Department at City Hall. Signs give a wealth of information about a particular time and place. Because historic signs often lack uniformity, they create a sense of vigor, spirit, and diversity. However, sign regulations are important within historic districts. Sign types need to integrate well with the historic character of the building and district. Here are some questions to ask when thinking about signs: ► If the business is changing hands, how can historic signs qe reused or replicated? The scale of the structure will dictate the size of the sign. The placement of the sign should not cover important architectural features or elements. ► How can corporate logos and signs be adapted to blend with the historic character of the structure or neighborhood? In an age of uniform franchise and generic plastic signs, matching or blending them with the historic character of the building is nearly impossible. Modification of color, content, design, and size is needed. An appropriate sign would be made of wood, preferably engraved or embossed, with creative decorative elements (i.e., gold leaf, carvings, etc.). Two choices to secure signs to the wall include mounting the sign perpendicularly with brackets, or mounting it flat to the wall or fascia. ► Signs should be compatible with the design qualities of the building's facade and with the surrounding historic context. They need to be compatible with the scale and design of the building. SIGNS AND REGULATIONS Signs are important for every community because they give necessary information to a passerby. They may reflect the identity and character of the area. Over time, signage types will change in accordance with architecture and technology changes. Since they can leave a lasting impression on visitors, the Historic Historic District Commission Guideline as amended 5-3-2023. #2-Signage Page 1 District Commission can regulate various aspects of the sign (i.e. height, size, color, type, number, location, etc). Sign Types: ► Hanging or Suspended Signs. These are signs that are either hung or suspended from a ceiling or other structure. ► Wall Signs. These are signs mounted flush against the building or painted directly on the building. ► Projecting Signs. These are signs that protrude from the building's surface. They include perpendicular signs that hang out over the sidewalk, marquee signs, and other variations. ► Ground Signs. These are signs that are not attached to a building. Ground signs shall be open base mount (posts). Solid skirt panels are discouraged. ► Window Signs. These are signs either painted or hung on windows visible to the public from the exterior. Should be appropriate, visually pleasing and reflect the time period of the building's architecture. No more than fifty percent (50%) of glass maximum. ► Upper Story Window Signs. These are signs either painted or hung on windows visible to the public from the exterior. No more than twenty percent (20%) of glass maximum. Gilt print is recommended. No internally lit or neon signs are permitted. ► Temporary Window Signs. These are signs that are not permanently affixed to the building, displayed in the window to advertise items such as sales, products, and information related to the business on site, for no longer than sixty (60) consecutive days. The glass maximums for "Window Signs" and "Upper Story Window Signs" applies to temporary windows as well as permanent signs that require HDC approval. The signs listed above are not exclusive. Generally, a sign is considered something that promotes, identifies, informs, or advertises. A variety of signs may include logos and symbols. Variations in signage include posters, print on awnings, art on blank walls, display of flags, and A-frame signs on sidewalks. The sign's form, function, placement, color, material, and lighting method are all important considerations. While sign regulation and control is to maintain public health and safety, it is also used for aesthetics. Signs in the historic district are reviewed to maintain the area's character. Signs cannot be installed to conceal, destroy, or violate any architectural features of a building. Signs that are installed on an interim basis, such as realtor and construction signs not exceeding sixteen square feet in sign face, are allowed for the duration of the project. However, these signs should not cause a visual nuisance. Historic District Commission Guideline as amended 5-3-2023. #2-Signage Page 2 Prohibited signs include, in addition to those identified in the zoning ordinance, anything that obstructs historic or architectural features; misleads, interferes, or confuses the viewers; and destroys or impairs the historic integrity of the resource or district. General Sign Criteria: 1. Only on-premise business identification signs are permitted in the city. 2. All signs shall comply with the regulations for erection and construction of structures as contained within the City's Building Code. 3. Signs must use appropriate materials and be compatible with the historic character of the building. For example Bright chromium effect, glossy or leatherette finished vinyl is not acceptable on a Victorian era fa�ade. Natural materials such as wood are appropriate on a Victorian Building. 4. Colors shall be appropriate for the era and the building. Fluorescent colors are prohibited. 5. The texture of sign must be compatible with that of the building facade. Sand blasted signs are not allowed. 6. With the exception of "Lighted Open Signs" (see standards below), internally illuminated signs are not permitted. Flashing, intermittent, rotating signs or signs that create the illusion of movement are prohibited. 7. Shape and form of signs shall be proportioned in mass and scale to the building where they are installed. 8. Logos (Corporate Logos) shall be integrated with designs compatible with the Historic District. 9. Plastic appearing materials are not allowed. 10. Halo Lit signs are permitted in the Historic District if they are simply stated (no Bright chromium effect or plastic appearing materials) with minimal illumination. The Commission reserves the right to reduce the illumination in the event that it is over-stated. The Historic District Commission reserves the right to address businesses that are not in compliance with the guidelines of the district or for failure to apply for a permit. Existing non-complying signage will be brought into compliance upon receipt of any application to the Historic District Commission. The following table provides the sign requirements for signage in the Historic District that does not require review from the Commission. Window Signs Limited to twenty percent (20%) of glass maximum, to include temporary and permanent signs that require HDC approval. ► Signs exempted from HDC review include commemorative plaques (max. 1 sq. ft.) or signs required by federal, state, or local ordinance for purposes of traffic, public safety, and directional assistance. ► Signs prohibited at all times include signs that create the illusion of movement or make noise, signs attached to any natural growth, and signs that are abandoned and do not relate to existing business. Historical Background relating to signage The signs in the downtown should work with the architecture to create a positive image for individual businesses and for the downtown as a whole. Four general concepts should guide the design of all signs. ► Each sign should be carefully planned to fit its facade. It should not be so large that it overwhelms the facade. Instead, it should be designed so that it looks like a part of the total facade rather than tacked on. It should not cover important details, but should complement them. ► Each sign should be coordinated with any other signs on the facade. The signs should look like they belong together. Each facade (storefront) should have no more than two or three signs. ► The signs on neighboring buildings should be coordinated. They do not need to be similar, but they should not clash in color, size or design. There should be a harmony between them. A simple well-made sign is far more appropriate than an extravagant sign which is sloppy in appearance. Quality sign makers should be able to do attractive signs using appropriate materials and colors. Historic District Commission Guideline as amended 5-3-2023. #2-Signage Page 6 ARTICLE TWENTY-ONE SIGNS [ANNOTATION: Article 21 Signs was repealed and replaced by Amendment 217-06, effective 6/16/17) SECTION 2100 PURPOSE Regulation of the location, size, placement, and certain features of signs is necessary to enable the public to locate goods, services, and facilities in the City of Manistee, to improve pedestrian and vehicular safety, and to promote and preserve the general attractiveness of the community. Accordingly, it is the intention of this Ordinance to establish regulations governing the display of signs that will: A. Encourage and protect the public health, safety, welfare and convenience; B. Enhance the economy and the business and industry of the City by promoting the reasonable, orderly, and effective display of signs, and thereby encourage improved communication with the public; C. Restrict signs and lights which overload the public's capacity to receive information, which increase the probability of traffic congestion and accidents by distracting attention or obstructing vision, and which are deemed to detract from the aesthetics of the community; and D. Reduce conflict between signs and their illumination and public and private land uses. SECTION 2101 PROCEDURES A. Sign Permit Application. The Zoning Administrator may approve sign permit applications. Applications require a fee, as determined by City Council. 1. The Historic District Commission may approve exceptions to this Article 21. 2. The City Council may approve exceptions to this Article 21 for community events. B. Inspection and Compliance. The Administrator shall inspect each sign for which a permit is issued. If the sign is in full compliance with this Ordinance the Administrator shall issue a Certificate of Compliance. If the construction is not in full compliance with this Ordinance the Administrator shall give the applicant notice of the deficiencies. If the deficiencies have been corrected upon re-inspection, the Administrator shall issue a certificate of compliance. If the deficiencies are not corrected within thirty {30) days, the permit shall be revoked and the sign shall be removed at the expense of the applicant. C. Permit Lapse. A sign permit shall lapse once the purpose of the sign has ended the sign and supporting structure shall be removed within 180 calendar days. A sign whose permit has lapsed shall be removed by the owner within thirty (30) days of receipt of notice to remove from the City. D. Permit Assignment. A sign permit shall be assignable to the successor of a business on the same parcel, except where the proposed sign is materially or substantially different in any way to the sign which was permitted. The Administrator shall make this determination. City of Manistee Zoning Ordinance Page 1 Article Twenty One Signs SECTION 2102 GENERAL STANDARDS A. Computations. The following standards shall be met when calculating the area and height of a sign. 1. The area of a sign face (which is also the sign area of a wall sign or other sign with only one face) shall be computed by means of the smallest square, circle, rectangle, triangle, or combination thereof that will encompass the extreme limits of the writing, representation, emblem, or other display. 2. The sign area for a sign with more than one (1) face shall be computed by adding together the area of all sign faces visible from any one (1) point. 3. The height of the uppermost portions of pole signs shall not exceed twenty (25) feet. The height of the uppermost portions of ground signs shall not exceed eight (8) feet in all districts except the GI district, where the uppermost portions of such signs shall not exceed twelve (12) feet. The uppermost portions of wall, marquee and projecting signs shall not project higher the roofline of the structure to which it is attached. 4. Where a sign projects or protrudes over any public or private sidewalk or walkway the bottommost point of the sign structure shall be at least eight (8) feet from said walkway. Area of Signs (marquee, suspended and wall). a. For properties fronting on US 31 in the G-C, P-D, C-1, C-2, C-3 and W-F districts or properties with a minimum of 10,000 sq. ft. of parcel area that front on a Key Street Segment in the R-2 Zoning District, marquee, suspended and wall signs shall be permitted and the maximum cumulative sign area permitted expressed in square feet shall be not more than 1.5 times the principal building width, measured from corner to corner, facing the public right-of-way or 50 square feet for each storefront, whichever is greater. b. For properties that do not front on US 31 in the P-D, C-1, C-2, C-3 and WF districts or properties with a minimum of 10,000 sq. ft. of parcel area that front on a Key Street Segment in the R-2 and R-3 Zoning Districts, marquee, suspended and wall signs shall be permitted and the maximum cumulative sign area permitted expressed in square feet shall not be more than 1.5 times the principal building width, measured from corner to corner, facing the public right-of-way, or fifty (SO) square feet for each storefront, whichever is greater. c. For properties with water frontage in the R-3 P-D, C-2, C-3 and WF marquee, suspended and wall signs shall be permitted on the water front side and the maximum cumulative sign area permitted expressed in square feet shall not be more than .75 times the principal building width, measured from corner to corner, facing the public right-of-way, or twenty-five (25) square feet, for each storefront whichever is greater. Each boat slip will be permitted a sign not to exceed twenty­ five (25) square feet. d. Allocation of Signage. Signage may be transferred to a side of the building where signage is not allocated. City of Manistee Zoning Ordinance Page 2 Article Twenty One Signs B. Illuminated Signs: Sources of Illumination shall not flash on and off or change color or intensity. Exceptions include: 1. Halo signs, where lighting is behind the lettering and the source of the illumination is not seen by a direct line of sight. 2. Electronic changeable message displays (any sign that uses electronic means within a display area to cause one message or display to be replaced by another, movable display or video) shall be limited to: a. One contiguous dynamic element on the face of the sign at a time. b. A dynamic element that does not change more than once every 15 minutes, and changes are instantaneous without any special effects. c. Static images and messages. d. Only that brightness that is necessary for clear and adequate visibility. e. Intensity or brilliance that does not impair the vision of a motor vehicle driver. All illuminated signs, including, halo, and electronic changeable message displays, shall be equipped with a mechanism that automatically adjusts the brightness in response to ambient conditions, or turns the illumination off during daylight hours. Externally illuminated signs shall be lit by use of a light shining downward onto the sign. The source of the light shall be baffled so it is not visible beyond the property line. C. The Historic District Commissions: Signs and the illumination of signs in the Historic District Commission require requires Historic District Commission approval. D. Substitution: Sign messages may be changed at any time. Any change of the structure or size of a sign, or structure the sign is mounted on requires approval under this Ordinance for purposes of compliance with this Ordinance.. E. Setbacks. All signs shall be setback at least four (4) feet from the public right-of-way to the front of the sign structure, provided clear vision can be maintained, pursuant to Section 513. F. Billboards. Refer to Section 1814. G. Covering. Covering around a pole shall be limited-to a width of not more than thirty (30) percent of the width of the sign face. Signage or copy shall not be permitted on pole coverings. SECTION 2103 EXEMPT SIGNS The following signs shall be exempt from regulations in this Article. A. Any public notice, traffic control or warning required by a valid and applicable federal, state, or local law, regulation, or ordinance. B. Any sign wholly located within a building including window signs. Except signs in the Historic District that require Historic District Commission approval. See HDC Guidelines #2 - Signage for exempt signs within the Historic District. [Annotation: Subsection B. was amended to include historic district guidelines by Amendment Z23-02, effective 6/30/23) City of Manistee Zoning Ordinance Page 3 Article Twenty One Signs C. Flags up to twenty-four (24) square feet in area. D. Signs posted by a governmental agency or on their behalf by an authorized contractor. E. Portable signs shall be permitted in the R-2, R-3 for properties with a minimum of 10,000 sq. ft. of area that front on a Key Street Segment, G-C, W-F, and C-1 districts subject to a determination by the Zoning Administrator that its placement will not impact safety or visibility for motorists and pedestrians and further limited as follows: 1. 8 square feet per side; 2. One per storefront; and 3. Permitted only during hours of operation of business. F. Temporary Signs on the property during construction, maintenance or improvements and relating to construction, maintenance or improvements on the property during the period of time of work. SECTION 2104 PROHIBITED SIGNS The following signs shall not be allowed in any district. A. Signs which are illegal under State laws or regulations and applicable local ordinances or regulations, and which are not consistent with the standards in this Ordinance. B. Signs that are not clean and in good repair, not securely affixed to a supporting structure, and signs that are out of compliance with applicable building and electrical codes. C. Off-Premise Signs. Except as provided in Section 1814 of this Ordinance. D. Signs that are not official traffic signs that appear to or attempt to regulate, warn, or direct the movement of traffic-:- E. Signs located in, projecting into or overhanging within a public right-of�way or dedicated public easement, except the following: 1. Signs posted by a governmental agency, transit company, public utility, or construction related signs placed by a contractor doing authorized or permitted work within the right-of-way. 2. Projecting, marquee, and suspended signs projecting over a public right-of-way as permitted and regulated in the P-D, C-2 and C-3 districts. 3. Banners that have been approved by the City Council. F. Portable signs shall be permitted in the P-D, C-2 and C-3 districts subject to a determination by the Zoning Administrator that said placement will not impact safety or visibility for motorists and pedestrians and provided clear vision can be maintained, pursuant to Section 513 and further limited as follows: 1. 8 square feet per side; 2. One per storefront; and 3. Permitted only during hours of operation of business. G. Feather Flags, except the following: City of Manistee Zoning Ordinance Page 4 Article Twenty One Signs 1. With the opening of a new business in non-residential districts, after completing a new business registration with the City Clerk. a. One (1) Feather Flag is permitted for no longer than sixty (60) consecutive days after the date of opening. b. Must be properly secured to the ground using a weighted base or ground spike. c. A land use permit is not required. d. Section 2102. E must be adhered to. e. Must be removed when wind speeds exceed fifteen (15) miles per hour. 2. In accordance with Section 2101 A.2. A Step-By-Step Guide The Museum Director/Curator has been designated by the Commission to review projects that are considered to be routine in an effort to expedite requests, reserving the right to forward the request to the Commission at their discretion. The requests that the Museum Director/Curator have oversight include: Awnings - Awning material and dimensions must be approved by the Museum Director or Curator. Requests for Awnings that do not meet the requirements of Guideline #1- Awnings will be forwarded to the Historic District Commission for review. If the Awning includes signage the applicant must follow the requirements for Signage. A Building Permit must be obtained prior to installation. Signage - Signage within the Historic District requires an approved Sign Permit. If the application does not meet the requirements of the Zoning Ordinance a variance from the Zoning Board of Appeals may be applied for. Zoning Requirements Per .,it Lapse. sign permit shall lapse if the business activity on the premises is discontinued for a period of six {6) months, unless the bl1siness is a seasonal activity, in which case, the sign permit shall lapse if the business activity is discontinued through one (1) normal business season. A sign whose permit has lapsed shall be removed by the owner within thirty (30) days of receipt of notice to remove from the City. If the event the owner fails to remove a sign in accord with such an order, the sign may be removed by the City, at the owner's expense, without notice or action from the City. The City shall reserve the right to place a lien on the property on which the sign exists to recover any expense associated with sign removal. Permit Assignment. A sign permit shall be assignable to the successor of a business on the same parcel, except where the proposed sign is materially or substantially different in any way to the sign which was permitted.
