August 17, 2020
Call to Order Pursuant to call and notice thereof, a Regular Meeting of the
Maple Grove City Council was held at 7: 30 p. m. on August 17,
2020 at the Maple Grove Government Center/ Public Safety
Facility, Hennepin County, Minnesota and via WebEx.
Members present were Mayor Mark Steffenson and
Councilmembers Judy Hanson, Karen Jaeger, Phil Leith, and
Kristy Barnett. Absent was none. Present also were Heidi
Nelson, City Administrator; Joe Hogeboom, Community and
Economic Development Director; Peter Vickerman, Planning
Manager; Ken Ashfeld, Public Works Director/ City Engineer;
Eric Werner, Police Chief, Tim Bush, Fire Chief; and Justin
Templin, City Attorney.
Mayor Steffenson called the meeting to order at 7: 30 p. m. and
led the city in the Pledge of Allegiance.

amended, removing item 3Z ( Proclamation International
Overdose Awareness Day — August 31, 2020). Upon call of
the motion by Mayor Steffenson, there were five ayes and no

Regarding Item 3Z ( Proclamation International Overdose
Pulled from
Awareness Day — August 31, 2020), Councilmember Barnett
the Agenda explained this declared August 31 S` as
proclamation
International Overdose Awareness Day in the City of Maple
Grove. She explained she proposed this item to the City Council
after she met a woman named Chrissy Princeton who was
looking for a rocking chair that she could paint purple in honor
of her son Grant, who died of an overdose. She discussed the
details of the overdose and how this family was trying to bring
awareness to the community. She thanked the Council for
supporting this proclamation and for their show of support to
the Princeton family.
Chrissy Princeton introduced herself to the Council and
explained she lost her son, Grant, on September 8, 2019. She
reported her son had struggled with drugs and addiction for a
few years. She thanked the Council for getting the word out on
overdose awareness.
Councilmember Jaeger discussed the DARE program that was
offered by the City of Maple Grove. She explained she has
been a part of this program for the past 20 years. She noted she
lost her son to a drug overdose four years ago.
Motion by Councilmember Barnett, seconded by
Councilmember Jaeger, to proclaim August 31, 2020, as
International Overdose Awareness Day in Maple Grove.
Upon call of the motion by Mayor Steffenson, there were
five ayes and no nays. Motion carried.

Open Forum An online public comment form was received from Lee
Walters, 9666 103"d Place N, questioning if the city has
considered an aerator fountain in the run off pond at 103' d
Avenue and Lancaster.
Update on Fire Chief/Emergency Management Director Bush provided the
COVID- 19 Council with an update on the city' s response to COVID- 19.
He discussed how COVID- 19 has impacted the community over

the past six months. He reported the State of Minnesota has
spent time and resources to better understand how this virus
spreads. He discussed how testing has increased in July and
August. He reported COVID- 19 continues to be the most
dangerous to the elderly and those with underlying health
conditions. He noted less than 1% of fatalities were individuals
with no preexisting conditions. He indicated there was a rise in
the number of positive cases for those ranging in age from 20 to
29. He stated 6. 8% of those tested in Minnesota were showing
positive results for COVID- 19. He commented on the different
peaks and waves models that were in place, with respect to
COVID- 19 and stated one model shows a significant peak was
predicted for this fall.
Retirement of Police Chief Werner stated it was an honor and privilege to
recognize Sergeant Trent MacDonald. He explained Sergeant
Police
MacDonald' s last day on the job would be September 11"'. He

thanked Sergeant MacDonald for his 24 years of dedicated

service to the City of Maple Grove. He discussed the ways in
MacDonald which Sergeant MacDonald has served the community and
wished him well in his retirement.
Councilmember Leith thanked Sergeant MacDonald for his
dedicated service to the community and wished him all the best
in his retirement.
Councilmember Barnett stated she got to complete a ride along
with Sergeant MacDonald last year during National Night Out.
She understood Sergeant MacDonald was very well liked in the
community and would be very missed.
Councilmember Jaeger explained she met Sergeant MacDonald
over 20 years ago. She hoped Sergeant MacDonald would
remain safe and wished him all the best in his retirement.

dedicated service to the community. He also thanked Sergeant
MacDonald' s family for allowing him to serve the City of
Maple Grove.
Retirement of Police Chief Werner stated it was an honor and privilege to
recognize Captain Keith Terlinden. He explained Captain

Terlinden' s last day on the job was July 315t. He thanked

Captain Terlinden for his 27 years of dedicated service to the
Terlinden
City of Maple Grove. He discussed the ways in which Captain
Terlinden has served the community and wished him well in his
retirement.
Councilmember Jaeger thanked Captain Terlinden for being an
officer and a gentleman. She appreciated Captain Terlinden' s
tremendous service to the community and wished him a happy
retirement.
Councilmember Leith thanked Captain Terlinden for his 27
years of service to the City of Maple Grove.
Councilmember Hanson thanked Captain Terlinden for his
service to the City and wished him all the best in his retirement.
Councilmember Barnett wished Captain Terlinden a long and
healthy retirement.
Mayor Steffenson stated Captain Terlinden will be dearly
missed by all in the community. He wished Captain Terlinden
and his family a happy retirement.
Liquor City Administrator Nelson reported Angel' s Liquor failed a
Violation compliance check on July 13th when the Maple Grove Safe
Streets Unit conducted an alcohol compliance check. She
Angel' s explained during the 2019/ 2020 alcohol compliance cycle
Liquor Inc. Angel' s Liquor sent two employees to the city' s training. She
reported Angel' s Liquor has not had a violation since May 18,
dba Angels 2011. She explained notice was given to Angel' s Liquor
Liquor
regarding the right to an administrative hearing, and the
business waived its right to a hearing. Staff requested the
Council take comment from Angel' s Liquor and make a
recommendation regarding the violation.
Angel Erickson, owner of Angel' s Liquor, stated she was
embarrassed to be in front of the City Council. She explained
her policy was to card everyone and her co- worker failed to do

this. She indicated her co- worker was unable to attend the city' s
training because it had been canceled due to COVID- 19. She
discussed the training she has provided to this co- worker since
the event occurred.
Mayor Steffenson questioned what had been done to ensure
carding occurs. Ms. Erickson stated she has cameras in the
establishment and she could watch from home to ensure her co-
worker was carding.
Mayor Steffenson commented he was frustrated by the number
of violations that occurred in the city this year. He anticipated
this might be due to COVID- 19. He wanted to be clear that
having a liquor license was a privilege and came with certain
expectations. He stated subsequent violations would be far more
serious for businesses. He commented licenses have been
revoked for businesses that cannot follow the rules.
Councilmember Barnett stated she too was surprised by the
number of businesses that failed their compliance check this
year.
Councilmember Hanson indicated there are other establishments
that have made it easier for themselves and their employees by
having a point of sale scanning system for all purchases.
Councilmember Leith commented this was considered a first
offense and generally the city does not suspend liquor licenses
for off-sale uses for two days.
Mayor Steffenson reported this was the case, but noted this was
a discretionary matter.
Motion by Councilmember Jaeger, seconded

Attorney to prepare appropriate findings of fact and
conclusion in support of the decision to impose a civil
penalty of up to $ 2, 000 per violation of the Off-Sale
Intoxicating Liquor License for Angel' s Liquor Inc. dba
Angel' s Liquor, 7496 East Fish Lake Rd, Maple Grove,
Minnesota at the next Council meeting. Upon call of the
motion by Mayor Steffenson, there were five ayes and no
nays. Motion carried.

Violation compliance check on July 13° i when the Maple Grove Safe
Streets Unit conducted an alcohol compliance check. She
CMG LLC explained during the 2019/ 2020 alcohol compliance cycle
dba Cambria Cambria Hotel sent five staff members to the city' s training.
She reported Cambria Hotel has not had a violation since

hearing. Staff requested the Council take comment from
Cambria Hotel and make a recommendation regarding the

Steve Leth, General Manager of Cambria Hotel, thanked the
Council for their time. He apologized on behalf of his
company. He discussed a letter that was sent to the city on
behalf of Mason, the employee who served a minor, and
described the training that has been provided to Mason after this
incident. He explained Mason was truly sorry for this violation
and was working to make up for this grievance. He reported
Mason would be attending the August 19`h alcohol compliance
training being offered by the City of Maple Grove. He stated
Mason would be discussing his violation with all current and
new team members.
Councilmember Jaeger stated this was a hard situation. She
asked if the hotel had refrigerators with alcohol in each room.
Mr. Leth stated the rooms do not have refrigerators with
alcohol.
Motion by Councilmember Leith, by seconded
Councilmember Jaeger, to approve directing the City
Attorney to prepare appropriate findings of fact and
conclusion in support of the decision to suspend the On- Sale
Intoxicating Liquor / Sunday Sale License for CMG LLC
dba Cambria Hotel Minneapolis Maple Grove, 9655 Grove
Circle, Maple Grove, Minnesota for at least two consecutive
days for a first violation within any three- year period
and/ or impose a civil penalty of up to $ 2, 000 per violation
for consideration at the next Council meeting. Upon call of
the motion by Mayor Steffenson, there were five ayes and no
nays. Motion carried.

never had a liquor violation. He stated he was very embarrassed
and truly sorry for his team member' s mistake. He indicated
Famous Dave' s has very extensive training for its team
members and noted the alcohol compliance training offered by
the city was another layer of training.
Councilmember Leith commented the police report states the
bartender asked for an ID and still served the minor alcohol.
Mr. Nelson explained he had discussed this with the server and
understood an ID was requested. He had a conversation with the
server regarding vertical ID' s
Councilmember Jaeger asked if this server was still working for
Famous Dave' s. Mr. Nelson reported per Famous Dave' s
policy this employee had been terminated.
Motion by Councilmember Jaeger, seconded by
Councilmember Leith, to approve directing the City
Attorney to prepare appropriate findings of fact and
conclusion in support of the decision to suspend the On- Sale
Intoxicating Liquor / Sunday Sale License for D & D of
Minnesota, Inc. dba Famous Dave' s, 7825 Vinewood Lane,
Maple Grove, Minnesota for at least two consecutive days
for a first violation within any three- year period and/ or
impose a civil penalty of up to $ 2, 000 per violation for
consideration at the next Council meeting. Upon call of the
motion by Mayor Steffenson, there were five ayes and no
nays. Motion carried.
Liquor City Administrator Nelson reported Hy- Vee Market Grille
Violation Express failed a compliance check on July 13` h when the Maple

check. She explained during the 2019/2020 alcohol compliance
Hy-Vee Inc. cycle Hy-Vee Market Grille Express sent four employees to the
dba Hy-Vee city' s training. She reported Hy-Vee Market Grille Express has
Market Grille not had a violation since obtaining their liquor license in
Express November of 2019. She explained notice was given to Hy- Vee
Market Grille Express regarding the right to an administrative
hearing, and the business waived its right to a hearing. Staff
requested the Council take comment from Hy- Vee Market
Grille Express and make a recommendation regarding the
violation.
Councilmember Leith asked if this was the first alcohol
compliance check for Hy-Vee and they failed. Ms. Nelson
stated this was the first check. She reported no compliance
checks were completed in May because bars and restaurants
were closed.
Jake Dimmitt, Hy-Vee Store Director, stated he has been at the
Hy- Vee in Maple Grove since the end of June. He apologized
for the incident and explained Hy- Vee has a zero tolerance
stance. He explained the employee at fault was terminated. He
explained seven employees would be attending the city' s
alcohol compliance training this week.
Motion by Councilmember Hanson, seconded by Mayor
Steffenson, to approve directing the City Attorney to
prepare appropriate findings of fact and conclusion in
support of the decision to suspend the On- Sale Intoxicating
Liquor / Sunday Sale License for Hy- Vee Inc. dba Hy- Vee
Market Grille Express, 18755 70th Way, Suite C, Maple
Grove, Minnesota for at least two consecutive days ( in the
restaurant) for a first violation within any three- year period
and/ or impose a civil penalty of up to $ 2, 000 per violation
for consideration at the next Council meeting. Upon call of
the motion by Mayor Steffenson, there were five ayes and no
nays. Motion carried.
Liquor City Administrator Nelson reported Sam' s Club failed a
Violation compliance check on July 13"' when the Maple Grove Safe
Streets Unit conducted an alcohol compliance check. She

from Sam' s Club and make a recommendation regarding the
violation.
Randy Pittman, Sam' s Club Member Specialty Manager, deeply
apologized for the incident that occurred at Sam' s Club. He
stated in his 31 years with Sam' s Club he was only aware of two
violations. He discussed the processes that were in place to
assist with preventing the sale of alcohol to minors and
commented on the corrective action that has occurred. He noted
he met with all of the cashiers to discuss the age verification
process. He stated Sam' s Club had a zero tolerance policy in
place and noted the employee at fault was terminated. He
reported secret shops would be conducted at his Sam' s Club
over the coming months to ensure his staff was properly asking
for ID' s.
Councilmember Jaeger questioned how the ID got past the cash
register. Mr. Pittman indicated the cashier failed to check the
ID.
Mayor Steffenson encouraged Sam' s Club to consider
purchasing a point of sale ID scanning system.
Councilmember Barnett commended Sam' s Club for pursuing
secret shopping events. She believed this would be an effective
tool for all employees.
Motion by Councilmember Leith, seconded

Councilmember Jaeger, to approve directing the City
Attorney to prepare appropriate findings of fact and
conclusion in support of the decision to impose a civil
penalty of up to $ 2, 000 per violation of the Off-Sale
Intoxicating Liquor License for Sam' s West Inc. dba Sam' s
Club # 6254, 16701 94th Avenue N, Maple Grove, Minnesota
at the next Council meeting. Upon call of the motion by
Mayor Steffenson, there were five ayes and no nays. Motion

The Village Planning Manager Vickerman explained the applicant is

Arbor Lakes requesting Planned Unit Development, Development Stage Plan
Sr. Housing and Final Plat approval for a five- story, 196 unit senior living
PUD building with a mix of independent living, assisted living and
memory care units. The site received Planned Unit
Residential
Development, Concept Stage Plan approval on May 18, 2020
Development for the same use. He reported staff sees this project was in
Stage Plan conformance with the Concept Stage Plan. It was noted a text
and Final Plat amendment would be required to the Comprehensive Plan to the
Regional Mixed Use area and staff would prepare this language
independent of this request. The design amenities, landscaping
plan and building elevations were reviewed with the Council
and it was noted the Planning Commission recommended
approval of the request.

Report On Community and Economic Development Director Hogeboom
Upcoming updated the Council regarding the following:
Community A planning and design study had begun for Main Street.

Development There was interest in the Marc Daniel Salon and Claddagh
sites.

Twelve murals were being completed along Main Street
related to Chalkfest.
The Planning Commission and Arbor Committee held
meetings last week.
The City had received around 20 applications for the EDA
sponsored loan program.
Bottineau Public Works Director/ City Engineer Ashfeld requested the
LRT ( Blue Council approve directing staff to provide comment to the Met
Line)
Council regarding the Bottineau LRT ( Blue line). He explained
a meeting was held last Thursday and the Corridor Management
Corridor
Committee had a split vote regarding the Bottineau LRT ( Blue
Management line). He discussed the history of this corridor and explained
Committee there has been resistance from the railroad. He noted the
committee elected to terminate negotiations with the railroad
and open up a study to amend the corridor route. He stated this
could mean a new route was chosen, or the route could be
shifted within existing roadways. He discussed how the
alignment of this corridor would impact Maple Grove users. He
reported the Corridor Committee was taking comment from the
public until Thursday of this week. It was noted staff would
like to be at the table while discussions regarding the Blue Line
occur.
Mayor Steffenson approved of the city making public
comments. He believed now was the time to remind people that

terminus was not what they thought it would be.
Motion by Mayor Steffenson, seconded by Councilmember
Jaeger, to approve directing staff to provide comment to the
Blue Line Corridor Management Committee of the
Metropolitan Council. Upon call of the motion by Mayor
Steffenson, there were five ayes and no nays. Motion
carried.
Report on Director of Public Works/ City Engineer Ashfeld updated the
Council regarding the following:

Engineering Staff updated the Council on the I- 94 project.
Items
Residents around Rice Lake would like the lake to be drawn
down again this year. Staff noted the last draw down
occurred eight years ago.
Heidi Nelson, Ms. Nelson explained that the Council has her Monday report if
there are any questions. She reported the Council would be

discussing the allocation of CARES Act funds at a worksession
meeting on September 8th. It was noted the Council would be
addressing the Tree Preservation Ordinance on September 21St
Staff discussed the recruitment process that was being followed
for the Finance Director position.
Items Added Councilmember Jaeger encouraged residents to keep their dogs
to the Agenda on a leash when walking around the community.
Councilmember Jaeger discussed the concerts that were
occurring each week at the Town Green.
Councilmember Jaeger encouraged all Maple Grove residents to
wear masks noting this protected seniors and family members.
Councilmember Jaeger reported the farmer' s market was in full
swing. She invited residents to visit the farmer' s market each
Thursday from 3: 00 p. m. to 7: 00 p. m.
Councilmember Barnett thanked all of the residents who came
out to CROSS last week to support their school supply and
backpack drive.
