Maple Grove City Council Meeting minutes September 3, 2024 Call to order Pursuant to call and notice thereof, a regular meeting of the Maple Grove City Council was held at 7:30 p.m. on September 3, 2024 at the Maple Grove Government Center/Public Safety Facility, Hennepin County, Minnesota. Members present were Mayor Mark Steffenson and Councilmembers Judy Hanson, Kristy Barnett, Kristy Janigo, and Rachelle Johnson. Absent was none. Present also were Heidi Nelson, City Administrator; Joe Hogeboom, Community and Economic Development Director; - Chris LaBounty, Public Works and Engineering Director; and Justin Templin, City Attorney. Mayor Steffenson called the meeting to order at 7:30 p.m. and led the city in the Pledge of Allegiance. Additions or Mayor Steffenson asked if there were any additions and/or deletions to the deletions to the consent agenda to which Heidi Nelson stated agenda the following: Item amended to the agenda None Item amended to the consent agenda None Item added to the agenda None Item removed from the consent agenda for discussion 3D. Appointment of administrative assistant I Motion to approve the hiring of Shannon Dietrich for the administrative assistant I position in the Fire Department. Subject to the successful completion of all pre-employment requirements and a 12-month probationary period. COMMUNITY & ECONOMIC DEVELOPMENT ITEMS D. Resignations and appointment to the Arbor Committee This item was removed by Councilmember Johnson for discussion. ENGINEERING AND PUBLIC WORKS ITEMS E. Dalton Commons, Cranberry Meadows, Longstreet Apts., Centennial Crossings Street Rehab Project No. 24-07 overnight working hours Motion to approve overnight working hours for the final paving work for the Dalton Commons, Cranberry Meadows, Longstreet Apartments, Centennial Crossings Street Rehabilitation Project No. 24-07. F. Rush Creek Boulevard-TH 610 Extension Project No. 19-24 Change Order No. 2 Motion to approve Change Order No. 2 to the Rush Creek Boulevard-TH 610 Extension Project No. 19-24 in the credit amount of $207,569. G. Sureties - 09-03-24 Motion to approve the surety actions. Maple Grove City Council Minutes September 3, 2024 Page 3 ADMINISTRATIVE ITEMS H. 2024 Wildlife Management Plan Motion to approve the 2024 Wildlife Management Plan. I. Premises permit application for a pull tabs (paper) operation at Minneapolis Elks Lodge No. 44 - Resolution No. 24-120 Motion to adopt Resolution No. 24-120 approving a premises permit application for Maple Grove Firefighters Relief Association to conduct a pull tabs (paper) operation at Minneapolis Elks Lodge No. 44, 6812 Hemlock Lane, Maple Grove, MN 55369. J. Approve claims Motion to approve claims totaling $ 2,945,446.30. Motion by Councilmember Barnett, seconded by Councilmember Janigo, to approve the consent items as amended, removing item 3D (Resignations and appointment to the Arbor Committee). Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Consideration of The following items were pulled from the consent agenda. items pulled from the agenda Regarding Item 3D (Resignations and appointment to the Arbor Committee), Councilmember Johnson welcomed Mark Ustimchuk to the Arbor Committee. Motion by Councilmember Johnson, seconded by Councilmember Janigo, to accept resignations from Cody Lensing and Apeckchya Karki from the Arbor Committee effective September 3, 2024. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Motion by Councilmember Johnson, seconded by Councilmember Janigo, to approve the appointment of Mark Ustimchuk to the Arbor Committee for a term to expire Maple Grove City Council Minutes September 3, 2024 Page 4 December 31, 2026. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Special business Open forum There were no open forum issues brought before the Council at this meeting. Community and economic development items Report on Community and Economic Development Director Hogeboom upcoming updated the Council regarding the following: community and economic  The Planning Commission would meet next on Monday, development September 9. items  The Memorial Blood Centers opened in Maple Grove and this organization would be holding an official ribbon cutting ceremony on Wednesday, September 4. Engineering- public works items Organics Public Works and Engineering Director LaBounty stated in 2023 recycling code changes to Hennepin County Ordinance 13 went into effect amendment and required that all cities of our size offer curbside organics collection to residents through either organized collection or Ordinance No. through their garbage hauler licenses. Later that year the 24-13 Minnesota Pollution Control Agency provided an interpretation of Minnesota Statute 115A.93, Subd. 3(c) which requires licensing authorities, such as cities, to prohibit waste haulers from imposing a greater charge on residents who participate in curbside organics collection services than those who do not. Since the initial mandate, the city has opted to have garbage haulers administer organics programs to residents, but through the recent extension negotiations with the city’s recycling contractor, the City Council opted to add organized curbside organics as a city service beginning in January 2025. As such, the city code can be amended to remove the organics recycling Maple Grove City Council Minutes September 3, 2024 Page 5 requirements for individual garbage haulers. If adopted, this would go into effect on January 6, 2025 when the city’s organics recycling program starts and from that point forward garbage haulers would be prohibited from charging residents for this service. Staff explained Ordinance No. 24-13 amends Maple Grove City Code 26-34 and 26-92 to remove the requirements for individual licensed garbage haulers to provide organics recycling and also prohibits them from charging residents for a service they do not provide. Motion by Councilmember Janigo, seconded by Councilmember Johnson, to adopt Ordinance No. 24-13 amending Maple Grove City Code 26-34 and 26-92 to remove requirements for individual licensed collectors to provide organics recycling. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Motion by Councilmember Johnson, seconded by Councilmember Hanson, to adopt Summary Ordinance No. 24-13 to reduce publication costs. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Report on Public Works and Engineering Director LaBounty updated the upcoming Council regarding the following: engineering  The fall curbside pickup would be held on Monday, items September 30. Administration items Report on City Administrator Nelson explained that the Council has her upcoming report if there are any questions.
