November MIPD Beach Report - Lt. Clayton Smith Lt. Smith reported monthly stats, he stated he is not at beach often due to weather, had 160 beach patrol hrs., not many people on beach. Received complaints on dead bird falling from sky, possibly red tide related. Vice Chair Lamb - bird harassment (flushing), birds moving to South Beach, J.W. Marriott and Residents Beach, meeting with FWC. Some bird species: black skimmers, terns are sick and die. Issue with beach raker was reported not doing work correctly, need to keep beach safe. Lt. Smith gave guidance to raker. Endangered Species Ordinance - Tonia Selmeski First reading of listed species ordinance with changes on December 10, 2018. Support and feedback on ordinance, and suggestion to incorporate several comments. Presentation on January 7, 2019 at City Council meeting. Questions: Cape Coral has new ordinance to protect Burrowing Owls, differs from Marco Island, model ordinance after our ordinance - Cape Coral only covering Burrowing Owls. Marco Island covers Gopher Tortoises and other endangered species typically found on Marco Island. Cape Coral does not require building permit, they have violations on site. Penalty section up to $500, plus potential 60 day jail time, Magistrate decision. Marco Island needs to create step systems for penalties, no flushing/harassing birds. Director Smith found owners who pull permits, violation happens, contractor gets off free. He wants to add to ordinance to follow agent, contractor or owner. Cost to remove burrowing owl, fines are low. First offense: $150 - $500, 2nd offense: $1,000., third offense $2000. Discussion on endangered species from committee/ordinance: . Discuss later in meeting opportunities for incentives . Add public sign on South Beach (Collier County) access once ordinance is passed. . Penalties be more stringent. . Add jail time to ordinance. Lt. Smith needs to address drone operators case by case, it is legal to fly drones on beach. Ms. Selmeski thanked committee and Owl Watch for support and to move forward at City Council meeting on January 7, 2019. MOTION by Vice-Chair Lamb, to add similar language (from Cape Coral Ordinance) to Part C with up to 60 days of jail time clause into Section 18.127, penalty add $2000 and 60 days jail time for third offense, seconded by Member Eastman, that this MOTION be approved. Iguana Trapper Update - Tonia Selmeski Ms. Selmeski reported City hired trapper (weekly visits) with bright yellow Iguana Control T-shirt. Fifty eight (58) iguanas were trapped, averaging 30 properties, he enters properties with permission, will be here while funds available. Reports will be provided to inform City of activities. d. Red Tide Update - Tonia Selmeski Ms. Selmeski reported Collier County beaches currently have no red tide. e. Beach Signage Update - Tonia Selmeski City of Marco Island Florida Page 2 Beach and Coastal Resources Meeting Minutes - Final December 19, 2018 Advisory Committee Ms. Selmeski stated will add "No Plastic Straws" on Tigertail, Madeira, Crystal Shores and South Beach signs. Estimate to add four (4) plaques under no parking sign, same color, same size $485 per plaque, can be ready to order January 2019. If approved, City will install, and move forward. Director Smith will approach subject on City budget with Interim City Manager. MOTION by Vice-Chair Lamb, to add four (4) plaques under existing signage stating "No Plastric Straws" to be posted on Marco Island beaches, seconded by Member Eastman, that this MOTION be approved. Urban Bird Treaty Update - Tonia Selmeski Ms. Selmeski was to meet with Executive Director of AWE to move forward, personnel changes at Audubon, waiting to hear back for application to partner with City. Process time consuming: need to take initiative, several meetings, great ideas, changes not yet confirmed, waiting to get information to move forward. (7) PUBLIC COMMENT (TIME CERTAIN 9:30 A.M.) Moved from Item 8 a.- Beach Art: Karen Swanker, local artist, presented beach debris artwork (picked up by her husband) made from plastic items washed ashore. Ms. Swanker will work with Tara O'Neill, and other artists to coordinate a large trash art project and will get back to the committee. Naples Zoo is making presentation on artwork at the January meeting. Jim Timmerman stated all organizations are in place, including Seacrest in Naples and Marco Island Academy. Need discussion to start program, need baseline, and what are location needs? Can tailor program to clean up parks to help eliminate debris with testing. He needs participation for lake water testing at Mackle Park, to move forward with approval to involve kids without using chemicals. Ms. Selmeski is moving forward with permitting, also agriculture program going on at Seacrest, permitting City of Marco Island Florida Page 3 Beach and Coastal Resources Meeting Minutes - Final December 19, 2018 Advisory Committee tailored to Marco Island. MOTION by Vice-Chair Lamb to test Mackle Park lake water, will coordinate with Ms. Selmeski and schools, seconded by Member Eastman, that this MOTION be approved. "Plastic Oceans" Movie - Scheduled Tuesday, January 15, 2019 @ 6:00 p.m-8:00 p.m. @ Mackle Park Chair McCann stated M.I.C.A. working together with Rookery Bay Research Facility (borrowing 1-1/2 hr. movie) to present with trash collection display. Event is open to public, will advertise. Charter Middle School was interested, class schedule did not work, will encourage students to attend evening showing. b. Incentives Discussion for Compliance with Listed Species Ordinance Chair McCann stated City Council reviewed ordinance and suggested incorporating incentive policy. Ms. Selmeski inquired to BchCRAC on what direction to move forward or how to create incentive program for individuals/organizations to comply? Need further discussion and research, need to go to City Council for approval and to move forward. c. Volunteer Beach Steward Program - Judy Novak Program is open to public on February 6, 2019 at Mackle Park at 9:30 a.m. Informal program to help accomplish beach safety, cleanliness and respect wildlife, stewards inform committee of issues, they do not collect trash, only educate public. Chair McCann will post article for program in Marco Island newspapers and MICA Wave Newsletter, plus request Chamber of Commerce to send email blast and Ms. Selmeski will post on City website. Director Smith and Director Pinter met with Tim Hall (to assist staff in obtaining RFQ to study monthly water testing). Need to schedule workshop with City Council in February 2019 for water testing results. (10) NEW BUSINESS a. Beach Clean-up 2019 Clean-Up Schedule is finalized. Next clean up is January 5, 2019 at 8:00 a.m. at J.W. Marriott. b. Fertilizer Ordinance - Decals & Registration BAC discussion on vehicle decal program for contractors who have fertilizer license to City of Marco Island Florida Page 4 Beach and Coastal Resources Meeting Minutes - Final December 19, 2018 Advisory Committee comply with Fertilizer Ordinance. Vice Chair Lamb - Decal program is currently in Fertilizer Ordinance. Collier County registers (can register on-line with fertilizer license) to City for free, given decal to adhere to truck window with fertilizer license. Marco Island can make ordinance work and easy to enforce, start with decal and registration. Ms. Selmeski will check on current details regarding decals, will discuss ordering decals and how registration should be handled by speaking first to Interim City Manager on how to move forward. Vice Chair Lamb - need to come up with brochure, next to Collier County brochure, display Marco Island Code Brochure where fertilizers are sold (Ace Hardware). BchCRAC 2019 Goals & Objectives - Discussion included: . Ban single use plastic/glass on beaches - be more responsible . Work with Publix/Winn Dixie and other local stores to not hand out plastic bags . Need proper disposal, stores charge 10 cents each bag or bring own bag . Use incentive program to help maintain beautiful beaches, take garbage with them, eliminate usage . Bring more suggestions back to next month meeting . Lifestyle of Environmental Stewards Director Smith - have environmental friendly community, change way we do things, important to keep Marco Island clean. c. Updating of Environmental Section of City of Marco Island Protecting our Community through Code Enforcement Brochure Reference Fertilizer Ordinance see Item 10.b. (11) COMMITTEE COMMUNICATIONS None.
