Pinter, P.E. Thursday, December 20, 2018 9:00 AM Community Room (1) CALL TO ORDER Chair Farnsworth called the meeting to order at 9:00 A.M. (2) ROLL CALL Present: 6- Member Roth, Member Sokol, Member Woodworth, Vice-Chair Parcelles, Chair Farnsworth and Member Crain (3) PLEDGE OF ALLEGIANCE - Led by Member Roth Following the pledge of allegiance, Chair Farnsworth announced Member Pierce has resigned from the Waterways Advisory Committee due to personal reasons. He introduced Mr. David Crain as the newest Waterways Advisory Committee Member appointed by Councilor Reed to fill Ms. Pierce's position. Mr. Crain provided his background information and experience. (4) APPROVAL OF THE AGENDA MOTION by Vice-Chair Parcelles, seconded by Member Sokol, to approve the Agenda. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 6- Member Roth, Member Sokol, Member Woodworth, Vice-Chair Parcelles, Chair Farnsworth and Member Crain (5) APPROVAL OF THE MINUTES a. ID 18-635 Waterways Advisory Committee Meeting Minutes of September 20, 2018 MOTION by Member Roth, seconded by Member Sokol, to approve the September 20, 2018 Waterways Advisory Committee Meeting Minutes. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 6- Member Roth, Member Sokol, Member Woodworth, Vice-Chair Parcelles, Chair Farnsworth and Member Crain City of Marco Island Florida Page 1 Waterways Advisory Committee Meeting Minutes - Final December 20, 2018 b. ID 18-636 Waterways Advisory Committee Meeting Minutes of October 18, 2018 MOTION by Member Roth, seconded by Member Sokol, to approve the October 18, 2018 Waterways Advisory Committee Meeting Minutes. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 6- Member Roth, Member Sokol, Member Woodworth, Vice-Chair Parcelles, Chair Farnsworth and Member Crain (6) STAFF COMMUNICATIONS a. ID 18-705 Fertilizer Ordinance Update (Public Works Director Tim Pinter) Public Works Director Tim Pinter added this item to the agenda for discussion to make the Waterways Advisory Committee aware that the Beautification Advisory Committee conducted a fertilizer workshop on December 5, 2018 that included a speaker from the University of Florida, Mr. Don Rainey. Mr. Pinter highlighted the following from Mr. Rainey's presentation: *issues with stormwater movement from roof tops, driveways, high density land uses *discussed drainage issues and nitrogen sources *recommended looking at the Department of Environmental Protection (DEP) ferilizer ordinance *stricter landscape management practices *state fertilizer license be granted for limited commercial fertilizer applicant certifications *typical fertlilzer ordinance requirements to be discussed at the joint workshop with Collier County *bring back professional decals on all vehicles showing certification *save the swales *fertilizer free zones *residential education *revision to the fertilizer ban timing (It is noted for the record, Mr. Rainey's presentation is attached to the agenda and can be viewed in its entirety by clicking File ID 18-705.) Following discussion, it was determined by unanimous consensus Public Works Director Tim Pinter will forward to the Committee Members a long term plan for how many miles of swales are to be regraded if available. b. Turrell, Hall and Associates Water Quailty Update (Public Works Director Tim Pinter) Public Works Director Tim Pinter provided an update regarding his meeting with Mr. Tim Hall with Turrell, Hall and Associates. He noted Mr. Hall is waiting on information from the off shore testing done by the County and the State. The draft report is projected to be submitted to staff by the end of January or first of February and based on that review, if acceptable, a presentation to City Council will be forthcoming the end of February or first of March. c. Quarterly Water Testing Report Update (Public Works Director Tim Pinter) Public Works Director Tim Pinter provided an update regarding the quarterly water testing report. He advised he received the report yesterday from the County and staff has not had time to review. He will forward to Mr. Hall and this item will be forwarded to the next Waterways Advisory Committee meeting for further discussion. City of Marco Island Florida Page 2 Waterways Advisory Committee Meeting Minutes - Final December 20, 2018 MOTION by Member Woodworth, seconded by Member Roth, to recommend to City Council, hiring Turrell, Hall and Associates to add the annual report from 2018. MOTION FAILED BY THE FOLLOWING VOTE: Yes: 1- Member Woodworth No: 5- Member Roth, Member Sokol, Vice-Chair Parcelles, Chair Farnsworth and Member Crain (7) PUBLIC COMMENT - None (8) PRESENTATIONS (9) OLD BUSINESS a. ID 18-708 ATON/PATON Motion (Parcelles) Ms. Debbie Roddy who represents Marco Island on the Collier County Coastal Advisory Committee provided an update regarding the missing and or damaged Aids to Navigations (ATON) and Private Aids to Navigation (PATON). She advised Collier County Coastal Zone Management mobilized October 30 to begin repairing federal waterways markers and the Marco Island area and noted the delay was due to working with Federal Emergency Management Agency (FEMA) to obtain funding and more repairs are forthcoming. To date the following federal markers have been repaired: * Caxambas Pass - G3, R6 * Caxambas Bay - G1, R14, R18, G19 * Horr's Island - G1, R2 * Picket Fence - R6 * Cape Romano - R2, G9, R12, G13 MOTION by Vice-Chair Parcelles, seconded by Member Roth, to recommend to City Council, to adopt a policy regarding the repair or replacement of damaged, destroyed or missing ATONS/PATONS for which they are responsible within the City limits of Marco Island or adjacent waters as needed. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 6- Member Roth, Member Sokol, Member Woodworth, Vice-Chair Parcelles, Chair Farnsworth and Member Crain (10) NEW BUSINESS a. ID 18-706 Public Information Booth (Farnsworth) Chair Farnsworth held a discussion on a public information booth at the Farmer's Market which is held every Wednesday till April 24, 2019 from 7:30 A.M. to 1:00 P.M. It was determined Chair Farnsworth and Public Works Director Tim Pinter will meet and gather information to forward to the next meeting. MOTION by Chair Farnsworth, seconded by Vice-Chair Parcelles, to move forward with the Public Information Booth plan. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 6- Member Roth, Member Sokol, Member Woodworth, Vice-Chair Parcelles, Chair Farnsworth and Member Crain City of Marco Island Florida Page 3 Waterways Advisory Committee Meeting Minutes - Final December 20, 2018 b. ID 18-707 Discussion - Police Captain Baer attend and discuss the role of Code Enforcement regarding the Fertilizer Ordinance (Farnsworth) Public Works Director Tim Pinter held a discussion on Committee Member Woodworth's previous motion to have Marco Island Police Captain Dave Baer attend a Waterways Advisory Committee meeting. He noted he presented that request to Interim City Manager Guillermo Polanco and the City Manager asked why Captain Baer is needed. Discussions ensued why Captain Baer is needed to attend a Waterways Advisor Committee meeting and it was determined it would be to speak about the enforcement of the fertilizer ordinance. (11) COMMITTEE COMMUNICATIONS Public Works Director Tim Pinter commented Chair Farnworth and Vice-Chair Parcellas terms will be expiring on February 1, 2019 and thanked them for their service on the committee.
