(2) ROLL CALL Present: 5- Vice-Chair Barto, Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan Also Present City Councilor Erik Brechnitz Mohamed Dabees, Vice-President & Senior Coastal Modeler, Humiston & Moore Engineers Craig Woodward, Attorney, Woodward, Pires & Lombardo, P.A. CITY STAFF: Timothy Pinter, Marco Island Public Works Director Guillermo Polanco, Marco Island Finance Director Martin Luna, Video / Broadcast Technician Jim Kornas, Marco Island Recording Specialist (3) PLEDGE OF ALLEGIANCE Led by Chair Delawder. (4) APPROVAL OF THE AGENDA Member Zinkan requested that Item 9g. (Report: Loan Approval Insights) immediately follow Item 9b. (Existing Bulkhead Placements) on the Agenda. Hideaway Tax District Board Attorney Craig Woodward recommended that Item 9f. (Report: Election Schedule and Referendum Timeline) precede the discussion on Item 9g. MOTION by Member Fernstrum, seconded by Member Zinkan, that the Agenda be Approved as Amended. MOTION CARRIED BY THE FOLLOWING VOICE VOTE: Yes: 5- Vice-Chair Barto, Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan (5) APPROVAL OF THE MINUTES ID 21-1507 Meeting Minutes of February 18, 2021 MOTION by Member Barto, seconded by Member Zinkan, that the Meeting Minutes of February 18, 2021 be Approved. MOTION CARRIED BY THE FOLLOWING VOICE VOTE: Yes: 5- Vice-Chair Barto, Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan (6) STAFF COMMUNICATIONS a. Status of Beach Tilling Contract Award to Eastman Aggregate Enterprises LLC Public Works Director Pinter reported that the beach tilling and testing for this year was completed as planned and the invoice was paid. The next beach tilling need is not expected until calendar year 2023. b. Purchase Order Issued to RDS Communications Group Public Works Director Pinter advised the Board that the Purchase Order to RDS Communications Group was issued in March. The vendor is prepared to begin work and is awaiting the Board's direction on a Scope of Work and the appointment of a 'point person' to provide day-to-day direction on behalf of the Board. c. Near Shore Borrow Area Expansion At the request of Mr. Michael Poff, President, Coastal Engineering Consultants, Inc. (CEC), Public Works Director Pinter read the following update from CEC: " ... CEC submitted the permit modification request to extend the Nearshore Borrow Area alongshore to capture the continued spit growth. FDEP received the application on 4-5-21 and assigned it file no. 0309260-010-JM . They have 30 days to issue a request for additional information. USACE received the application on 4-6-21 and assigned it file no. SAJ-1998-00290 (SJFL-SP MOD 10&404). They do not operate under such a time clock. CEC attended a meeting with USACE and Humiston & Moore on April 16 at the Ft Myers office. H&M presented their plans for the restoration of Tigertail Lagoon and beach fill placement on Sand Dollar Island; and described how CEC's plans are an integral part of the overall restoration plan. CEC presented their plans and reinforced the synergy of the two plans as one system-wide restoration strategy. The permit modifications for the borrow area expansion are predicated on the agencies approving the beach disposal site on Sand Dollar Island ..." "... CEC will conduct the annual monitoring surveys and the beach and borrow area in May. As promised, CEC will also collect the extra data H&M requested for the Tigertail Lagoon project ...". (7) PUBLIC COMMENT No members of the public came forward to offer comment during the meeting. (8) PRESENTATIONS No presentations were brought forward for Board review at this meeting. (9) OLD BUSINESS a. Update on Permit Submittal - Tigertail / Sand Dollar Island Restoration (Humiston & Moore) ID 21-1524 Tigertail / Sand Dollar Island Restoration Permit Submission Tasks, City of Marco Island Florida Page 2 Hideaway Beach Tax District Board Meeting Minutes - Final April 28, 2021 Timeline & Budget Mr. Mohamed Dabees, Vice President, Humiston & Moore Engineers, shared a timeline for submitting and obtaining permits and completing the project prior to the beginning of the 2022 turtle nesting season (May 1, 2022). Public Works Director Pinter noted that both permits (from the Florida Department of Environmental Protection and the U.S. Army Corps of Engineers) must be received before vendor solicitations to bid can be pursued. MOTION by Member Ryan, seconded by Member Zinkan, that the Scope of Work in the amount of $22,100 for permitting and surveys, be Approved. MOTION CARRIED BY THE FOLLOWING VOICE VOTE: Yes: 5- Vice-Chair Barto, Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan b. Update - Existing Bulkhead Placements (Humiston & Moore) ID 21-1523 Existing Bulkhead Structures and Placement Mr. Mohamed Dabees provided a historical record (with visual support) showing the placement and timetable for the nineteen (19) bulkheads currently in place along the Hideaway Beach shoreline. f. Report: Election Schedule and Referendum Timeline (Craig Woodward) Attorney Lenore Brakefield shared the information that she received from Collier County's Supervisor of Elections regarding the leadtimes, costs and related considerations in bringing a referendum forward for the residents of the Tax District in the late September / early October timeframe. g. Report: Loan Approval Process Insights (Guillermo Polanco) ID 21-1525 Report: Loan Approval Process Insights Marco Island Finance Director Guillermo Polanco presented a recommended funding plan for Hideaway Beach's anticipated capital expenditures associated with the Near Shore Borrow Project. He noted the opportunity for the Board to submit an application to the Florida Department of Environmental Protection (FDEP) Department's Beach Management Funding Assistance Program to take advantage of that program's lower rates. Applications materials are available beginning June 1, 2021, with submissions to FDEP due on or before July 31, 2021. c. Beach Grooming Report (Tom Ryon) Mr. Ryon was not available to provide his report. d. Identifying a Member to Lead Communications to Hideaway Beach Residents (Chair Delawder) The Board elected to defer discussion on this topic until its May meeting. e. Legal Review / Opinion - Re: Beach Raking Equipment Use & Maintenance (Craig Woodward) Hideaway Tax District Board Attorney Craig Woodward presented the results of his investigation into the City of Marco Island Florida Page 3 Hideaway Beach Tax District Board Meeting Minutes - Final April 28, 2021 Board's agreement with the Hideaway Beach Homeowner's Association regarding its billings for beach rakings. Marco Island Public Works Director Tim Pinter recommended that the Board pay for the net (beach raking, less lease payments) December through February billing of $6,728.90 as well as the Association's net March billing of $2,644.15. MOTION by Vice-Chair Barto, seconded by Member Zinkan, that the Beach Raking Billings for December through February ($6,728.90) and March ($2,644.15), be Approved for payment. MOTION CARRIED BY THE FOLLOWING VOICE VOTE: Yes: 5- Vice-Chair Barto, Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan Given that the equipment was not delivered until November 25, 2020, Attorney Woodward recommended that the Board recognize the Lease Agreement as beginning on December 1, 2020. MOTION by Vice-Chair Barto, seconded by Member Fernstrum, that the Tractor Raking Lease Agreement be recognized as beginning on December 1, 2020, be Approved. MOTION CARRIED BY THE FOLLOWING VOICE VOTE: Yes: 5- Vice-Chair Barto, Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan Public Works Director Pinter recommended that invoicing from the City of Marco Island for beach raking be calculated on a weekly basis and billed monthly, consistent with the approach that was previously in effect with Collier County. MOTION by Vice-Chair Barto, seconded by Member Ryan, that the Board accept monthly invoicing from the City of Marco Island calculated on a weekly basis and applied by the number of weeks in a given month, be Approved. MOTION CARRIED BY THE FOLLOWING VOICE VOTE: Yes: 5- Vice-Chair Barto, Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan (10) NEW BUSINESS a. Beach Erosion Near Collier Creek & T-Groins 18 & 19 (Member Fernstrum) Member Fernstrum reported his measurements of beach width on April 26, 2021 at mid-tide between T-groins 18 & 19, and noted two concerns: 1) at high tide, sea water flows behind the 19th T-groin parallel to the T-groin and the remaining beach, and; 2) there is a loss of sand between the 19th T-groin and the State property in the direction toward the jetty He requested that Mr. Michael Poff of Coastal Engineering Consultants, Inc. be asked to provide the Board with an update on the permit status and plans near the entrance to Collier Creek at the Board's next meeting on May 20th. b. Finance Report (Member Fernstrum) City of Marco Island Florida Page 4 Hideaway Beach Tax District Board Meeting Minutes - Final April 28, 2021 ID 21-1526 Finance Report Member Fernstrum highlighted the Repair & Maintenance charge for beach tilling that was noted in his report. (11) COMMITTEE COMMUNICATIONS a. Debrief / Discussion - Commissioner LoCastro's 4/8/21 Tigertail Beach Meeting (Member Ryan) Member Ryan shared a brief overview of the attendees and organizations that were represented at Commissioner LoCastro's Tigertail Beach Action Committee Meeting #1 on April 8th. She summarized the key topics and presentations that were brought forward during the meeting, and she noted the actions that were undertaken by Commissioner LoCastro and the local media to publicize the outputs. No date for a subsequent Tigertail Beach Action Committee Meeting was communicated. b. Sharing of Thoughts on Topics of Board Interest No other members of the Board shared ideas or thoughts during this portion of the Agenda. c. Scheduling and Board Member Availability for May - July Meetings The Board discussed dates and member availability for meetings entering into the summer months, and decided to schedule its next meetings for Thursday, May 20th at 2:00 P.M. and June 24th at 2:00 P.M. Member Zinkan indicated an inability to participate in the June 24th meeting.
