ID 17-1970 MIPD - Special Operations Officer Clayton Smith Special Operations Officer Clayton Smith was unavailable to attend the meeting. Marco Island Marine Officer Josh Ferris provided a slideshow presentation on an update on the post Hurricane Irma operations. He advised during the recovery efforts over the three (3) days post Hurricane Irma, over 125 vessels located were either misplaced, sunk or damaged to where the vessels became a hazard. Approximately thirty (30) vessels were pulled out before the officers could conduct inspections. Channel markers are being addressed; there were 5 damaged, 34 missing and 61 markers remain in tact and it is believed 95% of the markers missing or damaged was due to Hurricane Irma; whereas the vessels were 100% hurricane related. He believed that most of the boats in the water were due to improper methods of tying the vessels to the docks or the vessels tied properly, but to an older dock structure. An education component is under consideration for the future. (It is noted for the record, Member Farnsworth is now present for the meeting at 9:06 A.M.) City of Marco Island Florida Page 1 Waterways Advisory Committee Meeting Minutes - Final October 19, 2017 Public Comment: Ms. Debbie Doppelt, 585 Goldcoast Court, expressed her concerns with the Marine Units picking up debris from the waterways and asked who is responsible for that. Mr. David Rasmussen, 1495 Caxambas Court, asked how many vessels are still in the waterways that could be contaminating the waterways. b. ID 17-2024 Environmental Specialist - Chadd Chustz Marco Island Environmentalist Chadd Chustz gave a powerpoint presentation on the following: *Irma rainfall - 11.46 inches of rain from September 9 to September 11 *Significant impacts to water quality are expected after Hurricane Irma due to runoff, decomposing vegetation, building debris, hydrocarbons, and churning of benthic sediments *August and September samples have been comprised due to Collier County lab experiencing an interruption in power *Post Hurricane Irma water quality is good, no red tide reported for Marco Island *Waterway erosion and hazard - Villa D'Marco - boaters should use extreme caution *Report Hurricane Irma waterway debris to "www.dep.state.fl.us" *Hurricane Irma seawalls - 50 - 60 open cases, 50/50 pre and post Hurricane Irma (6) PUBLIC COMMENT Mr. Bob Olson, 900 Montego Court, thanked Chadd Chustz for the photographs of the hurricane and Mr. Timmerman for his work with Ocean Habitats. He said he was addressing the Committee Members today on behalf of City Council Chair Honig who could not attend. He commented that Chair Honig will support them when he is no longer City Council Chairman and he is in favor of an A-B-C- approach (analysis, block and control) and hopes Waterways Advisory Committee and City Council pass that approach and have City Staff place that information in utility bills. Mr. Bill Trotter, 720 North Collier Boulevard, commented that analysis and testing needs to be done and professional advice is needed. He believes the swales and inlets need to be raised, utilize ditch blocks and finally education and enforcement of codes. He is working with the Esplanade Marina and they are willing to alert the Marine Police for vessels in the bay longer than two (2) weeks and a brochure with pump out locations is needed. Mr. David Rasmussen, 1495 Caxambas Court, appreciates the work being done and believes data is needed to show if there is a water quality problem or not on Marco Island. Is he asking what City Council is going to do with that data. (7) PRESENTATIONS a. Oceans Habitat - Mr. Jim Timmerman Mr. Jim Timmerman provided a slideshow presentation on the summary of the Ocean Habitats for the last eighteen (18) months. City of Marco Island Florida Page 2 Waterways Advisory Committee Meeting Minutes - Final October 19, 2017 (8) OLD BUSINESS a. ID 17-1938 Discussion on Stormwater Ordinance Chair Heindl provided background information on the Stormwater Ordinance process. It was determined at the last meeting to establish a special drafting committee (consisting of Mr. Steve Morgan, Florida licensed engineer, Mr. Jason Bailey, Florida licensed building contractor, Mr. James Timmerman, former Waterways Committee Member, Waterways Advisory Committee Member Ben Farnsworth). The changes incorporated by the drafting committee was forwarded to City Staff and then to the City Attorney for legal review. The revised document is what is being addressed today and opened up for discussions. Public Works Director Tim Pinter advised the Board Members that the City Attorney has re wrote the entire document based on their legal expertise. This document is on the Planning Board's November 3, 2017 agenda and their charge is to determine if the document meets the criteria for the Comprehensive Plan. Following discussion, it was determined to go line by line, but first Chair Heindl asked for comments from the drafting to comment. Mr. Jason Bailey, 1727 Dogwood Drive, owner of FCI Homes on Marco Island, commented on the proposed revised stormwater ordinance. He believes the vast majority of contractors do not have an issue with stormwater management but expressed his concerns with the calculations being changed and the stipulation that only an engineer can submit the calculations. Mr. Steve Morgan, 216 Goodland Drive East, Florida Licensed Civil Engineer, commented the main changes he saw are the addition of language on the first five (5) pages, definitions removed and modifications for retention. The Board Member determined by unanimous consensus to recommend to City Council to allow a professional design engineer provide calculations as a cost saving mechanism for the homeowner. The following changes are recommended: *page 1 and page 2 - send back to the City Attorney for rephasing *page 9 - lines 92,93,94 - clarify single family lots *page 14 - change verbiage to Marco Island *page 15 - insert City Manager's name *page 18 - line 796, change from 365 days to ninety (90) days *page 19 - lines 864-866, remove paragraph 21in total *incorporate a penalty section During discussion, it was determined Chair Heindl and Mr. Steve Morgan will meet with the City Attorney to express their concerns. Public Comment: Mr. Jim Timmerman, 839 Perrine Court, commented this document meets the requirements of the MS4 and recommends moving it forward. City of Marco Island Florida Page 3 Waterways Advisory Committee Meeting Minutes - Final October 19, 2017 Mr. Joe Rola 879 Banyan Court, questioned the term "ordinance" and believes it will end up in the Land Development Code. Mr Pinter clarified the LDC is in Chapter 30 and this falls under Title 18 of the Municipal Code of Ordinances, which is environmental. Mr. Bob Olson, 900 Montego Court, supports relying on the contractors in order to reduce the cost to the homeowner. MOTION by Member Farnsworth, seconded by Member Roth, to forward to the Planning Board with the amended changes and then recommend approval to City Council of the proposed Stormwater Control Ordinance, including rescinding the former original approval.
