OFFICIAL COUNCIL PROCEEDINGS A regular meeting of the City Council of the City of Menomonie, Dunn County, Wisconsin, was held in open session on April 3, 2023, and called to order by Mayor Knaack at 7:00 p.m. in the City Council Chambers. The following members were present: Chase, Burstad, Sutherland, Yonko, McCullough, Schwebs, Solberg, Schlough, Erdman and Sommerfeld. SPECIAL RECOGNITION – Mayor Knaack recognized Lowell Prange, City Administrator, for his 35 years of service to the City of Menomonie and invited Council to a retirement party that will be held for Prange at 2 pm on April 6th at City Hall. MOTION made by McCullough, seconded by Erdman, and carried unanimously to approve the minutes of the March 2nd, 2023 special council meeting and the March 20th, 2023 council meeting. PUBLIC HEARING – Public Works Director Schofield addressed the council to give background information on the Volunteers Inc. Dunn County Interfaith (Stepping Stones) rezoning requests at 1620 Stout Road and 1602 Stout Road. Following the information presented, there were no comments/discussion. PUBLIC COMMENTS – Padraig Gallagher was present on behalf of Stepping Stones of Dunn County regarding agenda items 5(A) and 5(B), the proposed zoning ordinance amendments at 1620 Stout Road and 1602 Stout Road. Cory Buss was present in support of agenda item 6(E), the proposed zoning ordinance amendment at 1416 Brickyard Road. Liz Usborne spoke in support of agenda item 6(G), the Urban Forestry ordinance amendment. MOTION to waive the first reading made by Solberg, seconded by Schlough and carried unanimously, to adopt zoning ordinance amendment at 1620 Stout Road changing the zoning from Limited Multiple Family Residential (R-2) to Local Commercial (B-2) District. MOTION to waive the second reading made by Schlough, seconded by McCullough, and carried unanimously. MOTION to adopt the ORDINANCE amendment was made by Solberg, seconded by Yonko and carried unanimously. MOTION to waive the first reading made by Erdman, seconded by Schlough, and carried unanimously to adopt zoning ordinance amendment at 1602 Stout Road changing the zoning from Neighborhood Office (B-4) to Limited Multiple Family Residential (R-2) District. MOTION to waive the second reading made by Solberg, seconded by Yonko and carried unanimously. MOTION to adopt the ORDINANCE amendment was made by Yonko, seconded by Schlough, and carried unanimously. MOTION to waive the rules to allow Sean Lentz of Ehlers to speak on agenda item 6(A) made by Erdman, seconded by Solberg and carried unanimously. RESOLUTION - MOTION made by Yonko, seconded by Burstad, and carried unanimously on roll call vote to adopt the resolution providing for the issuance, sale and delivery of $2,590,000 General Obligation Corporate Purpose Bonds, Series 2023A to Baird. RESOLUTION – MOTION made by Burstad, seconded by Solberg, and carried unanimously on roll call vote to adopt the resolution providing for the issuance, sale and delivery of $2,450,000 General Obligation Promissory Notes, Series 2023B to Hilltop Securities Inc. ORDINANCE to adopt the annexation ordinance of Cedarbrook Church Corporation (N6714 470th Street), Town of Menomonie was INTRODUCED by Schwebs. MOTION to waive the first reading of the ordinance made by Chase, seconded by Schlough and carried unanimously. MOTION to waive the second reading of the ordinance amendment made by McCullough, seconded by Erdman, and carried unanimously. MOTION to adopt the annexation ordinance for Cedarbrook Church was made by Schwebs, seconded by Solberg, and passed unanimously. ORDINANCE - MOTION to INTRODUCE the zoning ordinance amendment at Cedarbrook Church to be changed from temporary Agriculture District (A) to Agriculture District (A) was made by Schlough. MOTION to refer the zoning ordinance amendment to Plan Commission was made by Schlough, seconded by Chase and carried unanimously. ORDINANCE – MOTION to INTRODUCE the zoning ordinance amendment at 1202, 1208, 1220, 1224, 1232, and 1240 Brickyard Road from General Industrial (I-3) District and Single Family Residential (R-1) District to Limited Family Twin Home Residential (R-4) District was made by McCullough. MOTION to refer the zoning ordinance amendment to Plan Commission was made by McCullough, seconded by Solberg and carried unanimously. ORDINANCE - MOTION to INTRODUCE the zoning ordinance amendment at 1416 Brickyard Road for Cory Buss from Agriculture (A) District to General Industrial (I-3) District was made by Burstad. MOTION to refer the zoning ordinance amendment to Plan Commission was made by Burstad, seconded by Schwebs and carried unanimously. MOTION made by Solberg, seconded by Yonko, and carried unanimously to authorize the submittal of the 2023 Carbon reduction (Street Light/Lamp Replacement) grant application to WisDOT. ORDINANCE to adopt the Title 2, Chapter 9 Urban Forestry ordinance amendment was INTRODUCED by Yonko. MOTION to waive the first reading of the ordinance was made by McCullough, seconded by Chase and carried unanimously. MOTION to waive the second reading of the ordinance was made by Yonko, seconded by Erdman, and carried unanimously. MOTION to adopt the ordinance was made by Yonko, seconded by Chase and carried unanimously. ORDINANCE to adopt the updated Building Inspection Department Permit Fee Schedule was made by McCullough, seconded by Sutherland and carried unanimously. ORDINANCE to adopt the Title 1, Chapter 9, Section 5 ordinance creation regarding Building Inspection Department Permit Fee Schedule was INTRODUCED by Sommerfeld. MOTION to waive the first reading of the ordinance was made by McCullough, seconded by Yonko and carried unanimously. MOTION to waive the second reading of the ordinance was made by Solberg, seconded by Burstad, and carried unanimously. MOTION to adopt the ordinance was made by Sommerfeld, seconded by Chase and carried unanimously. ORDINANCE to adopt the Title 7, Chapter 1, Section 7 ordinance amendment regarding Right-of-Way and Street Repair Permit fee schedules was INTRODUCED by Erdman. MOTION to waive the first reading of the ordinance was made by Burstad, seconded by Sutherland and carried unanimously. MOTION to waive the second reading of the ordinance was made by Yonko, seconded by McCullough, and carried unanimously. MOTION to adopt the ordinance was made by Erdman, seconded by Chase and carried unanimously. ORDINANCE to adopt the Title 9, Chapter 1, Section 9(A) ordinance amendment regarding Building and HVAC fee schedules was INTRODUCED by Chase. MOTION to waive the first reading of the ordinance was made by Solberg, seconded by Erdman and carried unanimously. MOTION to waive the second reading of the ordinance was made by Schwebs, seconded by Burstad, and carried unanimously. MOTION to adopt the ordinance was made by Chase, seconded by Sutherland and carried unanimously. ORDINANCE to adopt the Title 9, Chapter 4, Section 5(D) ordinance amendment regarding Electrical Permit fee schedules was INTRODUCED by Burstad. MOTION to waive the first reading of the ordinance was made by McCullough, seconded by Sutherland and carried unanimously. MOTION to waive the second reading of the ordinance was made by Yonko, seconded by Sutherland, and carried unanimously. MOTION to adopt the ordinance was made by Burstad, seconded by Sutherland and carried unanimously. ORDINANCE to adopt the Title 9, Chapter 5, Section 3 ordinance amendment regarding Plumbing Permit fee schedules was INTRODUCED by Sutherland. MOTION to waive the first reading of the ordinance was made by Erdman, seconded by Solberg and carried unanimously. MOTION to waive the second reading of the ordinance was made by McCullough, seconded by Sutherland, and carried unanimously. MOTION to adopt the ordinance was made by Sutherland, seconded by Chase and carried unanimously. ORDINANCE to adopt the Title 9, Chapter 10, Section 8(A)(2) ordinance amendment regarding Erosion and Sediment Control Permit fee schedules was INTRODUCED by Schwebs. MOTION to waive the first reading of the ordinance was made by Burstad, seconded by Erdman and carried unanimously. MOTION to waive the second reading of the ordinance was made by McCullough, seconded by Sutherland, and carried unanimously. MOTION to adopt the ordinance was made by Schwebs, seconded by Chase and carried unanimously. ORDINANCE to adopt the Title 9, Chapter 11, Section 12 ordinance amendment regarding Stormwater Management Permit fee schedules was INTRODUCED by McCullough. MOTION to waive the first reading of the ordinance was made by Sutherland, seconded by Yonko and carried unanimously. MOTION to waive the second reading of the ordinance was made by Burstad, seconded by Schwebs, and carried unanimously. MOTION to adopt the ordinance was made by McCullough, seconded by Yonko and carried unanimously. MOTION to approve the contract with the State of WI, Department of Military Affairs for Hazardous Materials response services as presented was made by Solberg, seconded by Schlough, and carried unanimously on roll call vote. BUDGET TRANSFERS – MOTION made by Solberg, seconded by Chase and carried unanimously on roll call vote to approve the Recreation Department’s internal budget transfer for $1,600, from the custom office supplies account to the contractual repairs account to purchase a new water dispenser for the building. MAYOR’S REPORT – The Mayor invited council to come to Lowell’s retirement gathering on April 6th at 2 pm in the Council Chambers at City Hall. The Mayor also shared that the Solid Waste Department will be holding an electronics recycling event on June 1st, from 3 pm – 7 pm, at the Community Services Building at no cost to city residents. COMMUNICATIONS AND MISCELLANEOUS BUSINESS – Prange reminded council that the annual organizational meeting will be held on April 18th, 2023 at 6 pm. Prange also reminded newly elected council members that they need to be sworn in by the City Clerk prior to the organizational meeting. CLAIMS - MOTION was made by Solberg, seconded by Sommerfeld, and carried unanimously on roll call vote to approve payment of the following claims: April 6, 2023 Claims AssetWorks USA Inc $1,848.00 EO Johnson $5,417.47 Oak Ridge Chemical $1,794.88 Total $9,060.35 MOTION was made by Chase, seconded by Sutherland, and carried unanimously to approve the following license: LICENSE YEAR - 2023 (expires June 30, 2023) CHANGE OF AGENT: Samantha J. Folkenson – Eaglewood Golf, LLC (dba Tanglewood Greens) MOTION to convene in closed session under Wisconsin Statues 19.85(1) (e), for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified business, whenever competitive or bargaining reasons require a closed session, was made by Erdman, seconded by Sommerfeld, and carried unanimously on a roll call vote. MOTION to reconvene in open session under Wisconsin Statutes 19.85 (2) was made by Sutherland, seconded by Solberg, and carried unanimously on a roll call vote.
