Attorney Mackey, and Clerk Witt silence for 9/11
ADMINISTRATIVE BUSIN ESS
Minutes Approval: Motion made by Trustee Herzog to approve the 8/14 & 8/28 minutes, seconded by Deputy
Mayor Murphy and all were in favor.
Voucher Approval: Motion made by Trustee Doro to accept the Voucher fund totals as presented, seconded by
Trustee Contino and all were in favor (attached in presentation).
DEPARTMENTAL REPORTS
Fire & Rescue – Chief Boscardin read from the attached monthly report. He reported Dutchess County gave the
FD a one-year extension for the grant submission to create a training center. He said the FD is planning to go out
and seek bids for the demo of a house that potentially has asbestos. It was reported that bingo will resume
October through March (first Friday of the month)- with the exception of December as it is Parade of Lights.
Mayor Collopy thanked the FD for taking charge of the Parade of Lights.
Police – Chief Dworkin read from attached monthly report. Reported he will be working with the Board on
code for e-bikes, bikes, skateboards, and scooters. Attorney Mackey to contact D.O.T regarding e-bike
rules/laws that can be imposed on Franklin Ave (as it is a state rd.) Chief and Mayor to put out guidelines for
residents before a Local Law is presented.
Police Officer Hire: Mayor Collopy and Deputy Mayor Murphy interviewed a candidate. The Board
authorized Chief to start the background check process for the candidate. Chief to bring recommendation
for conditional hiring by October meeting.
Serial Installment Bond (SIB) 2023 Dodge Charger: Clerk Witt reported she solicited bank interest rates on a
$52,000 5-year SIB for the purchase of a police vehicle. The Bank of Millbrook rate came in at 3.5%, The Bank
of Green County’s rate is 5.19%, and M&T was a no response/ no bid. Attorney MacDonald to draw up the SIB
paperwork for the loan through the Bank of Millbrook. (Resolutions listed on page 2)
Highway – Mayor Collopy read highlights from the monthly Highway report. Reported the Board will be
holding the second meeting in September (9/25) to interview the four candidates for DPW Supervisor. Before
the meeting, the candidates will me the highway crew and tour the facility.
Water & Sewer – S. Osborn: read from attached monthly reports.
WIIA Grant- WWTP Upgrade: Mayor Collopy explained it had been recommended by Tighe and Bond for the
Village to get a $300,000 Bond Anticipation Note (BAN) to pay for the engineering work (to be reimbursed
by the grant). The Board authorized Clerk Witt to solicit bank bids for the BAN. Board to approve bank rate in
October meeting.
Treasurer & Building Dept – Clerk Witt: read from attached monthly reports. She will be requesting the final
payment of $20,000 from the Dutchess County Community Development Block Grant (CDBG) for the Sidewalk
Project Phase 1 & Phase 2.

Trustee Doro said he is working with the Building Inspector and that they are in the preliminary stages. He will
be working on something to bring to the Board for review and plans to have it wrapped up by February.

Regulations Regarding • Must be at least 16 years of age

WHEREAS, the Village Board of Trustees (“Village Board”) has determined that it is necessary
to purchase a 2023 Dodge Charger Police Vehicle and in order to finance the purchase it will be necessary
to issue a $52,000 Statutory Installment Bond (“the Project”); and,
WHEREAS, the action of approving new financing for the purchase of a 2023 Dodge Charger
Police Vehicle by issuance of a Statutory Installment Bond is an Unlisted Action under the State
Environmental Quality Review Act (“SEQRA”); and,
WHEREAS, the Short Environmental Assessment Form (EAF) has been completed by the Village
Board; now,
THEREFORE, BE IT RESOLVED:
1. The Village Board shall act as lead agency for the environmental review of the Project.
2. The Village Board finds that the Project will not have a significant adverse impact on the
environment for reasons stated in the Notice of Determination of Non-Significance attached and
made a part of this resolution and hereby issues a Negative Declaration.
3. The Village Mayor is hereby authorized and directed to sign Part 3 of the SEAF indicating thereon
that an Environmental Impact Statement will not be prepared and cause the Notice of Determination
of Non-Significance attached to be filed as required by law.
4. This resolution shall take effect immediately.

REASONS SUPPORTING THIS DETERMINATION:
The Village Board has reviewed the Short Environmental Assessment Form (SEAF) and the
criteria contained in 6 NYCRR §617.7 and has determined that the Action will not have a
significant adverse impact on the environment for the following reasons:
A. As required by §617.7(a)(2), the Village Board has determined that an Environmental Impact
Statement is not required because any identified adverse impacts on the environment will not
be significant.
B. As required by §617.7(b), the Village Board has:
1. Considered the action as defined in subdivisions 617.2(b) and 617.3(g).
2. Reviewed the SEAF, the criteria identified in 617.7(c) and other supporting information to
identify relevant areas of environmental concern.
3. Analyzed the identified relevant areas of environmental concern to determine whether the
action will have a significant adverse impact.
4. Set forth herein its written Finding of No Significant Environmental Impact.

C. The Village Board has compared the impacts reasonably expected to result from the proposed
action to the criteria listed in 617.7(c)(1) as indicators of significant adverse impacts:

waste production, erosion potential, flooding, leaching or drainage problems;
2. Removal or destruction of large quantities of vegetation or fauna, interference with
migration fish or wildlife, impacts to special habitats, impacts to threatened or
endangered species, or any other impacts to natural resources;
3. Impairment of Critical Environmental Areas;
4. Conflicts with currently adopted community plans and goals;
5. Impairment of important historical, archeological, or aesthetic resources or community
character;
6. Major change in use or type of energy;
7. Creation of a human health hazard;
8. Substantial change in use or intensity of use of land including agricultural land, open
space or recreational resources;
9. Encouraging a population increase;
10. Creation of a material demand for other actions resulting in above consequences;
11. Changes in two or more elements of the environment that combined have a substantial
adverse impact on the environment;
12. Two or more related actions undertaken, funded or approved by an agency that
combined have a significant effect on the environment.
D. 617.7(c)(2) – For the purpose of determining significant adverse impacts on the environment
of those factors listed above, the long-term, short-term, direct, indirect and cumulative impacts,
including simultaneous or subsequent actions, to the extent reasonable, as included in any long-
range plan for the action, any action that is a result of the reviewed action or is dependent on
the action were reviewed.
E. 617.7(c)(3) – The significance of any likely consequences was assessed in connection with the
setting of the action, the likelihood of occurrence, duration, irreversibility, geographic scope,
magnitude and the number of people affected as a consequence of the action.
Based on this review, the Village of Millbrook Village Board has determined that no
significant adverse environmental impacts would result from this Action.

of Millbrook Police Department by the issuance of a Statutory Installment Bond in the principal amount of $52,000.
The new Police vehicle will be used in the same manner as the existing police vehicles and therefore is not
expected to have any adverse environmental impact.

Enacting Local Law 8 of 2024 Amending Chapter 136 of the Village Code Entitled
“Littering” to Require Residential and Commercial Landlords to Provide and Maintain
Trash Receptacles
At a meeting of the Village Board of Trustees of the Village of Millbrook (“Village
Board”), held at the Village Fire House, 20 Front Street, Millbrook, New York on the 11th day of
September, 2024, at 6:00 p.m., Village Mayor, Tim Collopy called the meeting to order, and
Trustee Contino, seconded by Trustee Murphy , moved
the following resolution, to enact the following local law, to be known as Local Law No. 8
of 2024, entitled “A Local Amending Chapter 136 of the Village Code Entitled ‘Littering’ to
Require Residential and Commercial Landlords to Provide and Maintain Trash Receptacles” as
follows:
WHEREAS, the following Local Law was introduced as Proposed Local Law No. 8 of
2024, by Resolution adopted at a regular meeting of the Village Board held on August 14, 2024;
and
WHEREAS, a properly noticed public hearing was held before the Village Board during
the meeting on September 11th, 2024, on Proposed Local Law No. 8 of 2024; and
WHEREAS, the enactment of this Local Law is an Unlisted Action pursuant to the New
York State Environmental Quality Review Act (“SEQR”) and the Village Board has determined
the enactment of this Local Law will have no adverse environmental impacts and issued a Negative
Declaration pursuant to SEQR; and
WHEREAS, the proposed Local Law set forth below is incorporated herein as if recited
verbatim, and the Village Board directs that said Local Law be recited in the minutes of this
meeting as if it, in fact, had been read verbatim during the meeting; and
BE IT ENACTED by the Board of Trustees of the Village of Millbrook (“Village Board”)
as follows:

Section 1. Legislative intent: The Village Board has determined it is necessary to require the
owners of both residential and commercial rental properties in the Village to provide and maintain
receptacles for commercial and household waste. The current version of Chapter 136 of the
Village Code entitled “Littering” requires trash and litter be disposed of in receptacles but does
not specifically require the owners of commercial or residential rental properties to provide and
maintain receptacles on their property. Therefore, the Village Board finds it is in the best interest
of the Village to amend Chapter 136 of the Village Code to include a new Sub-Section of Section
136-2 requiring the owners of commercial and residential rental properties of provide and maintain
receptacles for their tenants to contain trash and litter.
Section 2. Chapter 136 of the Village Code entitled “Littering” is hereby amended by
repealing the existing Section 136-2 “Prohibited acts” in its entirety and replacing it with the
following language.
“136-2 Prohibited acts.
A. No person shall sweep, throw, cast, drop, put or place or, having accidentally
dropped, fail to pick up any bag, bottle, bottle cap, box, container, garbage, paper,
piece of paper, wrapper or any other trash or litter, in or upon private property, or in
or upon any public street, place, park or building, except in receptacles provided for
such purposes or in lawfully established dumping grounds, or to permit any person
under his or her control or employ to do the same.
B. No owner of real property in the Village, his or her agent, occupant or other person
who controls a building with a commercial tenant and/or two or more residential
tenants shall fail to provide and maintain receptacles in that building or on that
property for the exclusive use by the tenants for their commercial or household waste
and recyclables. The receptacles must be of sufficient size and number to contain
household or commercial waste, as appropriate, and recyclables accumulated
between regular trash collection service or removal by that property owner or their
agent. The receptacles shall be made of plastic or metal and have a lid which closes
securely so the waste can be completely contained within the receptacle and cannot
be accessed by wild animals or vermin. No owner of real property, his or her agent,
occupant or other person who controls that building shall fail to schedule regular
trash collection and removal of the commercial and household waste and recyclables
generated by their respective tenants. Nothing herein shall prohibit the owner of real
property upon which a rental building exists from charging its tenants for this
service, subject to the lease agreement and New York State law.
Section 3. Severability. Should any word, section, clause, paragraph, sentence, part or
provision of this local law be declared invalid by a Court of competent jurisdiction, such
determination shall not affect the validity of any other part hereof.
Section 4. All other ordinances or local laws of the Village of Millbrook which are in
conflict with the provisions of this local law are hereby superseded or repealed to the extent
necessary to give this local law full force and effect during its effective period.

Section 5. Numbering for codification. It is the intention of the Village of Millbrook Board
of Trustees and it is hereby enacted that the provisions of this Local Law shall be included in the
Code of the Village of Millbrook; that the sections and subsections of this Local Law may be re-
numbered or re-lettered by the Codifier to accomplish such intention; that the Codifier shall make
no substantive changes to this Local Law; that the word “Local Law” shall be changed to
“Chapter,” “Section” or other appropriate word as required for codification; and that any such
rearranging of the numbering and editing shall not affect the validity of this Local Law or the
provisions of the Code affected thereby.
Section 6. This Local Law shall take effect as of the date of filing with the New York Secretary
of State.
