February 27, 2024 MILLERSVILLE BOROUGH COUNCIL MEETING MINUTES The MILLERSVILLE BOROUGH COUNCIL MEETING was held on Tuesday, February 27, in the Millersville Borough Public Meeting Room located at 100 Municipal Drive, Millersville, Pennsylvania. The meeting was called to order at 7:00 PM by Council President (CP) Mary Ann Gerber, followed by a pledge to the flag as well as an observed moment of silence. CM Kerlavage seconded the motion. The motion passed with a unanimous vote. CITIZEN REQUESTS OR CONCERNS Richard Frantz provided comments on the short-term rental ordinance discussion, as well as general comments about being informed about council discussion items. He also had a question about when the body warn camera program goes into effect for the Police Department, and the Chief told him that it was just started about two weeks ago. FUNK’s FARM AGREEMENT Les McMullen, street superintendent, and Bill Swiernik, with David Miller and Associates (DM/A), presented some changes being requested to an agreement between the Borough and DM/A regarding the Borough taking on the sewer of the new Funk’s Farm development. This is the second amendment to the agreement. CM Eager made a motion to allow the Borough Manager to work with the Solicitor to draft the second agreement. This motion was seconded by CM Giberson and passed unanimously. REPORTS OF BOARDS, COMMISSIONS, and COMMITTIEES None REPORTS OF COUNCIL COMMITTEES CM Giberson made a motion to approve the January Financial Reports, which was seconded by CM Bellile. This passed unanimously. CM Giberson brought forward an item out of the Public Works Committee, which was the approval of changes to the annual Turkey Trot event. All were in favor. CM Giberson also reviewed the items discussed at the meeting, which was the short term rental ordinance, the false alarm ordinance, the solar farm concept, and vacant properties. CM Eager brought forward a number of appointments to Boards and Commissions out of the Personnel Committee. They were: ▪ Reappointment of Vickie Usciak to Zoning Hearing Board with a new term expiration of 12/31/28. ▪ Reappointment of Cindy Bigler to Education Service Agency with a term new expiration of 1/1/27. ▪ Reappointment of Daniel Zeigler to Vacancy Board with a new term expiration of 1/3/25. ▪ Reappointment of Linda Bellile to Blue Rock Fire with a new term expiration of 12/31/25. ▪ Reappointment of David Sykes to Zoning Hearing Board with a new term expiration of 12/31/28. ▪ Appointment of Ken Eckert to Civil Service Commission with a term expiration of 2/27/30. ▪ Appointment of Michael Kaufhold to Historic Commission with a term expiration of 2/27/29. Each appointment above was unanimously approved. CM Eager reminded everyone that there are still openings on the Civil Service Commission, the Zoning Hearing Board, and the Parks Commission. MAYOR’S REPORT The Mayor presented a proclamation to the Delta Sigma Theta Sorority Inc. in celebration of their 50th anniversary. MILLERSVILLE UNIVERSITY REPORT 2 of 4  February 27, 2024 MILLERSVILLE BOROUGH COUNCIL MEETING MINUTES Dr. Victor DeSantis reported that the University raised $825,000 on their annual One Day Give event for student scholarships. The new Penn State Health Center will be opening on March 12th. The diplomacy event has been rescheduled for April 3rd. On April 6th, MU is partnering with the Millersville Area Historical Society for an upcoming lecture on architecture. The MU Men’s Basketball team is nationally ranked for the first time ever. There are a few games left before the playoffs. The Millersville Business Association is meeting at Jack’s on Wednesday March 6th at 7:30am. PENN MANOR REPORT The Penn Manor student representatives spoke about the MiniThon event held at Penn Manor High School the previous weekend, raising money for childhood cancer. On Sunday, March 3rd, the Post Prom Parents Committee is hosting a bingo night to raise money for post prom. The Future Farmers of America club is hosting a dance on March 1st to raise money for the Four Diamonds Foundation. BOROUGH MANAGER’S REPORT Manager DeSantis-Randall gave a quick update about the progress of the Charlotte Street Sanitation project, and Les McMullen gave some additional detail. The project is working its way up Charlotte Street and testing will begin soon. The contractors are running on schedule and most residents have been very supportive. Manager DeSantis-Randall also alerted Council to the upcoming Trash Day at Millersville University on April 19th from 3-6pm in which students from MU will be cleaning up areas around the Borough. DISCUSSION OF COMMITTEE MEETINGS CM Eager brought forward a discussion on committee meetings and their schedule. She suggested the Council discuss having the committee meetings on one night of the month, instead of the three nights currently. CP Gerber said that this format was done in the past, but that meetings might be lengthy, and the Council meetings could be shorter. CP Gerber suggested this be added again to the next agenda. PRESIDENT’S REPORT None UNFINISHED BUSINESS None EXECUTIVE SESSION 3 of 4  February 27, 2024 MILLERSVILLE BOROUGH COUNCIL MEETING MINUTES CP Gerber entertained a motion to enter executive session to discuss litigation and personnel issues. This motion was made by CM Giberson and seconded by CM Bellile. This was approved by all. The Council entered executive session at 7:42pm. The Council came out of executive session at 7:49pm. VOTE ON ITEMS FOLLOWING EXECUTIVE SESSON CP Gerber reported that Council discussed in executive session the position of the Council in relation to an appeal to a decision of the Zoning Hearing Board in regard to the property at 108 N. George Street. CM Eager moved to authorize the Borough Solicitor to file a notice of intervention on behalf of the Borough in the land use appeal captioned Grigoriades v. Millersville Borough Zoning Hearing Board and docketed to No. CI-24-00946 and defend the decision of the Zoning Hearing Board. CM Bellile seconded the motion. This was passed unanimously. The Council also discussed the candidacy of Luke Pennington for the vacant position of Finance Officer. The Borough Manager requested approval for this hire, at an annual salary of $62,000. CM Kerlavage made the motion to approve Luke Pennington as the new Finance Officer. This was seconded by CM Bellile. This was passed unanimously. ADJOURNMENT CM Giberson made a motion to adjourn.
