PERSONAL APPEARANCE – SHANE GOETTLE – LEGISLATIVE SUMMARY Shane Goettle, Assistant City Attorney for legislative affairs for the 2012/2013 State Legislative Session, appeared before the Council and provided a summary of the results of legislative action for the City of Minot. He reported the City of Minot is expected to receive up to $14.07 million dollars from the 5% gross production tax. He stated the City has the opportunity to apply for up to $25 million for the new airport terminal from discretional funding. He indicated funding to the State Water Commission was a priority for the property buyouts and engineering ($61 million) along with funding for the NAWS project ($14 million). Motion seconded by Alderman B. Miller. This property is located on 24th Avenue NW, west of the GEM Federal Credit Union. David Pollack, applicant, appeared before the Council to urge support for the request. He indicated the property would have an 8’ fence installed to separate it from the bank property and also plant trees and shrubs. He stated a valley gutter could be installed at the intersection to prevent stormwater draining to the bank property. Brett Hanson, Uhaul Center Manager, provided a description of how the facility would work and to answer questions from the Council. Bob Barnard, representing GEM Credit Union, appeared before the Council and stated the concerns by GEM of the water run off and fencing had been addressed and were satisfactory to the bank. Dave Pankow, Planning Commission Chair, appeared before the Council and provided information on the request in the Planning Commission. He stated the request was denied in Planning Commission as this business type was more appropriate for property zoned as light industrial. He commented a special use permit is used in situations where a hardship occurs, which this request did not meet. VARIANCE REQUEST – J2 VENTURES, JODI WINTERS – DENSITY VARIANCE – THE BEACON ADDITION, LOT 1 – FAILED Jodi Winters, applicant, provided an overview of the request for a density variance on a proposed development in north Minot. Upon questioning, the City Engineer indicated the NDDOT has rights to the frontage road; however, the City of Minot would be responsible for the maintenance. He commented the NDDOT would have final say over the frontage road usage. He stated concerns exist over the sewer and water service capacity issues for the new development and a fresh water study is being conducted to determine whether the supply is sufficient. Upon questioning, the City Planner stated staff does not recommend approval of the variance. She indicated other mixed-use developments have been approved without the need for a variance. She commented concerns exist due to the lack of alternate public transportation to the area. Whereupon, Alderman Krabseth moved that the City Council approve the request by J2 Ventures, Jodi Winters, for a variance from the allowed density of 40 units to 130 units, a variance of 225%, on The Beacon Addition, Lot 1; subject to meeting staff and NDDOT conditions regarding stormwater, sewer /water, traffic, and parking concerns. Motion seconded by Alderman Connole. Discussion was held on how the updates to the Zoning Ordinance would affect the request. Dave Pankow, Planning Commission Chair, stated the new Zoning Ordinance would lower the threshold for the variance amount; however, it would still be significantly over the allowed density. He commented the approval of the variance would set a poor precedence for future developments. Alderman Knudsvig expressed his concerns with approving the request without recommendation from the Planning Commission. The engineer representing Wal-Mart answered questions regarding the traffic study completed for the area. The City Engineer stated the traffic study recommended signal installation at 21st Avenue NW and the Highway 83 Bypass intersection. He commented interchanges are costly and require a significant amount of traffic. The City Attorney reminded the Council the request would need 8 affirmative votes in order to pass. He stated an abstention vote is considered as a negative vote. AMEND PROFESSIONAL SERVICES AGREEMENT – TERMINAL CONSTRUCTION ADMINISTRATION AND OBSERVATION- APPROVED Alderman Hatlelid moved that the City Council approve an amendment to the professional services agreement with Kadrmas, Lee, and Jackson, Inc. for construction administration and construction observation services for the new terminal building not to exceed $2,424,000 with the stipulation that a federal discretionary grant must be received prior to final approval and signature and further authorize the Mayor to sign the agreement and any related documents.
