July 22, 2013 MINOT CITY COUNCIL - SPECIAL MEETING ROLL CALL Members Present: Connole, Frantsvog, Frey, Hatlelid, Jantzer, Knudsvig, Krabseth, Lehner, B. Miller, M. Miller, Moen, Olson, Seymour, Withus. Members Absent: None. Mayor Zimbelman presiding. PLEDGE OF ALLEGIANCE Mayor Zimbelman led the City Council in the Pledge of Allegiance. PUBLIC HEARING – COMMUNITY FACILITIES SALES TAX FUNDS – MINOT CATHOLIC SCHOOLS – BISHOP RYAN CATHOLIC SCHOOL – UPGRADING/IMPROVING GYMNASIUM - $275,000 – CLOSED The City Council held a public hearing on the request from Minot Catholic Schools for proceeds from the City sales tax for community facilities in the amount of $275,000 for upgrading and improving the gymnasiums at Bishop Ryan Catholic School. No written protests were received. Bryan Kramer and Kevin Bohl, representing Minot Catholic Schools, appeared before the Council to urge support for the request. They stated this is the only private organization to allow various groups to use the facility at no cost. At this time, Alderman M. Miller entered the meeting. Whereupon, Alderman Frantsvog moved that the City Council close the public hearing on the request from Minot Catholic Schools for proceeds from the City sales tax for community facilities in the amount of $275,000 for upgrading and improving the gymnasiums at Bishop Ryan Catholic School. Motion seconded by Alderman Hatlelid and carried by the following roll call vote: ayes: Connole, Frantsvog, Frey, Hatlelid, Jantzer, Knudsvig, Krabseth, Lehner, B. Miller, M. PUBLIC HEARING – COMMUNITY FACILITIES SALES TAX FUNDS – MINOT COMMISSION ON AGING – IMPROVING PARKER SENIOR CENTER – $400,000 – CLOSED The City Council held a public hearing on the request from Minot Commission on Aging for proceeds from the City sales tax for community facilities in the amount of $400,000 for improving the Parker Senior Center. No written protests were received. Roger Reich, representing the Minot Commission on Aging, appeared before the Council in support of the request. Whereupon, Alderman B. Miller moved that the City Council close the public hearing on the request from Minot Commission on Aging for proceeds from the City sales tax for community facilities in the amount of $400,000 for improving the Parker Senior Center. PUBLIC HEARING – COMMUNITY FACILITIES SALES TAX FUNDS – MINOT CURLING CLUB – NORTH DAKOTA STATE FAIRGROUNDS – REPLACE ICE RINK FLOOR AND COOLING PIPES - $275,000 – CLOSED The City Council held a public hearing on the request from Minot Curling Club for proceeds from the City sales tax for community facilities in the amount of $275,000 to replace the rink floor and cooling pipes in their leased facility at the North Dakota State Fairgrounds. No written protests were received. Mark Hildahl, representing the Minot Curling Club, appeared before the Council in support of the request. Whereupon, Alderman Jantzer moved that the City Council close the public hearing on the request from Minot Curling Club for proceeds from the City sales tax for community facilities in the amount of $275,000 to replace the rink floor and cooling pipes in their leased facility at the North Dakota State Fairgrounds. Miller, Moen, Olson, Seymour, Withus. nays: none.  July 22, 2013 PUBLIC HEARING – COMMUNITY FACILITIES SALES TAX FUNDS – MINOT FAMILY YMCA – COMMUNITY OUTDOOR FITNESS PARK - $193,585 – CLOSED The City Council held a public hearing on the request from Minot Family YMCA for proceeds from the City sales tax for community facilities in the amount of $193,585 to build a community outdoor fitness park in southwest Minot. No written protests were received. Roger Mazurak, representing the Minot Family YMCA, appeared before the Council and stated the park will be attached to the current pathway system. Whereupon, Alderman Hatlelid moved that the City Council close the public hearing on the request from Minot Family YMCA for proceeds from the City sales tax for community facilities in the amount of $193,585 to build a community outdoor fitness park in southwest Minot. Motion seconded by Alderman Lehner and carried by the following roll call vote: ayes: Connole, Frantsvog, Frey, Hatlelid, Jantzer, Knudsvig, Krabseth, Lehner, B. Miller, M. PUBLIC HEARING – COMMUNITY FACILITIES SALES TAX FUNDS – MINOT PARK DISTRICT – HAMMOND PARK TENNIS FACILITY - $500,000 – CLOSED The City Council held a public hearing on the request from Minot Park District for proceeds from the City sales tax for community facilities in the amount of $500,000 for improvements and expansion of the Hammond Park Tennis Facility. No written protests were received. Whereupon, Alderman Krabseth moved that the City Council close the public hearing on the request from Minot Park District for proceeds from the City sales tax for community facilities in the amount of $500,000 for improvements and expansion of the Hammond Park Tennis Facility. No written protests were received. Whereupon, Alderman Frey moved that the City Council close the public hearing on the request from Minot Park District for proceeds from the City sales tax for community facilities in the amount of $1,000,000 for the construction of a third sheet of ice at the MAYSA Arena. PUBLIC HEARING – COMMUNITY FACILITIES SALES TAX FUNDS – MINOT PARK DISTRICT – YOUTH GIRLS’ FAST PITCH SOFTBALL FIELDS - $800,000 – CLOSED The City Council held a public hearing on the request from Minot Park District for proceeds from the City sales tax for community facilities in the amount of $800,000 to provide 3 fields for youth girls’ fastpitch softball fields. No written protests were received. Whereupon, Alderman Frantsvog moved that the City Council close the public hearing on the request from Minot Park District for proceeds from the City sales tax for community facilities in the amount of $800,000 to provide 3 fields for youth girls’ fastpitch softball fields. PUBLIC HEARING – COMMUNITY FACILITIES SALES TAX FUNDS – MINOT STATE UNIVERSITY – HERB PARKER STADIUM - $1,000,000 – CLOSED The City Council held a public hearing on the request from Minot State University for proceeds from the City sales tax for community facilities in the amount of $1,000,000 for completion of Phase III projects at the Herb Parker Stadium. No written protests were received. The initial distribution of funds was approved at the December 3, 2012 City Council meeting. This distribution is the second of four annual distributions.  July 22, 2013 Whereupon, Alderman B. Miller moved that the City Council close the public hearing on the request from Minot State University for proceeds from the City sales tax for community facilities in the amount of $1,000,000 for completion of Phase III projects at the Herb Parker Stadium. Motion seconded by Alderman Hatlelid and carried by the following roll call vote: ayes: Connole, Frantsvog, Frey, Hatlelid, Jantzer, Knudsvig, Krabseth, Lehner, B. Miller, M. Miller, Moen, Olson, Seymour, Withus. nays: none. COMMUNITY FACILITY FUND REQUESTS - DISCUSSION The City Attorney stated the application for community facilities sales tax funds did not initially include private non-profit organizations but was added into the eligible organizations by the City Council. He provided Attorney General opinions which state cities may not give outright donations to organizations but can engage in enterprise activities. He stated the concern exists that the applications received may not provide a sufficient benefit to the City to engage in an enterprise and would need to be addressed. ENTERPRISE AGREEMENT – BISHOP RYAN CATHOLIC SCHOOL – APPROVED Alderman Krabseth moved that the City Council enter into an enterprise agreement with Bishop Ryan Catholic School to provide physical fitness, recreational activities, tourism, and economic development for Minot citizens and approve the request for $275,000 in Community Facility funds for upgrades and improvements to the school gymnasium. Motion seconded by Alderman Frantsvog and carried by the following roll call vote: ayes: Connole, Frantsvog, Frey, Hatlelid, Jantzer, Krabseth, Lehner, B. Miller, M. Miller, Moen, Seymour, Withus. nays: Knudsvig, Olson. ENTERPRISE AGREEMENT – MINOT COMMISSION ON AGING – APPROVED Alderman B. Miller moved that the City Council enter into an enterprise agreement with Minot Commission on aging and approve the request for $400,000 in Community Facility funds for the upgrades to the facilities. Motion seconded by Alderman Hatlelid. Whereupon, Alderman Krabseth moved to amend the motion that the City Council enter into an enterprise agreement with Minot Commission on Aging to provide recreational activities, nutrition, and socialization to the elderly of Minot and approve the request for $400,000 in Community Facility funds for the upgrades to the facilities. Motion seconded by Alderman Hatlelid and carried by the following roll call vote: ayes: Connole, Frantsvog, Frey, Hatlelid, Jantzer, Krabseth, Lehner, B. Miller, M. Miller, Moen, Olson, Seymour, Withus. nays: Knudsvig. Whereupon, a vote was taken on the original motion, as amended, and carried by the following roll call vote: ayes: Connole, Frantsvog, Frey, Hatlelid, Jantzer, Knudsvig, Krabseth, Lehner, B. ENTERPRISE AGREEMENT – MINOT CURLING CLUB – APPROVED Alderman Krabseth moved that the City Council enter into an enterprise agreement with Minot Curling Club to provide winter physical activities, tourism, and economic development for Minot citizens and approve the request for $275,000 in Community Facility funds for improvements to the leased facility at the North Dakota State Fairgrounds. JOINT POWERS AGREEMENT – MINOT PARK DISTRICT – HAMMOND PARK TENNIS FACILITY – APPROVED Alderman Jantzer moved that the City Council enter into a Joint Powers Agreement with the Minot Park District to receive $500,000 in Community Facilities funds for the improvements and expansion of Hammond Park Tennis Facility. JOINT POWERS AGREEMENT – MINOT PARK DISTRICT – MAYSA ARENA – APPROVED  July 22, 2013 Alderman Jantzer moved that the City Council enter into a Joint Powers Agreement with the Minot Park District to receive $1,000,000 in Community Facilities funds to construct a third sheet of ice at the MAYSA Arena. JOINT POWERS AGREEMENT – MINOT PARK DISTRICT – SOFTBALL FIELDS – APPROVED Alderman Jantzer moved that the City Council enter into a Joint Powers Agreement with the Minot Park District to receive up to $800,000 in Community Facilities funds to construct three youth girls fastpitch softball fields. SUBDIVISION – FLICKERTAIL 2ND ADDITION, LOTS 1 & 2 – APPROVED Alderman Hatlelid moved that the City Council approve the subdivision of Flickertail Addition, Lots 11-16 and Lots 31-41 and vacated portions of 47th Avenue NW and Main Street North into two lots to be known as Flickertail 2nd Addition, Lots 1 & 2. This property is located east of Highway 83 North and north of 45th Avenue NW. RESOLUTION NO. 3213 – DECLARE SUPPORT FOR MINOT AIR FORCE BASE JOINT LAND USE STUDY PROGRAM – APPROVED Alderman Hatlelid moved that the City Council adopt Resolution No. 3213, declaring support for the Souris Basin Planning Council’s application to the Department of Defense, Office of Economic Adjustment for the Minot Air Force Base Joint Land Use Study. AWARD OF BID – RUNWAY 13/31 PAVEMENT MARKINGS PROJECT – APPROVED Alderman Hatlelid moved that the City Council declare the bid by HI-LITE Markings for the Runaway 13/31 Pavement Markings project in the amount of $87,745.72 to be the lowest and best bid received; and further, authorize the Mayor to sign the contract on the City’s behalf.
