She stated she would still like the City to address Mr. Brekke concerning PTI, which also washes vehicles in the lot. She stated Mr. Brekke’s overflowing garbage dumpster, which has limited space for all tenants, requires a neighbor to pick up garbage from the property. She also stated the lot owned by Mr. Brekke at 1321 5th Ave SE which had been turned into an access road to his adjacent property is still being used for that purpose. She would like to see the City address this. Mayor Barney stated he would meet with the City Engineer and Mr. Brekke to resolve the matter. CITY MANAGER REPORT The Acting City Manager stated the Storm Sewer Adhoc meeting would be rescheduled from July 8 to August 12. She also stated there will be an Environmental Impact Statement meeting with regard to NAWS on July 23 rd. She informed the Council she would be out of the office from July 10-15th and July 24th and 25th. MAGIC FUND – MADC – MINOT AREA AG COMPLEX/PORT EXPANSION– APPROVED Alderman B. Miller moved the City Council approve the application from Minot Area Development Corporation (MADC) for the amount of $4,292,440 for the site work and associated costs in the development of approximately 120 acres of land, strategically located in Minot’s Value-Added Agricultural Complex – Port of North Dakota expansion. MARK’S LUTHERAN CHURCH – APPROVED Alderman Lehner moved the City Council adopt Resolution No. 3304 for Dave Lindee of St. Mark’s Lutheran Church to extend a special use permit, granted by the City Council on July 2, 2012 and May 6, 2013, for one year increments to allow for 6 camper hookups in the church parking lot on Sun Valley Addition, Block 1, Lot 1, subject to the following conditions:  The interim use permit shall expire on November 30, 2014.  All campers shall be used by only volunteers for the flood recovery registered with the church.  No more than six (6) campers may be parked on site at any one time.  Required parking for St. Mark’s Lutheran Church and all related uses shall be preserved for use at all times.  Any outdoor lighting shall be minimal so as not to disturb neighboring residences.  No outside facilities (eating, showering and gathering area) shall be approved as this site is in very close proximity to adjacent residential structures to the south and west.  In order to be in compliance with the City Ordinance and THU regulations, staff will not support continual request for interim use for camper hookups. Motion seconded by Alderman Lehner Randy Bell of 2005 Ida Mae Court appeared before the Council representing “The Welcome Table”. He stated the organization has worked to find available land for a “one stop shop” and would like it to be a shelter also. He said in order for this to happen, the required zone change is needed. He said homelessness is an ongoing concern in the City of Minot. Rod Emly of R&M Painting and Woodworking appeared before the Council to protest having the shelter in this location. He stated that he has no problem with the shelter itself, but he does not feel as if this is the right place to put it in regards to safety concerns. Bruce Beefer of Bruce Beefer Trucking appeared before the Council to state the shelter is needed but not in the indicated industrial area. He stated the truck traffic as a safety issue. Alderman Lehner agreed the project is needed but did not consider the industrial area the correct spot to put the shelter. Will Sutterhome of 1705 Terrace Court appeared before the Council as a representative of “The Welcome Table.” He stated the potential residents to the shelter would be brought in via bus and not walking among the truck traffic. He continued by saying this shelter would be for men only and women and children would not be present and it would not be a safety issue. Upon questioning by Alderman Frantsvog, Mr. Sutterhome stated the land was the only affordable land located that was also large enough to accommodate a shelter and the one stop services. He stated some neighbors are protesting to having the shelter located in that area. He concluded by stating any help from the City would be appreciated. Motion seconded by Alderman Olson.  JULY 7, 2014 Eric Popinga of 1120 15th Court appeared before the Council to mention that a petition signed by 143 neighboring properties had been received in protest of the development. He provided a presentation that opposed the development due to elevation issues of buildings, increase traffic issues, school overcrowding, and lack of adequate buffer/screening to surrounding neighbors. Willy Fielhaber, representing the developer Future Builders, appeared before the Council to state they have met all City Requirements and had 2 public meetings with over 30 neighbors. He continued by saying they have addressed issues from the first plan with regard to traffic on Sycamore Ave and the placement of apartments. He said they have maximized distance to neighbors to the north and placed garages north for an additional buffer. Mr. Popinga asked the Council consider moving this item back to planning for a potential plan change. City Planner, Donna Bye, gave a background on the history of the property in question. She stated the property was owned by a church and sold to investors for Multiple Apartment Buildings as the property was under R4 (Planned Residence District) zoning at the time. She stated the R4 zoning was then omitted in new zoning with Medium Density proposed to replace the R4 zone. She then verified for Alderman Lehner that townhomes were proposed by previous owners but never platted or submitted. Christine Morsfield of 905 18th Ave SE, President of the Edgewood Village, appeared before the Council to state that Edgewood does support the developer’s plan. She stated the developer has made changes to address the issues. Kim Neilson of 1512 11th St SE appeared before the Council to oppose the development because of traffic concerns. She inquired as to how this development would affect the neighborhood. She concluded by stating the neighborhood to the north opposes the developer and believes further changes need to be made. Kevin Beck of the First Assembly of God Church, appeared before the Council in favor of the builder. He believes the apartments will be a nice asset to the neighborhood and said the developer has been good with communication. Denise Tischer of 1116 15th Court appeared before the Council to state she stands behind the neighborhood in opposition of the development. Alderman B. He stated the activities would not affect the drainage. Kyle and Melissa Burchard of 2615 62nd St. SE appeared before the Council to cite the City’s administrative requirements that must be met to issue the interim use permit. They stated this application did not meet the requirements. They also said they oppose the approval as this gravel pit would be directly behind their home. They don’t want their children playing outside being exposed to all the dust. They also noted the truck traffic will be taken off 55th Crossing and put behind their home. They continued by saying reclaimed land never grows back to what it was prior to excavation. They stated the drainage ditch will tie information into the development and would cause further water issues as would changing the lay of the land. Shane Hill of Sundre Sand & Gravel stated that safety is Sundre’s main concern. He said the pit will keep trucks off roads and the roads will remain intact. He states they do respect the neighbor’s views and understand their concerns. He noted the crushing is actually 750-800 feet across from the neighbor’s property and the area is diagonally across from 55 th Crossing so trucks will not be in the neighbor’s backyard.
