PERSONAL APPEARANCES Keith Jones came before the Council to bring up an issue regarding a nuisance dog in his neighborhood. He asked if there was an ordinance forbidding animals from leaving droppings in people’s yards. The City Attorney stated there is an ordinance and it is enforced by animal control. Mr. Jones explained, he had spoken to animal control and they said they would contact the owner but the problem has continued. The Mayor asked Captain White to please follow up with Mr. Jones after the meeting. CITY MANAGER REPORT  July 5, 2016 The City Manager explained to the new Council members that he creates his report to cover the important topics as compiled by all department heads. He notified everyone that the meeting was streaming live online and would also be available on the website after the meeting concludes. He listed some dates for upcoming meetings including Monday, July 18th when a meeting will be held at the location of the old Ramstad Middle School to discuss public input on greenspace uses. There will also be a meeting at Oak Park on Thursday, August 4th for public input on a downtown gathering space. He then said, each Council member received a guidebook to explain information on meetings, committees, and department functions among other things. He also said it would be available on the website for reference. Mr. Staab gave updates on the current construction projects. Mark Lyman distributed a handout summarizing the status of the downtown infrastructure project, which is progressing well. The Oak Park Bridge is about a week behind but is anticipated to open on time. He said there have not been any major issues on the Water Treatment Plant and the 6th Street Pump Project is complete. He continued by saying, the 37th Ave SW road expansion is on schedule, weather permitting and 36th Ave is going well. He also thanked the residents around Hillcrest Drive for being so patient with the detours while work continues on the water system and retaining wall. The City Manager then gave some information on the National Disaster Resilience Project where he described the importance of a coalition of community support. He explained, the City is working with the USACE, the North Dakota Water Commission, the Souris River Joint Board, and Canadian Water Authorities, among others as decision support tools. He stated, staff is currently analyzing the affordable housing study to evaluate Minot’s current needs. Other projects include a sustainable family shelter and continuation of the buyout program. Mr. Staab then read a letter of resignation as City Manager, effective August 20th. He thanked the citizens of Minot for their support over the past two years and commended the staff and City Council for their continued service to the City. MAYOR’S REPORT Mayor Barney stated, he respects the City Manager’s decision but assured the community, he does not want the City to slip backward but rather will continue to move forward. He said the Human Resource Director has already begun the search for a replacement, though they are very big shoes to fill. He explained, in Section 22-8 (3) where it describes the use of multi-tenant signs, he would like to add the phrase, “as allowed by lot frontage” at the end of the sentence, in order to better suit the size requirements. Scott Harmstead, a consultant on the project from SRF Consulting Group came forward and agreed, the suggested wording is an acceptable change. Mr. Munson also stated, he would like the wording changed from “all” to “every” in Sections 22-9 a) 2 and 22-10 a) 2 in order to allow tenants to customize the sign size based on need rather than require all tenants to use the same size sign. ADOPT-A-LOT – APPROVED Alderman Jantzer moved the City Council authorize the Mayor to sign a joint powers agreement between the City of Minot and Minot Park District to assist with the Adopt-A-Lot program. Motion seconded by Alderman Lehner. Alderman Schuler asked who would be responsible for maintenance of the proposed lots such as mowing and snow removal. The City Attorney responded by saying, the Park District would take care of those tasks. MINOT AG COMPLEX 6TH ADDITION, LOT 5- AGT FOODS USA, INC. – SENT BACK TO PLANNING Alderman Jantzer stated he would like to address a variance request which was denied by the Planning Commission. Les Knudson came before the City Council to explain his request for a variance regarding the paving of a lot located at 625 42nd St NE. He stated, he would like to avoid paving the parking lot of the property while gravel roads lead to the facility because of the upkeep that would be necessary to maintain it. He said he would be willing to sign an agreement that would require him to pave the lot after the road leading to it is paved.  July 5, 2016 Upon questioning by Alderman Jantzer, he explained, they are in the final stages of completing an addition to the property. The original plan was to have a parking lot of crushed gravel but since the expansion was over 50% the requirement for a paved lot was triggered. The Mayor suggested it be sent back to Planning Commission. Alderman Shomento asked what it would cost to pave the lot, to which Mr. Knudson replied by saying, about $400,000. Alderman Schuler asked the City Engineer if there would be enough time to get the item on the next month’s agenda. He stated, staff needs to make sure they meet the notification requirements but there should be time. Alderman Schuler then asked if there are any plans to pave the road in question. The City Engineer replied by saying, the City does not improve or pave roadways unless a development project occurs. He explained, there was a project being planned with the MADC prior to the flood in 2011 but that was put on hold. He said there are no plans for that road unless future development takes place. Upon questioning by Alderman Withus, the City Engineer stated the purpose of paving the lot is for ADA compliance as well as aesthetics and dust control. He continued by saying, the 129 required parking spaces is determined based on the square footage and by the building’s use. Alderman Podrygula asked if there would be funding to have the road paved. The City Engineer stated there are no plans to pave the road but those funds come from special assessments or developer donated improvements. Alderman Pankow asked if the City could create a document that would include a condition that the parking lot be paved at the point in time the City paved the road. The City Attorney stated, they can recommend conditions but there is no guarantee the Planning Commission will accept them. Alderman Jantzer moved the City Council send the variance request back to Planning Commission for review.
