PERSONAL APPEARANCES Patty Bender, who lives in the Brekke Leite Addition, came forward regarding the buyout process which will take place in her neighborhood. She questioned why the City would purchase these properties five and a half years after the flood. She Page | 6  December 5, 2016 stated, the area was rebuilt when the market was high and now the City wants to buy the property when the market is low. She further explained, her family had to use all of their savings in order to rebuild and now they are losing everything. Mayor Barney explained, the flood protection plan has been an evolving process since the flood. He said, he and several aldermen have been working since the public meeting to discuss alternatives. He assured Ms. Bender she will be contacted by him personally, if not by city staff. MAYOR’S REPORT The Mayor listed his recent meetings, welcomes, and ribbon cuttings. He attended a conference in Norway, funded mostly by the North Dakota Commerce Department. During the Norwegian UAS Conference, he came in contact with some promising leads for economic development in Minot, one of which is software development in precision agriculture as well as a possible manufacturing opportunity. He then gave a brief history of the Hepatitis C outbreak and the contact he has made with Trinity Hospital. The timeline of events he shared resulted in a determination by the Centers for Disease Control not to pursue testing. He said, he has exhausted all of his resources and cannot move forward. Kristi Burgess, of 921 13th Ave SE, thanked the Mayor for his effort and said she is disappointed in Trinity and First District Health Unit but she will continue to pursue the issue. Chris Todd, of 601 3rd St SE, also spoke in support of Hepatitis C testing. He encouraged citizens to get tested and said he would like to find a connection at the State level to ensure the Department of Health conducts its due diligence. The Mayor then presented Dena Filler with a proclamation thanking her for her strong leadership and dedication during her 29 years of service with the Domestic Violence Crisis Center. Alderman Straight also took a moment to recognize efforts by the State Fair, Visit Minot, and the Grand Hotel for organizing the North Dakota- South Dakota Fairs Convention, which has never been held in Minot. Craig Rutland initiated a partnership to put on the three day convention which turned out to be so successful, it will likely return to Minot in future years. CITY MANAGER REPORT Interim City Manager, Cindy Hemphill stated, the new City Manager, Tom Barry will start on Monday, December 12th. She listed the upcoming meeting schedule and important dates and announced, the independent audit by Eide Bailey will begin on March 27th. She continued by describing construction updates which have finished for the season and will pick up again in 2017. There are several new projects for next year and engineering is now working on those plans. She gave an update on the Airport and stated, the former terminal demolition is complete and the FAA is reviewing the Master Plan. She described the ongoing snow removal efforts taking place and explained some of the challenges the department is facing with the amount of snow, the wind and resulting snow drifts. The property is primarily in the 100-year and 500-year floodplain, and as such, not developable except for recreational uses. 2. The existing outlots along U.S. Hwy. 83 By-Pass are also in the floodplain, have never been annexed even though they abut the corporate limits, and would continue to be an ”island” of un-annexed land if they are not brought into the City limits at this time. 3. The highest and best use of this land is recreational and open space, with very limited low density residential north of 7th Avenue SW. 4. The various zoning categories in place on this property today including AGP, AG, R-1 and C-1 would better represent the use of the land as recreational and open space if the zoning districts were changed to P, Public zone, while the three existing R-1 lots can remain R-1. Golf courses, public and private, are an allowable use in R-1 zoning. 5. Platting of this property allows for the dedication of public right-of-way to complete the 7th Avenue SW corridor and also dedication of the permanent flood control levees. 6. The applicant has requested a variance based on a demonstrable hardship such that the proposed pump house cannot be located on the irregularly shaped lot without the setback variance. ENGINEERING AMENDMENT TO FLOOD PROTECTION PLAN – FAILED Alderman Schuler moved the City Council direct Dan Jonasson to request the Souris River Joint Board make an engineering amendment to the flood protection plan to reduce the size of the Broadway entrance from 56ft. to 24ft. with an 8ft. opening on each side and to add an 8ft opening at the Anne Street Bridge. Motion seconded by Alderman Straight. The members of Council discussed the positive and negative aspects of an additional opening in the flood wall at the Anne St. Bridge. Alderman Lehner stated, he does not want to jeopardize future phases of the flood plan with any delays. He also said he doesn’t support the motion because of the uncertainty of the future of the Anne St. Bridge. Alderman Jantzer stated, the flood wall is the more important aspect and since the Public Works Director is not behind the idea, he does not support Page | 12  December 5, 2016 the motion. Alderman Withus brought up concerns over line of sight issues and the safety of crossing the street at that location. Alderman Shomento reminded those in attendance, there would also be an opening two blocks away at 3rd St. Alderman Straight stated, he believes there can be flood protection and another opening. He wants to encourage the community to use the pedestrian bridge to invigorate downtown business. Alderman Kossan agreed and said, the citizens of Minot have to live with this wall so the residents should have their comments heard. Alderman Podrygula believes the connection to downtown is important for all of the students and employees who use the bridge for their commute on a daily basis. Several residents of the area came forward to explain their experiences using the Anne St. Bridge. Jon Hanson, of 920 1st St NE, said the access to downtown was a selling point when purchasing his house and he prefers to avoid the traffic on 3rd Street. Scott Joern, of 412 1st St NE, uses the bridge regularly and suggested the City create an opening at the bridge and if the bridge is removed in the future, the entrance can be filled in. Gladys Garrison, of 611 1st St NE, explained, she has been using the bridge for 60 years to commute to and from her job downtown. She said, the additional two blocks to the next opening makes a big difference in her commute. Josh Wolsky of 1340 Main St, stressed the importance of using the citizen’s comments from the public input meetings. He said the concerns over the opening are not valid and an increase to pedestrian traffic produces a higher quality of life. The Public Works Director was questioned about the structural concerns, cost, and the approval of the Corps of Engineers. He stated, there is still time for the Corps to review the plans without delaying the project but said, the protection of life and safety is the primary concern and every opening reduces the integrity of the wall. There will be another 22 total openings in the flood wall and each one of them will require equipment and personnel to seal in an emergency. He added the cost of making the proposed change is kind of a wash as the smaller openings will require more concrete but less stop logs and the additional opening comes with a cost.
