To the Honorable Mayor and All Aldermen: Following are the recommendations of the Public Works and Safety Committee meeting called to order at 4:15 p.m. on August 1, 2012: 1. That the City Council approve the request from Terry Boe to relocate a single-family dwelling from 6271 67th Street NE in Cando, ND to 4606 33rd Avenue SE (East Side Estates Addition, Block 1, Lot 27), subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. An adequate foundation in compliance with City of Minot building codes and zoning ordinances must be furnished at the new location. 3. The plumbing, mechanical, and electrical systems must be in compliance with current code requirements of the City of Minot. 4. All work at the new location must be in compliance with City of Minot building codes and zoning ordinances. 5. Egress windows must be installed in the basement and every bedroom. 6. Smoke detectors must be installed in the basement, in each bedroom, and in areas outside bedrooms. 7. Paint and repair siding as necessary. 8. Applicant must obtain all necessary permits, and coordinate all relocation activities with public utilities and traffic authorities. 9. The property must be provided with proper drainage, and must be landscaped in a manner similar to surrounding properties. 10. All work must be completed within ten months and generally in accordance with the following schedule: a. Foundation to be complete within two months. b. Structure relocated within four months. c. Work required for code compliance complete within six months. d. That the City Council declare the bid by Great Plains Fire for a Fire Fighting Foam Trailer in the amount of $95,831 to be the lowest and best bid received and authorize the Mayor to sign the contract on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 3. That the City Council declare the bid by Hight Construction for the Minot Public Library shed and sidewalk restoration in the amount of $31,900; and further, authorize the Mayor to sign the contract on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 4. That the City Council adopt the proposed resolution establishing a policy prohibiting the use of excessive force against non-violent civil rights demonstrators. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 5. That the City Council adopt a resolution correcting the previously approved plat of Talon Point Addition, Block 1, Lots 1-20, Block 2, Lots 1-7, Block 3, Lots 1-14 to be known as Talon Point Addition, Block 1, Lots 1-24, Block 2, Lots 1-8, Block 3, Lots 1-13; and correct Ordinance No. 4545 rezoning Talon Point Addition, Block 1, Lots 1-24, Block 2, Lots 1-8, Block 3, Lots 1-13 from C-2 (General Commercial District) to R-1 (Single-Family Residence District) ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 6. That the City Council declare the bid by Kipp’s Heating and Air for the replacement of the HVAC system for the Carnegie Center in the amount of $42,938 to be the lowest and best bid; and further, authorize the Mayor to sign the contract on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 7. That the City Council authorize the Police Department’s application to the US Department of Justice for a Federal Bulletproof Vest Partnership Grant for reimbursement of 50 percent of the purchase cost of bulletproof vests, at a total cost of $14,880 with estimated City share to be $7,440; further, authorize the acceptance of the grant funds, if awarded; and further, authorize the Mayor to sign any required grant documentation. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE August 1, 2012 Page 3 8. That the City Council approve the plans and specifications for the 11th Street/18th Avenue SE Street and Utility Improvements and authorize the City Engineer to call for bids. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 9. That the City Council approve the plans and specifications for the 11th Avenue/39th Street SE Street and Utility Improvements and authorize the City Engineer to call for bids. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 10. That the City Council approve the plans and specifications for the Puppy Dog Interceptor Relief Sewer and authorize the City Engineer to call for bids. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 11. That the City Council approve the plans and specifications for the 3rd Street NE Sanitary Sewer Improvements and authorize the City Engineer to call for bids. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 12. That the City Council approve the request from Kelsey Slauter to relocate a single-family dwelling from 2099 17th Avenue NW, Ruso, ND to 805 2nd Avenue NE (Torbenson’s Third Addition, Block 4, Lot 9) to replace a flood damaged home; and further, approve a variance to reduce the front yard setback from 25’ to 16’; subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. Kelsey Slauter, applicant, appeared before the Committee to verify the variance request was also included in the motion. Whereupon, a vote was taken on the above motion by Alderman Hatlelid, seconded by Alderman Lehner and carried unanimously. 13. That the City Council approve the request from Tom Ripplinger to relocate a 2012 model 27' X 40’ manufactured home from Iseman Homes Inc., Minot, ND to 1526 1st Avenue SE (Lenox Park Addition, Wasvicks R/A of Lots 77 & 78, Lot 3) to replace a flood-damaged home; and further, approve a variance to reduce the front yard setback from 25’ to 16’; subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 5. Home must be placed on a permanent foundation. 6. Work shall be accomplished generally in accordance with the following schedule: a. Foundation to be complete within one month. b. Relocation of structure to be complete within two months. c. All work associated with the request to be complete within four months. ********** The above motion by Alderman Lehner and seconded by Alderman Withus. Alderman Hatlelid commented he was opposed to the request as the home would be used as a rental property instead of owner-occupied. Tom Ripplinger, applicant, stated the home was the same as another placed in the neighborhood and was an improvement upon the previous home on the site. Aldermen Lehner and Knudsvig indicated the rental status could not be used as a factor in the decision. Whereupon, a vote was taken on the above motion by Alderman Lehner, seconded by Alderman Withus and carried by the following roll call vote: ayes: Lehner, M. Ordinance No. 4461 – Rezoning Skyport 6th Addition from AG (Agricultural District) to R-4 (Planned Residence District). c. Ordinance No. 4499 – Rezoning Conrad Cook 1st Addition from M-1 (Light Industrial District) to R-3 (Multiple-Family Residence District). d. That the City Council place and pass the following ordinances on second reading: a. Ordinance No. 4592 – Rezoning Northridge Villas Addition, Block 1, Lots 1-28 and Block 2, Lots 1-9 from AG (Agricultural District) to R-4 (Planned Residence District). ********** The above motion by Alderman Hatlelid and seconded by Alderman Lehner. Tina Langhans, 713 27th Street NW, appeared before the Committee in opposition of the motion and requested the zoning be changed to R-1 (Single-Family Residence) instead of R-4 (Planned Residence District). Upon questioning, the City Planner clarified R-1 zoned areas have a minimum of 7,500 square feet and an R-4 zoning allows for reduced lot sizes and setbacks. Whereupon, a vote was taken on the above motion by Alderman Hatlelid, seconded by Alderman Lehner and carried by the following roll call vote: ayes: Hatlelid, Lehner, Withus. nays: Connole, M.
