To the Honorable Mayor and All Aldermen: Following are the recommendations of the Public Works and Safety Committee meeting called to order at 4:15 p.m. on August 29, 2012: 1. That the City Council adopt a resolution stating the City Council approves of and supports the application made by the City of Minot to the North Dakota Department of Emergency Services for the Housing Rehabilitation and Citizen Retention Grant. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 2. That the City Council place and pass an ordinance amending the 2012 budget in the amount of $17,360 for the North Dakota Department of Commerce energy efficiency grant to be used to upgrade lighting fixtures in the Minot Public Schools Administration Building, on first reading. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 3. That the City Council place and pass an ordinance amending the 2012 budget in the amount of $7,831 for the purchase of a firefighting foam trailer, on first reading. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 4. That the City Council place and pass an ordinance, amending Section 20-12 of the City of Minot Code of Ordinances in regard to weight restrictions, on first reading. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 6. That the City Council authorize the Public Works Director to call for bids for the purchase of two sander bodies for use by the Street Department. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 7. That the City Council approve changes to the City Transit early morning North Central and Bel Air/Perkett route. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 8. That the City Council authorize the Mayor to appoint a member of the City Council to serve as a member of the Transit Study Selection Committee. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 9. That the City Council ratify the Title VI Coordinator’s signature on the North Dakota Department of Transportation’s Title VI Assurances document. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 10. That the City Council authorize SRF Consulting Group, Inc. to file the application to the Federal Railroad Administration and begin the design phase of the Southwest Railroad Quiet Zone; and further, authorize the Mayor to sign any necessary documentation, on the City’s behalf. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 11. That the City Council authorize the Public Works Director to complete and submit the Innovative Readiness Training Request for Military Assistance application for 2013 and 2014 for the aerial spraying of mosquitos. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 14. That the City Council declare the bid by Joseph Schmalz for the sale of a handicap accessible van in the amount of $4,500 to be the highest and best bid; and further, authorize the Public Works Director to complete the sale of the van. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE August 29, 2012 Page 4 15. That the City Council approve the request from Terry Boe to relocate a single-family dwelling from 8907 54th Avenue in Perth, ND to 4616 33rd Avenue SE (East Side Estates Addition, Block 1, Lot 26), subject to the following conditions: 1. A ten-thousand dollar completion bond must be posted with the City prior to start of any work. 2. An adequate foundation in compliance with City of Minot building codes and zoning ordinances must be furnished at the new location. 3. The plumbing, mechanical, and electrical systems must be in compliance with current code requirements of the City of Minot. 4. All work at the new location must be in compliance with City of Minot building codes and zoning ordinances. 5. Egress windows must be installed in the basement and every bedroom. 6. Smoke detectors must be installed in the basement, in each bedroom, and in areas outside bedrooms. 7. Replace the shingles and siding as necessary. 8. Applicant must obtain all necessary permits, and coordinate all relocation activities with public utilities and traffic authorities. 9. The property must be provided with proper drainage, and must be landscaped in a manner similar to surrounding properties. 10. All work must be completed within ten months and generally in accordance with the following schedule: a. Foundation to be complete within two months. b. Structure relocated within four months. c. Work required for code compliance complete within six months. d. Work complete and final cleanup complete within ten months. ********** The above motion by Alderman Hatlelid and seconded by Alderman Lehner. Chairman Knudsvig stated one protest letter had been received. Mike Hamilton, 901 1st Avenue SW, appeared before the Committee with concerns about a sewer smell in the area. He believes this is due to the compaction of the sewer area in lots which are less than 2 acres. Aldermen discussed the required lot size for Eastside Estates and septic systems. Alderman Krabseth commented the Eastside Estates subdivision was grandfathered with half-acre lot sizes. He requested a report from the First District Health Unit regarding the area’s septic system. Terry Boe, applicant, appeared before the Committee and stated the FDHU drew up the septic system plan and indicated he would follow the plan. Whereupon, a vote was taken on the above motion by Alderman Hatlelid, seconded by Alderman Krabseth, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE August 29, 2012 Page 5 16. That the City Council approve a request from Dean Kokot to relocate a 46’ x 30’ single family home with an attached garage of 24’ x 26’ from 3205 47th Street SE, Minot to 5400 30th Street NW (Kokot 2nd Subdivision, Lot 1); subject to the following conditions: 1. A ten-thousand dollar completion bond must be posted with the City prior to start of any work. 2. An adequate foundation in compliance with City of Minot building codes and zoning ordinances must be furnished at the new location. 3. The plumbing, mechanical, and electrical systems must be in compliance with current code requirements of the City of Minot. 4. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 5. That the City Council approve a request from Charlotte Kremer to relocate a 2013 model year, 27’ x 52’ manufactured home from Iseman Homes Inc. Minot, to 421 3rd Avenue NW (Lee & Jacobsons 1st Addition, Block 3, Lot 4); subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 5. Home must be placed on a permanent foundation. 6. Work shall be accomplished generally in accordance with the following schedule: a. Foundation to be complete within one month. b. Relocation of structure to be complete within two months. c. All work associated with the request to be complete within four months. ********** The above motion by Alderman Hatlelid and seconded by Alderman Withus. Warren Hoppman, 422 3rd Avenue NW, appeared before the Committee in opposition to the motion. He stated his concerns with the foundation supports, anchoring methods, and property values for manufactured homes. Norma Opperud, owner of 304 5th Street NW, appeared before the Committee in opposition of the request. Tom Ripplinger, representing Iseman Homes, appeared before the Committee and described the anchoring system and foundation support for manufactured homes. He also indicated a home could not be occupied without a State inspection on the anchoring of the home. Following discussion, a vote was taken on the above motion by Alderman Hatlelid, seconded by Alderman Withus and carried by the following vote: ayes: Hatlelid, Krabseth, Lehner, M. Miller, Withus. nays: Connole. 19. That the City Council approve a request from Double the Back Property Group, LLC to relocate a 2012 model year, 27’ x 52’ manufactured home from Iseman Homes Inc. Minot, to 1505 Wildwood Avenue (Subdivision of a portion of Block 13, West Minot Addition, Lot 6 of PUBLIC WORKS AND SAFETY COMMITTEE August 29, 2012 Page 7 Block 2); subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 5. Home must be placed on a permanent foundation. 6. Work shall be accomplished generally in accordance with the following schedule: a. Foundation to be complete within one month. b. Relocation of structure to be complete within two months. c. Aldermen Connole and Krabseth expressed concern with allowing manufactured homes to be used for rental property purposes. Discussion was held on the criteria used to assess a manufactured home for placement in a neighborhood. Following discussion, a vote was taken on the above motion by Alderman Hatlelid, seconded by Alderman Withus and carried by the following vote: ayes: Hatlelid, Krabseth, Lehner, M. Miller, Withus. nays: Connole. 20. That the City Council approve a request from Double the Back Property Group, LLC to relocate a 2012 model year, 40’ x 26’8” manufactured home from Iseman Homes Inc. Minot, ND to 804 Burdick Expressway East (Hecker’s 3rd Addition, Lot 5 less the north 10’ of Block 3); subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 5. Home must be placed on a permanent foundation. 6. Work shall be accomplished generally in accordance with the following schedule: a. Foundation to be complete within one month. b. Relocation of structure to be complete within two months. c. Minot, ND to 1008 Burdick Expressway East (Sunnyside Addition, east 40’ of Lots 11 & 12 of Block 2); subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 5. Home must be placed on a permanent foundation. 6. Work shall be accomplished generally in accordance with the following schedule: a. Foundation to be complete within one month. b. Relocation of structure to be complete within two months. c. All work associated with the request to be complete within four months. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. General Information David Morris, 3212 11th Street SE, appeared before the Committee to express his concerns with the speed of the traffic on 11th Street SE. He commented many vehicles travel at much higher speeds than the allowed 25 mph and use this street due to the unpaved condition of 13th Street SE and 37th Avenue SE. The Traffic Engineer stated her office has received complaints on this area. The Police Chief indicated the speed trailer had experienced some mechanical issues and when fixed, would be placed in the area. He also has asked patrol officers to pay extra attention to 11th Street SE. Upon questioning, the Public Works Director stated 13th Street SE would be reconstructed in 2013 and 37th Avenue SE would be completed in 2014.
