PUBLIC WORKS AND SAFETY COMMITTEE June 26, 2013 Page 1 Members Present: Connole, Hatlelid, Krabseth, Lehner, M. Miller, Withus. Members Absent: Knudsvig. Others Present: City Manager, City Clerk, City Attorney, Finance Director, City Engineer, Assistant City Engineer, Public Works Director, Fire Chief, Police Chief, Police Captain White, Recreation/Auditorium Director, Public Information Officer, City Planner, Assistant City Planner, Traffic Engineer, Building Official, Chuck Barney, Mark Lyman, and Jill Schramm. To the Honorable Mayor and All Aldermen: Following are the recommendations of the Public Works and Safety Committee meeting called to order at 4:15 p.m. on June 26, 2013: 1. That the City Council approve the request from Ryan Hofer to relocate a 40’ x 50’ steel building from 3725 11th Street NE, Coleharbor, ND to 3220 County Road 19 South(Outlot 25 of SW1/4SE1/4 of Section 32-155-82); subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. An adequate foundation in compliance with building codes and zoning ordinances must be furnished at the location. 3. Plumbing, mechanical, and electrical systems must be in compliance with current code requirements. 4. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 5. Permits for all work must be obtained from the City of Minot. 6. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 7. Structure must be placed on a permanent foundation. 8. Work shall be accomplished generally in accordance with the following schedule: a. Foundation to be complete within two months. b. Relocation of structure to be complete within four months. c. All work associated with the request to be complete within six months. d. Work complete and final clean up complete within ten months. ********** The above motion by Alderman Hatlelid, seconded by Alderman Connole, and carried unanimously. That the City Council approve a Memorandum of Understanding (MOU) with the Minot City Transit for evacuation bus services in an emergency, as part of the Ward County Emergency Management Plan, on file in the City Clerk’s Office. ********** The above motion by Alderman Hatlelid, seconded by Alderman Connole, and carried unanimously. 3. That the City Council place and pass an ordinance amending Chapter 1 (General Provisions) of the City of Minot Code of Ordinances to increase the range of fines with respect to driving under the influence charges to the potential amount of $1,500 in certain circumstances, on first reading. ********** The above motion by Alderman Hatlelid, seconded by Alderman Connole, and carried unanimously. 4. That the City Council authorize the Police Department to apply for North Dakota Department of Transportation Traffic Safety Office grants for the overtime enforcement of impaired driving ($17,500), seat belt ($7,000) and underage drinking ($4,200) and radar and patrol car video surveillance equipment (three each) in the amount of $16,500; further, authorize the Police Department to accept any grant funds awarded; and further, authorize the Mayor to sign any grant documentation on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Connole, and carried unanimously. 5. That the City Council declare the bid by J.R. Ferche, Inc. for the Southwest Minot Sanitary Sewer project in the amount of $1,427,794.50, to be the lowest and best bid; and further, authorize the Mayor to sign the contract on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Connole, and carried unanimously. 6. That the City Council authorize the Minot Police Department to apply for a STOP Violence Against Women grant to hire an additional police officer in order for a senior officer to be transferred to the Detective Division to specialize in domestic violence, stalking, and sexual assault cases; further, authorize the acceptance of any grant funds awarded; and further, authorize the Mayor to sign any grant documentation on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Connole, and carried unanimously. Ordinance No. 4655 – Rezoning River Oaks 4th Addition, Block 1, remaining portion of newly described Lot 1, Block 1, Lots 2-18, Block 2, Lots 1-48, and Block 4, Lots 1-13 from AG (Agricultural District) to R-1 (Single-Family Residence District). b. Ordinance No. 4656 – Rezoning River Oaks 4th Additin, Block 3, Lots 1A-19B from AG (Agricultural District) to R-2 (Two-Family Residence District). c. Ordinance No. 4685 – Rezoning Section 4-154-82, Outlot 50 from RA (Agricultural Residence District) to R-1 (Single-Family Residence District). d. Ordinance No. 4697 – Rezoning 55th Crossing 4th Addition, Blocks 4, 9, 10, and 12-14 from R-3 (Multiple-Family Residence District) and C-2 (General Commercial District) to R-1 (Single-Family Residence District). e. Ordinance No. 4698 – Rezoning 55th Crossing 4th Addition, Blocks 2, 8, and 11 from R- 3 (Multiple-Family Residence District) and C-2 (General Commercial District) to R-2 (Two-Family Residence District). f. Ordinance No. 4699 – Rezoning 55th Crossing 4th Addition, Blocks 1, 3, 5 and 7 (Lots 2- 4) from R-3 (Multiple-Family Residence District) and C-2 (General Commercial District) to R-3 (Multiple-Family Residence District). g. Ordinance No. 4700 – Rezoning 55th Crossing 4th Addition, Block 6 and Block 7, Lot 1 from R-3 (Multiple-Family Residence District) and C-2 (General Commercial District) to C-2 (General Commercial District). h. Ordinance No. 4732 – Updating the Zoning Ordinance. i. Ordinance No. 4711 – Rezoning 55th Crossing 2nd Addition, Blocks 1-3 from AG (Agricultural District) to R-2 (Two-Family Residence District). j. Ordinance No. 4730 – Rezoning Magic City Walmart, Lots 1-3 from AG (Agricultural District) to C-4 (Planned Commercial District). ********** The above motion by Alderman Hatlelid, seconded by Alderman Connole, and carried unanimously.
