Following are the recommendations of the Public Works and Safety Committee meeting called to order at 4:15 p.m. on
May 27, 2015 by Alderman Lehner:
1. The Public Works Committee forwarded the item concerning the bid for Water/Sewer Department
Building Expansion without a recommendation due to a late bid opening. (4060)

2. The City Council approve the plans and specifications for Dakota Square Pump Station, authorize a
call for bids, adopt a resolution establishing compliance with reimbursement bond regulations under the
internal revenue code officially declaring the intent to finance the project by issuing tax-exempt bonds. (4030)

3. The City Council approve the request from Chad Kerston of 1715 19 th Ave NW to move a 22’ X 30’
detached garage from Serene Addition Lot 7 Block 6 also known as 24 7 th St SW Minot, ND to Prairie View
Estates Second Addition Lot 1 also known as 1715 19 th Ave NW Minot, ND under the following conditions:
A $10,000 completion bond must be posted with the City of Minot prior to issuance of any permits
for this work.
Building permits for all proposed construction
An approved foundation design in compliance with City of Minot building codes.
The plumbing and electrical systems must be brought into compliance with current code
requirements of the City of Minot.
All work at the new location must be in compliance with the City of Minot building codes and zoning
ordinances.
Egress windows must be installed in the basement and all sleeping rooms.
Smoke detectors must be installed in the basement, in each bedroom, and in areas immediately
outside bedrooms.

5. City of Minot Zoning Ordinance, Section 23-1 states that “All off-street parking spaces and all
driveways on private property leading to such parking areas shall be all-weather hard surface

this work.

S/D Lot 3 Block 13, Lot 1 Block 1, also known as, 824 7th Ave NW Minot, ND under the following conditions:
A $10,000 completion bond must be posted with the City of Minot prior to issuance of any permits

7. The City Council ratify the application by the Minot Police Department and authorize acceptance if
awarded the 2015 United States Department of Justice (USDOJ) – Bulletproof Vest Partnership Grant.

8. The City Council ratify the application by the Minot Police Department Bomb Team and authorize
the acceptance if awarded the NDDES FY 2015 SHSP Regional Response Team Grant for the purchase of an
XTK Grid X-ray System ($5,000) and replace the bomb team’s aging Heavy Response Vehicle ($200,000),
tuition and expenses to send 5- team members to AT Solution Hand Entry Course ($26,000), and expenses for
2- members to attend FBI Hazardous Devices School Basic Training ($13,000).

9. The City Council ratify the application by the Minot Police Department and authorize acceptance if
awarded the 2015 North Dakota Office of the Attorney General Criminal Justice Oil Impact Grant.

10. The City Council approve the engineering amendment with Houston Engineering for the HMPG
Water Plant Flood Protection – Phase 1 project (3673); and authorize the Mayor to sign the amendment on
behalf of the City.

11. The City Council approve the award of contract for the purchase of the RouteMatch Intelligent
Transportation System (4108); and further authorize the Public Works Director to accept the proposal and to
sign any associated contracts and agreements pertaining to this project.

12. The City Council approve the contract amendment with CPS for the additional services for the
Landfill Master Plan; and further authorize the Mayor to sign the contract on behalf of the City.

13. The City Council require property owners with THU’s to have the units moved by the June 1, 2015
deadline; and further authorize the City to file criminal complaint(s) after July 1, 2015, against those
property owners who do not comply.

Deb Luetzen of 720 2nd Ave NE indicated she is almost done with property. She cannot be done by June 1, 2015 but
should be able to complete it by July 1, 2015.
At 4:20 pm Alderman Connole entered the meeting.
Paula Leier La Rocque of 2109 1st Ave SW appeared on behalf of her mother. She indicated the THU will be
removed but not by June 1, 2015. She is in the process of selling the unit.
Kelsey Slauter of 805 2nd Ave NE stated his house is now on foundation. He is currently working on electrical and
putting in windows. He will not have THU moved by June 1, 2015. The THU has been arranged to be sold but will
need another 2 months to complete home.
Upon questioning by Alderman Jantzer, the City Planner stated she has contacted some local plumbers and
electricians with regard to volunteering to help complete some of the houses. She has not received any
commitments from individuals at this time. She stated she included this information in her report in an effort to
have others reach out to those who may be able to assist.
14. Informational –
The Public Works Director appeared before the committee to give an overview of GPS tracking software currently
being tested in some of the department vehicles. This software will give detailed tracking information of the vehicles
at all times. The Public Works department receives a lot of citizen calls concerning missed/late garbage pick-up and
snow removal. These units will report data that will be accessible to the public on the city website indicating where
the vehicles are in the route. The GPS units are portable and can be interchanged with other vehicles. He stated he
will be including a request to purchase some of the units in the 2016 budget.
The City Manager stated the updated City website will have a link to the GPS tracking.

1. Award of Bid – Water/Sewer Department Building Expansion (4060)
On Wednesday, May 27, 2015, bids will be opened for the Water/Sewer Department Building Expansion project.
Due to the timing of the bid opening, a recommendation will be placed on the Committee’s desk.
2. Approve Plans and Specifications – Dakota Square Pump Station Rehab (4030)
Houston Engineering has finished the design to rebuild this pump station with only minor staff comments to address.
This project will replace old outdated electrical switchgear and replace pumps to better serve the South Hill Distribution
system. The plan set is now in a position to go out for bids.
Fiscal Impact: The engineer’s estimate for the construction portion of this project is $882,000. The project was
identified in the 2015 CIP and will be paid for with funds from utility bonds.
It is recommended the Committee and Council approve the plans and specifications for this project, authorize a call for
bids, adopt a resolution establishing compliance with reimbursement bond regulations under the internal revenue code
officially declaring the intent to finance the project by issuing tax-exempt bonds.
3. Building Relocation Request – Chad Kerston – 1715 19th Ave NW
The City has received a request from Chad Kerston of 1715 19th Ave NW to move a 22’ X 30’ detached garage from
Serene Addition Lot 7 Block 6 also known as 24 7 th St SW Minot, ND to Prairie View Estates Second Addition Lot 1
also known as 1715 19th Ave NW Minot, ND.
The detached garage has vinyl lap siding, 16’ overhead door, 1 walk-in door and 2 windows. The garage has a gable roof
with asphalt laminate shingles. The interior is finished with sheetrock on the walls and metal on the ceiling. The garage
was built in 2013 and therefore did not get flooded from the 2011 flood event. The overall condition of the detached
garage would be considered average to above average. The 22’ X 30’ detached garage to be moved is of similar design
and construction as if it were built on site. The immediate area of northwest Minot consists of a variety of types of homes
from 1 story, bi-level, condominiums, and even a few 2 story homes. A number of the homes located in the immediate
area currently have oversized yard sheds, with some neighbors having a 2 nd garage located on their lot. If the garage is
moved to this location and the siding was re-done to match the existing home it may be difficult to distinguish it apart
from those garages that were built on site.
It is the opinion of the City of Minot Assessor’s Office that this structure is compatible with the area, if the siding is
replaced to match the house. Pictures of the exterior of these structures and a plot plan of their proposed locations are
attached to the moving permit application. These structures have had all required inspections conducted by the
Assessor’s Department and the Building Inspection Department.
If this relocation request is approved, it is recommended it be subject to the following conditions:

The City has received a request from Ardell Haugen of 6930 28th Ave SE to move a 2008 year built, 1,273 square foot
single family residence from 614 Forest Rd Minot, ND to 6930 28 th Ave SE Minot, ND.
The building to be moved is a 2008 year built 1,273 square foot single family residence. The home was flooded in the
2011 flood and has since been repaired. The home is a 2 bedroom, 1.75 bathroom dwelling with asphalt shingles, wood
frame construction, and exterior vinyl siding. The home is located in Minot and a photo is provided by the property
appraiser. The home to be moved to this location is to be attached to a permanent foundation according to the Minot
Building Inspection department specifications. The information provided by the homeowner indicates the home will be
placed on a permanent concrete basement foundation.
The area that is under consideration for the moving application is 6930 28 th Ave SE Minot, ND 58701, also known as
Haugen 2nd addition lots 1 & 2. The proposed moving location is a rural setting with several homes along the main road
which is 72nd St SE. This structure is going on a lot just to the east of the owner’s current residence. There are two other
properties along this road which is 28th Ave SE. One is the owner’s current residence which is just west of the proposed
moving location. The other is a neighboring farmstead just west of the owner’s current residence.
It is the opinion of the City of Minot Assessor’s Office that this structure is compatible with the area. Pictures of the
exterior of these structures and a plot plan of their proposed locations are attached to the moving permit application.

The City has received a request from Clay Burns of 824 7th Ave NW to move a 1968 year built, 1,280 square foot single
family residence from 716 Forest Rd Minot, ND to 824 7 th Ave NW Minot, ND.
The building to be moved is a 1968 year built 1,280 square foot single family residence. The home is a 3 bedroom, 1.5
bathroom dwelling with asphalt shingles, wood frame construction, and exterior composition siding. The home is
located in Minot and a photo is provided by the property appraiser. The home to be moved to this location is to be
attached to a permanent foundation according to the Minot Building Inspection department specifications. The
information obtained from the property owner indicates the home will be placed on a permanent concrete basement
foundation. The previous structure that was on the proposed site had been built in 1928, and had 816 square feet above
ground as well as a detached garage measuring 20 X 20. Both of these previous structures have been demolished since
the 2011 flood. The area that is under consideration for the moving application is 824 7th Ave NW, also known as North
Minot Addition Bryn Mawr S/D Lot 3 Blk 13 Lot 1 Block 1. The assessed values within a three house radius of the
proposed moving location range from approximately $99,000 to $278,000 on the 800 block of 7th Ave NW. It would
appear that most of the properties in the immediate area have been repaired since the 2011 flood. It is the opinion of the
City of Minot Assessor’s Office that this structure is compatible with the area.
Pictures of the exterior of these structures and a plot plan of their proposed locations are attached to the moving permit

The building to be moved is a 2003 year built 16’ X 24’ 384 square foot detached garage that was in the 2011 flood but
has since been cleaned out. The garage is wood frame construction with asphalt shingles, and exterior steel siding. The
garage is located in Minot and a photo is provided by the property appraiser. The garage to be moved to this location is
to be attached to a permanent foundation according to the Minot Building Inspection department specifications. The
information submitted with the moving application indicates the garage will be placed on a permanent concrete floating
slab foundation and is intended to go in the back yard. The proposed site currently has a single family home sitting on
the lot, which is a 1927 year built 928 square foot above ground house. The home on the lot has been repaired since the
2011 flood and is currently a single family rental unit. The area that is under consideration for the moving application is
822 7th Ave NW, also known as North Minot Addition Bryn Mawr S/D Lot 3 Blk 13 Lot 2 Block 1. The assessed values
within a three house radius of the proposed moving location range from approximately $99,000 to $278,000 on the 800
block of 7th Ave NW. It would appear that most of the properties in the immediate area have been repaired since the
2011 flood. It is the opinion of the City of Minot Assessor’s Office that this structure is compatible with the area.
Pictures of the exterior of these structures and a plot plan of their proposed locations are attached to the moving permit
application. These structures have had all required inspections conducted by the Assessor’s Department and the Building
Inspection Department.
If this relocation request is approved, it is recommended it be subject to the following conditions:
A $10,000 completion bond must be posted with the City of Minot prior to issuance of any permits for this
work.
Building permits for all proposed construction
An approved foundation design in compliance with City of Minot building codes.
The plumbing and electrical systems must be brought into compliance with current code requirements of the
City of Minot.

All work at the new location must be in compliance with the City of Minot building codes and zoning
ordinances.
Egress windows must be installed in the basement and all sleeping rooms.
Smoke detectors must be installed in the basement, in each bedroom, and in areas immediately outside
bedrooms.
There must be fire resistive wall and door between the house and attached garage.
The exterior of the structure must be one consistent color or scheme of colors and relocation.
Applicant must obtain all necessary permits, and coordinate all relocation activities with public utilities and
traffic authorities.
The property must be provided with proper drainage, and must be landscaped in a manner similar to
surrounding properties.
All work must begin within 30 days of issuance of moving and building permits and completed within ten
months of start date and generally in accordance with the following schedule.
1. Foundation complete within two months.
2. Structure relocated within four months.
3. Work required for code compliance complete within six months.
4. All proposed construction and final clean up complete within ten months.
5. City of Minot Zoning Ordinance, Section 23-1 states that “All off-street parking spaces and all driveways on
private property leading to such parking areas shall be all-weather hard surface material. Acceptable surfacing
materials include asphalt, concrete, brick, cement pavers or similar materials installed and maintained
according to industry standards.”
7. FY2015 United States Department of Justice (USDOJ) – Bulletproof Vest Partnership Grant
The Minot Police Department requests ratification of the application and authorization to accept, if awarded, the 2015
United States Department of Justice (USDOJ) – Bulletproof Vest Partnership Grant. This has been an ongoing annual
grant program which pays 50% of qualified bulletproof vest purchases. The Police Department anticipates the need for
18 new and replacement vests (estimated cost $12,897). The maximum amount reimbursed by this grant would be
$6,448.50.
Fiscal Impact: Funds provided in this grant require a 50% local match. This match would be paid from the Police
Department’s Operations budget.
It is recommended the Committee and Council ratify the application by the Minot Police Department and authorize
acceptance if awarded the 2015 United States Department of Justice (USDOJ) – Bulletproof Vest Partnership Grant.
8. North Dakota Department of Emergency Services (NDDES) FY 2015 State Homeland Security Program
(SHSP) Regional Response Team Grant for the Minot Police Department Bomb Team
The Minot Police Department Bomb Team has applied for the NDDES FY 2015 SHSP Regional Response Team Grant
for equipment and training in the amount of $244,000. They have requested grant funding to purchase an XTK Grid X-
ray System ($5,000) and replace the bomb team’s aging Heavy Response Vehicle ($200,000). In addition they requested
funding for tuition and expenses to send 5- team members to AT Solution Hand Entry Course ($26,000) and expenses for
2- members to attend FBI Hazardous Devices School Basic Training ($13,000). The application deadline was May 1,

Fiscal Impact: NDDES grant payments are reimbursements to the fiscal authority. No matching funds are required.
It is recommended the Committee and Council ratify the application by the Minot Police Department Bomb Team and
authorize the acceptance if awarded the NDDES FY 2015 SHSP Regional Response Team Grant for the purchase of an

9. 2015 North Dakota Office of the Attorney General Criminal Justice Oil Impact Grants – Minot Police
Department
The Minot Police Department is requesting ratification of the application and authorization to accept, if awarded, the
2015 North Dakota Office of the Attorney General Criminal Justice Oil Impact Grant. The Police Department has applied
for funding to hire a full time evidence technician to assist records staff with evidence/property duties, retain a part time
community service officer/court bailiff position, and purchase a Cellebrite Universal Forensic Extraction Device and lab
quality evidence storage refrigeration units.
Fiscal Impact: The total cost of the proposal is $201,079.53. The grant is for 90% or $180,971.58. The 10% cash match
of $20,107.95 will come from the Minot Police Department budgeted funds.
It is recommended the Committee and Council ratify the application by the Minot Police Department and authorize
acceptance if awarded the 2015 North Dakota Office of the Attorney General Criminal Justice Oil Impact Grant.
10. HMGP Water Plant Flood Protection – Phase I (3673)
The City was awarded HMGP funding for the design and environmental permitting portion of the water plant flood
protection in 2013.
The City currently has a design contract with Houston Engineering for $1,957,828.34 which is approximately 8.3% of
the estimated construction cost for the floodwall project to protect the water plant and high service NAWS pump station.
Over the past several months, as the design was coming to completion, there have been several items of additional work
not estimated during the preliminary application and cost estimate. A few of these items were, extension of floodwall
length along 8th avenue in lieu of levees due to space constraints, internal storm water modeling chlorine modifications
at the water plant to meet drinking water requirements if surface water is treated, as well as UV addition for disinfection.
There were also additional requirements and meetings as well as design issues to meet the USACE 408 permitting
process, USACE design criteria and cultural investigations for the Environmental Assessment requirements to meet
EPA’s criteria, and address the prolonged time frame of meeting the FEMA requirements. In addition permitting with
BNSF has been a long process.
Houston is asking for additional cost for design engineering due to the above requirements. The additional costs would
amount to $280,907.66 or a revised design engineering contract cost of not to exceed $2,242,736.00. The revised
engineer’s estimate of cost for construction of this project with all additional work is now estimated to be $23,603,900.
The revised engineering cost would be 9.5% of construction, which is under our allowable rate of 11% approved by
council.
Fiscal Impact: This project is funded with 75% FEMA funds, 10% NDDES funding and a local match of 15%, which
was budgeted in the water plant budget.
It is recommended the Committee and Council approve the engineering amendment with Houston Engineering for the
HMPG Water Plant Flood Protection – Phase 1 project (3673); and authorize the Mayor to sign the amendment on behalf
of the City.

11. Award of Contract for Purchase of RouteMatch Intelligent Transportation System (4108) (BUS015)
The City is requesting permission to enter into a contract with RouteMatch Software for the purpose of purchasing a
fixed route intelligent transportation system for the bus department.
This ITS would provide real time Automatic Vehicle Location for the transit buses and allow that information to be
passed on to customers via websites, smartphones, tablets etc. It would also provide automatic stop announcements,
passenger counts and other information vital to evaluating the performance of each bus route, or even portions of bus
routes. This software would also allow coordination with Souris Basin Transportation’s demand response and para
transit service to provide better coordinated transit options to the citizens of the City of Minot and the surrounding area.
Fiscal Impact: This purchase would be 80% funded through a Veterans Transportation and Community Living Initiative
grant. This grant has already been obtained by the City of Grand Forks in partnership with the North Dakota Department
of Transportation to provide RouteMatch software to transit agencies statewide. The grant contract is being administered
by the City of Grand Forks. The invoice will be paid initially by the City of Grand Forks and they will invoice the City
of Minot for our required 20% matching funds. The total cost of this system would be $246,441. The total cost to the
City would be $49,289. These matching funds were approved in the 2015 budget.
It is recommended the Committee and Council approve the award of contract for the purchase of the RouteMatch
Intelligent Transportation System (4108); and further authorize the Public Works Director to accept the proposal and to
sign any associated contracts and agreements pertaining to this project.
12. Landfill Master Plan – Contract Amendment #2 – CPS (3700)
For the past year the City of Minot has been working with the consulting firm CPS to update their City Landfill Master
Plan. The City has also been trying to negotiate the purchase of additional land for expansion of the landfill since the
remaining life is approximately 10-12 years. CPS has not been able to negotiate a land purchase with any of the adjacent
landowners. As a part of state requirements, when a landfill is close to 10 years of remaining life, the state wants a plan
to address future expansion possibilities.
The first part of this contract would assess the existing waste in the trenches, determine a quantity, and determine if
reclaiming is a feasible alternative with the State Health Dept. CPS has provided an estimated contract cost for
completing an expansion plan as part of our landfill master plan update of $246,540.
The reclaimed areas would then be constructed with clay liners and plastic liners to meet the current state standards for a
landfill disposal area. If in the initial investigation process, it is determined for some reason this option is not acceptable
or viable the entire $246,540 would not be used and the contract would be terminated with CPS. The Public Works
Director believes this to be a viable option in lieu of purchasing additional land or relocating the landfill to an alternate
site.
Fiscal Impact: City staff has proposed the contract amendment be funded with remaining CDBG-DR funds dedicated to
landfill master planning and state land grant funding that was dedicated to the landfill expansion.
It is recommended the Committee and Council approve the contract amendment with CPS for the additional services for
the Landfill Master Plan; and further authorize the Mayor to sign the contract on behalf of the City.

13. Remaining THU’s (Temporary Housing Units)
On October 7, 2013 and November 4, 2013, Minot City Council passed Resolutions (3239 and 3254) allowing all
remaining THUs to be maintained on private property until June 1, 2014. On February 2, 2015, the City Council passed
Resolution 3389 granting another extension for THUs. The resolution allowed property owners to violate Section 29-8
(a, 1-3) and (b) of the City of Minot Zoning Ordinance up until the June 1, 2015 date. On April 21, 2015, the Public
Works and Safety Committee were given a list of THUs that remain on private property.
Code Violations:
Section 29-8 of the City of Minot Zoning Ordinances prohibits structures from being used as a permanent residence
unless it is served by approved (1) a potable water supply; (2) sanitary sewage system; and (3) sufficient heating unit.
Because the THU is considered a temporary structure, its connections do not meet the City of Minot zoning code or the
Minot City Specifications relating to the installation of sewer and water utilities. Also, if a property owner uses the THU
as a permanent residence for thirty (30) days in a twelve (12) month time period, they are in violation of Section 29-8 of
the Zoning Ordinance.
For some of the properties zoned R1, Section 5-5 of the City of Minot Zoning Ordinances allows accessory dwelling
units by way of a conditional use permit. FEMA trailers, however, do not meet the minimum requirements for this type of
structure since they are, among other things, detached structures. With that, property owners currently maintaining a
THU on any property zoned Residential are also in violation of section 4-1 of the City of Minot Zoning Ordinances since
they are using a structure that is only permitted in MH (Manufactured Home) districts.
Therefore, the Planning Department will take the following steps to ensure the removal of the THUs:
Certified letters will be sent informing the property owners that the temporary connections previously issued by the City
of Minot Public Works Department are no longer acceptable, therefore, the THU cannot be used as a permanent
residence as defined by section 29-8 of the City of Minot Zoning Code. The letters will also address any other applicable
zoning violation. The letters will be a final notice to specifically require that the THU be removed by July 1, 2015.
If the THU is not removed by July 1, 2015, a criminal complaint(s) will be filed with the Minot Police Department and
prosecution will be requested for violating section 29-8 and/or section 4-1 of the City of Minot Zoning Ordinances.
Maximum penalty for each violation is a $1,500 fine and 30 days in the Ward County Jail; punishment can also include
orders to remove the THU from the property immediately. It should also be noted that each day a violation occurs
constitutes a separate violation.
Or, in visiting with many of these individuals, it appears that by finding skilled volunteers and some materials, 5 of these
final 7 individuals could be back in their homes in the coming months. Connection to the Plumbers Union and
Electricians Union may produce some volunteer hours that could be of great assistance. Connection with the Minot
Association of Builders and the local Contractors groups could also help in what I believe could be the best option for
these properties that still contain THU’s. These individuals are willing to take this assistance. Below is the list of
