The City Council approve the request from Amy Jenkins to move a single family dwelling from S2S2SENE & N2N2NESE S6-154-83 also known as 4500 62nd St SE to North Minot Addition S/D of block 14, lot 10 block 2 also known as 834 University Ave W under the following conditions:  A $10,000 completion bond must be posted with the City of Minot prior to issuance of any permits for this work.  Building permits for all proposed construction  An approved foundation design in compliance with City of Minot building codes.  The plumbing and electrical systems must be brought into compliance with current code requirements of the City of Minot.  All work at the new location must be in compliance with the City of Minot building codes and zoning ordinances.  Egress windows must be installed in the basement and all sleeping rooms.  Smoke detectors must be installed in the basement, in each bedroom, and in areas immediately outside bedrooms.  There must be fire resistive wall and door between the house and attached garage.  The exterior of the structure must be one consistent color or scheme of colors and relocation.  Applicant must obtain all necessary permits, and coordinate all relocation activities with public utilities and traffic authorities.  The property must be provided with proper drainage, and must be landscaped in a manner similar to surrounding properties.  All work must begin within 30 days of issuance of moving and building permits and completed within ten months of start date and generally in accordance with the following schedule. 1. Foundation complete within two months. 2. Structure relocated within four months. 3. Work required for code compliance complete within six months. 4. All proposed construction and final clean up complete within ten months. 5. City of Minot Zoning Ordinance, Section 23-1 states that “All off-street parking spaces and all driveways on private property leading to such parking areas shall be all-weather hard surface material. Acceptable surfacing materials include asphalt, concrete, brick, cement pavers or similar materials installed and maintained according to industry standards.” ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE July 1, 2015 Page 2 ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 2. The City Council pass the proposed amendments to section 23-34; addition of 23-34.1 and 23-34.2 regarding the Marijuana Ordinance thereby updating and becoming current with state law. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 3. The City Council ratify the application by the Minot Police Department and authorize acceptance if awarded the 2015-2016 NDDOT Traffic Safety Enforcement Grant. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 4. The City Council approve the request and authorize the City Attorney to prepare individual sidewalk encroachment permits for downtown businesses as requested subject to the following: 1. That the permit contains the usual language protecting the City from any liability that may result from the encroachment. 2. That the applicant pays a processing fee of $100. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 5. The City Council pass an ordinance to restrict parking on 21st Ave NW between 8th St NW and 12th St NW ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 6. The City Council pass an ordinance to change 5th Ave SE from 11th St to 9th St to a One-Way street westbound. Also, to restrict parking on the south side of 5th Ave from 11th St to 10th St to a No Parking Loading Zone during school days. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 7. The City Council pass the proposed amendments to section 18-196 to Division 11 (Sexually Oriented Business) of Article III (Specific Businesses and Occupations) of Chapter 18 (Licenses and Business Regulations) of the City of Minot Code of Ordinances ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE July 1, 2015 Page 3 8. The City Council pass the Resolution in support of the efforts by MDA for the Fill the Boot Campaign for the Minot Fire Department and further authorize the Mayor to sign the Resolution. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 9. a. The City Council award the bid for the Public Works, Shop, Street Building Expansion (3884, 3884.1), to Rolac Contracting in the Amount of $2,831,200 for the base bid and alternate #4 welding room expansion and also that an additional $250,000 be made accessible if needed from second penny sales tax infrastructure, should unforeseen circumstances require this funding be needed. b. The City Council reject all bids for the Water, Sewer Department Building Expansion (4060) and authorize the Public Works Director to re-advertise and re-bid this project at a later date. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 10. The City Council adopt the proposed fee increase to offset inspection costs for gas line permits and to be within a standard fee limit. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 11. The City Council ratify the application by the Minot Police Department and authorize acceptance if awarded the 2015 Byrne JAG grant. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 12. The City Council award the bid for sander bodies (3875.1) for the Street Department to Custom Truck Equipment Inc. for the two Henderson FSH II sand spreaders in the amount of $64,448 and further authorize the mayor to sign the contracts. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 13. The City Council award the bid for Flood Damaged Guardrail (4110) to Dakota Fence in the amount of $58,939 and further authorize the mayor to sign the contracts. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 14. The City Council award the bid for the Perkett, Muus, and 16th St Lift Station Rehab (4010) to CC Steel Inc. in the amount of $317,800 and further authorize the mayor to sign the contracts. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE July 1, 2015 Page 4 15. The City Council pass a resolution waiving the temporary building permit fee for non-profit organizations. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 16. The City Council pass an ordinance amending Section 9-113.8 Temporary Structures as shown on the attached proposed ordinance. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 17. The City Council accept EMC Insurance’s offer of 90% with regards to the damage incurred in a car accident involving City employee’s on January 9, 2015. ********** The above motion by Alderman Lehner, seconded by Alderman Schuler, and carried unanimously. 18. The City Council approve the request by Amy Jenkins for a 3 year tax exemption for improvements made to a single family dwelling moving to 834 University Ave W. The City Assessor stated that the exemption is available to qualifying applicants by state code. The idea of the tax exemption is to allow relief on structures that are going through rehabilitation. Alderman Lehner asked if the work needs to be completed in the 3 year time frame. The City Assessor responded that the property will be regularly reviewed and the exemption will be applied on the portions that are complete. Upon questioning by Alderman Schuler, the City Assessor confirmed the land is fully assessed. The structure is the only part eligible for exemption. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 19. Informational – First District Health Unit Presentation on the North Dakota Strategic Prevention Framework State Incentive Grant to address binge drinking and underage drinking. Lori Bierley, a representative from the FDHU appeared before the Committee to review the current strategies involved with the grant. Those strategies include compliance checks of alcohol retailers, responsible beverage server training, enhanced enforcement and teen party ordinance. Ms. Bierley provided some statistics on North Dakota with regard to drinking and vehicle fatalities. She stated North Dakota has the highest percentage of fatalities that involve alcohol. She explained ND is also first in the nation with regard to beer consumption, spirits and binge drinking. Sergeant Margie Zietz of the Police Department said she has been working with the FDHU to assist with instruction of bar servers. She stated the class has been completed by 180 bartenders and servers. The bar owners in Minot have been very cooperative in sending servers to training. She indicated there has also been significant progress with compliance checks.
