PUBLIC WORKS AND SAFETY COMMITTEE September 2, 2015 Page 1 Members Present: Connole, Hatlelid, Berg, Jantzer, Lehner, Schuler, Shomento Members Absent: None Others Present: City Manager, City Clerk, Clerk Admin., City Attorney, City Assessor, Assistant City Assessor, Finance Director, Assistant City Engineer, Fire Chief, Police Chief, Public Works Director, Auditorium/Recreation Director, Public Information Officer, Alderman Olson, Mark Lyman, Jill Schramm, Mike Ward, Larry Holbach, Dave Schwengler, Bruce Walker To the Honorable Mayor and All Aldermen: Following are the recommendations of the Public Works and Safety Committee meeting called to order at 4:16 p.m. on September 2, 2015: 1. The City Council approve the contract amendment with SRF Consulting for the Oak Park Bridge Replacement engineering services and authorize the Mayor to sign the amendment. (4032) ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 2. The City Council approve the contract amendment from KLJ for the 37th Ave SE Reconstruction Project and authorize the Mayor to sign the amendment. (3647) ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 3. The City Council place and pass the proposed Ordinance amendments relating to Section 9-12 Administrative Search Warrants. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 4. The City Council approve the corrected contract amendment for CPS for the Landfill Master Plan in the amount of $254,460. (3700) ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 5. The City Council approve the request from Kimble Osteroos to move a single family dwelling from 1030 5th Ave SW to North Minot Addition N50 S100 Lot 6 Block 1, also known as 710 3rd St NW under the following conditions: • A $10,000 completion bond must be posted with the City of Minot prior to issuance of any permits for this work. • Building permits for all proposed construction PUBLIC WORKS AND SAFETY COMMITTEE September 2, 2015 Page 2 • An approved foundation design in compliance with City of Minot building codes. • The plumbing and electrical systems must be brought into compliance with current code requirements of the City of Minot. • All work at the new location must be in compliance with the City of Minot building codes and zoning ordinances. • Egress windows must be installed in the basement and all sleeping rooms. • Smoke detectors must be installed in the basement, in each bedroom, and in areas immediately outside bedrooms. • There must be fire resistive wall and door between the house and attached garage. • The exterior of the structure must be one consistent color or scheme of colors and relocation. • Applicant must obtain all necessary permits, and coordinate all relocation activities with public utilities and traffic authorities. • The property must be provided with proper drainage, and must be landscaped in a manner similar to surrounding properties. • All work must begin within 30 days of issuance of moving and building permits and completed within ten months of start date and generally in accordance with the following schedule. 1. Foundation complete within two months. 2. Structure relocated within four months. 3. Work required for code compliance complete within six months. 4. All proposed construction and final clean up complete within ten months. 5. City of Minot Zoning Ordinance, Section 23-1 states that “All off-street parking spaces and all driveways on private property leading to such parking areas shall be all-weather hard surface material. Acceptable surfacing materials include asphalt, concrete, brick, cement pavers or similar materials installed and maintained according to industry standards.” ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 6. The City Council approve the two easements requested by SRT on airport property and authorize the Mayor to sign the easements. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 7. The City Council approve the amendment with Houston Engineering for construction engineering services on the HMGP Water Plant Flood Protection Project and authorize the Mayor to sign the amendment on behalf of the City. (3673) ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 8. The City Council approve contract amendment 3 with HMjv for downtown infrastructure improvements engineering services, approve the use of general obligation, refunding improvement and water and sewer bonds to pay for costs and further authorize the Mayor to sign the amendment. The City Council allow Park South Development to construct a detention pond and lift station on Lot 2 of Rosehill Cemetery 2nd Addition. (4135) ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 10. The City Council award the bid to Gravel Products for $14.98/ton for sand for the 2015-2016 winter operations. (4128) ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 11. The City Council award the bid to H & H Trucking for $63.89/ton for salt for 2015-2016 winter operations. The total for the 600 tons is $38,334. (4127) ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 12. The City Council place and pass the following ordinances on second reading: a. Ordinance No. 4994 – Rezoning Skyport 11th Addition, Lots 1 & 2 b. Ordinance No. 4997 – Library RFID Inventory Machine c. Ordinance No. 4996 – Conditional Uses of the CMCO as it relates to Clinics ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 13. The City Council approve the request to use the City Auditorium as the transit transfer location beginning October 1, 2015. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 14. To pass to City Council, the relocation request from Kevin Beck to move an 8 stall garage to 1805 2nd St SE, without recommendation until staff can verify if the structure is allowed in the current zoning. Acceptable surfacing materials include asphalt, concrete, brick, cement pavers or similar materials installed and maintained according to industry standards.” Alderman Hatlelid moved the Committee recommend City Council approve the item for relocation, seconded by Alderman Lehner Alderman Connole stated he had several residents from the neighborhood call with concerns of where this structure was being located. He had concerns the location was not zoned properly. Kevin Beck, representing Assembly of God Church stated the church grounds are zoned R1. He said the intended use for this structure was for storage of props and lawn equipment. The Assistant City Engineer stated R1 zone allows for 2 storage sheds or accessory units on the property. She will review the ordinance by the end of the week to make sure the lot size is sufficient for the structure. Alderman Schuler stated she has concerns with this new structure looking like a commercial storage unit. She inquired as to how many doors the structure has. Mr. Beck confirmed the garage is one large structure with 8 doors. Jim Lee, Deacon Trustee for Assembly of God, stated the church previously owned Twin Villas which has 10 garages. The structure to be relocated is similar and should be acceptable. Alderman Lehner explained that Twin Villas is a multi –unit residential property which is probably zoned commercial to allow for multiple garages. Whereupon Alderman Lehner amended the motion to pass the request to Council without recommendation until staff verifies needed information. Motion seconded by Alderman Hatlelid and carried unanimously. 15. The City Council confirm the requirement for sidewalks at 3012 8th St NW. Alderman Lehner moved the Committee recommend the City Council confirm the requirement for sidewalks at 3012 8th St NW. Motion seconded by Alderman Hatlelid. Mike Ward, representing Tammy and Robert Hodge of 3012 8th St NW, appeared to protest the requirement for sidewalks at the location. Mr. Ward stated the owners were currently in litigation with the contractor over the existing portion of sidewalk which is sunken. PUBLIC WORKS AND SAFETY COMMITTEE September 2, 2015 Page 5 The Assistant Engineer stated letters were sent out to 30 home owners to address sidewalk deficiencies. City staff cannot waive the requirement and the ordinance states sidewalks must be constructed to the full property line. Mr. Ward stated he would like the requirement to be delayed until the legal issue is resolved. The owner is willing to put a clause that if sold, the property needs to have sidewalks. Alderman Lehner stated his concern on the legality of the clause which would force the next property owner to put in sidewalks if it is not already done. The Assistant City Engineer stated she was informed by Mr. Hodge, they would respond to the letter by September 15th. Chairman Connole stated Council has not given a variance to the sidewalk requirement. He believes this should go through as it is already required to happen. Alderman Schuler suggested the Hodge’s put in the required sidewalk and pour a temporary connection to level the sunken area for safety concerns. The City Manager explained this issue has come up twice in the last two months. The intention is to provide sidewalks to the citizens throughout the community. The City wants citizens to have safe sidewalks to commute and not require they walk in the street. He stands firm with the engineering department on the sidewalk requirement. Whereupon a vote was taken on the motion by Alderman Lehner, seconded by Alderman Hatlelid and carried unanimously. 16. Informational Item- Orders of demolition on flood damaged structures Alderman Schuler indicated she is very happy to see a property demolition list as one of the properties is nearby her. The City Manager said he will provide pictures of the properties to be demolished at the September 8th City Council meeting.
