September 5, 2012 ACTION: Approved as submitted. ***End of Consent Agenda*** PUBLIC COMMENTS None. PUBLIC APPEARANCE 2. Consider 1064 Harrison Street; Tree Removal Appeal 12-232 for Removal of an Oak Tree; Applicant/Owner Todd and Marianne Bartos; R-1-6 Zoning District; Exempt from CEQA Requirements. ACTION: Continued the item to allow the applicant an opportunity to submit a driveway permit. Architectural Review Committee Minutes Wednesday, September 19, 2012 Staff Presentation/Committee Member Questions: Forrest Ebbs presented the Agenda Report and along with City Forester Reid, answered Committee Members questions. Applicant: Todd Bartos gave a brief description of the project and expressed concern that if the tree removal is not approved, off street parking will be a constraint. He said the street is narrow and his property is one of the few properties on Harrison that does not have a driveway. He also said he did not want to consider moving the driveway because it would create asthetic concerns if a garage was added in the future. Marianne Bartos also expressed concern that moving the driveway would place it in the same path as the front door. Public Comments: None. Committee Member Comments: Vice Chair Hill said the Committee has not been provided sufficient evidence that the tree should be removed. In answer to Chair Dawson's question regarding the number of street-side parking spaces available in front of the property, Mr. Ebbs said there are two spaces. Mr. Ebbs informed the Committee that the tree removal application could be deferred until the applicant submits a driveway application so the Committee is provided the appropriate information necessary to make a decision on the matter. Committee Member Jacoubowsky said without a scale drawing of the property depicting the location of the trees in question, a tree removal cannot be granted. Committee Member Bartram made a motion to adopt a Resolution denying the tree removal request and direct the applicant to come back with a complete package that includes a request for parking. He also suggested the applicant consider a different approach to their project and seek advice from staff. Chair Dawson seconded the motion. Committee Member Davis suggested continuing the project to allow the applicant an opportunity to return to the Committee with a complete package. Committee Member Latasa said he will not support the motion and sufficient evidence has been submitted to support approval of the applicants request to remove the tree. The Committee had a discussion regarding the impact of the expense to the applicant to either continue the item or deny it with the direction to return to the Committee with a new application. Mr. Ebbs suggested the Committee continue the item. Committee Member Latasa suggested removing the contingency that approval is pending a parking permit. Committee Member Jacoubowsky suggested the applicant consider using open paving stones rather than concrete and the driveway should be moved to the left side of the property to avoid cutting the tree down. 2  Architectural Review Committee Minutes Wednesday, September 19, 2012 Vice Chair Hill encouraged the applicant to consider future plans for the project if a garage will be added to the site. Committee Member Bartram withdrew his motion and made a new motion to continue the item to allow the applicant an opportunity to submit a Driveway Permit. Committee Member Dawson concurred with the changes motion and seconded the motion. Committee Member Latasa said he will not support the motion because the applicant has provided sufficient information and he concurred with Committee Member Jacoubowsky regarding his recommendations on the driveway materials. Consider 640 Wave Street; Sign Permit Application 12-045 for Installation of New Signs; Applicant Phil Vanderkraats; Owner Cannery Row Company; C-2 Zoning District; Exempt from CEQA Requirements. ACTION: Adopted a Resolution approving the proposed signs with an added Condition of Approval: Staff Presentation/Committee Member Questions: Forrest Ebbs presented the Agenda Report and answered Committee Members questions. Applicant: Frank Donangelo, Cannery Row Company, introduced Mike Pernell, Bill Grimm and Ed Lackey with Lackey Signs. Mike Pernell, theater Manager for Cinemark, gave a brief description of his role in the theater and how the business and building are managed. He said he has had complaints from people because they have a difficult time finding the business because the outside of the building is bare and plain and is often mistaken for a closed business. He also said the movie poster cases are not easily seen because they are not internally illuminated and there is nothing on the building that gives it the identity of a movie theater. Mr. Pernell said that because of the lack of signage on the building, the business is struggling. Frank Donangelo complimented staff on the work that has been done on the project and concurred with Mr. Pernell that people do not patron the business because they do not know what it is from the outside. He said the failure of the use will be detrimental to the Cannery Row area and the murals will help to identify the use of the building. He also said the mural on the recreation trail will provide valuable advertising on the trailside of the building and requested the Committee allow the applicants an opportunity to comment on Committee Comments when the public hearing is closed. Chair Dawson acknowledged the request. 3  Architectural Review Committee Minutes Wednesday, September 19, 2012 Public Comments: William Whipple, President of the New Monterey Neighborhood Association, spoke in support of the Sign Ordinance and said any decision to create an exception on the recreation trail side of the building should be considered carefully. He expressed concern regarding the 80% coverage of the proposed window sign and concurs with staffs recommendation against the small mural sign facing the recreation trail. Frank Donangelo responded to Mr. Whipple’s comments indicating that the proposed signs are not intended to offend anyone, rather to bring business to the theater. He said Cannery Row is an industrial area with very large buildings and internally illuminated signs add significant signage to the evening hours and encouraged staff and the Committee to consider the size of the building when considering the signs proposed. Committee Member Comments Vice Chair Hill said no sign depicting the overall look of the recreation trail signs was presented and made a motion to adopt a Resolution approving the proposed signs. Committee Member Bartram suggested adding a Condition of Approval stating that the upper line shape of the murals be changed to match the curve of the building. Vice Chair Hill concurred and added the condition to the motion. Added Condition of Approval: 6. The large mural shall be revised to contain a curved top that compliments the curved parapet of the building. Committee Member Jacoubowsky concurred with Committee Member Bartram regarding the change in the shape of the murals to match the building curve. Committee Member Davis seconded the motion. Committee Member Latasa complimented the applicant on the project. Committee Member Jacoubowsky said that Cannery Row has different standards regarding the Sign Ordinance, than other business districts in the area. Staff Presentation/Committee Member Questions: Forrest Ebbs presented the Agenda Report and answered Committee Members questions. Applicant: No Applicant present. Public Comments: William Whipple, New Monterey Neighborhood Association President, spoke in support of the Lighthouse Window Guidelines and said the neighborhood association is in support of staff's findings and the divided light asthetic should maintain on the project. Committee Member Comments Committee Member Bartram said he is in favor of the transition with the non-divided light. Committee Member Davis expressed concern about making a motion without an applicant present if changes are being made to the divided light. Committee Member Sullivan said the building looks better with divided light windows. Vice Chair Hill said the project is an improvement to the frontage of the property on Lighthouse Avenue and is making good use of the building. Chair Dawson concurred with Committee Member Davis about making a motion with no applicant present. Committee Member Latasa concurred and made a motion to continue the item to allow the applicant an opportunity to be present. Committee Member Davis seconded the motion. Committee Member Jacoubowsky said the applicant should be made aware that no action will be taken on the project without representation at the meeting. ACTION: Continued the item to the October 3, 2012 meeting, to allow the applicant an opportunity to be present. 5 Architectural Review Committee Minutes Wednesday, September 19, 2012 Staff Presentation/Committee Member Questions: Forrest Ebbs presented the Agenda Report and answered Committee Members questions. Applicant: No Applicant present. Public Comments: None. Committee Member Comments The Committee had a discussion on the asthetic look of the project; the building modulation, window placement, elevation and massing. Vice Chair Hill expressed concern that the applicant was not present to hear the suggested changes or corrections being discussed. Committee Member Latasa said the look is very bland and suggested possible changes to the garage, roof, side of the electrical panel, the side of the building facing Hannon and improvements should be made to the lack of modulation. Committee Member Bartram said the hip roof is out of character and there is no continuity to the project. The Committee concurred that more modulation was needed for the project and should be added to the design. Committee Member Bartram said the scale of the windows should be changed as well. Forrest Ebbs suggested the Committee continue the item. Committee Member Jacoubowsky made a motion to continue the item to allow the applicant an opportunity to be present. Vice Chair Hill seconded the motion. Committee Member Davis said gabel roofs can be to harsh for a project and hip roof's are common in Monterey.
