Staff Presentation/Committee Member Questions Associate Planner Buggert presented the Agenda Report and answered Committee Members’ questions. Vice-Chair Pauly and Committee Member Ostovar asked for clarification on tree replacement conditions. Mr. Buggert referred to tree replacement proposal. Applicant Quyen Luong, project architect, provided additional insight on the scope of the project. Committee Member Ostovar questioned the lighting design. Vice-Chair Pauly questioned the acoustic paneling. Ms. Luong explained the lighting will be low impact and the acoustic paneling is meant to limit cross communication between sea otters. Staff Presentation/Committee Member Questions Senior Associate Planner Schmidt presented the Agenda Report and answered Committee Members’ questions. The Architectural Review Committee (ARC) asked for clarification on what items they are allowed to comment on. Mr. Schmidt outlined which items need architectural review. Committee Member Turgen questioned the window requirements. Mr. Schmidt said the findings of approval relate to style and privacy. Applicant Edrees Rohina, applicant and owner, shared additional details about the design. Public Comments Carole Erickson neighbor, spoke disapprovingly of the project and cited issues with drainage, windows, skylights, and safety. Molly Erickson, daughter of neighbor, spoke against the project and urged the ARC to delay action until the code enforcement issues have been resolved. Committee Member Schmidt agreed. Vice-Chair Pauly suggested reducing the number of skylights to two and added the ARC isn’t here to litigate the other non-confirming issues on site. Committee Member Ostovar echoed the comments of fellow Committee Members and added permitted childcare could solve some of the code compliance issues. Mr. Schmidt made the ARC aware they can place a condition stating the applicants must remove lighting. Chair Tregenza commended applicant on redesign and emphasized the importance of obtaining permits. Chair Tregenza made a motion to approve with the condition that the applicant follow staff recommendation and obtain a use permit for daycare center, the number of skylights will be reduced from 6 to 2 on east side (facing back) of roof, and the downspout on south side of house shall be rerouted and percolate on site. Vice-Chair Pauly announced he lives next door to the project site, recused himself, and left the Council Chamber at 5:27 p.m. Staff Presentation/Committee Member Questions Associate Planner Buggert presented the Agenda Report and answered Committee Members’ questions. Committee Member Ostovar asked for clarification of staff’s approval recommendation. Committee Member Schmidt asked if the neighbors could request to be notified of changes. Principal Planner Roveri said notification is not required per city code, but they could request to be notified. Chair Tregenza asked for reference photos of other fences on the property. Committee Member Ostovar asked if the current fence allows room for planting. Mr. Buggert said there is no room between the fence and retaining wall to plant. Applicant None. Public Comments Jean Rasch, president of the Monterey Vista Neighborhood Association, spoke against the installation of a chain link fence, the seating area, and suggested planting a hedge. Ms. Rasch requested notification of any changes to the project site. Susan Thompson, neighbor at 50 Via Buena Vista, spoke against the project and requested the fence be replaced with greenery. Charles Thompson, neighbor at 50 Via Buena Vista, spoke against the project and suggested there is more graffiti due to the appearance of the fence. Mr. Thompson requested the applicant bring plans back for ARC approval. Committee Member Comments Committee Member Ostovar inquired about potential safety concerns if the fence is removed. Ms. Roveri said they will refer this question to the building department. Committee Member Schmidt inquired about continuing the item and spoke against the chain link fence. Ms. Roveri cited the permit streamlining act. Mr. Buggert pointed out the applicants waived the permit streamlining act. Chair Tregenza questioned alternate materials for the fence and asked what the fastest way would be to remedy the fence design. Ms. Roveri reiterated there is no time limit on the permit. Committee Member Ostovar made a motion, seconded by Chair Tregenza to continue the item to the August 16, 2023, ARC Meeting with the recommendation that the applicants modify and bring back to the ARC a proposal with more appropriate materials including wood, stone, or stucco and additional landscaping. Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office, or on the web at http://www.monterey.org beginning late Friday afternoon prior to the date of the meeting. Members of the public have the right to address the Committee on any Agenda items. The Chair will formally open the floor for public comment.
