Consider 870 Doud Street; HPC Application 13-397 for a Mills Act Contract and H-2 Historic Zoning; Applicant/Owner Pat Canada; R-1-6 Zoning District; Exempt from CEQA Requirements  Historic Preservation Commission Minutes Thursday, October 10, 2013 ACTION: Adopted Resolutions recommending that the Planning Commission recommend that the City Council adopt an Ordinance to rezone the property as a City Historic Resource from R-1-6 to R-1-6-H-2 and recommending that the City Council approve a Mills Act Contract (property tax savings program for historic structures) for the property. Staff Presentations/Committee Member Questions: Christine Hopper presented the Agenda Report and answered Commissioners’ questions. Applicant: Applicants Pat Canada and James Henry were present. Ms. Canada said the majority of solar panels to be installed will be on the addition. She said the solar provider recommended placing the panels on the south facing side and it would be difficult to see the panels. Public Comment: None. Commissioner Comments: Commissioner O’Neil said that solar panels sit very lightly on the roof and do not cause any irreversible changes to the roof. Commissioner McLain said that the solar panels would not be visible from the street or sidewalk. Commissioner Petty made a motion to accept staff’s recommendation to adopt Resolutions recommending that the Planning Commission recommend that the City Council adopt an Ordinance to rezone the property as a City Historic Resource from R-1- 6 to R-1-6-H-2 and recommending that the City Council approve a Mills Act Contract (property tax savings program for historic structures) for the property. Mr. Jones said he wants to maintain the house without changing its historic character. In response to Commissioner Petty’s question, Mr. Jones said that none of the proposed maintenance will change the appearance of the house. He also said the veranda and one of the support columns have dry rot that needs to be repaired. In response to Commissioner Petty’s question, Ms. Hopper said that repairs to the property would be eligible for Administrative Review, but anything beyond repair would come back to the HPC for review. Consider 1008 Jefferson Street; Historic Permit 13-374 to Allow a Historic Circular Entry Window to be Eliminated; Applicant/Owner Jamie Haaland; R-1-6 Zoning District; Exempt from CEQA Requirements Historic Preservation Commission Meeting Minutes 3 Thursday, October 10, 2013 3 Historic Preservation Commission Minutes Thursday, October 10, 2013 ACTION: Adopted a Resolution approving Historic Permit 13-374 to allow a historic circular entry window to be eliminated at 1008 Jefferson Street with added Condition of Approval. Staff Presentation/Commissioner Questions: Christine Hopper presented the Agenda Report and answered Commissioners’ questions. Applicant: Applicant Jamie Haaland said that she had planned to switch the location of the door and window as approved, but during the construction process there was a miscommunication due to a language barrier with the laborers and the window was severely damaged. Ms. Haaland said she was left having to patch up the hole in the wall and the window was not removed intentionally. Ms. Haaland said there are other houses in the area by the same architect and not all of them have circle windows. Ms. Haaland also said she is not opposed to recreating the window, but would like the Committee to approve removing it completely because she cannot afford to recreate the window at this time. In response to Commissioner Petty’s question regarding replacing the window instead of patching the wall, Ms. Haaland said this was not a viable solution because the other windows were already ordered for the rest of the house. Public Comments: None. Commissioner Comments: Commissioner O’Neil said that the circular window is a character defining feature. In response to Commissioner Petty’s question, Ms. Hopper said the arched front window is the most distinctive feature of the house. She said the HPC should determine if the window is so much of a character defining feature that the property would no longer be historically eligible without it. Vice Chair Fletcher said the pointed arch windows and shed roof over the covered entry are the most character defining features and not the circular window. He also said the house is no less of a structure without the window. Commissioner McLain said loss of the circular window causes the house to lose one of its character defining features. Commissioner Petty agreed with Commissioner McLain that the window distinguishes the house, but said he is not sure that it is essential to defining the house as a particular style. Commissioner O’Neil said that some houses were eliminated from the New Monterey Historic Survey for changing their doors and front entryways. Commissioner Fletcher said there were also many properties included that were changed significantly. Commissioner O’Brien said the window could be replicated in a manner that is reminiscent of the original and said the owner should have the right to choose whether or not to replace it. On a motion by Commissioner O’Neil, seconded by Commissioner McLain, the Historic Preservation Commission Voted to Adopt a Resolution denying the Historic Permit: AYES: 3 COMMISSIONERS: McLain, O’Brien, O’Neil, NOES: 3 COMMISSIONERS: Petty, Fletcher, Palminteri ABSENT: 1 COMMISSIONERS: Barlow ABSTAIN: 0 COMMISSIONERS: None RECUSED: 0 COMMISSIONERS: None The motion failed. Ms. Hopper informed the Commission that the alternative motion would be to approve the Historic Permit. Commissioner Petty made a motion to approve Historic Permit 13-374 not requiring the window to be placed on the south facing wall. Ms. Hopper clarified that by approving the Historic Permit the HPC may not be able to approve a Rezone application or a Mills Act application in the future. She also said that the HPC can choose to add a Condition of Approval requiring that the original location and style of the window be documented. Commissioner Petty amended his motion to approve Historic Permit 13-374 to allow a historic circular entry window to be eliminated at 1008 Jefferson Street with the added Condition of Approval as follows: Special: 5. That, prior to Planning office sign off on the Building Permit final, the window dimensions, materials and original location shall be documented and submitted to the Planning office for placement in the Planning files for the property. On a motion by Commissioner Petty, seconded by Commissioner Fletcher, and carried by the following vote, the Historic Preservation Commission Adopted a Resolution approving the Historic Permit with added Condition of Approval: AYES: 6 COMMISSIONERS: Palminteri, Fletcher, McLain, O'Brien, O'Neil, Petty NOES: 0 COMMISSIONERS: None ABSENT: 1 COMMISSIONERS: Barlow ABSTAIN: 0 COMMISSIONERS: None RECUSED: 0 COMMISSIONERS: None COMMISSIONER COMMENTS Commissioner O’Neil said she received an email from the Cultural Arts Commission asking for input on the Interpretive Plan for Colton Hall and confirmed that other Commissioners received the email. Historic Preservation Commission Meeting Minutes 5 Thursday, October 10, 2013 5 Historic Preservation Commission Minutes Thursday, October 10, 2013 Commissioner Fletcher asked when the discussion of the Cooper Molera would be coming before the HPC. Ms. Caraker said that one of the City Council Members is working to coordinate an open house for the Council and general public within the next couple of months. Ms. Hopper said the City does not have a project application for any particular project on the site at this time. Commissioner Petty asked when the Wharf Marketplace sign will go up. Ms. Hopper said that the sign is being constructed. INFORMATIONAL REPORTS & STAFF COMMENTS Ms. Hopper announced that the Wharf Marketplace had its grand opening the weekend of October 5, 2013 and had approximately 200 people in attendance. Ms. Hopper also announced that the California Preservation Foundation (CPF) conference scheduled for May of 2013 will be held in Monterey.
