Call Meeting to Order Art Pencek, Council President called the May 4, 2026, regular meeting to order at 7:00 p.m. Pledge Of Allegiance: Art Pencek, Council President Roll Call: Arthur Pencek (President) Present Rosemarie Warner (Mayor) Present Edward Gaughan (Vice-President) Present Joseph Castrogiovanni Present Luis Arias (Junior Council) Present Dennis Cawley Present Alia Rava (Junior Council) Absent Earnest Church Present Nichole Musewicz Present Also, present were: Amy Carlson (Business Manager) Bruce Zero, Esquire (Solicitor), Ivy Brenzel (Police Chief), George Parker (Zoning/Code Enforcement Officer), Stephanie Drake (Pennsylvania State Association of Boroughs) , Frank Walsh, Paul Burns, Frank Hubbard, Charles & Martha Ludlum, Elise Hanna, Carol Yanko (residents) Lisa Duffy, (NP Cultural Society) Oath of Office Mayor Rosemarie Warner administered Oath of Office to Brooks Hanna as new Moscow Borough councilmember. Moscow Borough Council made the appointment at a special meeting held on Monday April 27, 2026. Brooks will serve the remainder of the term which expires 12/31/27 Junior Council Recognition Stephanie Drake, Pennsylvania State Association of Boroughs was in attendance to make a presentation to Luis Arias, who has served as Moscow Borough Junior Councilmember from 2024-2026 Approval of Minutes The monthly council meeting was held on April 6, 2026, and a special council meeting was held on April 27, 2026. Minutes were submitted for both meetings for review and approval. Motion was made by Dennis Cawley to accept council meeting minutes as written for both. Motion was seconded by Ed Gaughan. The motion carried unanimously. Citizen’s Comments And/or Follow-Up On Previous Citizen’s Requests Paul Burns, 500 Hideaway Drive was in attendance to voice his concerns again to borough council of four separate issues regarding RLE Enterprises, Inc. located at R 457 N. Main St., Moscow, PA 18444. The issues Mr. Burns put forth to address were noise control, lighting issues, lot appearance and zoning as he stated at the April 6, 2026 council meeting. Also, supporting Paul in his concerns were resident Frank Walsh, 506 Hideaway Drive and Frank Hubbard, 502 Hideaway Drive. After lengthy discussions as to moving forward Solicitor Bruce Zero suggested that George Parker, Zoning Enforcement Officer submit a list of the ordinance violations to him for review. Paul Burns also noted that RLE Enterprises Inc. has two (2) buildings on RLE property that were existing on the property without permits. George Parker verified that this was a true statement and will include that in his reporting to Attorney Zero. Lisa Duffy NP Cultural Society requested specific road closures for the annual Moscow Street Fair to be held Thursday July 23, Friday July 24 & Saturday July 25, 2026. Requests for closures of borough and state roads were presented. Lisa stated that before the state will consider these closures on Main Street, they need council approval. Ed Gaughan suggested to table until a special meeting can be held to discuss the requests further in detail. Art Pencek stated in agreement with councilmembers that a tentative date of 05/18/26 at 6PM would be scheduled and advertised. Moscow Volunteer Fire & Hose Co. Chief Colin Young of the Moscow Volunteer Fire and Hose Co. was not in attendance to present April 2026 report General Information: Laurel Lines, Vol 53, Issue 4 – April 2026, Publication of of the Lackawanna And Wyoming Valley Railway Historical Society, Inc can be downloaded and viewed at https://lwvrhs.org/monthy-laurel-lines-newsletter/ Business Office Ed Gaughan made a motion to approve Resolution 318-2026 regarding Destruction of Specific Records and Resolution 319-2026 regarding Intent to follow schedules and procedures for disposition of records set forth in the PA Municipal Records Manual. The motion was seconded by Joseph Castrogiovanni. The motion carried unanimously with a roll call vote. Treasurer’s Report There were no transfers for approval for the month of April 2026. The treasurer’s report was submitted and reported for the month of April 2026. Nichole Musewicz made a motion to accept the treasurer’s report as reported and to pay the bills as presented. Ed Gaughan seconded the motion. The motion carried unanimously with a roll call vote. Real Estate Tax Collector's Report Real Estate Tax Collector report was submitted for the month of April 2026 for informational purposes and review. Financial Report Joseph Castrogiovanni initiated discussion regarding renewal of HNB certificate of deposit with a maturity date of 05/22/26 in the amount of $11,349.16. Advised by Joe’s recommendation, Ed Gaughan made a motion to invest a certificate of deposit at maturity in Edward Jones for a term of nine (9) months at an APR of 3.90%. if the rates stay as reported. (Should rates change Joe will be contacted and approve at terms & highest interest rate) Nichole Musewicz seconded the motion. The motion carried unanimously with a roll call vote. Zoning and Code Enforcement Zoning and Code Enforcement monthly report for April 2026 was submitted for review. Joseph Castrogiovanni inquired on the status of a complaint the borough received (from the residents at 800 Clover Lane) about trash and a collapsing above-ground pool in the yard of 406 Marion Street. George responded that he will be addressing and contacting the property owner. Streets/Planning Commission and Council of Governments: The need for a special council meeting was discussed and changed from original 05/18/26 to be held on Thursday 05/14/26 at 7PM regarding both MarKoz Realty 90-Day extension of land development (expiration for update is Sunday 05/17/26) & the NP Cultural Society street closure requests. Parks & Recreation / Shade Tree Commission Nichole Musewicz stated that the Porta-Potties have been delivered to the required Moscow Borough Parks for the 2026 spring/summer months. The Annual Arbor Day Ceremony was held at Golden Park Friday, April 24, 2026 by the Shade Tree Commission Police Report Chief Ivy Brenzel submitted police report for April 2026. There was a total of 135 911 calls and 132 cleared calls for the month, also several events and training. Multiple thank you notes were submitted that were received in the month of April 2026 regarding police assistance to residents. Recycling Earnest Church, Recycling Chair stated he would be looking onto grants that support an electronics recycling event and other recycling related events.
