Present: John Hackenberg, Robert Crosland, Gene Gallogly, Corey
Barber.
Staff: Austin Rutherford, Kate Dolan, Julia Copeland, Jane Yager-
Baumrind
Mr. Rutherford called the meeting to order at 5:01pm.
The Commission elected Mr. Hackenberg as temporary chair.
I. Approval of Agenda
Mr. Hackenberg moved to approve the agenda. Mr. Crosland seconded
the motion. All in favor.
II. Approval of Minutes—1.13.2020 Minutes
Mr. Gallogly moved to approve the minutes. Mr. Crosland seconded the
motion. All in favor.
III. Correspondence
Mr. Rutherford reviewed with the Commission the correspondence and
Town Council decisions.
IV. General Public Comment
Mr. Chris Colman, 118 Pitt Street, expressed concern with the rehearing
process and suggested that there has not been a significant change to
warrant a rehearing.
Mr. Hamlin O’Kelly, 652 Coleman Blvd., attorney 101 Mary Street. Stated
that they are before the Commission because of direction from Town
Council.
There being no further public comments, Mr. Hackenberg continued with the
agenda.

V. Consent Motion
There being no consent motions, Mr. Hackenberg continued with the
agenda.
VI. Reconsideration of request for an encroachment permit for dock at
101 Mary Street. (This item referred to HDPC from Transportation
Committee of Town of Council on September 30 and December 2,
2019; Deferred by Commission January 13, 2020) –Revised Dock
Plan, Revised Staff Report, Correspondence from November. –
Correspondence from January – Correspondence from February
Mr. Rutherford reviewed this application with the Commission
(attachment 1).
Ms. Mary Shahid and Mr. Hamlin O’Kelley reviewed the request with the
Commission.
Mr. Ted Strauss, 102 Mary Street, stated that he and his wife are in full
support of the request.
Mr. Louis Horton, 138 Live Oak Drive, stated he is favor of a dock at 101
Mary Street.
Mr. Chris Colman, 118 Pitt Street, suggested that the Town is the upland
owner and the entity that has the right to submit for a permit from OCRM.
He suggested that the request should benefit the good of the Town as a
whole and not an individual homeowner. He expressed concern with the
master dock program and that the previous permits associated with that
master dock program are no longer valid.
Ms. Carol Tinkey, 208 Venning Street, expressed concern with the distance
between docks and waterfront access.
Ms. Helen Cook, 113 Bennett Street, stated she has no issue with the dock
and suggested that it would be a benefit for the neighborhood.
Ms. Linda Balzac, 422 Hobcaw Drive, suggested that it might be beneficial
to have a pictorial representation of the dock.

There being no further public comment, Mr. Hackenberg closed public
comment.
Mr. Gallogly moved to convene into executive session for legal advice.
Mr. Barber seconded the motion. All in favor.
The Board convened into executive session at 5:54 pm and reconvened at
6:04 pm. No action was taken while in executive session.
Mr. Hackenberg moved that no recommendation should be made at this
time by this Commission until the appropriate encroachment permits have
been approved and approvals from all applicable state agencies are
secured. Mr.Gallogly seconded this motion. All in favor.
VII. Business
a. 208 McCormick Street – (TMS 532-09-00-263) Applicant is
seeking Final Review for the demolition of a shed.
Mr. Rutherford reviewed the application with the Commission
(attachment 1).
Mr. Brian Maiden reviewed the application with the Commission.
Ms. Balzac suggested that the shed should not be considered historic.
Mr. Mark Regalbuto, 754 Pitts Street, suggested that the condition of the
structure should be a consideration. He suggested that the shed does
not add to the “historic fabric” of the historic district. He stated that he is
in favor of the request.
There being no further public comment, Mr. Hackenberg closed public
comment.
Mr. Hackenberg moved to approve demolition of the shed because
it is a public safety hazard. Mr. Gallogly seconded the motion. Motion
passed on a 3 to 1 vote with Mr. Hackenberg, Mr. Gallogly, and Mr.
Crosland in favor; Mr. Barber opposed.
b. 224 Queen Street – Historic 6094 – (TMS 532-05-00-022)
Applicant is seeking Final Review for alteration of roof material
and door replacement.

Mr. Rutherford reviewed the application with the Commission
(attachment 1).
Mr. Keith Harris reviewed the application with the Commission.
Ms. Balzac suggested that there are options available for replacement
of the door with an insulated door. She suggested that all efforts should
be made to use approved materials.
Mr. Keith Harris announced that they were withdrawing the door
replacement portion of the request.
Mr. Hackenberg moved for approval of Option A for the roof material.
Mr. Crosland seconded the motion. Motion passed on a 3 to 1 vote with
Mr. Hackenberg, Mr. Crosland, and Mr. Gallogly in favor; Mr. Barber
opposed.
c. 333 Bennett Street – Historic 6164/6164.01/Survey 6164.01 –
(TMS 532-01-00-028) Applicant is seeking Final Review for new
windows.
Ms. Dolan reviewed the application with the Commission
(attachment 1).
Mr. John Crass, 232 Bennett Street, reviewed the request with the
Commission.
Mr. Colman thanked the applicant for using actual wood and 2/2
windows.
Mr. Crosland moved for approval of the request as recommended by
staff. Mr. Barber seconded the motion. All in favor.
d. 754 Pitt Street – Historic 5960/Survey 5960.01 – (TMS 532-09-
00-245) Applicant is seeking Final Review for minor exterior
alterations.
Mr. Rutherford reviewed the application with Commission
(attachment 1).

Mr. Mark Regalbuto reviewed the request with the Commission.
Mr. Crosland moved to approve with staff recommendations. Mr.
Hackenberg seconded the motion. All in favor.
e. 916 Pitt Street – Survey 6284/6284.01 – (TMS 532-13-00-056)
Applicant is seeking Final Review for alterations to foundation
of approved ADU.
Mr. Rutherford reviewed the application with the Commission
(attachment 1).
Mr. Carl McCants, reviewed request with the Commission.
Mr. Barber moved for approval of the request. Mr. Hackenberg
seconded the motion. All in favor.
f. 204 Live Oak Drive – Historic 6234 – (TMS 517-15-00-029)
Applicant is seeking Final Review for after-the-fact for
hardscaping and alterations to approved ADU.
Mr. Rutherford reviewed staff comments with the Commission
(attachment 1).
Ms. Balzac and Ms. Allison Dailey reviewed the request with the
Commission.
There being no comments, Mr. Hackenberg closed public comments.
Mr. Gallogly moved to approve the application as presented as it
meets the design guidelines and include approval of the gate by staff.
Mr. Crosland seconded the motion. All in favor.
g. 110 Bennett Street – Historic 6146 – (TMS 517-15-00-090)
Applicant is seeking Final Review for a bathroom addition.
Ms. Dolan reviewed the staff comments with the Commission
(attachment 1).
Ms. Kate Campbell, Beau Clowney Architects, reviewed the request with
the Commission.

There being no comments, Mr. Hackenberg closed public comments.
Mr. Gallogly moved for approval as submitted including approval for
the fence as proposed. Mr. Crosland seconded the motion. All in favor.
VIII. Staff Approvals
Mr. Rutherford reviewed the following staff approvals with the
Commission:
➢ 903 Royall Avenue – Survey 6289 - (TMS 532-13-00-061) Alteration
of roof covering.
➢ 440 Whilden Street – Historic 6176/6176.01 - (TMS 532-01-00-120,
-279) Alterations to approved walkways.
➢ 100 Friend Street – Survey 4226 – (TMS 532-05-00-042) New
windows.
IX. Continued Discussion Regarding Paint Color in the Old Village
Historic District.
Mr. Rutherford reviewed the history of approval of paint colors with the
Commission.
Mr. Colman suggested that a tier approval process could be considered,
but the current process of having a group of approved paint colors is
appropriate as well. He commended the Commission on trying to have more
consistency while providing some variety.
The Commission agreed that staff should bring back options for
consideration.
X. Discussion on Ranch-Styled Homes in reference to Historic
Designation.
Mr. Rutherford reviewed ranch-style homes in reference to historic
designation with the Commission.
The Commission discussed historic designation throughout the Town.
The Commission received this as information.

XI. Election of Chair and Vice-Chair
The Commission agreed to defer the election of chair and vice-chair to
the next meeting.
There being no further business, the meeting adjourned at 8:05pm.
