Staff: Austin Rutherford, Julia Copeland, Lynnette Lynes Mr. Rutherford called the meeting to order at 5:17 pm and stated that the Commission needed to appoint a temporary chair. Mr. Barber moved to appoint Mr. Crosland as temporary chair. Mr. Gallogly seconded the motion. All in favor. I. Approval of Agenda Mr. Hackenberg moved for approval of the agenda. Mr. Barber seconded the motion. All in favor. II. Approval of Minutes There are no minutes to approve. III. Correspondence Mr. Rutherford stated that 129 Live Oak has withdrawn their request. IV. General Public Comment There being no public comment, Mr. Crosland continued with the agenda. V. Consent Motions Mr. Crosland moved for consent approval of 840 Pitt Street. Old Business a. 129 Live Oak Drive – (TMS 517-15-00-062) Applicant is seeking Final Review for a trash can enclosure. Correspondence Deferred from July 7, 2020 meeting. This item was withdrawn by the applicant. VII. New Business a. 312 Venning Street – Historic 6184/6184.01/Survey 6184.02 – (TMS 532- 01-00-109) Applicant is seeking Final Review for alterations to approved driveway. b. 9 Pierates Cruz – Survey 6068 – (TMS 532-09-00-014) Applicant is seeking Final Review for a screen porch addition on the rear of the home. c. 10 Pierates Cruz – Survey 6072/6072.01 – (TMS 532-09-00-018) Applicant is seeking Final Review for a replacement fence. These items were approved by staff. d. 840 Pitt Street – Historic 5966/Survey 5966.01 – (TMS 532-09-00-057) Applicant is seeking Final Review for pool replacement. This item was approved through a consent motion. e. 932 Richters Way – Survey 6043 – (TMS 532-13-00-089) Applicant is seeking Final Review for fencing. f. 201 McCants Drive – Survey 6080 – (TMS 532-09-00-259) Applicant is seeking Final Review for solar panels. g. 967 Royall Avenue – Survey 5979 – (TMS 532-13-00-042) Applicant is seeking Final Review for revision to previously approved pool. These items were approved by staff. h. 309 Bennett Street – Survey 4238/4238.01 – (TMS 532-01-00-023) Applicant is seeking Final Review for a new pool. Mr. Rutherford reviewed staff comments with the Commission (attachment 1). Ms. Linda Balzac stated that the lots are tight and smaller than surrounding properties. She suggested that the request is reasonable and should be allowed given the unique circumstances. There being no comments, Mr. Crosland closed public comment. Mr. Barber moved for approval as meets the design guidelines with the condition that the side setbacks remain as shown on site plan presented. Mr. Crosland seconded the motion. All in favor. i. 744 Pitt Street – Survey 5959 – (TMS 532-09-00-069) Applicant is seeking Final Review for demolition of a single-family home. Mr. Rutherford reviewed staff comments with the Commission (attachment 1). Mr. Will Dupree and Ms. Mary Dupree reviewed the request with the Commission. Ms. Linda Balzac, stated that the home is not historic, but is a contributing factor Mr. Alan Smith, 115 Friend St, stated that he is familiar with the home and it is a typical 1970s home. He stated that Pascullis did very few residential homes. He suggested that the home does not fit the Old Village Historic District vernacular and there are several significant building violations to the property. Ms. Carol Tinkey, 208 Venning St, stated that previously this home was considered as modern village architecture and was a contributing structure, and therefore a previous request for demolition was denied. She suggested that the home should be preserved as it is close to being historic. Ms. Carmen Scott, 415 Church Street, suggested that the property should not be considered historic because it does not meet the guidelines in terms of years and is not a significant architecture. She suggested that delaying the Historic District Preservation Commission July 13, 2020 Page 4 of 8 homeowner to move forward would cause further monetary damage for the family. She suggested that relying on an obituary as justification is ill-based. She suggested that further delaying the homeowner in allowing them to move forward with their home, could mean legal action. There being no further comments, Mr. Crosland closed public comment. Mr. Crosland moved for approval of the request subject to submission of approved plans, that demolition be allowed in accordance with §156.432(I)(2)(d). Mr. Gallogly seconded the motion. Motion passed on a 3 to 1 vote with Mr. Gallogly, Mr. Hackenberg, and Mr. Crosland in favor; Mr. Barber opposed. j. 11 Pierates Cruz – Survey 6071 – (TMS 532-09-00-017) Applicant is seeking Final Review for site improvements, home alterations, and an accessory pool. Mr. Rutherford reviewed staff comments with the Commission (attachment 1). Ms. Paula Rallis and Mr. Ron Rallis reviewed the request with the Commission. Mr. Kevin Miller, landscape designer for the applicant, stated that they are planning landscape design to compliment the neighborhood. There being no comments, Mr. Crosland closed public comment. Mr. Crosland moved for approval of the request with the exception of the pool equipment and screening to be approved by staff and with obtaining an encroachment permit as it is consistent with the surrounding neighborhood, have good intentions and are improving the property, and the request is not unique from others in the historic district. Mr. Hackenberg seconded the motion. Motion passed on a 3 to 1 vote with Mr. Gallogly, Mr. Hackenberg, and Mr. Crosland in favor; Mr. Barber opposed. The Commission convened for short break at 7:27 pm and reconvened at 7:33 pm. Correspondence – AMENDED 7.10.2020 Mr. Rutherford reviewed staff comments with the Commission (attachment 1) Ms. Laura Beck, representative for owner, reviewed the request with the Commission. Ms. Balzac suggested that if the request is approved it would set a bad precedent. She suggested that this is historic and fits within the historic district. There being no comments, Mr. Crosland closed public comment. Mr. Barber moved for denial of the request for removal from the Old Village Historic District as it would set a precedent, it is against the provisions of the Comprehensive Plan and properties within register of historic places. Mr. Crosland seconded the motion. All in favor. l. 410 Church Street – Historic 6195 – (TMS 532-01-00-098) Applicant is seeking Final Review for patio modifications. m. 430 Church Street – Historic 6192 – (TMS 532-01-00-094) Applicant is seeking Final Review for a new roof. n. 754 Pitt Street – Historic 5950/Survey 5960.01 – (TMS 532-09-00-245) Applicant is seeking Final Review to replicate historic fencing. These items were approved by staff. o. 304 Bank Street – Historic 6114/Survey 6114.01 – (TMS 532-05-00-201) Applicant is seeking Final Review to reestablish a 2nd story front porch and side windows. Mr. Rutherford reviewed staff comments with the Commission (attachment 1). Ms. Ashley Graham, owner, thanked the Commission for their consideration and asked that the request be approved. There being no comments, Mr. Crosland closed public comment. Mr. Gallogly moved for approval. Mr. Crosland seconded the motion. All in favor. p. 104 Mary Street – Survey 4241/4241.01 – (TMS 517-15-00-077) Applicant is seeking Final Review for a new shed. Correspondence – AMENDED 7.10.2020. Mr. Rutherford reviewed staff comments with the Commission (attachment 1). Mr. Alex Gonzalez and Ms. Ana Gonzalez reviewed the request with the Commission. There being no comments, Mr. Crosland closed public comment. Mr. Barber moved for approval of the request as the shed meets the guidelines with a three-foot encroachment and staff working with the applicant on exact placement. Mr. Crosland seconded the motion. All in favor. The Board convened for a short break at 8:38 pm and reconvened at 8:41 pm. q. 975 Pitt Street – Survey 5889 – (TMS 532-13-00-033) Applicant is seeking Final Review for new construction of a home and pool. Mr. Rutherford reviewed staff comments with the Commission (attachment 1). Ms. Nicole Vieth and Mr. Lee Richardson reviewed the request with the Commission. Mr. Barber moved for approval with the exception of the solar panels as they do not meet the design guidelines and that the roof solar tiles should come back to the Commission for approval. Mr. Crosland seconded the motion. All in favor. r. 234 Middle Street – Survey 6011 – (TMS 532-09-00-025) Applicant is seeking Final Review for a new home, accessory garage, and pool. Mr. Rutherford reviewed staff comments with the Commission (attachment 1). Mr. Craig Thomas reviewed the request with the Commission. Mr. Lowell Grosse, 827 Pitt St, expressed concern with the placement of the buildings and that it would cause drainage issues for the surrounding properties. He suggested that approval should not be made until after the drainage has been resolved. Ms. Balzac agreed that drainage should be considered with approvals of these issues. There being no comments, Mr. Crosland closed public comment. Mr. Crosland moved for approval as presented. Mr. Hackenberg seconded the motion. All in favor. s. 827 Pitt Street – Historic 5897/Survey 5897.01 – (TMS 532-09-00-052) Applicant is seeking Final Review for alterations and additions to Historic home, demoing and replacement of Non-Historic shed, and new pool. Mr. Rutherford reviewed staff comments with the Commission (attachment 1). Ms. Balzac and Mr. Grosse reviewed the request with the Commission. Mr. Crosland moved for approval with the condition that a post as-built survey is completed to ensure impervious lot coverage compliance and staff approval for the location of the HVAC system, the front setback is conforming per the provisions of historic buildings and side setback as there is a precedent. Mr. Gallogly seconded the motion. All in favor. VIII. Staff Approvals Mr. Rutherford reviewed staff approvals with the Commission. There being no further business, the meeting adjourned at 9:22 pm.
