TOWN OF MOUNT PLEASANT, SOUTH CAROLINA HISTORIC DISTRICT PRESERVATION COMMISSION JUNE 14, 2021 MINUTES Present: Louisa Montgomery, Chair, Gene Gallogly, Anne Shaw, Robert Crosland. Absent: Corey Barber. Staff: Kate Miller, Lynnette Lynes Ms. Montgomery called the meeting to order at 5:05 pm. I. Approval of Agenda Mr. Crosland moved for approval of the agenda. Ms. Shaw seconded the motion. All in favor. II. Approval of Minutes May 10, 2021 Approval of the minutes were deferred. III. Correspondence All Correspondence was linked to the agenda and distributed to the Commission. IV. General Public Comment There being no comments, Ms. Montgomery continued with the agenda. V. Consent Motions Ms. Montgomery moved for consent approval of the following items: ➢ 111 Hyer Street – Survey 6077/6077.01/ Non-Historic – (TMS 532-09-00-059) Applicant is seeking Final Review for full demolition and new construction. ➢ 155 Live Oak Drive – Survey 6250/6251/Historic – (TMS 517-15-00-081) Applicant is seeking Final Review to replace existing gray metal roof with green metal roof. ➢ 231 Bennett Street – Survey 6137/Historic – (TMS 532-01-00-012) Applicant is seeking Final Review for revision to previously approved plans. ➢ 114 Pitt Street – Survey 5938/Historic - (TMS 532-01-00-087) Applicant is seeking Final Review for hardscaping (patio, fireplace, driveway, etc.), fencing and enclose porch. Mr. Crosland seconded the motion. All in favor. VI. Appeal of Staff Level Approval - 416 Church Street – Survey 6194/Non- Historic – (TMS 532-01-00-097) Remove existing style fence, replace with wood fencing. Ms. Shaw recused herself due to a conflict of interest. Ms. Miller reviewed staff comments with the Commission. Ms. Ansley Tolman, representative for Nicole Dickens, and Ms. Nicole Dickens reviewed the appeal with the Commission through a PowerPoint presentation. Mr. Joe Schuster stated that the fence was not installed per the guidelines as it was erected with the “bad” side of the fence facing her property and exceeds the height limitation. He asked that at a minimum the fence should be reviewed by the full board. He also asked that the whole in the fence should be repaired. He suggested that an after-the-fact approval that does not meet the ordinances or guidelines should be allowed or approved. Mr. Dan Shaw, homeowner, stated that they tried to have a living fence on the property but it did not grow. He stated that the fence was taken down because it was not thriving. He stated that there have been many disputes with Ms. Dickens. Mr. Crosland moved to convene into executive session for legal advice. Ms. Montgomery seconded the motion. All in favor. The Commission convened into executive session for legal advice at 5:29 pm and reconvened at 5:37 pm. No action taken while in executive session. Ms. Tolman rebutted that staff cannot give an after-the-fact approval. She stated that it the staff approval should be reversed. Historic District Preservation Commission June 14, 2021 Page 3 of 6 Ms. Miller rebutted that after-the-fact applications have been received and approved in the past and are allowed when “mistakes” occur. She suggested that this is a code enforcement issue and civil issue. There being no further comments, Ms. Montgomery closed public comment. Mr. Crosland moved for denial of the appeal and to uphold staff's approval as it was handled according to procedure. Mr. Gallogly seconded the motion. All in favor with Ms. Shaw abstaining. VII. Business - STAFF REPORT a. 111 Hyer Street – Survey 6077/6077.01/ Non-Historic – (TMS 532-09-00- 059) Applicant is seeking Final Review for full demolition and new construction. b. 155 Live Oak Drive – Survey 6250/6251/Historic – (TMS 517-15-00-081) Applicant is seeking Final Review to replace existing gray metal roof with green metal roof. This item was approved by consent. c. 0 Live Oak Drive – No Survey/Non-Historic – (TMS 517-15-00-082) Applicant is seeking Preliminary Comment for new construction and accessory structure. Ms. Miller reviewed staff comments with the Commission. Mr. Ross Ritchie, architect, reviewed the request with the Commission. There being no comments, Ms. Montgomery closed public comment. The Commission provided comments. d. 231 Bennett Street – Survey 6137/Historic – (TMS 532-01-00-012) Applicant is seeking Final Review for revision to previously approved plans. This item was approved by consent. Ms. Miller reviewed staff comments with the Commission. Ms. Miller noted that the applicant is not present. There being no comments, Ms. Montgomery closed public comment. The Commission provided comments. f. 114 Pitt Street – Survey 5938/Historic - (TMS 532-01-00-087) Applicant is seeking Final Review for hardscaping (patio, fireplace, driveway, etc.), fencing and enclose porch. g. 203 Center Street – Survey 6058/Historic - (TMS 532-13-00-019) Applicant is seeking Final Review for demolition and revisions to previously approved plans. h. 102 Mary Street – Survey 6255/Non-Historic - (TMS 517-15-00-066) Applicant is seeking Final Review for accessory structure. These items were approved by consent. i. 813 Pitt Street – Survey 5900/Non-Historic (TMS 532-09-00-255) Applicant is seeking Final Review for addition/alterations to home, new construction of accessory structures and fencing. Ms. Miller reviewed staff comments with the Commission. Ms. Amber Aument, architect, reviewed the request with the Commission. There being no comments, Ms. Montgomery closed public comments. Mr. Crosland moved for approval. Ms. Montgomery seconded the motion. All in favor. Ms. Miller reviewed staff comments with the Commission. Ms. Margaret Donaldson reviewed the request with the Commission. There being no comments, Ms. Montgomery closed public comment. Ms. Montgomery moved for approval. Mr. Crosland seconded the motion. All in favor. k. 206 Bank Street – Survey 6111/6111.01/Historic – (TMS 532-05-00-009) Applicant is seeking Final Review for hardscaping and accessory structure. Ms. Miller reviewed the request with the Commission. Mr. Paul Kime, representative for the homeowner, reviewed the request with the Commission. Ms. Melanie Horton, 210 Bank St, stated that she is not aware of any existing pergola. She expressed concern with the drainage. She also expressed concern that the pergola would be seen from the street. She stated that there has been work completed without approval. She expressed concern that the pergola would exacerbate the drainage problem. Ms. Lauren Netter, homeowner, stated that they are intending to improve the drainage in the area. There being no further comments, Ms. Montgomery closed public comments. Mr. Crosland moved for approval as submitted. Ms. Montgomery seconded the motion. All in favor. Review Proposed Changes to Design Guidelines Ms. Miller reviewed changes to the guidelines with the Commission. She stated that the changes would be included on next month’s agenda for approval. X.
