TOWN OF MOUNT PLEASANT, SOUTH CAROLINA HISTORIC DISTRICT PRESERVATION COMMISSION APRIL 11, 2022 MINUTES STAFF REPORT Present: Louisa Montgomery, Chair, Gene Gallogly, Robert Crosland, Anne Shaw. Absent: Corey Barber Staff: Michele Reed, David Pagliarini, Kate Miller, Jake Carter, Kristen Forbus, Lynnette Lynes Ms. Montgomery called the meeting to order at 5:00 pm. I. Approval of Agenda The Commission approved the agenda with correction of the date to 2022. II. Approval of Meeting Minutes, March 14, 2022 Ms. Montgomery stated that approval of the minutes would be deferred to the next meeting. The Commission agreed. III. Correspondence All correspondence received was linked to the agenda. IV. General Public Comment Mr. Mike Tinkey, 208 Venning, spoke regarding staff approvals. He suggested that the procedures for staff approvals should be reviewed and amended to allow review of staff approvals when deemed necessary. He referred to 101 Middle Street and suggested that the guidelines state that a roof or roof structure shall be permitted. He suggested that unless it can be shown that the roof was legally constructed, any changes or replacement should not be allowed. He asked that the staff approvals be deferred for this month until the review has been completed. He also referred to the fence at 101 Pitt Street has been constructed at 8 feet, 1 inches instead of having a 48 inch fence as stated in the guidelines. Consent Motions Mr. Crosland moved for consent motion for the following items: ➢ 926 Pitt Street – Survey 5973/ Historic (TMS 532-13-00-051) Applicant is seeking Final Approval for alterations to previously approved plans. ➢ 430 Church Street – Survey 6192/Historic (TMS 532-01-00-094) Applicant is seeking Final Approval for exterior repairs/alterations. Mr. Gallogly seconded the motion. All in favor. VI. Business - a. 234 Middle Street- Survey#6011/Non-Historic (TMS#532-09-00-025) Applicant is seeking final approval for revisions to previously approved plans. Deferred from last meeting Ms. Miller reviewed staff comments with the Commission. Mr. Chuck Baker, representative for applicant, Ms. Julie O’Connor, and Mr. Cameron Baker reviewed the request with the Commission. Ms. Polly Player, 10 Pierates Cruz, spoke regarding setbacks and referred to the sections of the Town Code. She suggested that the home would be 16 feet forward of other homes on the street and suggested that this would not meet the ordinance or guidelines requirements. She asked that the application be denied. Ms. Carol Burns, 9 Pierates Cruz, expressed concern with the signage and windows that are currently painted orange. She read the ordinance referring to a street block and suggested that the homes located on corner lots should not be included for justification of streetscape. She stated that other homes on the street were denied having the homes closer to the street as it was inharmonious with the neighborhood. She suggested that the request should be denied. Mr. David Creech, 212 Center St., expressed concern with the enhancement of the historic district and that the tree protection is part of the Historic District Preservation Commission April 11, 2022 Page 3 of 7 enhancement of the district. He expressed concern that the reduced tree protection area would be a detriment to the tree. He also expressed concern with the pitch of the main roofline and that it would affect the limbs of the tree. He asked that the house be allowed to be moved back on the lot to further protect the tree. Ms. Anita Yantis, 155 Wingo Way, expressed concern with the comments that have been raised on this request. She stated that her understanding was that the only issue was the connection of the garage. Mr. Paul Brady, 226 Middle St, asked that the streetscape be honored and the home align with the other homes on the street. He stated that he is opposed to the garage as it is too close to the property line. He expressed concern with drainage and that there is not a comprehensive plan for this area to address the drainage. He suggested that the home should be placed farther back on the lot in order to better address the drainage. He expressed concern with the home lying dormant for the past three years. Ms. Melissa Levesque, 4068 Harleston Green Lane, stated that she is in favor of the request. She stated that there is some angst with issues that are not in the Commission’s purview that have already been settled and approved. She suggested that there is a balance that should be achieved between property rights, excellent, compatible architecture and being too restrictive. Mr. Mike Tinkey, 208 Venning St, spoke regarding protection of the historic tree. He suggested that the site plan is deceiving as the tree would be trimmed to avoid the home. He suggested that rules and regulations should be upheld and that allowing the reduced setback, would damage the tree. Mr. Warren Player, 10 Pierates Cruz, suggested that the request should be denied strictly on the streetscape and setback requirements. He spoke regarding drainage and that the requirements state that construction should be accomplished without negatively impacting or damaging neighboring properties. He suggested that the Town should encourage the owner to install a pump to handle the stormwater runoff and it should not be the neighboring property owner’s responsibility to pump off the stormwater. He suggested that the existing drainage basin would be affected. Historic District Preservation Commission April 11, 2022 Page 4 of 7 Ms. Cheryl Shoun, 241 Middle Street, and attorney representing interested parties, asked for those in opposition of the request to signify by a show of hands. She suggested that the Commission should require adherence to the ordinances and guidelines. She expressed concern with the pool and suggested that it is not a right but a privilege and does not have to be approved. She suggested that there has not been a taking by eminent domain as suggested by the applicant. She suggested that a hardship cannot be used when purchasing the property. Ms. Jeannie Powers, 163 Harbor Watch Way, suggested that often it is difficult to build on older lots because of established trees. She read a letter from Ms. Donna Liptak for the Commission. There being no comments, Ms. Montgomery moved to Commission questions. Ms. Montgomery moved to staff and applicant rebuttals. There being no further comments, Ms. Montgomery closed public comment. Mr. Crosland moved for denial of the request. Mr. Gallogly seconded the motion. All in favor. The Commission convened for a break at 6:20 pm and reconvened at 6:29 pm. Due to a technical issue, the recording for items b, c, e, and f are not available. b. 130 Middle Street – Survey 6016/ Non-Historic- (TMS 532-09-00-033) Applicant is seeking Final Approval for alterations to previously approved plans and new pool. Ms. Miller reviewed staff comments with the Commission. Mr. Crosland moved for approval of the request. Ms. Montgomery seconded the motion. All in favor. Mr. Jake Carter reviewed staff comments with the Commission. Ms. Julie O’Connor reviewed the request with the Commission. There being no comments, Ms. Montgomery closed public comment. The Commission provided comments. d. 926 Pitt Street – Survey 5973/ Historic (TMS 532-13-00-051) Applicant is seeking Final Approval for alterations to previously approved plans. This item was approved by consent. e. 101 Middle Street - Survey 6019/ Non-Historic (TMS 532-09-00-001) Applicant is seeking Final Approval for alterations to previously approved plans. Ms. Miller reviewed staff comments with the Commission. Mr. Tinkey, 208 Venning, reiterated his concern with staff approvals and suggested that a review of what can be approved by staff be reviewed. He suggested that more requests should be reviewed by the Commission. There being no further comments, Ms. Montgomery closed public comment. Ms. Montgomery moved for approval with the condition that the railing material be changed to an approved material. Ms. Shaw seconded the motion. All in favor. f. 317 Bennett Street- Survey 6129/Historic (TMS 532-01-00-025) Applicant is seeking Preliminary Comment for an addition to the home. Ms. Forbus reviewed staff comments with the Commission. There being no comments, Ms. Montgomery closed public comment. The Commission provided comments. g. 430 Church Street – Survey 6192/Historic (TMS 532-01-00-094) Applicant is seeking Final Approval for exterior repairs/alterations. This item was approved by consent. h. 124 Mary Street - Survey 6253/Historic (TMS 517-15-00-075) Applicant is seeking Final Approval for new windows. Ms. Miller reviewed staff comments with the Commission. Ms. Miller noted that the applicant is not present. There being no comments, Ms. Montgomery closed public comment. Ms. Montgomery moved for approval as presented for replacement of windows for the non-historic portion of the house that is not visible from the street. Mr. Crosland seconded the motion. All in favor. VII. Staff Approvals a. 303 Morrison Street – No Survey/ Non-Historic (TMS# 532-01-00-046) Exterior paint. b. 205 Queen Street- Survey 6099 /Historic (TMS 532-05-00-026) Replace driveway material. c. 111 Live Oak Drive – Survey 6244/ Historic (TMS 517-15-00-058) Replace roof. d. 101 Middle Street - Survey 6016/ Non-Historic (TMS 532-09-00-033) Dock roof. e. 318 Morrison Street – Survey 6160/ Non-Historic (TMS 532-01-00-051) Paint with color from approved list. Ms. Miller reviewed staff approvals with the Commission. Historic District Preservation Commission April 11, 2022 Page 7 of 7 Mr. Tinkey, 208 Venning St, reiterated that items being approved by staff should be allowed to be reviewed by the Commission. He suggested that the request for 101 Middle should show where the dock was originally approved. He also suggested that this is an ex post facto approval of staff and is a significant change of the roof structure. Ms. Miller reviewed the staff approval of 101 Middle with the Commission. She stated that anyone wanting to appeal the Zoning Administrator’s decision would need to request the appeal through BOZA. VIII. Discussion of Items for Next Agenda The Commission discussed items for the next agenda and agreed that the following should be included on next month’s agenda: ➢ Approvals for artificial turf and visibility There being no further business, the meeting adjourned at 7:30 pm.
