STAFF REPORT
Present: Robert Crosland, Gene Gallogly, Corey Barber.
Staff: Kara Browder, Bryan Hankinson, Kate Miller, James Ward, Lynnette Lynes
Mr. Crosland called the meeting to order at 5:02 pm.
I. Approval of Agenda
Mr. Barber moved for approval of the agenda. Mr. Gallogly seconded the
motion. All in favor.
II. Approval of Minutes July 10, 2023
Mr. Barber moved for approval of the minutes. Mr. Gallogly seconded the
motion. All in favor.
III. General Public Comment
IV. Correspondence
There being no comments and all correspondence being linked to the agenda, Mr.
Crosland continued with the agenda.
V. Consent Motions
Mr. Crosland moved for consent approval for the following items:
➢ 436 Church Street – Survey 6191/Historic (TMS #5320100092) Applicant is
seeking final approval for after the fact changes to the previous COA.
Mr. Barber seconded the motion. All in favor.
VI. Business -
A. 216 Bennett Street - Survey 6150/Historic (TMS #5320100064) Applicant
is seeking final approval for after-the-fact approval of a fence.
Ms. Miller reviewed staff comments with the Commission.

Ms. Sarah Canon, owner, reviewed the request with the Commission.
Ms. Carmen, Scott, 415 Church St, stated that their ADU was built within
the allowed setbacks. She asked that the request be denied as it is not within
the guidelines and there is no economic hardship. She suggested that the
contractor was put on notice that the fence was not within the guidelines. She
suggested that the Town also put the owners on notice that the fence and was
not built.
Mr. James Scott, 415 Church St, stated that he included a timeline to the
Commission on their efforts and notifications to the contractor of the
violations. He stated that they are not in favor of the after-the-fact approval.
He stated that after being notified of the violations, the work continued on the
fence. He suggested that there are no hardships to approve the after-the-fact
approvals. He suggested that approval of the request would set a bad
precedent.
Ms. Linda Balzac, 422 Hobcaw, stated that the fence guidelines have been
in place for over 25 years. She suggested that there is no precedent for
approving the request and asked that it be denied.
Mr. Chris Coleman, 118 Pitt St, suggested that there are not definitive
hardships established in the guidelines. He suggested that after-the-fact
approvals should not be considered as there is nothing in the guidelines
outlining those approvals.
Mr. Louis Horton, 108 Live Oak Dr, suggested that the fence cannot be seen
from the street. He suggested that additional landscaping could be planted to
further screen the fence. He suggested that the six foot should be reviewed.
Mr. Crosland closed public comment and moved to Commission questions,
applicant and staff response, and deliberation.
Mr. Crosland moved for approval with the condition that the height of the
fence is reduced to six feet, but can remain a solid construction. Mr. Gallogly
seconded the motion. Motion passed on a 2 to 1 vote with Mr. Gallogly and
Mr. Crosland in favor; Mr. Barber opposed.

B. 110 Bennett Street - Survey 6146/Historic (TMS #5171500090) Applicant
is seeking final approval for alterations to previously approved pool and
decking plans.
Ms. Miller reviewed staff comments with the Commission.
Mr. Bill Smith reviewed the request with the Commission.
There being no comments, Mr. Crosland closed public comment and
moved to Commission questions.
Mr. Crosland moved for approval. Mr. Gallogly seconded the motion. All
in favor.
C. 116 Hyer Street - Survey 6075/Non-Historic (TMS #5320900061)
Applicant is seeking final approval for modifications to existing porch
and installation of a pool.
Mr. Hankinson reviewed staff comments with the Commission.
Mr. Miller Harper, owner, reviewed the request with the Commission.
There being no comments, Mr. Crosland closed public comment and
moved to Commission questions.
Mr. Barber moved for conditional approval based on staff’s comments and
to have the edge of the pool align with the existing porch. Mr. Crosland
seconded the motion. All in favor.
D. 717 Royall Avenue – Survey 5988/Non-Historic (TMS#5320900092)
Applicant is seeking preliminary review for an addition.
Ms. Browder reviewed staff comments with the Commission.
Mr. Wentz Chesson, architect, reviewed the request with the Commission.

There being no comments, Mr. Crosland closed public comment and
moved to Commission questions.
The Commission provided comments.
E. 436 Church Street – Survey 6191/Historic (TMS #5320100092) Applicant
is seeking final approval for after the fact changes to the previous COA.
This item was approved by a consent motion.
F. 305 McCants Street – Survey 6083/Historic (TMS #5320900079)
Applicant is seeking final approval for an addition, rear porch and deck
relocation, and demolition of existing non-historic carport
Ms. Browder reviewed staff comments with the Commission.
Ms. Linda Balzac, architect, reviewed the request with the Commission.
There being no comments, Mr. Crosland closed public comment and
moved to Commission questions.
Mr. Barber moved for approval with the condition that the applicant work
with staff to differentiate between the historic structure and the addition. Mr.
Crosland seconded the motion. All in favor.
G. 133 Mary Street - Survey 6258/Non-Historic (TMS #5171500072)
Applicant is seeking final approval for existing front porch renovation,
side two-story addition, side bay window / dormer, and rear accessory
building. Demolition of existing carport and shed.
Mr. Hankinson reviewed staff comments with the Commission.
Ms. Linda Balzac, architect, reviewed the request with the Commission.
Mr. Crosland moved for submittal of letters from neighbors. Mr. Gallogly
seconded the motion. All in favor.

There being no comments, Mr. Crosland closed public comment and
moved to Commission questions.
Mr. Barber moved for approval with the condition that front porch is
changed to have a hip appearance on each end and work with staff on chimney
material change and infill of the rafter portion; with approval of the location
of the accessory structure in the rear of the property. Mr. Crosland seconded
the motion. All in favor.
VII. Staff Approvals
a. 747 Pitt Street – Survey 5903/Non-Historic (TMS# 5320900045) Rear
accessory structures less than 144 sf.
b. 108 Carr Street - Survey 6269/Non-Historic (TMS# 5320500057) Change
to previously approved garage door.
c. 101 Mary Street – Survey 6256/Non-Historic (TMS# 5171500067) Change
to driveway design.
d. 507 Whilden Street – Survey 6169/Non-Historic (TMS# 5320100253)
Repainting home and new shutters.
VIII. Discussion of HDPC Rules of Procedure Revisions
Mr. Hankinson reviewed the changes with the Commission.
Mr. Crosland moved for approval as presented. Mr. Gallogly seconded the
motion. All in favor.
IX. Discussion of Items for Next Agenda
The Commission agreed to include the following items on the next agenda:
➢ Discussion and possible action on approval of allowing shed roofs
➢ Discussion and possible action on approval of pools in side yards and front
yards for corner lots
There being no further business, the meeting adjourned at 7:30 pm.
