TOWN OF MOUNT PLEASANT, SOUTH CAROLINA POLICE, JUDICIAL & LEGAL COMMITTEE MONDAY, MAY 4, 2020 Video Conference Meeting https://youtu.be/MM8jpOy4GdQ Minutes Members Present: Mayor Will Haynie, Chair, Jake Rambo, GM Whitley, Laura Hyatt Staff Present: Eric DeMoura, Chief Ritchie Also Present: David Pagliarini, Corporation Counsel Mayor Haynie called the meeting to order at 12:20 pm. 1. Call to order 2. Roll Call 3. Approval of Minutes from the March 3, 2020 meeting Mayor Haynie asked that the minutes from March 3, 2020 meeting be approved. Mr. Rambo made the motion for approval of the minutes; seconded by Ms. Whitley. Motion carried unanimously. 4. Public Comments No Public Comments 5. Police matters No Agenda Items 6. Discussion of Emergency Ordinance passed by Council and any possible changes Police, Judicial & Legal Committee May 4, 2020 Page 2 of 3 Mayor Haynie stated that everyone received a copy of ordinances #20025, #20026 and #20027. He added that #20025 is the one that addressed normal operating procedures of Town Council and gave expressed permission to participate remotely so long as the provisions of the South Carolina Freedom of Information act were adhered to and that item #2 of that was to instruct the Town Administrator to authorize and develop a plan to insure continuity of delivery of Government services in light of the Covid- 19 outbreak. He stated item #3 had to do with revoking any special event permits and #4 announced that this expired 61 days after enactment of the ordinance which is State law. He added that #5 is that all deadlines imposed by Town ordinance applicable to the Municipality or the Applicant shall be suspended until the expiration of the ordinance and #6 had to do with price gouging. Mayor Haynie stated that he would like the committee to take a look at this emergency ordinance and advise what the Committee needs to do as the timeline is expiring on Monday, May 17, 2020. Discussion followed. Ms. Whitley made the motion to recommend to full council that a new draft of the ordinance be issued effective thru the end of June and that preserves the optionality as discussed and with the discussed provisions in place. After discussion Mr. Rambo seconded the motion. After further discussion the vote was taken, and all present were in favor. b. Discussion of Declaration of Civil Emergency by the Mayor and possible changes Mayor Haynie stated that thinking back to when this was done on March 16, 2020 and wondering at the time if it should be done for a week, 10 days, two weeks and now here we are in the first week of May. He added that he appreciates that Council has always had veto power over proclamations for any aspect of those and feels it is a good tool to have. Police, Judicial & Legal Committee May 4, 2020 Page 3 of 3 Mayor Haynie stated that whatever the will of Council, that he is more than ready to not be under an emergency proclamation as long as doing so did not adversely affect funding or flexibility. Mayor Haynie stated he would like the advice of the Committee and Legal. Discussion followed. Ms. Whitley made the motion to recommend to full Council to allow the declaration of Civil Emergency to expire on its original date of May 7, 2020. Mr. Rambo seconded the motion. After discussion a vote was taken, and all present were in favor. c. How to proceed on evaluating applications for and hiring of a General Counsel Mayor Haynie stated that Ms. Whitley had made an offer as a lawyer herself, to categorize not eliminate, the applications. He added that he feels this is a good idea and ask what the will of the rest of the Committee was. Discussion followed. No motion was made. 8.
