TOWN OF MOUNT PLEASANT, SOUTH CAROLINA POLICE, JUDICIAL & LEGAL COMMITTEE Monday, August 1, 2022 9:15 a.m. Municipal Complex, Council Chambers 100 Ann Edwards Lane, Mount Pleasant, SC 29464 Minutes Members Present: Mayor Will Haynie, Chair, Carl Ritchie, Guang Ming Whitley, Howard Chapman (via Teams) Staff Present: Eric DeMoura, Chief Arnold, David Pagliarini, General Counsel 1. Call to order Mayor Haynie called the meeting to order at 9:16 a.m. 2. Approval of Minutes from the July 5, 2022 meeting Ms. Whitley moved to approve the Minutes; seconded by Mr. Ritchie. Motion carried unanimously. 3. Public Comments Chris Coleman, 118 Pitt St., thanked, the Committee, for their attention on the noise issues. He believes that the pilot program has helped. Karen Tinkey, 208 Venning Rd., thanked, the Committee for their good work on the noise ordinance. Shannon Carter, 334 Hook St., discussed his concerns with the noise ordinance particularly the removal of the special events permit requirement needed for outdoor music. Gary Santos, 1390 Greystone Blvd., discussed his concerns about the large mufflers on trucks. The noise of large mufflers needs to be addressed. 4. Police matters a. Employee years of service recognition Chief Arnold recognized SPO Alyson Kinder for 10 years of service. Police, Judicial & Legal Committee August 1, 2022 2 Chief Arnold recognized Detective Gerald Jenkins and Sergeant Eric Postell for 20 years of service. Council applauded their dedication and service. b. Update on Noise Ordinance Pilot Program Chief Arnold reviewed the 90-day Noise Ordinance Pilot Program. He discussed the data collected during this time stating there were 28 citizen complaints for the months of May, June, and July. Discussion followed. Ms. Whitley addressed Mr. Santos’ comment stating mufflers are controlled under state law, asking Chief Arnold if this needed to be added to our ordinance. Chief Arnold responded Ms. Whitley is correct and it is not necessary to add it. Ms. Whitley stated she would like add a time and change the decibel level for daytime to 60 decibels until 10:30 p.m. and then reduce it to 55 decibels between 10:30 p.m. until 8:00 a.m., seconded by Mr. Chapman. After further discussion, Mayor Haynie called for the vote and the motion carried unanimously. Mr. Chapman moved to put the special events permit requirement back in the ordinance. Motion failed for lack of a second. Ms. Whitley moved to send this to full council with a recommendation for approval; seconded by Mr. Ritchie. Motion carried unanimously. 5.
