1. Call to order
Mr. Rambo called the meeting to order at 2:45 p.m.
2. Approval of Minutes from the March 3, 2020 meeting
Ms. Whitley moved for approval; seconded by Ms. Hyatt. All present
voted in favor.
3. Public Comments
Tom O’Rourke, 528 East Rice Planters Lane, MP, stated that each
month, Mr. German attends the Council meetings and talks about
Snowden and water, and he continues to attend Council meetings and
talk about these issues. He would like to request that the Committee
address the Town’s position as it relates to the allowance or not of
sewer and water services in areas that the Town does not govern. He
believes most are likely legal issues and he is not aware of many of the
other issues that may be surrounding this item. However, he would like
for the Town to let Mr. German and those requesting water and sewer,
know why water and sewer are not being provided. He said they may
not agree; however, there should be discussions with Mount Pleasant
Waterworks and those requesting water and sewer to see if there is
some sort of compromise. He said the bottom line is that there are

people on septic tanks that are being compromised and believes this is
a health issue. He said instead of not doing anything to address this
issue, he would like to have the conversation.
Howard Chapman, stated that there was an article a few weeks
ago regarding flooding at Shem Creek. He said the article mentioned
that the e coli levels in a parking lot in the vicinity of Shem Creek were
four times what it should be in an area such as this, according to DHEC
(Department of Health and Environmental Control). He understands
there are issues with septic tanks and other issues, but the Town
recently renewed Coleman Boulevard and as part of this put in
measures to attempt to reduce the pollution in Shem Creek. He said this
has obviously not been as effective. He said as Mr. O’Rourke has
mentioned regarding Snowden, these are all public health issues. Many
of the recreation facilities are near Shem Creek and something needs to
be done to clean up this public health issue.
4. Mount Pleasant Waterworks project updates
Clay Duffie, General Manager of MPW, stated that E-coli comes
from feces and there are three sources; people, pets and pelicans,
which contribute to the E-coli concentrations in Shem Creek.
Mr. Duffie stated that he would like to discuss the Ben Sawyer waterline
project, where they will connect MPW with the Charleston Water System

(CWS) on Sullivan’s Island. He said in 2016 MPW renegotiated a thirty
(30) year contract with CWS where they negotiated a third connection
with their system on Sullivan’s Island, which will greatly benefit Mount
Pleasant residents with redundancy and resiliency. This will also assist
the customers of CWS which is Sullivan’s Island and Isle of Palms to be
able to have a second source of supply to the Islands in the event there
are issues. He said MPW and CWS are sharing the $8 million project
cost 50/50. He said the project is expected to begin soon; however,
there are pipe delays, and the project will take approximately 10 months
to complete. Mr. Duffie continued with his presentation on this project.

Mr. Duffie stated that in order to lay the pipe across the intracoastal
waterway, using a horizontal direction drill, they will need to close off the
bike/walking path for public safety reasons.
Mr. Duffie stated that the next item of discussion is the water tank.

He stated that there are three cell phone carriers on the MPW water
tank at King and Simmons Streets and they have been there since 1996.
He said the water tank has been out of service and obsolete. He said
the water tank is now 86 years old and not in good condition due to the
structural integrity. He said it has come to the point where they either
take the water tank down or pursue putting up a monopole. He said
MPW has made the decision not to address the issue of the monopole.
He said at the last Commissioner’s meeting, the decision was made to
take the water tank down. He said it will take several months to secure
the contract for demolition and will likely be down sometime in 2021. He
said this is a public safety issue for MPW and the decision had to be
made.
Mr. Duffie stated that he will turn over the next item to Nicole Bates,
Customer Service Manager.
Nicole Bates stated that she would like to discuss MPW’s Customer
Portal which went live approximately three months ago.
She added that MPW customers are able to review and pay their bills
online. She said they are now able to obtain information regarding their
daily use.

She stated that customers may also choose how to receive notifications
if they are experiencing higher usage than previous usages.

Ms. Bates stated that she would be happy to discuss additional details if
Committee members have any questions.
5. Discussion and possible action related to Town Code of
Ordinances Chapter 51 and annexation requirements for sewer
service (Map 1) (Map 2)
Mr. Duffie stated that this is a Town ordinance that MPW abides by and
support the Town in this effort. He said any decision made regarding this
ordinance is not the decision of MPW. He stated that the Snowden
project is an example of good success of the ordinance. He said MPW
began with 28 in-town customers which was their primary reason for
running sewer lines within the Snowden community. He said getting
these lines in made service available to over 30 other customers. He
said over half of them have not annexed into the Town in order to
receive the service and the incentives. MPW partnered with the Town in
assisting customers with impact fees and the Town agreed to contribute
approximately half of those fees to those customers in the Town of
Mount Pleasant. Connecting to the sewer system is very expensive.
He added that the following map indicates many areas that are in the
county. He stated that MPW has studied the cost to provide service to all
of the communities if they put gravity service into all of the communities.
He said this would cost approximately $80 million, which MPW does not
have. He said there is also the issue of providing the service since there
is no mandatory connection ordinance in the County, there is no
assurance that anyone would even utilize the system. He said providing

gravity sewer systems is one of the costliest construction projects. He
said they can continue to provide incentives to those who are not on
sewer or water. He stated that water service is provided without any
caveats. He added that the Commissioners have approved formation of
the Clean Water Council and they will ask representatives of all the
areas who are still on septic if they may wish to acquire water and sewer
services. What their hesitancies are and how MPW may be able to help.

Committee members continued discussing annexation issues.
MPW Legal Counsel, provided information on annexation.
Ms. Whitley asked if there is a way to help existing properties with failing
septic systems with the sewer line already in place. She said this has
been an issue with some Snowden residents as they wish to tie in;
however, do not wish to annex into the Town.
Mr. DeMoura stated that he believes that more legal advice would be
required to consider this further.
Mr. Rambo asked about heirs’ properties and if they can be annexed if
they do not have a clear title.
Mr. DeMoura stated that courts act without approval from all property
owners if there is an heirs’ issue. He does not believe that a question of
title impedes the ability to annex.
Mr. Pagliarini stated that this is generally correct. He added that there
are also other methods of annexation. State statute calls for 100% and
then there are varying degrees of a percentage or number to go through

the process. He said there are a number of ways to accomplish this, but
it is more difficult in that situation.

b. Rezoning R-34-20, Request to amend the Gregorie Ferry

for workforce housing may be comprised of one (1) building or
multiple buildings, not to exceed a maximum of 42 units,
located off Winnowing Way near its intersection with Gregory

c. Proposal to amend Sections 156.140 - 156.142 of Chapter 156,
Zoning Code, of the Mount Pleasant Code of Ordinances,

Proposed is amended language that differentiates treatment
based on damage or destruction due to neglect, natural and/or
man-made hazards.
7. Consideration of Amendments to the Flood Damage Prevention
